[Resolved]  ICICI Bank — Non-bailable warrant in respect to Non payment of credit card dues

ICICI bank people calls you frequently, even you have explained your financial difficulty (or family member death). One or the representative will call you and threatened you about payment.
They make a call to your company/office officials and explain that you are very bad defaulter.
They often call your family members/ relatives.

As per RBI circular RBI/2005-06 / 211 DBOD.FSD.BC. 49/ 24.01.011/ 2005-06 dated November 21, 2005
addressed to the All Commercial Banks / NBFCs (Excluding RRBs) regarding "Credit Card Operations of banks" full copy this is on RBI website.
In page No.2 & 3 of the circular there is clear-cut instructions regarding your information (in case default) no one should share with your family member/office member/relatives or friends.

The are threatening by arguing with you that "NON BAILABLE WARRANT" and police takes you.
In this context, We can send legal notice to ICICI.

No one can issue you a "NON BAILABLE WARRANT" due to non-payment of credit car/personal loan dues.

ICICI people must understand this, They should STOP this non-sense Immediate

(ii) Customer confidentiality
a. The card issuing bank / NBFC should not reveal any information relating to customers
obtained at the time of opening the account or issuing the credit card to any other person or
organization without obtaining their specific consent, as regards the purpose/s for which the
information will be used and the organizations with whom the information will be shared.
Banks / NBFCs should satisfy themselves, based on specific legal advice, that the
information being sought from them is not of such nature as will violate the provisions of the
laws relating to secrecy in the transactions. Banks / NBFCs would be solely responsible for
the correctness or otherwise of the data provided for the purpose.
b. In case of providing information relating to credit history / repayment record of the
card holder to a credit information company (specifically authorized by RBI), the bank / NBFC
may explicitly bring to the notice of the customer that such information is being provided in
terms of the Credit Information Companies (Regulation) Act, 2005.
c. Before reporting default status of a credit card holder to the Credit Information Bureau
of India Ltd. (CIBIL) or any other credit information Company authorized by RBI, banks /
NBFCs may ensure that they adhere to a procedure, duly approved by their Board, including
issuing of sufficient notice to such card holder about the intention to report him/ her as
defaulter to the Credit Information Company. The procedure should also cover the notice
period for such reporting as also the period within which such report will be withdrawn in the
event the customer settles his dues after having been reported as defaulter. Banks / NBFCs
should be particularly careful in the case of cards where there are pending disputes. The
disclosure/ release of information, particularly about the default, should be made only after
the dispute is settled as far as possible. In all cases, a well laid down procedure should be
transparently followed. These procedures should also be transparently made known as part
of MITCs.
d. The disclosure to the DSAs / recovery agents should also be limited to the extent that
will enable them to discharge their duties. Personal information provided by the card holder
but not required for recovery purposes should not be released by the card issuing bank /
NBFC. The card issuing bank / NBFC should ensure that the DSAs / DMAs do not transfer or
misuse any customer information during marketing of credit card products.
(iii) Fair Practices in debt collection
(a) In the matter of recovery of dues, banks / NBFCs may ensure that they, as also their
agents, adhere to the extant instructions on Fair Practice Code for lenders (circular DBOD.
Leg. No. BC. 104 /09.07.007 / 2002–03 dated May 5, 2003) as also IBA’s Code for Collection
of dues and repossession of security. In case banks / NBFCs have their own code for
collection of dues it should, at the minimum, incorporate all the terms of IBA's Code.
(b) In particular, in regard to appointment of third party agencies for debt collection, it is
essential that such agents refrain from action that could damage the integrity and reputation
of the bank / NBFC and that they observe strict customer confidentiality. All letters issued by
recovery agents must contain the name and address of a responsible senior officer of the
card issuing bank whom the customer can contact at his location.
(c) Banks / NBFCs / their agents should not resort to intimidation or harassment of any
kind, either verbal or physical, against any person in their debt collection efforts, including
acts intended to humiliate publicly or intrude the privacy of the credit card holders’ family
members, referees and friends, making threatening and anonymous calls or making false and
misleading representations.

CIBIL — CIBIL not adhering to Credit Information Companies Regulation Act 2005

As per the Credit Information Companies Regulations Act, under Chapter VI:Information Privacy Principles And Furnishing of Credit Information
"If a credit information company or specified user or credit institution in possession or control of the credit information, has not updated the information maintained by it, a borrower or client MAY REQUEST ALL or ANY OF THEM TO UPDATE THE INFORMATION; whether by making an appropriate correction, or addition or otherwise, and ON SUCH REQUEST the CREDIT INFORMATION COMPANY or the specified user or the credit institution, as the case may be, SHALL TAKE APPROPRIATE STEPS TO UPDATE THE CREDIT INFORMATION WITHIN THIRTY DAYS AFTER BEING REQUESTED TO DO SO"
But when i called CIBIL and informed them that there is an inaccurate information appearing on my credit report and i want them to correct the same, instead of registering my complaint and initiating an investigation with the data provider they refused to take up the complaint saying that "we are only information reporting company and we report the information which is provided by banks. In case of any dispute or incorrect reporting i need to contact bank directly as they are the one who are reporting wrong information".
In this way they have clearly breach the Credit Information Companies Regulations Act and i want the concern authorities to take up this issue seriously to safeguard the consumers interest.
Now i have been been denied credit by other credit institutions on the basis of CIBIL report which is inaccurate.
In such scenerios where bank denies to accept their mistake and update the information with CIBIL and on other hand CIBIL denies to register the consumer dispute poor consumer has nowhere to go.
Hence i request RBI to come up with strict procedures to safeguard the consumers interest similar to Credit Disputing procedures in develope countries like U.S, U.K and South Africa.

ICICI — DISCLOSURE OF CARD INFO BETWEEN 2 COMPANIES

One tale caller from ICICI LOMBARD explained me about one parent insurance med claim insurance and taken all details about my family .promised me to send me the document .Before i revive document ICICI LOMBARD "blocked " 15477 Rs in my card which is not currently using by me .I closed the same card in 2005 and made disabled . Since i am not interested to use that card i requested them to cancel the insurance. They cancelled the came and said that money refunded back to you account. In the card section saying that they received 15000 only. and now they are sending letter for payment of 1642 including the fine and late payment fee .for the service i am not used .Most important thing I like to know that how ICICI LOMBARD is able to take the money from a card which even customer don’t know. I know only last 4 digit and first 4digits
Next question of My out standing payment?? I have not shared the card number with the tele caller of the person claimimthat he is from ICICILOMBARD for your Ref Policy no:4063/HAP/03765208/00/000

ICICI Bank Credit Card — Repayments

Dear Sir,
I have paid initial amount of Rs. 2200 to my icici credit card dept. after the discussion had with one of the executive. But my salary account is blocked due to ICICI credit card. I am unable to operate my account where as I have submitted my application to the bank and their executives are also working on.

My Issue is that my salary account is in same bank as with credit card. I am paying honestly then why they are blocking my account, this is really hampering me to do other work as I am not financially strong.
Kindly help me out.

Hi,

I can see only the complaints and no resolution to the customer compliants have been added here. I suppose the Multi National Banks are playing with the dreams of the citizens in India by putting their name in the defaulter list in CIBIL. They are authorised only to add the name to the list, but I guess there is no way the name can be deleted from the list.
If someone get to know this please do let me know the same.

Cibil report has inaccurate information. I have never used any credit card. My name is also listed as defaulter of credit card. Can someone help me how to go further and if we complaint through this forum, is some body reply us or take action againt them.

ICICI Bank — Information Not Being Provided By the Bank Relating to Personal Loan

Hi I have a personal loan from ICICI that I have been paying EMI for the last 2 years or so. However due to an unfortunate incident I have lost the documents relating to that personal loan. As a result I do not have access to the personal loan account no or any other information pertaining to that loan. The EMI is being paid out automatically from my HDFC bank salary AC No-[protected], Salt Lake, Sec - II Branch in Kolkata. I have sent repeated mails to ICICI Bank for the last 3 days asking for some response in helping me out by providing me the Loan Account No and also telling me how many months I would have left for my loan amount to be fulfilled , but I have received no response from them. This is causing me emotional duress and effecting my life to a great extent. I would like help in getting a positive response from ICICI.
