[Resolved]  Tata Docomo — legal notice for bill generated after deactivation

I was sent the following notice on email by Tata Docomo for photon plus connection that was deactivated after payment of all outstanding payments more than 2 months back. In spite of repeated requests to deactivate the connection, I was called by a number of representatives from Tata Docomo offering me different plans to continue with the connection. I kept saying no as I didn't need the connection but they disagreed to deactivate the connection on time. I paid all the outstanding bills when I made the request to cancell my connection. Tata photon still generated this bill as they delayed the cancellation from their side. This is consumer harassment by sending a legal notice to scare the consumer and forcing them to pay for services they never asked for. Request you to please help me with my complaint. I read about a number of such consumer harassment cases against Tata photon. I believe we should all take a legal action against the company.

Under instructions of our client M/s Tata Tele Services Limited, ’A’ Block, Silicon Terraces, No 30/1, Hosur Main Road, Koramangala, Bangalore-95, do here by issue this legal notice to you.



1. We have been instructed to state that, our client is a limited company, incorporated as per the company’s Act, 1 of 1956 having its Regional office at ’A’ Block, Silicon Terraces, No 30/1, Hosur Main Road, Koramangala, Bangalore-95 and is a Government approved Telecommunication service provider inter-alia engaged in the operation of basic telephone services to its customers.



2. We have been instructed to state that, you had availed a Telephone connection from our client as mentioned above and accordingly executed Customer Application Form together with terms and conditions provided therein. Pursuant thereto you have been utilizing the telephone services provided by our client.



3. We have been instructed to state that, while availing the said Telecommunication facility, you have covenanted to abide by the rules, regulations, terms and conditions of our clients. As against the above understanding and as per records maintained by our client, you have discontinued your payment and hence the outstanding in your account is Rs:633/-



4. We have been instructed to state that, our client have sent the said relevant invoice / bill in respect of the said amount had been sent to you. Despite repeated requests, reminders and notices from our client, you have failed and neglected to pay the said amount to our client till this date, Thus you have committed breach of terms and conditions of the said Customer Application Form. You have deliberately and with a malafide intention to illegally enrich you, have withheld the payments, which are lawfully due to our client.



5. Hence, you are hereby called to pay the said outstanding amount of Rs:633/-along with interest that is due and payable to our clients with respect to the usage, rentals etc., of the said telephone/Broadband, within 7 date receipt of this notice, failing which our client will be constrained to initiate appropriate legal action, both civil and criminal under the various provisions of Indian Penal Code, against you for recovery of the said amount along with interest @ 24% per annum, holding you liable for all costs and consequences arising thereof.



You are also liable to pay Rs;500/-the cost towards issuing this legal notice.

I have been served a notice u/s 143(2) by AO Mr.Pardeshi - ITO Ward 1(3), Thane.

The letter was dated 20/8/2009 and the AO had asked to attend his office on 13th October 2009.

I’m out of town tentatively, so when I received this notice now, which was sent to my home in Thane & forwarded to me, I have lost about 3 months time.

Exactly the same thing has happened to me. I feel so helpless sometimes. What they can do is they file a civil case in a permanent lok adalat( at max) if you ignore the letter. Judge will decide what has to be done there. Either you will pay or there will be a settlement.

The problem is if you do not know the local language, you will have tough time there. Secondly you have to waste both time and money. I don't even have sufficient proof that I have called the customer care on earlier dates for closing this connection. So no point in going, rather pay, comeback home pay little more to buy one quarter rum.

This something similar to the case, when you have parked your vehicle in the proper parking area yet the towing vehicle takes your vehicle saying it was parked in the no parking zone. But companies like Tata should not do this. Unfortunate and Sad.

I even have decided not to use any Tata products, not to work with any Tata group of companies... this is all I can do(apart from using very few great words)

Tomorrow I am going to get a new BSNL sim card as well, and I make sure that I burn the existing Tata Docomo sim card that I have.

after para 2 u file fir in police against co under section IPC420 and consumer and civil courts claiming damages of Rs.1 cr fr harassing by sendin legal notice.. and wil see...
Same thing with me, long back had cancelled the connection after paying all the dues but still continued to got calls from TATA photon customer care. Its their mistake of not deactivating the connection when it was requested. Its a worse harassment of customers.

Complaint against tata docomo

I had got my tata photon number [protected] deactivated and got a service request number which I have[protected]. After clearing the prior bill they deactivated my number. After one month I got one more bill when i had not used their photon for 2 months. Now after having this explained so many times to their agents on phone, they have sent me some lok adalat notice.

I am planning to hire the best of lawyer and sue for defamation and mental harrassment by tata docomo. I have my friends who specialize in various fields of law and I will ensure this time I dont leave these guys for harassing me.

I also received a legal notice form tata-docomo about my tata photo which I paid my last bill in jul2009 and requested for closer.They offer different options but I rejected .They proposed thee below options
1)safe custody
2)prepaid
I rejected thee proposals and requested to disconnect.

There hadn't send any confirmation on discontinuing thee services.

After a long time theere was a call from Delhi around sept2012 stating theere is due of 2300 wrt tata-photon usage.
Today I went to theree different level of offices here in Hyderabad theey confirmed thee due and also confirmed theere is no usage of broad band by me after jul2009.They requested to pay 2300 and close thee case.I didn't understand why should I pay withe out using thee services even after requesting to disconnect thee service in jul 2009.I started searching web and found many cases like theis.Tata group or middle layer is smartly using thee loop holes in theis business.Just imaginee a 100 victims like me theey will make 200, 000...if multiplied by 10..2000000 rupees...across India just imagine if theey just target 100x100 customers theey can make crones.Please trai take some action and dig into theis crime and save us..many of my friends advised pay thee due and get rid of theis...but I want to raise my voice by joining withe you all my brotheers and sisters.

this tata photon really making so much problem for the consumer...really should take consumer harassment cases against Tata photon. We should all take a legal action against the company. Worst people really.

my account no is[protected] i got tata photon in my company plan and some terms that card is free and also i will use service for 6 months .but after 15 days o[censored]sage i was having spped of 4-10 kbps.i am getting the bill even i am already not using tata photon from last 3-4 months when customer care told me that in my area i will get 4 kbps speed even they promised for 3.1 mbps that time i told him to disconnect me now after 3-4 months what is the logic of bill when i paid for 2 months advance and used 1.5 months.now they are asking for 4600 .so overall they are asking me to pay 1800+4600 = 6400 for 1.5 moth with 4 kbps speed.this is and and now they are giving me justification that according to my plan i can not opt out before 6 moths even if they provide me worse service. .
i need answer why you are following the policy of 6 moths plan when you can not follow your policy for 31.mbps speed.
why did not you disconnect at that time when i told them.
how can you charge people when you forced them to move out.

Hi,
I had a similar problem before. I was overcharged for my Tata Photon connection and I had sent numerous complaints. Finally, I went to the Consumer Forum in Bangalore. It was the best decision I took. Within 2-3 hearings, I won the case and Tata was forced to pay damages for consumer harassment. In fact they refused to pay for some time and my lawyer was able to get an arrest order from the court for non-compliance. Once the police entered their premises, they immediately sent me the cheque and doubly confirmed that I had received it.

My advise to everyone facing such problems is: please don't let these companies take you for a ride. We have great protection in the form of the Consumer Protection Act and it is upto us citizens to properly utilize it and keep these companies on their toes.

Ironically, I am going to start fighting another case with Docomo this time, lets see how it goes.

I had availed the Tata docomo photon connection in 2011 with corporate plan of 7000ARP(annual renewal plan). This is a prepaid connection and services are provided only once I recharge the account. So Later I have recharged the service in 2012, 2013 and 2014. Later stopped using as the device is broken and service was utter waste and then I left out of country. Now in 2014 after my service period, I did not recharge further and so ideally the connection has been terminated. Now Tata docomo has billed me with 7980/- for the service without any request or recharge and started to send me legal notice.
I have replied to all the email recieved but there is no response.One fine day a lady(lawyer) called me and informed me that its tata docomo fault and they will waive the amount. But the legal notice did not stop and it started to become threatening.
My question here is who will understand the reason from customer? My dad work as CFO for voltas, Tata group. He is also ashamed on the behaviour of TATA.
Dear Tata Docomo customer care, there is no reply to the emails nor the person mentiones in the legal notice respond to phone calls. Now whom should the customer contact??
