[Resolved]  Municipal Corporation Of Delhi — Failure to prevent encroachment/illegal demolition etc at A-17 Kailash colony New Delhi 48.

The facts of the matter are as under:
1. The property notified under section 4 vide notification no.F9(83)L&B/LA/MRTS(S)/14616 dt 17.1.2008 is A- 17 East of Kailash New Delhi.
2. The property notified under section 6 vide notification no.F9(83)L&B/LA/MRTS(S)/17135 dt 11.3.2008 is A-17 East of Kaiiash New Delhi.
3. No notice under section 9(1) of Land Acquistion Act, 1894 was ever issued/ served in respect of captioned private property as the said property was never subject matter of any acquisition proceedings.
4. On 23.4.2008 the owner personally met the ADM/LAC(S) to seek a copy of the S9 notice in respect of above notifications but was denied a copy of the same. Barely 3 days later on 26.4.2008 t officers of Delhi Metro and Gammon India obtained forcibe entry and carried out demolition of built-up private property not notified for acquistion as per law.
5. On 26.4.2008 itself two police complaints were lodged followed by another complaint dt 30.4.2008.
6. Subsequently owners made representations to various govt. autorities. The office of the Hon’be CM of Delhi lent positive support and issued orders to help the senior citizen.
7. Order No CMO/OSP2/08/682 dt 6.6.2008 issued by office of CM of Delhi to ADM Revenue clearly stated that property No A-17 Kailash Colony had been wrongly taken over. Copy attached).
8. GNCTD issued a corrigendum dt 28.8.2008. This is a public admission of the above facts. We have challenged the legality of said corrigendum by way of writ No. 7417 of 2008. The matter was heard, notice issued and since govt decined to file a counter it was reserved for final orders on 23.10.2008.
9. In addition we have filed several complaints on the Public Grievance Cell of GNCTD and Deptt of Public Grievances, GOI, Commr Delhi Police
10. The vigilance cell had conducted a hearing on 7.10.2008 and advised the owners to meet the Hon’ble LG of Delhi. Appointment with LG not yet given.

In the light of the foregoing the owners are aggrieved that
· the civic agency has failed to examine the legality / validity of the statutory sanctions obtained by the said govt agency to occupy built-up private property and illegally occupy the same without following the statutory procedure under the Land Acquisition Act, 1894.
· Public funds have been used against the provisions of the statute and in violation of Art 300-A of the Constitution of India to grab private property and demolish built-up office premises and engage in unlawful activities thereat since 26.4.2008.
I am 86 years and in lawful use of the said premises since 1956. I am deeply traumatized by the above events and fail to understand how the various authorities can ignore the orders of the Hon’ble CM of Delhi as well as other independent govt. agencies.

Sub: Complaint-encroachment of road & footpath

Dear Sir
We wish to draw your kind attention towards following encroachments made by house no. B-1/8 Rana Partap Bagh, Delhi

1. The party has covered whole of foot path with grill and entry gate.
2. A steep concrete ramp has been made for entry of their car covering full footpath.
3. The ramp has further been extended to road where people are walking.

The above encroachment has resulted in great inconvenience for the public. People have to walk on the road instead of footpath. Now the new extension of steel ramp has covered the road as well. Other people opposite have also followed the examples.

We request you for a survey and remove all the encroachment from road and footpath as well, including both the ramps of concrete and iron in the interest of public at large.

In this regard we further wish to state that how so ever influential the person may be, no body is above the law.

We await your reply with thanks in anticipation.

MCD — Foot Path Has not been built.

From House No. 1 to 12 of CU Block Pitampura, Delhi 110088, the footpath has not been built for last 15 years. The hightening of nullah adjacent to house NO. CU-1 to 12 has not been done since long. REsidents has given shape to space in front of their home according to their will. As a result the water stagnates on the road and results in ditches on the road. The footpath of other nearby places except these 12 hosues has not been built three four times in the last 15-18 years. Why this road is being ignored.
Dear Sir,
I am a resident of 49, Bharat Nagar, New Friends Colony Lane opposite to Deep Sweets.
2-3 Junk sellers and few Garages encroached the whole lane illegaly and they have occupied the whole lane by there waste and junks by unauthorised occupation of Junk. When we complaint to the concerned authority, they simply collect money from them and went back. It is humbly requested to kindly take a neccessary action and to get rid o[censored]n-necessary junk and waste from the lane.

MCD — Encrochments on footpath

Dear Sir,

On busy road called GTB Hospital Road, from GT Road to GTB Hospital there are lots of encrochments. There are two meat Shops on the pavement where liqure is also consumed after 8.00 P.M. One person has built a worship structure on the footpaht itself. Besides these there are other vendors, mechinics, Pan shops etc. All the shops are working from the garages alloted to the residents of the flats of A Block, Dilshad Garden, Delhi. I hope some action will be taken to remove all these sops/structures.

Road and footpath not repaired for last four years — Road and foot path not repaired for last four years

In Roop Nagar Road No.1 near Grasim Company, near Reliance and Man Hospital the foor path has not been repaired for the last four years after digging no one has taken care of the same by Municipal Corporation employee / contractor, kindly do the needful.

HI SIR,

ASHOK NAGAR 54 BLOCK VEDIC MARG, TIHAR ROAD THERE IS AN OLD FURNITURE STORE NAMED JANTA PURANA FURNITURE AT 54/17 BUILDING.
THE SHOPKEEPER HAS BLOCKED THE FULL FOOTPATH WITH OLD FURNITURE ITEMS.
MANY TIMES PEOPLE ASKED HIM NOT TO BLOCK THE FOOTPATH BCAUSE PEOPLE PASS THROUGH THIS AT RAINY TIME AND MORE. BUT HE SAYS I PAY RS. 500 TO DELHI POLICE AND RS. 500 TO MCD. NO BODY DARE TO ASK ME NOT TO OBSTRUCT THE FOOTPATH. BUT PEDESTREINS ARE FACING PROBLEM DUE TO HEAVY RAIN AND WATER INFECTED ROAD THERE IS 2 FEET WATER ON THIS ROAD WHEN IT RAIN 10 MINUTES.
PLZ RESIST THIS FOOTPATH BLOCKAGE AND TAKE ACTION AGAINST CORRUPTED POLICEMEN AND MCD ASSOCIATES.

SIR THIS COMPLAINT AGAINST ENCOUROCHING THE ROAD OPPOSITE THE GURUDWARA KHAZAN BASTI MAYAPURI PHASE 2 NEW DELHI 110064
This is to bring to your notice that we are resident of village Pat Par Ganj Delhi-110091. There is a road passes inside the village. The road actually so wide 10 years back that there was DTC buses uses to move. There was a registered route of DTC 321 bus passes quite easily through the road. But in the present scenario the encroachment done by the people residing along with road. The condition become severe that even two cars have lot of difficulty to pass. There is always a position of Jam due to very less passage space left for vehicle movement. This road is very important as it connects Laxmi Nagar to Mayur Vihar. Even with naked eye the encroachment can be seen, the old shop and now the encroached new entry of the shops. Seeing the same even the encroachment is happening in the streets as well due to which the movement of children’s, women’s and old aged is restricted.

Is there any authority will take the same in consideration and do needful.

Builders are very active in the area and with the same level of increasing encroachment it will be very difficult to live in the vicinity.
