Subject: Flight cancellation due to corona virus - refund request On Feb 21, 2020 had made a return flight booking for four members and made the full payment of Rs.22, 648 and we were scheduled to fly with Spicejet Airways from Mumbai to Cochin on 05.04.20 by flight no.SG-6476 (PNR AGSE7E) and Cochin to Mumbai on 15.04.20 by flight no.SG-6475 (PNR YBYR5Z). These concerned flights were cancelled by your airline due to the corona virus. Refusal of voucher In the event of a flight cancellation due to the corona virus, I was offered a credit shell, which can be used till March 2021. On 25th April 2020 I indicated vide email that I don’t want to make use of this offer and requested for a 100% refund of the ticket price. To date I have not received a refund. Right to refund of ticket price As per the order passed by Supreme Court by the three-judge Bench, headed by Justice Ashok Bhushan, after taking into account the recommendations of the Director General of Civil Aviation (DGCA) Airlines will have to refund money collected from tickets that were cancelled following the coronavirus induced lockdown without any cancellation charge. The Judgement also states that If a passenger booked a ticket during the lockdown period (from March 25 to May 24) for travel during lockdown period and the airline has received payment for booking of air ticket for travel during the same period, for both domestic and international air travel and refund is sought by the passenger against that booking being cancelled, the airline shall refund the full amount collected without any cancellation charges. The refund shall be made within a period of three weeks from the date of cancellation, the order said. "On such refund, the amount shall be passed on immediately by the agent to the passengers, " it said. Therefore, I am entitled to a refund of the ticket price in the amount of INR 22, 648/- that I paid for the ticket (without any deduction of insurance or convenience fee). Refund request I herewith request you to remit INR 22, 648/- within 5 days to my account number, account holder RTGS/NEFT:, MICR:, HDFC Bank Ltd., Mumbai 400026, with payment reference ‘Refund ticket. As a great punishment for opting your airlines and the agent, I have been continuously following up with Spicejet & Happyeasygo since April 2020 onwards, putting my energy, time and money that has been under your use since last one year, but neither of you have given a concrete reply nor has the amount returned to me even after elapsing almost one year. Summary of my correspondences through email is reproduced below for your references. It seems, it is in your interest to keep passengers money and put blame on each other, that airlines says they have already refunded the money to happyeasygo and happyeasygo on other hand stick to a stereo tape reply that if airlines return, then they will refund without even checking whether the money has been deposited by airlines or not, thus passengers are made as fools. --- If my request does not result in payment of the above-mentioned compensation amount, I will submit my complaint to the relevant supervisory authority and will take legal action if necessary. With kind regards, Jose Kunjuvareed Panamkulathukaran Attachments: - Copy of booking confirmation - Copy of bank payment transaction I had written above letters to spicejet for refund of my flight booking through Happyeasygo, who are not refunding the full amount, though the airlines - spicejet claims they have refunded the full amount to Happyeasygo amounting to Rs.22, 648/- whereas Happyeasygo is willing to give only Rs.18000 thereby deducting around 4000 that too after one year o[censored]tilising this amount. I want them to give the full refund it not interest, atleast they should refund my full amount of Rs.22648, as there were nothing materialized, and no insurance or any conveyance has been taken place.
