[Resolved]  Speed Post Letters (Indian Post Office) — Non delivery of regd. Speed Post[Time bound parcel]

Sir,
I had booked a regd. SPEED POST[Time bound i.e. must deliver on or before 16th July, 2009] parcel.Declaring "Application for the H.J.S-2009 i.e Higher Judicial services Uttrakhand. postmaster assured delivery positively by 15th July, 2009.Disclosed, its my lst oppurtunity in case not delivered in time, loss in lacs will be caused.On their positive oral gaurantee, I paid demanded consideration of Rs 34/- at 10:40 A.M on 13-07-09 due to deficiency and negligance in service of the post office department for not delivering a consignment within stipulated time as assured under its speed post service, postal department is liable for any deficiency in service or negligance.Department could be sadled with liability for non-delivery of postal article within the stipulated time.Yet, the speed post failed to deliver. on August 1st, 2009, to be specific, the packet was returned to the sender in an open and mutilated condition with the remark "recipient not accepted delivery on 20-07-09 by post man no. 13". What had happened to the mail during this time? . Even then, if the service was really ‘speedy’, it could have gone well in time. But that did not happen.Post official department person has caused the same fraudulently or by his wilful act or default.Therefore, the post office could not escape liability.when they specifically advertise and declare"Speed Post, the market leader in the domestic express industry, was started by Department of Posts in August 1986 for providing time-bound and express delivery of letters’ documents and parcels across the nation and around the world. In the past 20 years, it continues to be the market leader in the express industry with monthly volumes exceeding 1.4 crores.
Speed Post ushered in a new era when ‘One India, One Rate’ scheme was launched @ Rs 25 for all destinations across India, from Kashmir to Kanyakumari. Now, Speed Post delivers ‘Value for money’ to every one every where, delivering local Speed Post upto 50 grams @ Rs 12, inclusive of Service Tax. Walk into any of the Speed Post booking centres across the country and experience the ‘joy of communication’ ".
That due to their intentional malafide, farudulent, wilful fault or default, I have been denied opportunity to appear and avail the opportunity to be additional distt. Judge or in higher judicial services and expectations of my bright future and that of my family and children have been spoiled by the post officials.I have suffered great mental tortour, agony, harassment, financial loss and loss of professional time, more so it was my last opportunity, the damages for the same are though not countable, the same are limited to Rs 25 lacs within the jurisdiction of distt. forum.
That the distt. consumer redressal forum Una H.P has the jusdriction to try the complaint.The matter has been complained on 31st July, 2009 vide complaint no.[protected] at www.indiapost.gov.in/Ccc/PCData.aspx and reminder complaint dated 06-08-09 but all in vain.The post office dept. did not pay any heed and even have not dared to reply the same uptill now.
That the complaint is made in good faith and bonafidy manner.
It is therefore prayed that the Indian post office department may kindly be ordered to pay damages for their deficiency and neglegance in service due to their intentional malafide, fraudulent, wilful act or default
by not delivering the article in time as assured by their speed post service and causing loss to complainant to the tune of Rs 25 lacs and to compensate the complainant and to pay cost and expenses incurred and to be incurred in the cause including to and fro fare, lodging and boarding, expenses of litigation, including professional expenses from lower forum upto the tribunal or court of final judicature i.e till final realization of damages or payment of compensation by the postal department and any other further relief which the honourable court/tribunal deemfit to be awarded to the complainant in the interst of justice, good conscience and equity.

SPEED POST ARTICLE, DEPT. OF POST — deficiency of service

Sir,
I had sent one speed post article on 19/2/10 at 12.45 from Dabagardens post office, Visakhapatnam to the following address:

Dr. T. Hanumantha Rao
Flat No.B3, 3rd Floor,
Padmavathi Apartments,
Road No.4, Green Hills Colony,
Kothapet, Hyderabad-35

As from the enquiry, I got to know that it was delivered to Smt. A. Uma Lakshmi who was residing in the same apartments. When I contacted Smt.A. Uma Lakshmi from the mobile noted against her signature, she said that since her brother's-in-law name is similar to my father name and he is also a doctor, she had collected the article and sent to her brother-in-law who was residing in Flat No.204, Gharonda Apartments, behind VST, Ramnagar, Hyderabad.

The said article containing synopsis of my thesis and the last date for submission in Osmania University is 25/2/2010. If I could not submit it in time I will lose my MBA degree.

The same subject was emailed to the Manager, Speed Post Centre, Hyderabad and also spoke to him over phone and asked him to take action to deliver the article on 23/2/2009 itself.

The reply I got from him is reproduced below:

The SPM Saroornagar was instructed to recollect the article and deliver it to the correct addressee over phone yesterday. The postman will deliver the same to the addressee today.
