[Resolved]  BPTP Park Elite Floors Faridabad — FRAUD BY BPTP

I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. Wish is yours to pay or not to pay, everyone has his own outlook, yes, I have my personal vested interest in Naharpar area, I own few floors there.

DLF and Unitech is not present in Naharpar area of Faridabad because they did not get a chance to buy land they wanted to, 1400 acres cornered by BPTP at very low rates long back.

I still want to ask a simple question? Where are we going to get a house at this price. Noida is complete no no for me because of the political situation o[censored]P, Sonepat is too far and any other area of Delhi is to costly, Darueda is far off and Bhiwadi still further off, I cannot afford to live in Gurgaon beyond budget.

Give me one choice, I am scared of those high rise buildings and ground floor in those high rise buildings are pathetic to live for any family.

My money in naharpar area is already appreciated and I don't see it going back to the levels from where it has started, ofcourse I have to wait for 3 years for the boom there. 8000x12 -1 lakh x 3 years = 3 lakhs is the rent I would be paying but if everything goes right then I would get aleast 40% increase in my floor which would 12 lakhs plus - not a bad deal, at the worst I would be losing some money if the project is complete on time in specified time but being an investor I am ready to take that risk.

This is not a call to any one to get influenced use your brain. don't listen to anyone including me.
Choice is yours afterall money is yours.

This note is specially for you. I am agree with all the facts written with you, for instance, but do let me know few points :

Up to when a person can expect the floor buyer / tpa from bptp, because only after that banks will come in picture to release money.

What do you feel, as it looks that you have sound in out knowledge about this project, up to when we can expect to get the possession.

What will be the outcome if we will try to wait for TPA/floor buyer in case demand get raised, with the help of sanction letter.

Why this project is being delayed up to this extent. As you said that DLF and Unitech, do you have any good examples of specific projects, if yes do let me know.. Please leave DLF Belaire as it was in high rise and more than 1.25 Cr cost..

I will be more clear if you will give answer of all of my question .. and may eb more satisfied as well.

Too many pointed questions which only BPTP can answer however as a thumb rule I am looking at the end of 4th year from the time of announcement which would be somewhere between 2nd half of 2013 and 1st half of 2014.

I am not sure what would be stance of BPTP for the customers holding sanction letters they are the best guys to answer that.

Unitech Habitat which you missed from Unitech side :)

In a nutshell if anyone does not have the ability and willingness to pay from own funds should look for exit, and with govt bonds yields above 8% be prepared to some rise in interest rates.

I got response to my queries from BPTP customer care. According to them they will be sending agreements by this week.

" This is to update that we would be going ahead with the agreement this month i.e. March. The agreements would be sent to you on your mailing address by this week."

First of all congratulations to everybody who got allotment and my sympathy with people like me who have not got allotment yet.

Can you guys please help me as i have a booking for 180 sq yd and have paid 25% amount till not and have given sanction letter from 1st october 2009 for 3rd installment and still waiting for my allotment. When should i expect my allotment as BPTP customer care is always giving me wrong deadlines. Any information on this front will be a great help.

Today I went to BPTP Office they have provided me with the checklist of documents that are required for Buyers agreement and they said they will be sending the agreement by next Sunday.

Total all formalities of buyers agreement will take another 1-2 month.
I HAD BEEN GIVEN ALLOTMENT IN PARK ELITE FLOOR PROJECT OF BPTP.THEY HAVE ADVERTISED FOR SECT-85 BUT NOW THEY R MAKING ALLOTMENT IN VARIOUS SECTORS & SURPRISINGLY EVEN AFTER ALLOTING ME THE UNIT IN SECTOR 75 AT SECOND FLOOR, THEY HAVE SEND ME THE BUILDERS BUYERS AGREEMENT WHICH STATES THAT THIS FLAT NO. MAY ALSO BE CHANGED IF COMPANY DESIROUS SO, & I HAVE NO RIGTH TO QUESTION BUT TO ACCEPT WAT WILL BE OFFRED BY CO. IS THIS FAIR? SHOULD I SIGN THE AFFIDAVITS/UNDERTAKING/ & AGRREEMENR WID COMPANY OR ASK FOR REFUND. SOMEONE PLEASE ADVICE AS THE COMPANY IS FORCING THE ALLOTTEES TO ACCPET THOSE UNFAIR TERMS & CONDOTIONS

Hi All,

I have booked a flat of 300 SQY GF in Park 81. I was interested only for Ground floor and at the time of bokking also dealer has confirmed that I will get GF only at the time of allotement. 2 day back all of sudden I got a mail from BPTP that I have been allocated FF through draw. I called them and asked there was not draw how can you do that and did you informed to anyone. They told me that management has teken a decision of draw but we have not calledd any one.

This is really surprising to me . How then can do draw. This project is in demand and price increased by 20-25% within 6 month. and Now BPTP want to make the money and allocating the cheap flat to everyone . I am going to complaint everywhere for it. Anyone can advice what should I do now .

By going through your experiences, i feel the jitter now..as i was planning to buy a 3 BHK flat in BPTP'S Princess Garden in sec.86. Now i don't know what to do, but for sure i am going to HUDA's office to verify the facts & figures...in the meantime & any suggestions / advice will be an added bonus...Add me to the gang!!!

I've received Agreement Papers for floor allotted to me in 'P' block. The agreement mentions some charges, like Club Membership Charges (Rs.50, 000/- per floor), some Interest Free Maintenance Security charges (Rs.20 per sq.ft.) and others, apart from the registration charges in Haryana (12.5% plus additional 1% for floor). Also there is an element of PLC of 5% for those who have been allotted a corner floor, a park facing floor or a floor on more than 12 m wide road. So calculate your total cost of floor accordingly.

The completion period of 30 months (exclusive of 6 months grace period) has been shown to take effect from the date of sanction of Building Plan. I have no idea whether Building Plan has been sanctioned or not. If anybody has some knowledge, kindly enlighten all.

I have second though of having this floor. Kindly advise.

There are nmerous issues with BPTP. No one can do anything individually. I am still waiting for the alltoment. According to BPTP cc it will take another 4-5 months even that is not certain???

My request to all of you please join the Group called : EliteFloors_BPTP on Yahoo. The group has already reached 100 members, and very soon the group will have a meeting with BPTP management people to discuss all these issues behanl of every member. Its really a time to unite to gether.

some people have signed the builder buyer agreement.
refund become little easy now. Read the comment below from Indiaspace.com.

Also I have heard that BPTP is paying 9% interest with refund, though they do not wish their customer to opt refund.

NOC is not required for the unalloted customer as per CC BPTP and they are giving refund in 15 to 20 days...
Can anybody tell me, how would I submit the buyer's aggrement to BPTP office?
