[Resolved]  HDFC Bank — CREDIT CARD GRIEVANCE

It all started on a very fine day i.e 25/3/2008, when I received a letter from the bank stating that I owe the bank the sum of Rs. 8, 660.53 towards credit card outstanding and after their repeated reminders by way of telephone calls and letters, the bank has placed a ‘hold on funds’ by exercising the ‘Bankers lien and right of setoff’ .

To my shock I got to know that they have been making calls at wrong numbers and talking to wrong persons .

and I haven’t received any statement of outstanding amount since 2005, they had been contacting wrong persons and they never cared to send any document by courier nor the statement of outstanding of outstanding since 2005. a

HARASSMENT CALL RATHER THEN A CUSTOMER CARE CALL
there statement also show only 4000 as outstanding and they are demanding 8000 with no records given to me as to how the amount almost doubled. And when i tell that in my last payment reciept i got full & final payment settled on the reciept, they refuse to acknowledge that .

Adding more to harassment my Cheque was being presented in HDFC Bank was dishonored wherein the reason for that mentioned in was ‘ Funds Insufficient ‘ and marked hold due to credit card lien marked, , which lead to monetary losses & business losses, incurred by the customer and harassment.

when the customer asked for a closure of his account, he was being told that even a closure could not be done as FUNDS WERE IN HOLD and credit card Lien was marked on the account .

No correspondence had been made from the bank’s side since Jan 2005 till date

I would like to state that as per RBI’s guidelines

1) I have been WRONGFULLY BILLED
2) No time limit was given to me to sort out the issued as per RBI ‘s guide lines a time limit of sixty (60) days may be given to the customers for preferring
their complaints / grievances.
3) No statement of outstanding balance amount received from since 2005 till 2008
4) Banks fault in contacting me. Calling at wrong numbers.

Sub: Sincere grievance towards recovery of Credit Card dues by bank

This is to draw your kind attention that on 16/07/2018 a recovery agent without prior intimation and identity shown, represented HDFC Bank visited my home and asked for making minimum payment due on the above mentioned credit card to my wife when I was not present at home.

My wife immediately made phone call to me and explained the situation. I then spoke to the recovery agent and told him that I have explained to the bank that I am going through a financial crisis and reason why I am unable to make minimum payment due. However, I am trying to borrow some fund so that I can go for settlement of the above card.

Recovery agent was not ready to listen to me and he made conference call with Bank manager. Then I explained my situation to the bank manager that I was a regular payer for the above credit card outstanding however because of financial crisis I am going through I am unable to make payment from last two months. I told him that I gone bankrupt as someone taken 20 lakhs from me and not returning back. I am also unable to pay my Home Loan EMI with SBI and HDFC personal loan EMI. My house, my car all on sale. I am somehow surviving hand to mouth from my only job with my family dependent on me. I am also put into bench and my job also at a stake since I am unable to perform at work due to various above reason. My cash outflow become more than my cash inflow. I also requested SBI card to help me with settlement.

So I asked Bank manager to give me few days’ time so that I can arrange the money and go for settlement.

However, bank manager was not ready to listen to me and he instructed recovery agent to collect minimum due by hook or crook. Finally, recovery agent before leaving my house shouted on my wife and threatened that next morning he is coming at 7:30 am to collect the money. In such incident all my family losing social reputation and why my wife gets metal torture as 3rd party when loan was borrowed by me.

Now my wife after this incident happened mentally become very depressed and her health condition deteriorated. In this situation my only plea to you is that if my wife’s health condition deteriorates further because of the above mental insult who will be responsible for that?

I firmly believe that bank also abide by RBI guideline and will not do any such incident where customer gets mentally torture. Any deviation from RBI recovery guide line by the bank I will have no other option but to raise complaint against bank and bank will be liable to pay back losses incurred as penalty.

I understand I am liable to the bank to repay the loan I have taken however in the above situation if I request bank to provide me grace period am I doing a crime is a question? Bank has given me option of converting below outstanding amount towards HDFC credit card into EMI but I can’t afford EMI at this moment hence I requested bank for settlement of the card.

Thanking you and I appreciate justice to the above matter in personal/social interest and for the sake of humanity sooner possible. I am also taking above insulting situation to the legal and consumer forum till I get your response in line with guideline set by RBI.
