      Hello,

      I need to file a case in consumer Court against "SIM PROPERTIES" known as Bhandari Associates and project is known as Savannah.

      Project is already delayed by 5 months and as per the current status it will take another 6 months to complete. Can some one please guide me how to file a case against the builder as he is not making any efforts to complete the projects.

      He has changed his plan and giving a poor quality product. So atleast, if someone is trying to buy a house in Savannah or any project from Bhandari Associates or SIM proporty , please do not think of doing so.

      I do agree and I am a victim of this delay as well.

      Please let us know where we can lodge a complaint
      I am also facing same issue. Delay has been crossed to one year. I am just paying heavy intrests to bank.

        i had booked a flat with maruthi vihar housing complex, 2 years back, paying 75% of the amount, with the promise that the flats will be ready within 3-6 months, but till now the flats are in same conditions as it was 2 years back,,,now i have asked for refund of my money, the builder gave me 2 cheques , which have bounced twice, ,,and he keeps on promising that the cheque will be cleared next week or so,,and i doubt him,,,can you suggest me, whats to be done to get my money back,,

        Real Estate — Landlord asking to vacate house

        I live in a vry posh society of greater noida with more than 500 houses,,,, i got separated from my wife and after 6 months now the landlord is asking me that i should vacate as the society does not allow singles to live in the society. what are my legal rights in this case?

          Hi,

          1. I have purchased appartment in December 2005 at Kondapur, Hyderabad. In the building plan and sale deed there is an approval of G+2 appartment. Builder has left cellar for parking and built 3 floor + pent house. As per GHMC, they are considering cellar as ground floor and based on that they are saying that there is no approval for 3rd floor. And they are asking me to pay 76,000 for building penalization.

          2. Builder has violate the rules in building so, why should consumer pay for it? And more over as per sale deed, the builder should take care of the building transformer but there is no response from him on that.

          3. As there was severe voltage problems, all the flat owners has contributed for the transformer and installed it. And there is a water leakage among the entire appartment since from past 2 years.

          4. Parking is also not alloted yet.

          So, please look into it and do the needful.

            I have rented out my flat on 11 months lease which has no clause for renewal.

            Doesn't the lease terminate automatically at the end of it? Is it really necessary to send a notice when the lease has no renewal clause? Do I need to have a reason like I want to occupy the property, some work to be done, …… to ask/force a tenant to vacate?

            If yes, what should be the format and/or procedure to send such a notice.

            We have given plot for development and builder has handed over the our share of flats in 2/09.But builder has not marked the car parking ares for flat owners including whom he sold his share of flsts.when I asked about marking of car parkings the builder is avoiding. Mean while The flat owners whom he sold have marked carparkings themsefes at their convience and alloted owner's share of parkings unevenly and no privision for taking of car unless one car is takenout there is no runway to takeout car from parking area. There is no authorisation to flat owners for marking/Allot parking.the Builder has not marked the carparking areas.in this situation shall i proceed legally/repersent case to consumer forum for justice?Another thing One side wall in completely is wet/leakagewhich caused sweapagewhen I asked builder he refused for repair/the Flats were handed to us in month of Feb/2009. shall I repersent the case the cosumer fouram or in court. please give the advise.               I Vijay Kumar purchased flat in 1995 from Anand Sriram Modhe of Anand Constructions with register address of Anand Modhe, Sahade Building, Dadar West, Mumbai. Initially I had paid amount of Rs.8.23 lacs and booked flat of 650sq.ft underconstructed at Nerul sector19, and agreed upto for making balance paymentof 1.50 lacs after possession.

              After one year due to uncompletition stage I had requested Anand Modhey to cancel the flat and refund the paid amount, hence Modhey agreed and returned amount of Rs.3.40 lacs after 2 years in dd and cheques and shown inability for making balance payment and agreed for giving another flat which is equivalent amount of balance pending. Flat no. 202 for 800sq.ft at Nerul Sector 6 sarsole in 1998 (second flat).

              In between above, I got information that Modhe had sold my second flat to Sansare, and registered the docs in 2000. I had filed cheating case against Anand S Modhey in Thane civil case no. 193/2000 to declare us owner of property and got stay order for second flat. Beside court stay fraud/cheater Anand Modhe again sold this property to one more builder at Nerul and new builder demolised entire building.Although construction work at Sector 9 was completed stoped due to several case pending against him.

              I had filled complaint in nerul police station and produced copy at court and case is going on.

              Pls advice me for quick action and take more steps to punish such cheater like Anand Modhe.

                the many real estate agent are Unauthorized doing work without any liecense and the costumer and investor are taking property illigaly roughly paper works, Incomplete documents,Unauthorized property, Unauthorized Constructions, Unauthorized rates, & know body is in power to look these such thing the poor people are suffring many and lots problem so sir i request u take action if you have any power for these problems.

                  Misconduct and fraudulent act of Ansal Housing & Construction Ltd.

                  Hereby I present you the practices of real estate company of good repute, which also an ISO 9001:2000 company. This company has shown a plot via their layout plan, which was never in their possession. Company has booked a plot, which was other’s land and continuously has taken the payments for 3 years. Following facts are well documented and proof enough to press the criminal charges and file a civil suit too. We like to expose these practices of the self declared company of repute, so other individuals cannot be victim of this company and these kinds of other companies.

                  I- Plot 400: 18.08.2006 to 06.09.2006
                  II- 147: 06.09.2006 to10.08.2007
                  III- A-218: 10.08.2007 to 20.03.2009

                  Office Representative Mr. A.K. singh in Agra and Mr. G.K. Singh in Delhi, Ansal Housing & Construction Ltd. said that it is only a renumbering exercise. Location and size of the plot is same
                  The same was ensured by the layout plan which was provided by company it self.

                  IV- D-131: 20.03.2009 till now

                  This time company verbally informed us via Mr. A.K. Singh and G.K. Singh that location of plot has been changed, as company is not able to procure or buy the land, on which above-mentioned plot was shown & sold. Therefore now it is a compulsion to change the location.

                  It shows that once company has ensured, allottee has paid 95% of the plot value and 11 installments of the EDC (Extra Development Charges), therefore they dare to open this fact. It is in their mind set that now allottee cannot run away, so they can do, what ever they like to do.

                  When my manager (Manish Rawat, who is looking this matter from the beginning) and I visited the site, we couldn’t find this plot easily, as approach roads have not been done. We tried to speak somebody in the site office, but nobody was there to assist or to give proper answer to us. We have tried our best to inform about the ground realities to the concerned persons, but we never received any proper answer for our queries regarding the plot for which we have paid. Rs.82944201 up till now..

                  In last year when they have demanded EDC Rs.128234.04, we asked them; on what basis they have worked out this particular amount, which was to be paid in 10 installments. They never explained this till today as now only 1 installment is to be paid on 15th October and 5% of the basic value to be paid at the time of possession. In brief we have reached this conclusion that from the very beginning of the project, company had some bad intentions.

                  All this mess is extremely disappointing and a cause for mental strain. Therefore I want full refund of my money paid with interest.

                  Following are the details of the payment & correspondence by email & postal services

                  *Date: 03.04.2006: Booking amount advance towards registration of a Plot Rs.180000/-
                  *Date: 18.08.2006: Letter Ref.M/M/AT/400 signed by G.K. Singh Manager (Mktg.) informed that Plot No.400 allotted to us. Basic Cost+PLC=Rs.805297.50, Total amount due (30%) = Rs.241589.25, Balance payable=Rs.61589.25
                  *Date: 06.09.2006 Letter Ref.M/M/AT/930 signed by G.K. Singh Manager (Mktg.) informed that Plot No.147 allotted to us. Basic Cost+PLC=Rs.766950, Total amount due (30%) = Rs.230085, Balance payable=Rs.50085
                  *Date: 26.10.2006 Allotment Letter for plot no.147 in Ansal Town for sign.
                  *Date: 11.11.2006 Allotment Letter date
                  *Date: 10.08.2007 Letter ref.10/08/2007/1703 Unit /Plot no 147 Renumbered in Ansal Town, Agra (Plots) as A-218

                  Total amount paid for basic price Rs.714030.09 till date.

                  *Date: 29.12.2008 Letter ref.29/12/2008/5864 payment notice for Development charges at the rate of Rs.627/- per Sq. Yd. amounting Rs.128234.04
                  *Date: 27.01.2009 Request Letter was sent to reduce the Development charges amounting Rs.128234.04
                  *Date: 04.02.2009 Email from Arvind Singh Dy Mgr (M), Agra Branch, received that these charges were not included in basic sale price. But not explained that how Rs.627/- per Sq. Yd. rate has been calculated.
                  *Date: 05.02.2009 We sent a letter & also Email to Ansal’s Agra Office and also CC to M.D. AHCL, New Delhi and Mr. Vipin Mehta (GM, Mktg.), New Delhi asking for the detail of EDC charges that how this amount was calculated and who has taken this decision to calculate the rate of Rs.627/- per sq. yard.
                  *Date: 10.03.2009 Received a letter from Ansal’s Office signed by some authorized signatory (Name was not mentioned) reiterating same facts as in email dtd.04.02.2009
                  *Date: 20.03.2009 Received a letter from Ansal’s Office signed by some authorized signatory (Name was not mentioned) informed that Unit/Plot no A-218 Renumbered in Ansal Town, Agra (Plots) as D-131.
                  *Date: 14.08.2009 Letter Sent to Arvind Singh Dy Mgr (M) to know that "Is D-131 the same plot which was allotted (as 147) to us as per the allotment letter dated 11.11.2006?" Is the area and facing same as previous? Why the plot which was allotted has been changed without our consent? Never received any kind of intimation nor we had asked any consent for this from Ansal Housing & Construction Ltd., require latest brochure and layout plan clearly marked & showing the previous plot A-218 (previously 147) and actual present position of the above mentioned plot D-131 along with a fresh letter mentioning area of the plot. Reply is still awaited

                  *Date: 24.09.2009 Email sent asking below questions:
                  Question1: On the basis of the above-mentioned fact when you will be ready to give possession of the plot with all extra development work done?

                  Question2: "Is this the same plot which was allotted (as 147) to us as per the allotment letter dated 11.11.2006?"

                  Question3: Is the area and facing same as previous?

                  Question4: Why the plot, which was allotted, has been changed without our consent? Or without giving a written intimation?

                  Question5: After paying almost whole the amount of External Development Charges, why there is no such development??

                  Question6: We had asked the information in our previous correspondence but no any clarifying reply received yet, reiterate the same: What system has been adopted to calculate these EDC Charges? Reply is still awaited

                  I have purchased a house No. AC-190, Ansal's East End, Tronica City, Loni, Ghaziabad from Ansal Housing & Construction Ltd, New Delhi. While taking over the possession, I pointed out many shortcomings in the house. The Estate Manager assured that all the shortcomings in the house will be carried out.

                  After many verbal requests to Estate Manager my grievances were not redressed. Then I sent e-mails to the company. Consequently, I was asked by the estate manager to vacate the house for one month so that remaining work could be carried out. I vacated the house for one month and lived on a very small rented house in the vicinity.

                  After having given the house for complete one month to the company, still a lot of work has been left unattended. The list is as follows :-

                  (a) Plaster (Madrasi Dana) of front side which is in a very bad state has not been redone. (b) Door bell - which is foremost thing in a house has not been wired ! (c) One electric switch has been provided for two bulbs. (d) One bulb constantly burn because it does not have any on-off switch! (e) In staircase underground wiring has not been done. (f) In bathrooms and kitchen damaged tiles are used which have not been replaced. (g) Rainwater comes into bedroom. (h) While bathing, water comes into rooms since down has not been given in the bathrooms and so in kitchen as well. (i) Instead of two sets of keys, only one set was given.

                  Through your esteemed good offices, may I request you to take up my case with Ansal Housing & Construction Limited, New Delhi?

                    I own an apartment in Annanagar East, Chennai. We are facing the following issues in the residence.
                    1. The common area of the property is being allowed to be misused for family living of the Watchman/Servant maid, by the association president and two more resident owners. The servant family ( 5 or 6 adult members) are being used for 24 hrs household errands by these three flat owners. The servant family is naturally loyal to these three owners. Since we take objection they are very antagonistic towards us. This is being perpetuated for 8 years. The association president says that this servant family was left in the premises by the builder (India Builders, Anna Nagar) , which is refuted verbally by the CEO of the builder.
                    2. Another issue is , since I do not continuously live they are also grabbing my legally reserved car park. The builders agreement signed between them & myself shows in the article 28 , that Iam allotted a reserved car park. The builder also gave me a letter allotting slot no. 7 to us before occupation. The builder specially told us while booking , to take this slot , because it is on the left side of the building and has only one slot, which will be more convenient that the others in the right side of the building which is used for several cars and has the main entrance. This is a fact
                    3. This time I lived there for two months and started claiming my right to the car park. This is not liked by the residents who exploit my absence. One resident who has two cars tries to deny my right to reserved car park , even though he enjoys his reserved car park on the right side of the building. He misbehaved through his driver as well as he himself in one evening.
                    4. I also went and talked to the builder on all the issues faced in the residential block. Following this, to my shock, the builder sent a letter to the association stating the car park is open to all. But he chose not to deal with the issue of illegal occupancy in the common areas.
                    5. I called the CEO of the Builder and read out the agreement clause and questioned about the breach of agreement. He said he will send a correction letter. When I questioned him why he is silent about the misuse of the common area of the property, he said he will advise against that also to the president of the association. But until now he has not kept up his promise. This builder’s recent letter is to my knowledge a clear breach of contract.
                    6. With great difficulty I asked for a residents meeting which was attended by these three plus myself (others did not attend) I pointed out. They are not in any mood to correct the situation.
                    7. Due to the hostility of the neighbors & servant family ( who always float around in the premises) we are hesitant to permanently move into our legally owned prime location property.

                    I am aware of the long drawn legal process in our country. I do not have time, energy or money for that. Can the consumer forum .

                      Dear Sir,
                      I have got releived from my previous employer by Dec 08 and they have submitted my pf settlement from by 25th May 09 in kandwali west PF OFFICE. But, still i have not received my claim.

                      Actully lead time to take to settle the pf is 45 days. But more than 90 days gone, still i have not. received
                      Kindly do the needful at the earliest for withdrawl of my claim

                        This is what you are providing in Spendlour appartment, Gagularamaram

                        1. None of bore working properly and no water available
                        2. Stopped tankers abruptly
                        3. Site office was shut down from 21.04.2015, without proper intimation to residents in general, through a mail, or notice board.
                        4. Increased maintenance without calling a general body meeting.
                        5. Never responding to mails or request to meet MD of Modi builders.
                        6. Major amenities is not in working condition as per agreement (no water is swimming pool)
                        7. Old, useless, deaf security guards
                        8. Basement 2 is not all usable and rain water enters basement 1. A small dog is roaming in basement. Everyone parks in basement as people dont have proper space in basement 2
                        9. Lift if stops takes days to completed
                        10. No proper maintenance staff
                        11. Garbage in badminton court, basement.
                        12. Terrance full of broken bricks and stones
                        13. Fire Safety never tested and not in working condition
                        14. 2 or 4 CCTV camera without any purpose

                            Hi,

                            I have been cheated by Metro developers for 3, 00, 000/-; The ransome they took for a land which has no existance and all the sites, layouts displayed by them are fraud and they are not owning any of them. The following people are the owners of this property, and I request every one to pay more attention while dealing with these people; You may encounter them in one form or the other, as they are smart in changing the companies. Unfortunately, I do not have the pictures of them.

                              Bagaria builders is the biggest fraud, cheat that I have seen in my life. He has just taken maintenance and is not providing any service..

                              Not only this project the Rahul Nagar Project near the Ambernath Station is also total failure.

                              Please don't flats here.. otherwise you will just get stucked up and your life will get screwed up .

                              If you don't believe me ask the people living out here, Rahul Nagar Peoples .. they will give the real picture..

                              1.) Water does come, But it doesn't come in Flats. Everyone has to carry water to their home

                              2.) Sewage line leaks every time.

                              3.) Maintenance has been taken but no bill has been paid.

                              4.) Advance payment has been taken for Swimming pool, gym etc. but nothing has been done till now

                              In short it is a living hell.

                                carpet area definition

                                Builders are still charging the build up and No action has been no action taken

                                Mumbai: In a bid to clarify the concept of carpet area and make builders more accountable, the state government will soon ‘define’ what carpet area is. The state housing department, along with the Urban Development (UD) department, is preparing the modalities to finalise the definition.

                                This move comes following the amendment to The Maharashtra Ownership Flats (Regulation of the promotion of construction, sale, management and transfer) Act, 1963, that makes it mandatory for the builder to sell the flat on the basis of carpet area for all the proposals submitted after May 12, 2008.

                                However, with no clear definition of carpet area, the builders used different parameters to describe carpet area, built-up area and super built-up area to confuse buyers. “Our department, in co-ordination with the UD department, is working to define carpet area, ’’ said Sitaram Kunte, secretary, housing department.

                                A senior officer in the UD department said the development control rules were being changed following complaints from consumers who had been cheated by builders. “The definition for the carpet area will be ready soon, ’’ he added.

                                According to the amendment to the Act, balcony is part of the carpet area. “To increase the space of a flat, people generally modify the balcony provided by the builder, ’’ said a senior official from the chief minister’s office. To discourage such illegal construction, The CM, in a meeting with the Housing and the UD departments this week at Mantralaya, suggested exclusion of balcony from the carpet area, the official added.

                                According to the amendment to section 3 (2) of the Act, a builder selling flats without specifying the carpet area and charging in excess to the mentioned area can face severe punishment like three years’ imprisonment. The amendment to this act was passed by the state legislature during the monsoon session.

                                Built-up area: It covers the balcony and width of the walls
                                Carpet area: Internal area of a flat (wall-to-wall area of the flat). The amended law includes balcony as part of the carpet area

                                  Am in a fix as the apartments / flats in Karnataka come loaded with all levies- stamp duty, vat, service tax.

                                  1. Stamp duty is fine : its an immovable good.

                                  2. VAT : All builders charge a 4% VAT and Sobha Developers charges 8.75%. I wonder if they are at all required to charge it in the first place, two if they at all deposit it into government kitty ! Charging VAT along with Stamp Duty is fraudulent.

                                  3. Service tax : why service tax ? Whatever logic is given; if construction and sale of flat is a service - then manufacturing and sale of TV, mobiles, ACs, printers should also be burdened with service tax and VAT !

                                  Everyone wants to exploit the poor customers, but i hope you would answer my doubts and also raise it at the right platform.

                                  I have booked a Flat with Prestige Group-wellington appartments, Jalahalli, Bangalore entering into a agreement in the year 1987. In the agreement their commtiments to deliver the Flat before-2008 december. If delayed 7% intrest they comiited to pay us for the delay period. They politely collected 98% of payment payable to them before 2008 December. Now they are relunctant to hand hover the flat with new claims like, that we have to bear 12.5% VAT on Construction value of the flat and also the SEvice Tax 12.5% . Moreover Denying to give the intrest for delay in hand over the Flat. Kindly suggest me whether Sevice tax and Vat applicable for the buyer.If so what is the rating of tax and percentage of tax and on what value.

                                      I had filed a case in Consumer Redressal Forum when the Builder whom I paid Rs 1 lakh five years before failed to give me the plot at Bhubaneswar, nor he returned the money even after repeated approach. The Consumer Court, after fixing five dates for hearing, delivered the judgment ex-parte since the defendant did not turned up and according to the judgment the Builder has to pay the amount with 9% interest. I waited for three months and when the order was not implemented I filed another contempt petition in the Consumer Court. The Hon'ble court summoned the Builder thrice and even then he did not attend the court. Finally the Court issued an arrest warrant. Two months have passed since the issue of arrest warrant, but the Police is doing nothing. What should I do now ?
