[Resolved]  BPTP Park Elite Floors Faridabad — FRAUD BY BPTP

I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. Hi,
I had also booked a flat in this scheme, paid 25% amount.
Also received next demand to be depsited by Oct23rd otherwise they will charge interest.

No bank is giving loan without ALLOTMENT letter, which BPTP supposed to give us in September.
Futher Now we also donot know status of various approvals of this project.

I have expericed how nationalised banks simply take your duly filled detailed forms & take so many decalrations( surety & Gaurantor etc.) and then simply say your application is not considered. "Sorry".


A little wrong thought always chase me now and it leads to high BP.

I talked to bptp office in CP on 08.10.09 and they are saying that the project has been approved by HUDA. But, we must cross check and confirm it from HUDA office. Me 2 victim of same here, and now we have 2 come upfront to resolve this issue, ANYBODY HAVE EITHER OF THIS NOTED POINT

1) In written statement where BPTP assure us that, they give allotment letter after paying 25 % of booking amount, ( If v have this in written than only v can logged any complaint against BPTP)
2) In written where BPTP confirm that they r shift completion time to 2012.

all said and done, what is our legal position in the matter, if anyone is a lawyer or something who can actually help us? these people (builders) are cunning and the frame forms with terms and conditions adverse to customers.

i have booked same with BPTP . now we all need to get together as the problem is same for all o[censored]s . can we all jointly visit BPTP office and demand something in written . there CC is saying that they will consider bank sancion cases and will waive of interest rate till bank starts giving loan . we need this thing to be documented . please come together

I had also booked a 250 sq.yds flat with BPTP and paid 25% of the BSP as of August 2009. BPTP is demanding third instalment by 23.10.09. I applied for loan from LIC who say that though loan can be sanctioned, actual disbursement will start only after BPTP supplies them construction plan/map of the flat. PNB with whom BPTP have apparently tied up for loans say that they require allotment letter in the name of the loan applicant. If we don't pay by 23.10.09, we will be losing discount offered by BPTP and will be forced to pay penal interest on the delayed payment. We should jointly force BPTP to either supply these documents to the applicants or else withdraw the demand for third instalment. A joint visit to the BPTP may help.

I have also booked a floor in Park Elite Floors. I am also suffering the same problem. Please let me know what should be our strategy.do you think...we should pay third installment before allotment? Please let me know your views. I think, Riachandani is right.. we should force BPTP to either supply these documents to the applicants or else withdraw the demand for third installment.
So long Silence...Is there anything that can be done or you guys are planning to pay the 3rd install ment or getting the Sanction letter from PNB as instructed by BPTP ???????

While going through all your above contents.. actually nothing is coming out but sharing views to each other and then back end doing our own working to ensure 3rd Installment goes own time..However we as a team, come out with solution e.g.

~ Lets all o[censored]s meet at BPTP Office in next one or 2 days with some solid plan
~ Barzen to HUDA Adminstrator office.. as this department is also highly non-responsive or useless. Its hard to get any clue or response from HUDA.
~ At least 100 odd applicants " give some DHARNA" on BPTP Office at CP
~ Or we can demand from BPTP first to complete this booking and then go to next launches

But, we have to come out with some plan.. else its just wate of time and energy

Its very difficult to Break the chain of all these influential people.. but not impossible. In fact 23rd Oct. is the day.. when no. of payer will be highest and most of them definitely like us..

Post ur comments and let's find the solution to come out from this problem..apart from becoming simple Hindustani.. " Yaha pe to sub esa hi hota hai"

BPTP Elite Floors — What Consumer Forum is Doing?

I have gone through the frustration expresed by buyers of BPTP Elite floors in your forum. It is just a listing expanding day by day.
Now my legitimate question is - What is Consumer Forum doing to help these complainants?
Many builders are just doing the same under the nose of the guradians of law and the guardians of law are simply doing nothing effective to curb the menace. The cases are being piled up in courts because the courts have failed to plug the holes.
How is the way the forum helps to protect the interests of consumers? Merely giving ads of jaago Grahak in media has litle worth if protection of consumer interest is not effected practically.
I also booked a BPTP elite floor in Faridabad. I have already paid 2 installements. Now, again they demanded 10 % by 23.10.2009.

I opted to go for loan. BPTP has said that their project is approved with PNB and LIC. PNB is asking for the Guarantor. How can a salaried person provide a Guarantor who has property and lend property papers? It is really impossible for anyone to fulfill the requirement of PNB bank. Then, I approached LIC. LIC people has said that loan will be sanctioned in 1 month. According to BPTP people, it has to get approved within 10 days. I donot understand why LIC is taking too much time.

I am not in a position to pay the third payment. I am also agreed with the people that their third demand is totally illegal. They have to no right to ask for it.

Please let me know how can I avoid the penalty charges as my loan will not be sanctioned from LIC.

hi friends,

i called up the customer cae dept of bptp & they've confirmed that there will be no interest on the delayed payment if the customer submits a loan sanction letter from the bank. Submission of the sanction letter will also make the customer eligible for allotment. also, banks like PNB, HDFC etc are giving the sanction letter. let's hope that they would live up to what they say.
I am also one who booked Park Elite Floor (3br+Study-Luxury). Kindly include me in your mailing list and update.Payment last date 23.10.09. Shall i deferred or paid up.

Now I am getting worried by reading yours post .so far no info. Now they are talking about lottery in November. Does any of you guys checked in site what is happening?
