[Resolved]  BPTP Park Elite Floors Faridabad — FRAUD BY BPTP

I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. Also BPTP is a reputed builder, so better to wait..
I had also booked in park elite premium.I had also paid 35%, but allotment letter not issued by BPTP.No bank is is intrested to provide lone.
Once maps are approved, and we get proper allotment letter's, then only bank will provide loan.

This is the worst investment one can think of .Yes i would definetly want to join a forum where we all can join in and take out a solution to get our money out .
Our dealer too misguided us and have paid so far only the booking amt which is 250 000 Rs . And later we had loan approval issues and many ifs and buts to it .
Pls let me know if there is anyone who can help in this issue .

it is very difficult to take the money backup from the BPTP .we have only one option that is wait and only wait .till now we don't have any document to file a case against BPTP

I had applied in PARK ELITE PREMIUM (6 STORIED TOWERS) in the month of July 2009 and till date paid 25%. Does anyone have status of the project and approx. date of allotment

Why this hue and cry ? Here is the simple calculation - Cost of plot in Naharpar Area Faridabad 15000 per sq yd - which means 45 lakhs for 300 sq yd - Cost of construction - 1400 x 1500 sqft = 21 Lakhs per floor or 21 + 15 lakhs = 36 lakhs per floor + 8 lakhs misc expenses, if you outsource everything from acquiring to construction

So total cost of any floor built on 300 sq yd will have a cost of Rs 44 lakhs. All the developers are offering the same stuff at total cost of less than 30 lakhs that too spread over 3 yrs period -

Why crib on this clear cut bargain ? Those who are worried about their money can exit from resale market and they try to buy a plot and then build on it :) you will understand what I am talking about.

I have seen all your complaints above and I myself feel in the same boat. I have booked floor in BPTP park elite floors and still no agreement with BPTP.
Does anybody have got their loan sanctioned with any banks ? I am looking after to go with IDBI. Is it good option ?
hello everybody, is it true that in the month of November there has been an income tax raid in bptp office and that all the files have been taken away by the income tax department. if so then our allotment in bptp park elite wont happen on 10th december 2009? please confirm.

I am planning to buy a park elite floor from a person who has already booked it. Purchase would be through property dealer. For a 4BHK I have to pay total 27.20 lakhs. But initially I have to pay to the original buyer 35% i.e.9.35 lakhs through a demand draft. Please suggest whether, I should proceed or there is any hitch in going for the deal. I have a doubt that why original buyers want to sell their bookings if the deal of BPTP is fair?

1.) BPTP had no right to demand third instalment before giving the Alotment Letter.
2.) BPTP commitment failed of saying that "after 25% payment alotment letter will be given"
3.) It was never told that floors will be overbooked & will be given by lottery. according to them whoever has booked will get the flat. Draw will be only for Floors choice.
4.) At the time of booking it was told it will be ready by 2011. but now they are saying 2012. This is not at all fair.

We shall surely raise our voice for the Non confirmence actions done by BPTP !

Who gave this information that floors have been overbooked and will be given by lottery ?
This means that some people will NOT GET flats ? So
1. Will BPTP refund the money or will force to move to other flats which might not be even in faridabad ?
2. If BPTP refunds, will it give all amount ?
3. Will it pay interest along with amount ?? Becuse it has kept money so ideally should return with interest part.

Lets go by the book - BPTP never committed that it will allot after 25% payment - (does anyone has any written document ?) The third installment was timebound 150 days since booking so they were right to demand that - Now about lottery - Since it was a prelaunch which means nothing was clear (I am sure none has even bothered to ask about the plans before handing over the booking cheque) . Now about refund in case of non allotment - BPTP as it claims has 1400 acres of landbank in Naharpar Area of Faridabad and it has the capability and capacity to provide allotment to every booking, however the location of the floors might be scattered for 180sq yd floors because of overbooking in that segment only. For the argument sake if at all BPTP does not allots the floor in Faridabad Naharpar Area they would be legally bound to refund the booking amount this is part of the application form however there is no mention about the interest part which I feel would not be given.
Now the real matter which is concerning is the maps approval - Non of the floors booked in May June this year has the maps approved as of now. till maps are approved no bank funding would be available this is clear .
Now the 4th installment which is due at the start of construction - Now it can be contested that if escavation of site or site development as they are calling it qualifies as construction of actual building. if we have any advocate reading this his professional comments are welcome.
As far as delivery of the floors are concerned low rise houses hardly take 4-6 month to complete till flooring levels so 2011 end or 2012 first qtr would hardly make any difference .
The naharpar area is yet to see meaningful development from the Govt side which means even if the floors by various builders are delivered in 2011 it may not be livable.
The good thing is the continuation of central and state govt which means things can move without much hitches.
Most of the booking in floors were done by the end users so the builders know for sure that till bank funding is not available those who booked would face trouble in paying whole amount from their pocket.
As far as my sources go all the builders of that area are striving hard to get the approvals done.

I think you did not notice the break up of third payment;it was including PLC which is taken only when you have particulat allotment number so they were supposed to give us the allotment before 3rd installment i.e. after 25% of the payment.
They excluded this payment of PLC part in third installment since they did not allot.

Majority of the neharpar area is occupied by BPTP area. So if BPTP grows the area itself will grow. Once maps are approved things will changes totally! So better be patient and watch
what is actual output of this bptp elite floor scheme, In future we will be happy or ...

BPTP and all other builders are greedy that is established, it is very likely that BPTP will demand next installment which is construction linked-if they do this before the maps being approved I would suggest not to pay them the cash - instead place that money in a Fixed Deposit and give them a conditional cheque or pledge that fd with them to be encashed only when the maps are approved.
There are around 6000 plus customers of bptp in their new projects - if we go by this way this will put enough pressure to them to get the things straightened out.
