[Resolved]  Standard Chartered Bank / Credit Card — Fraudulent Transactions on Stolen Card

Dear Sir,

My standard chartered card ([protected]) was stolen on 28-Feb-09 and 5 transactions were made on this card
1. Airtel Bill - INR 2000/- on 28-Feb-09
2. Dream Collection INR 23000/, 10000/, 5000/- All three high value transaction within 2 min of time on 1-Mar-09.
3. Petrol INR 100/ 1-Mar-09

I got the call from SCB fraudulent department at 4:30pm confirming high value transaction of INR 10000/- and I declined and told that I have not made any transactions so please make the transaction void and block the card. She told ok. After this call I immediatly called up Customer Care of SCB, they confirm that card is blocked. They also told that I am liable to pay because card is stolen, and if I have any issue I should log the dispute. but transactions are not update in their system so I waited till 4-Mar-09 untill their system was updated with transaction and log the dispute on 4-Mar-09 and while filing I clearly asked that if I need to log the FIR to police departement they assured me that i dont need to worry as these are fraudulent transactions bank will take all necessory action, hence I did not log the FIR to Police.
After that I am regularly following up them for proper investigation but they are just responding that as card is physically involved I am liable to pay. I suspect that they are not doing any investigation to catch hold of the people who did this scam and just mentally torchering me to pay the amount and threating me that if I am not paying my credit history will be spoiled and I wont be able to take any kind of housing loan etc in the future.

I have read on 10-Jun-09 Times of India where card was stolen from wonder la and purchase was done, ICICI bank came into action and caught the people who were involved in the fraudulent transactions, even card lost was reported after in the evening. When I refer to this case the manager customer care Mr Shafiq simple told that there transactions were more than a Lakh. It clearly indicates that they are just putting the burdon of fraudulent transaction on customer rather taking action against the fraud.

I went to dream collection ( a very small perfume shop at brigade road bangalore) in person and try to find out about the transactions and merchant acknowledged that he knew the person by face thats why I swiped the card. This clearly proves that there is a gang running who steals the card and with the help of merchant they swipe the cards and do fraud.

I also requested to SCB that if you have done the proper investigation then please provide me the following documents which you would have collected as part of investigation.

1. Copy of FIR which they would have log before starting the investigation
2. Items purchase receipt of the dream collection.
3. Argument summary with the dream collection on swiping the card thrise instead of once.
4. Airtel store address where the card swiped to pay the bill
5. Chargeslip of all fraudulent transactions.

Out of these five document they just send me dream collections charge slip where I clearly acknowledged that the signature on recipts are not mine. When I asked them that you give me address of airtel store they told that they are not able to get the chargslip and address so they have revert back INR 2000/, I feel if I would have received the address of the store I would have trace the person by Phone number and address for which bill was paid.

I have been talking to customer care that all above transactions are fraudulent and I am not liable to pay but rather than taking any action they are just increasing interest and putting all junk charges and send me the statements.

Finally I tried finding on the internet and got your referece and with lots of hope I am sending mail to you.

Please help me out in resolving this issue.

Hi there,

After going through your case i would like to suggest you one thing, as you said you have already complained to the bank about the transactions that you have not done, please tell me did you forward any form called DDF(DISPUTE DECLARATION FORM) to the bank, or did you complain orally over the telephone, if you have forwarded the ddf form but still as the case is not resolved, Re dispute on the Transactions, log a complaint again with the banker. and wait for 10 days, you will get a status about, if again you get a feedback from the bank that you are liable to make the payment, escalate you case to head service department of SCB through mail then you will be able to get a resolution for it.
