Subject: N73-5 (GENERAL) A FAULTY PRODUCT OF NOKIA.
Sir/Madam,
Through this complaint I would like to bring to light that the hugely popular product of Nokia N73-5 (General) has a fault in its video section in all the said models of Nokia (acknowledgement copies of the company duly signed attached herewith) so that the other customers are not cheated after purchasing the said product.
I (Mr. Armaan Shafique Hazarika) having purchased the hugely popular product of Nokia, [N73-5 (R-132) IMEI [protected]] feel cheated. It was purchased on 8th Jan, 2008 from UTSAV (copy of the cash memo attached herewith), a retailer of NOKIA MOBILE PHONES in Dibrugarh (Assam, India).
The said Model of Nokia has a fault in its video section (confirmed after observing several phones of the same Model) which I was not aware of at the time of purchase. I came to know about this much later. The recorded video files when played do not run smoothly but run with jerks similar to that of a corrupted Video Compact Disk with scratches.
The matter was first reported to the retailer (UTSAV) but they paid no attention saying that they are not responsible for after-sales service. Then the matter was reported to Nokia Care Dibrugarh (herein said L2). The transreceiver was checked twice and Software upgraded thereby. (Copies of the Job Sheets with number and date obtained). But the problem was not solved. L2 confirmed that the solution to the problem is beyond their capabilities. (Copy of the acknowledgement obtained). It was further added that it might take around 30 days for the handset to be sent to Nokia Care Gauhati (herein said L3) for further investigation. This sounded very inconvenient to me for a new handset purchased hardly two months back.
The handset was sent to L3 by L2. But to my utter surprise L3 returned my handset saying that it was faultless when it had been sent to them for the first time. On further complaints, they asked me to go to L3 and explain the matter as they failed to understand the problem. So on 28th Mar, 08 the handset was personally handed over to them. (Job Sheet with number and date obtained). They accepted the fault and agreed to replace my handset after 20 days. This was ridiculous and foolery on L3’s part. How could they put forward two opinions contradictory to each other?
On 11th Apr, 08 I again had to go to Gauhati (450 km from here, approx.) after receiving an SMS from them that the handset was ready for pick-up. On 12th Apr, 08 I was provided with a new handset bearing IMEI 35185/01/080026/7 RM (133) at 11:30 a.m. at L3. But the new handset also had the same video fault as mentioned earlier. So I did not accept the same faulty product.
I was then told to meet Mr. Sachin Darji, Distribution and Marketing Area Manager Nokia (North East). I went to his office instantly, met him and gave a detailed explanation of the matter. He then checked the new handset himself and down-loaded another version of the Software of N73-5 in my presence. But all these efforts turned futile as the video fault in the said Model could not be rectified. (Acknowledgement obtained, fault accepted and confirmed by L3).
L3 assured me to solve the problem within a week. After completion of the stipulated time when nothing was heard from them, I lodged an F.I.R. at the Dibrugarh Police Station against the dealer on charges of cheating me. But the Dibrugarh Police Station has not yet issued the case number against my F.I.R.
I even took the matter to the MEDIA and several vernacular newspapers including ‘The Sentinel’ published my complaint but without any positive effect. I am still without my handset and it has been two months now.
A hue and cry was raised on the 19th Apr, 08 after the coverage of the matter by a local T.V. channel here. The dealer and L2 contacted me over phone out of panic and asked me for a compromise off the record. They were even ready to provide me a seal-packed handset but unofficially which was denied to me earlier saying that it was against NOKIA’s rules and regulations. I refused to accept such offer by keeping the general people in darkness as Nokia is still selling the faulty product (N73-5) in the market nationwide.
Mr. Manish Keshan, L2, confirmed over telephone that N73-5 contains a weak processor. So why should I accept such a faulty product? Now they are trying their best to conceal the matter and manage the entire episode.
My interview was recorded along with necessary evidences by ‘NEWS LIVE’ and ‘NE NEWS’ but has not been cast yet. I fail to understand procrastination of the telecast.
I being a novice in this field think that perhaps the Software used in N73-5 is not compatible with the hardware or there might be a fault in so called 3.2 Mega Pixel Carl Zeiss Lens. In short, it is entirely the Company’s fault in cheating its customers by selling a faulty product.
Moreover, Nokia has been turning a deaf ear to my complaints. Several Emails had been sent earlier to Mr. Sachin Darji, Distribution and Marketing Area Manager Nokia (North East); Poonam Kaul, Director Nokia Gurgaon and so on, but no reply came to me. Perhaps they are too busy to listen to such complaints of a common person like me. This is out and out customer’s harassment.
Finding no other way out I have sought help of The International Consumer Rights Protection Council as they are at least responding to my emails and assured a help. I have decided to take LEGAL ASSISTANCE and also the help of the MEDIA so that the other customers do not run into the same quagmire as they are unaware of the fault in the said Nokia product.
My complaint has been published recently in the following vernacular newspapers under the heading ‘NOKIA’s TREACHERY’.

I now want my amount be refunded along with due compensation by Nokia and that the licenses of L2 and L3 as Nokia Care Units be cancelled on grounds of irresponsibility and inefficiency in providing proper customer services.
Now it seems that the retailer in collusion with the Nokia Company have cheated me through the sale of a faulty product. This is gross violation of the term they offered at the time of the sale of the handset to me.
I therefore request you kindly to take appropriate actions against the persons concerned for cheating me in the manner aforesaid.

But the Dibrugarh Police Station has not yet issued the case number against my F.I.R.
I even took the matter to the MEDIA and several vernacular newspapers including ‘The Sentinel’ published my complaint but without any positive effect. I am still without my handset and it has been two months now.
A hue and cry was raised on the 19th Apr, 08 after the coverage of the matter by a local T.V. channel here. The dealer and L2 contacted me over phone out of panic and asked me for a compromise off the record. They were even ready to provide me a seal-packed handset but unofficially which was denied to me earlier saying that it was against NOKIA’s rules and regulations. I refused to accept such offer by keeping the general people in darkness as Nokia is still selling the faulty product (N73-5) in the market nationwide.
Mr. Manish Keshan, L2, confirmed over telephone that N73-5 contains a weak processor. So why should I accept such a faulty product? Now they are trying their best to conceal the matter and manage the entire episode.
My interview was recorded along with necessary evidences by ‘NEWS LIVE’ and ‘NE NEWS’ but has not been cast yet. I fail to understand procrastination of the telecast.
I being a novice in this field think that perhaps the Software used in N73-5 is not compatible with the hardware or there might be a fault in so called 3.2 Mega Pixel Carl Zeiss Lens. In short, it is entirely the Company’s fault in cheating its customers by selling a faulty product.
Moreover, Nokia has been turning a deaf ear to my complaints. Several Emails had been sent earlier to Mr. Sachin Darji, Distribution and Marketing Area Manager Nokia (North East); Poonam Kaul, Director Nokia Gurgaon and so on, but no reply came to me. Perhaps they are too busy to listen to such complaints of a common person like me. This is out and out customer’s harassment.
Finding no other way out I have sought help of The International Consumer Rights Protection Council as they are at least responding to my emails and assured a help. I have decided to take LEGAL ASSISTANCE and also the help of the MEDIA so that the other customers do not run into the same quagmire as they are unaware of the fault in the said Nokia product.
My complaint has been published recently in the following vernacular newspapers under the heading ‘NOKIA’s TREACHERY’.

I have left no stones unturned but in vain. I am in need of help and looking forward to you with great expectations so that the matter is brought to the national level in the greater interest of the general public clientele. I now want my amount be refunded along with due compensation by Nokia and that the licenses of L2 and L3 as Nokia Care Units be cancelled on grounds of irresponsibility and inefficiency in providing proper customer services.
Now it seems that the retailer in collusion with the Nokia Company have cheated me through the sale of a faulty product. This is gross violation of the term they offered at the time of the sale of the handset to me.
I therefore request you kindly to take appropriate actions against the persons concerned for cheating me in the manner aforesaid.

I bought two Nokia E-65 mobile's from Hot Spot mobile shop ( gaziabad and durgapuri). I spend Rs. 38000/- on both mobile's. Since than i am facing continous problems with both mobile like :-
*mobile automatically restart every 3-4 hours.
*colour is peeling off (low quality material is used).
*mobile is dead for 3-5 hours every 3 days.(i always keep a standby mobile for this situation).
*Keypad buttons (inner and upper keypad)and light is not working properly.
One of my mobile is once replaced, battery replaced and three time repaired .(set is again in service centre) but problem is not sorted out..
My second mobile is in service centre and god knows what will happen.
Now i do not want any repair. Kindly do me a favour and refund me the actual amount i had spend.
