[Resolved]  ICICI Bank — Wrong deduction from my bank account for 8 yrs old credit card

( After 8 years, Rs 22 thousand deducted from my ICICI Bank Personal account )
Dear Sir,
I am Deepak Choudhary residing in Jaipur for last 10 years in Nirman Nagar, Jaipur. My Native place is kota . This letter is for Complain against ICICI bank, Credit Card department. After 8 years they deducted Rs 22 thousand from my personal saving bank account.
Brief Story behind the matter :
In year 2006, I was working a Area Sales Manager in GE Money, Kota, where One of the Sales Executive of ICICI Bank approached me to take Credit card. I agreed upon it and all the related formalities were done. ICICI Credit card with number [protected] was issued to me . I received it and started using it from 9th Jan 2006 .
Everything went smooth for initial 5 month that is for month of Jan 06, Feb06, March 06, April 06 and May 06, I used to get the bill and had made the payment accordingly with all late fee and penalties imposed on it.
One Fine morning, In June 2006, I received one Envelop from ICICI Bank by some Courier Company, I received it & opened it, Envelop was having ICICI Lombard Policy Health Insurance named ICICI Lombard Health Care. Policy Certificate no was 4034/FNP/00818612/00/000 & Period of Insurance was for two yrs from 25 may 2006 to 24 may 2006 and renewable to 24 may 2008.
As I have not asked anyone for any policy, So I called up to that ICICI Bank executive who has done the formalities of my card, but Fortunately / Unfortunately there was no response from his number. I went to ICICI Bank Branch in Credit card section and had discussion with them. After a hour time, Branch manager of ICICI, after checking & having words with some of the senior officials, he reverted that I have given telephonic consent over a phone to their Customer Care department, So they have issued the policy. I argued that I haven’t ordered or I haven’t given consent to any phone call for such Policy to anyone.
They referred me to ICICI Lombard department, there again I had a discussion with them. They pressurised me and insisted to keep the policy by saying that they have a official recording in which it is crearly mentioned that I had given the Consent to issue the Policy. But I didn’t agreed upon it, As I was very much confident that I have not given any consent, So I asked them to show me and provide me the proof of recordings. Branch Official requested me to call to ICICI Lombard call center from their branch . I called up and again explain the matter to Customer Care Officials.
Both Customer Care Official and Branch official assured me to provide the proof soon. Time given at there end was a month as there headoffice and Customer care dept is in Mumbai. Simultaneously they asked me to submit the Original Policy and application mentioning all the details in it, So they can take the action or can process the things. I submitted the Original ICICI Lombard policy to Bank officials and kept photocopy of same with me .
Meanwhile, I received the Credit Card Statement in which EMI Principal, EMI Interest, Service Tax, Service Charges were imposed. I again went to ICICI Branch Credit card department, but there were all new faces and no one was aware of my matter. I called up to Customer Care department and told them about the Statement. They requested me to keep the patience and ignore the statement by saying that these are all system generated Statements. They assured me that my request is under process and soon I will get the solution of it. I was regularly following up matter, But every time I got the same revert that things are under process and will take some more time. Month of June and July were Crossed but there was not Solution of it .

Meanwhile Branch official & Collection team suggested me to make payment of the amount / expenses which I had incurred and done, I agreed upon it and made the payment accordingly.
In July 06, I made payment of Rs 3568,
In Aug 06, I made the payment of Rs 1915.
I interacted again and again with ICICI Lombard official and Customer care department in Sept 06 and Oct 2006, But no result of it. I was not getting any revert & solution of my problem.
As branch official & Collection team guided me to make payment against my incurred expenses, So I made it accordingly. In 14th Nov 2006, I made payment of Rs 16031.
Dec 06 and Jan 2007 passed away, but there was no solution of my problem.
But in Feb 2007, when I received the Credit card statement, I was literally Shocked. The amount of EMI Principal, EMI Interest, Service Tax, Service Charges were between 5, 000 to 6, 000.
In previous statement amount use to be between 500 to 600. I went to branch to surrender the Credit card, but they asked to pay the entire balance .
I approached every one, I contacted Jaipur ICICI headoffice, Customer care officials and every one, But from every one, I got the same answer that your Complain is under process. Again Branch Official and Collection team suggested me to make payment of expenses incurred by me and not to use this Credit card in future . As all suggested me and assured me that this was the only solution of my problem, So I did it.
I destroyed the card and submitted to Credit card team and regional Collection team, I made the final payment of Rs 6268 .
After this closure I got Statement of next month ie June2007, I again informed the officials that I have received the statement and matter is not yet closed. They assured me that from next month onwards, I will not get the statement. Same thing happened, I didn’t received any statement after that month. I was in Impression and much relaxed that case is closed .
After a year, I got a notice from some advocate in year 2008, He called me up and started threatening to make the payment . But when I briefed him about the case, he was polite to me and reverted that he will check out the matter and will revert back.
After 5-6 months, I again got a call from someone from Advocate team, He said that he had a discussion with Bank officials and they have suggested him to Settle done the case, by depositing 25 % to 30 % of outstanding amount that is I have to pay Rs 5000 and bank will issue me Settlement Letter and will issue Non Dues letter of Credit Card. But, as I was confident that I haven’t asked for the policy so why should I pay for it. It was Bank officials mistake that they had issued me this policy without my consent and till date bank is not able to show the proof of my consent. I also added that I will make entire payment of Rs 22 thousand to ICICI Bank, If they will provide me the proof of my consent. After having lot of argument, I didn’t agreed upon it, as I was aware of it that bank is simply compelling me to make the payment of policy which I have not asked for.
After that Incident and Argument, No one approached me either from Credit card department nor from Collection Department or Advocate team.
Six years passed up, no call from them, I was in 100% Sure that problem is resolved and matter is closed.
Meanwhile, I took many loans small as well as big loans upto 50-60 lakhs from HDFC, LIC, Bajaj Finance, Kotak mahendra etc Every body checked my CIBIL record, There was nothing like any outstanding amount for Credit card . My repayment and my track record was very smooth and very Good, Not a Singh EMI Bouncing for last 7-8 years..
In year 2015, One newly appointed Executive in ICICI Bank, Nirman nagar, Jaipur branch approached me and requested me to open a account in their Nirman Nagar branch, I agreed upon it and did all the formalities for bank account.
After a month around, Branch manager of Nirman Nagar ICICI Bank called me to branch and enquired me about this Credit Card matter . I told her each and every thing. But I was really shocked that the matter was still open . She was convinced and said that she will do the needful.
Two months passed on, In April 2015, I received a letter from Bank that they have marked a lien on my bank account. I took that letter to Branch and discussed with branch Manager Ms Aarti Nathali. She assured me not to worry and she will take care of this matter. May 2015, June 2015, July 2015, Aug 2015 went smooth. But on 2 September 2015, I again received the letter from ICICI bank, mentioning about Lien on my account towards the unpaid outstanding dues and mentioning that within 10 days of time span they will deduct this amount from my account. I went to bank, they again assured that she is working upon it and not to worry.
On 15 September 2015, I again received the letter, In which they mentioned that,
“ We have execersied the act of Bankers Lien by debiting your ICICI Bank Saving / Current Account[protected] for Rs 22, 857.23 /- on the September 15, 2015 and have credit the monies towards the outstanding dues on your ICICI Bank Credit Card.”
I again contacted bank manager, She assured me that she is in contact with head office and trying to recover my money, She assured me that She has received the mail from Head office, Collecteion team that they will reverse the amount.
For next 2-3 months she was simply giving the excuse that, It was Festive Season, She is having Audit in Branch, She is on Training, Concerned person is not available at Mumbai office and many others. But after some time she said sorry and said that she is not capable enough to recover the amount and she refered me to her Sn Manager and Credit Card Collection Manager.
After listening the matter and examining the things, They asked me to wait for Few days and said that they will do the best whatever will be possible at their end.
But after 10 days time they reverted that, they all are helpless and nothing has been done in such matter. They accepted and mentioned that My problem is Genuine and should be resolved but their Senior officers had denied and had refused for refund and resolve the matter.
Few of ICICI people suggested me the way to recover the amount by taking fresh and new Credit Card and not to pay from day one, Few suggested me to go of some OD limits to recover from ICICI and Few suggested me to contact Omburdsperson and complain in RBI.
From day One I was ready to make the payment subject to present the proof of my concent, Payment of Rs 22 thousand or Rs 5 thousand are not a big issues, but imposing such dictatorship is wrong .I have feeling very helpless and not able to understand that such dictatorship is still going on and no one is here to resolve my complain.
Every time when I discuss with any of the branch official, It seems, I am begging in front of them. IS IT SO !!!
I need your help to kindly do the justice.
