[Resolved]  Bajaj Highland Holiday Homes — Refund of Money due false promises and poor service

I am Jitesh Karanjkar, and this is regarding the refund of my membership (of Rs.35000/-) with Bajaj Highland Holiday Homes.

On 05-FEB-2011, I got a phone call from “Bajaj Highland Holiday Homes”. The lady on the other side asked 3 questions and my answers were declared correct and I was invited to claim a gift vouchers in the evening at their office at MG Road, Pune (mentioned below).

I was offered a 5 years package of 7 days a year, for an “initial investment” of Rs. 35, 000/- on Saturday 5 Feb 2011 through their Sales Manager Siddharth and sales girl Komal.

But when i returned home and cross verified with the affiliated club, they directly denied any links with Highland Holiday Home. Also the sales person there had told us that i would be receiving my membership certificate and card within 15 days but even after 21 days I had not received any documentation from them. And hence I visited their pune office on sunday 26 Feb 2011and met Branch Manager Priti Gwal and asked for my complete refund of payment of Rs 35,000 /- since they had made false promises and i had not used any service. The lady after much discussions and debate asked me to write application. And more over she said that she has no rights to take any action and the branch at Mumbai will be taking the necessary actions. I received an answer to my application on 2 mar 2011 stating that membership cannot be cancelled since it is non-cancellable and non-refundable.

According to the Consumer Court
"It is illegal to tag a service as NON-CANCELLABLE and NON-REFUNDABLE when you are actually not using their services."

Some more points for Cancellation:

1. I was assured by Manager Siddharth that i will get free access to Pan Card Club and Ganga Retreat club at Pune during my membership with highland, but when i personally contacted both the club they denied any such free affiliation and said i will get only 10% discounts on recreation.

2. On my second visit to highland office on sunday Branch Manager Priti was very rude and ill mannered and told me that i need to pay Maintenance cost of 300-400 for each club that i use for every year. Again this was never mentioned anytime during the session.

3. I was even assured by Sales Manager Siddharth and Marketing Girl Komal that if i opt for any affiliated Resort/hotel for my stay i need to pay only 650 /- as utility charges for any star hotel, but later on i discovered that its 650 /- onwards and this smart guys had never used this word onwards.

4. When i got the membership, they told me that i can rent out my unused holidays through them for which they will give me money. Now they are saying, its not their responsibility.

5. There are some more points which was being told by them but never mentioned on paper or something else written on paper and they have said something else. Even the marketing lady told me that Highland is Bajaj's Electrical group, on hearing this i said him to call your manager and give me proof that when bajaj has entered the relationship with you, then siddharth came and clarified that its no where related with Bajaj group.

6. Also during my session with Sales Manager Siddharth he told me various things about Highland Holiday and its affiliation but he or his teams never mentioned that the Highland Holiday Homes Pvt Ltd managed by Mr. Manohar P Bajaj was banned by SEBI on July 26, 2001 "debarring the Appellant, its promoters, directors, managers and persons in charge of the business of the schemes, from operating in the capital market for a period of five years"

7. There are many more victims like me and few of them have approached the Media and there was article published against them in Pune Mirror on 22 March 2011.

Now since they have dedcuted my money in one shot, i am expecting the same while refund.

Bajaj Investor Services Pvt Ltd — Bad Service

1) after placing order the webpage takes too much time (3 to 4 minutes) just to check the pending order status as well as 3 more minutes to check the Net positions. In these 5 to 6 minutes we are loosing as a day trader. Please do some thing to quick REFRESH .

2) if we call so called Helpline:[protected], 80% of the calls it just says no help line representative available, please call after some time (goes on till end of the trading session) . This is ridiculous.

3) Above two complaints i did informed their costomer care many times, , but no solution till date.. Now a days we are facing problem even to log-in.. forget about trading using bajaj capital..

I strongly believe with Mr. Jitesh. Bajaj Highland Holiday Houmes has also cheated my parents on the same grounds in Mumbai. I want to take strict action against them so they dont cheat any innocent people from now onwards. My name is Anil Balan. I too have been cheated by these fraudsters, Highland Holiday Homes. Me and my wife were called by their representatives in January, 2010 and given a very slick presentation. After falling for their false promises like afflilation with 3 star hotels, etc, we finally paid Rs.25, 000 for 5 years. Then, in November, 2010, when I called them up for reservations, I was told that they no longer have the affiliation with the hotel in Mahabaleshwar, I had requested for and their own property in Lonavala was under renovation. As I was not interested in the alternatives suggested by them, as they were not 3 star hotels, I told them I wanted to rent back the holidays for that year ( They had promised me that in case I did not want to avail the holidays, I could rent the holidays back to them @ Rs.1, 500 per day). To my surprise, they told me they do not have any such provision and these guys are so clever that they conveniently did not mention this point in the terms and conditions handed over to me.

I have now approached the consumer court in Mumbai and my case has been admitted for hearing. The date has been set for 3rd December, 2011. Now, as mentioned above, as the rent back facility was not mentioned in the terms, the only way I can prove this is if I can get affidavits from other people, who have beem given this false promise. I have already got an affidavit from one of my office colleagues, who had been cheated in a similar way. My appeal to all of you is that, if any one of you could come forward and send me an affidavit along with the relevant photocopies of your membership, then I will have a stronger case.

If I succeed, then this will also help you all, in case you want to teach a lesson to these cheaters. I will keep every one here updates with the progress of my hearings and I will share, all that I can with anyone wanting to ge back their hard earned money forom these frauds.

Membership sold based on false information by Highland Holiday Homes Pvt. Ltd

We were at Goa. One Person Name Sagot has given us voucher for promotional offers, in that we got an Holiday Package. Then he told us we need to visit the Highland Holiday Office to attend a company presentation to avail it, we were glad and went their office. They presented their membership scheme for a holiday timeshare system with lot of other benefits. We found the membership scheme quite beneficial based on their information and opted for a 5 years, 8days per year membership, costing Rs. 50, 000/- ( Rs. Five Thousand Only). We later came to know that all the information provided was false and the company had cheated us into buying the membership.

The following false information was given in the presentation.

1) We had purchased the membership on a 12 months EMI plan, using HDFC credit card(35, 000/-) and Citibank (15, 000/-). The sales person claimed that the company has a tie-up with HDFC and Citibank, the payment would be converted EMIs, and the interest, service charges and service tax would be borne by Highland Holiday Homes. On inquiring with HDFC and Citibank, we were informed that there is no such scheme available and they have no tie up with Highland Holiday Homes.


2) I have been also informed in presentation by Mr. Zayed Shaikh (Manger, Goa) that, if I am not satisfied with the offer in feature, within time span of 12 months I can cancel my membership.
-- But that was all fake, today I called them (Lisa - [protected]) saying, I am not happy with your services about the EMI, I want to cancel my membership, then she clearly said please read out your document there is written that you cannot cancel the membership, I was shock to hear that, I requested them, they said you can sell your membership to some there, but I said not I cant who will buy from me.
Then She was very arrogant and said do whatever you want do, will not cancel your policy, regrading EMI will refund you interest rate, but I said what’s guarantee and every month I have to ask for refund and if not paid i am not sure of this, after hearing all the lie from them.

3) For document part they said one more lie that, what we say will be completed documented, but I am sure what they say is not documented (we trusted them that was big mistake, I am very upset companies in India doing such fraud).
They took sign on paper involving us in lite chat, generally we trust them and also they create such an atmosphere that hardly who not visited them refuse the membership. Kind of Hypnotism.

4) If they give any assurances in feature will not believe on them, I know they do that.

Team, I need my 50, 000/- back please help me, me and my wife are very much in tension. I am not the only one whose suffering, many of them are suffering from this.
I am not sure but, as per Consumer curt also it’s written that we do not use their services and utility we have right to cancel the policy.

Please help me.
