[Resolved]  The Royal Bank of Scotland N.V. — harassment and threatening

I have taken personal loan in The Royal Bank of Scotland N.V. After taking the loan I have paid regularly to the bank. After some time, in the year 2008 I got sudden heart attack and was undergone treatment for few days and my business was also running under losses. Although I was in the hospital I am with good principles and ethics, contacted all the bank officials and requested for one time settlement option. After negotiations, I have settled the one time settlement payment in post dated cheques. After that I asked for no due certificate but bank officials told me after clearing the cheques you will get no due certificate. After that I stopped following up the bank. After two years, in June 2010 the bank has sent a legal notice to me stating to clear the dues. I have surprised and approached bank but they don't have any records for the loan account. Immediately I have given a reply notice through my advocate in the month of July 2010 for which they have acknowledged. After this reply, there is no communication from bank.

Again after two more years, I have received a letter no.PARC/R1P2999305 dated.30th May 2012 stating that RBS have been sold their loan to Phoenix ARC Group and they are taking care of loans and in that letter also they quoted I have some dues to clear. I am very surprised by seeing that letter and thought still my account was not cleared whereas I have made the payment in 2008 itself.

After receiving the above said letter, I have called the numbers given in the letter but there is no response or any details. After that, I have verified my status in CIBIL rating with a doubt, surprisingly my above said loan is still showing that the loan was not cleared. They have not reported CIBIL that I have cleared all my dues well in 2008 itself.

Adding to that, few days back I have received call from the number [protected] mentioning that the person is calling from Delhi High Court and harassing and black mailing me to deposit Rs.35,000 immediately to avoid issuing arrest warrant against me. I have patiently explained him that I have no dues whatsoever and I have asked him to give the details but refused to do so and I have tried calling number of times to that number but it’s always busy and/or if ringing nobody’s lifting and/or if lifted the call, someone will say call again after some time, you will get the details.

I don’t understand after paying full and final amount I am getting this kind of calls which affecting my health badly. Who is responsible if anything goes wrong to me because of this nonsense? Who will take care of my family if anything goes wrong?

So I am writing this complaint to you to know the facts and take severe action against the people who called me, threatened me and also harassed me. Please also take action against the bank, bank officials, and the persons who are encouraging this kind of torture to the innocent people like me. without knowing the facts and background of people who lives in the society.

Sub: No due certificate and remove from CIBIL credit rating

I, Cheela Venugopal have taken a loan from your bank vide loan account no.9447859 and cleared all the dues in the year 2008 itself which mentioned in detail below paragraphs.
I have paid my payments regularly without any default upto 2008. In the year 2008, I was hospitalized because heart attack combined with multiple complications such as diabetic, kidney and related problems. Being doctors advised me to take complete bed rest and there is no other person to look after my businesses in my absence, which was also running under losses, I forced to close all my business activities to save my life and to avoid further losses, problems, tensions & complications.
As I am a principle person with ethics, I, by myself have approached all the Banks & individuals and explained them about my health & business position by showing the documents and came to an understanding with them for pre-closure of my loans under one time settlement [OTS] against the agreed payment after reaching an understanding on the settlement amount against proper receipts which includes closing of my personal loan account with your bank which I availed wide loan account no. 9447859. I have settled the account as per the understanding reached under OTS, which I have paid by Post dated Cheques in July, Augst 2008 itself after negotiating with your bank officials.
We have demanded for loan closure / no due certificate at the time of issuing cheques in August 2008 but your executives convinced me by saying that you will get no due certificate automatically after realization of above mentioned cheques. [I am enclosing all the copies of receipts for your information.]

After that, I have called and reminded to your bank number of times for the issuance of no due certificate but unfortunately I have not received the same and I was under the opinion anyway the loan account is closed and I have the receipts for records and stopped following up after sometime.

And after two year, surprisingly, I have received a notice dated[protected] from your laywer Mr. M. Srinivas Reddy stating that I have not cleared the loan for which immediately I have replied through my advocate Mr. Y. Balakrishna Rao vide letter dated[protected] which your advocate acknowledged the notice on[protected]. In that notice we have clearly mentioned that the allegations made by you is baseless and relieve me from this issue by grating no due certificate.

After that reply from me, there is no communication from the bank and I personally visited your bank officials to look into the matter seriously. They said we have no proper records and there is no problem as you have paid all the dues. They also said they will verify with Head office and will get back to you with a no due certificate as early as possible. I thought the problem was solved and I have not visited your bank and officials after the commitment made by them.

Again after two more years, I have received your letter no.PARC/R1P2999305 dated.30th May 2012. I am very surprised by seeing this letter that still my account was not cleared whereas I have made the payment in 2008 itself.

As per the telephonic conversation as mentioned by the person that summons have been issuing and case been filing against me then that summons or case filed against me that has to be withdrawn immediately by your end. Otherwise I will file criminal and defamation case against your bank.

Who will take care of my family? So I am writing this letter to you people to know the facts and act accordingly.
I would like to inform you that please check your records properly and send me no due certificate at the earliest. Also please instruct CIBIL credit rating to close my account immediately.
I have not remembered [or] having record of the date of availing the loan, amount of loan, EMI amount, No. of EMI’s because it’s a personal loan borrowed to meet my personal problems and I have maintained only the record of only account closure receipts. Generally, any individual will tear off/destroy the any receipts after may be year and so. But fortunately I have kept these receipts even after 3 years and some safety I have atleast to quote. Please understand what would have been my position if I have not maintained the records of receipts and what I feel that “your bank has taken advantage of my innocence and goodness” and in this situation to safeguard myself, forced to make this written complaint to your bank and all the higher authorities of your bank, and to your banks ombudsman and ombudsman of RBI.

I have taken loans from 20 to 25 various banks and cleared the dues with one time settlement although I was admitted into hospital with a principal and good intention. But your bank and Barclays Bank only have created this kind of problem and trauma. Please refer my loan account no.[protected] with Barclays Bank. [I am enclosing all the records for your information]. They have given me apology letter and also ready to give compensation but I have refused.

Atleast now, your bank and bank officials have to seriously look into this complaint and have to issue the no due certificate along with the apology letter for the drama created against me for my personal loan account no.9447859 immediately and should relieve me from this issue and I also demand compensation for the mental torture which affected my health.

Even after this justice is not done I have decided to go to any extend including filing criminal & defamation case in India and other countries, approaching press & electronic media, human rights commission, Govt of India for my constitutional rights and justice.

Royal Bank of Scotland/ABN AMRO Bank — Credit card dues and harrassment

I had taken a ABN AMRO freedom card no [protected].In 2005 i noticed that i was being debited with instalments of an insurance policy which i never took. After upmteen reminders and no solution i decided to dump the card. I was then approached by diff agents from time to time telling that my dues were 7000! I And everytime i demanded to know my statement so that i could verify the details of the debits.I was never provided that and was continuously harrassed by diff agents.Now the agents threaten that my name has been put in CIBIL. Why should i be asked to pay something which even the Bank is not able to provide the details even! Why should i pay for an insurance policy which was not ordered by me? This is nothing but pure harassment....
ya man u just should complaint to consumer court that is free and just leave that bank after widrawing ur money other wise u will be in problem!~

Royal Bank Of Scotland - RBS — Harrasment over call not related to ME

I am being harrased by RBS bank callers on my mobile number [protected] daily. they call up for some vallabhbhai whereas this number belongs to me over a period of 8 months now. I have made several requests to change the records which never happens. daily i am receiving calls. i am being mentally harrased and along with this complaint i am sending this to consumer forum as well to file a case against your company. my call records show the same. This is just for your info. The telecallers who call are using rude launguages. how the hell do they talk to someone who says he is not vallabhbhai.

The Royal Bank of Scotland N.V. — My Money has not been credited in my account

My Banglore office had deposited a Chq-230366 on 18th dec 2010 of Rs 19,926 in RBS Banglore branch and it got cleared on 22dec 2010, but Bank did not credit this amount in my saving account. They kept it in there suspense account as there was a little mistake of my name like my account name is Vandana Gupta and this chq was in the name of Bandana Gupta.
I spoke to the customer care of RBS over the phone and they told me I just need to go to the RBS any Branch along with BANDANA Gupta’s ID Proof. So I went to the RBS-sect18, Noida branch on 3rd Jan 2011 and shown them my papers and given then a photo copy and a letter to Mr Kumar
But I still did not receive my payment. If there was an error in my name then they should return the cheque, why they have cleared it and kept my money in their account.
Please help me.
