Claim No.142803/11/2010/000002

Dear Sir,

Sub : Policy No.142803/11/2010/152 Exp.[protected].
Claim No.142803/11/2010/000002

It has been considerable length of time since I had intimated the
loss/damage to your office through my letter dated 16.07.2009. The
claim of Rs.6,10,000/- is not yet settled by you. It is far from my
capacity to understand the reason behind so much delay that has taken
in settling the claim. Please let me know if any document is required
by you other than what I have duly provided to you as per the letter
received from the surveyor.

The loss has made me handicapped financially. I am facing great
financial hardship. Your early settlement of claim will restore me in
the same financial position as I was before. However, I am unable to
wait for unnecessary long time as it will lead me further damage and
put me financially from bad to worse situation so I request you to
please settle the claim at the earliest and do not oblige me to take
the help of third party mediation like insurance ombudsman.

Thank you,

Dear Sir,

Sub : Policy No.142803/11/2010/152 Exp.[protected].
Claim No.142803/11/2010/000002

The discharge voucher of Rs.9355/- issued by you is partial (short)
payment and is underestimated settlement of the claim so I have not
signed it and is not correct arriving at the settlement of the case
according to the actual loss incurred to my property.

It is now after receiving my letter through registered ad that
clarifications are issued. Yes, I have received a letter of
20/07/2009 from the surveyor about the claim related papers but it
does not mean that I have not sent the detailed estimate alongwith
required building papers duly signed by me. I have not received any
reminders over phone that the same have not been received by him. It
is only after I rang him over the phone that I have received partial
(short) discharge voucher from the insurance company then he told me
that papers have not been received by him. I am sending herewith 2nd
copy of all the required documents. Before issuing the survey report,
if he had asked me to provide 2nd copy of all the documents, I would
have sent at the earliest because documents are in order with me.

I have insured my property as under :-

1) Building Rs.3,50,000/-
2) FFF Rs. 50,000/-
3) Contents Rs.2,10,000/-

According to photographs taken by the surveyor, my house is not
totally destroyed. I agree with you that my house is not totally
destroyed but I will never agree that my house has not been washed
out. Only the building has not fallen to the ground, otherwise
everything is done to the house. You would consider for Rs.3,50,000/-
only if the building is totally damaged and if not nothing, no one
would take the policy from you. I have estimated the repairing cost
of the building to Rs.3,50,000/-. The total cost of the building is
greater the amount than what I have insured. Each and everything in
the house has been destroyed. I have also taken the photographs. If
you base your report solely on the photographs and rely on your survey
report is partial, unjustified and not fair.

P.T.O
If you consider the entry level of water of 2 feet only to my house
then it will make all the newspapers, the people living the area, the
Mamalatdar report and survey of Municipality wrong in their estimate
of level of water entered in the houses of our society. The muddy and
sandy water entered in my house is upto 4 ½ to 5 feet and not 2 feet.
I have kept the evidence to prove that. The Furniture items and most
of the contents do lie to this level and these items are destroyed and
some are washed away with the water.

The surveyor did not even called me up to say that he required the 2nd
copy of the documents, the question of all the facts explained by him
does not arise.

Since, my claim is not settled which amounts to Rs.6,10,000/- and
since the discharge voucher is of short payment, I cannot sign it
until full & final claim is settled.

Thank you,

Yours faithfully,

Dwarka Balchand Kundlani

Claim No.142803/11/2010/000002

Dear Sir,

I have taken the Fire & other perils Policy for my house located at
Dabhore Road, Nr. Gayatri Mandir, Veraval from The Oriental Insurance
Co., Ltd., Veraval Branch as per the details mentioned above. After
the flood, furniture, goods and house are damaged. I have intimated
on time of the damage/loss to my property to the insurance company.
The survey of my house is conducted. The house is extensively damaged
and goods and furniture in the house are completely destroyed. I have
provided them a copy of all the documents asked by them as per their
letter. I have put the claim of Rs.6,10,000/- (sum assured) though
the estimate of damage/loss is more than that. In response to my
claim, they have issued me a discharge voucher of Rs.9,355/- which is
partial, unfair and unjustified settlement of the claim.

I have registered my complaint with them about the partial settlement
of the claim and requested them to settle the claim of Rs.6,10,000/-
as full & final settlement of my claim. But they have not responded
to my letters.

I enclose herewith the policy and other documents corresponded with
the company till now.

I kindly request you to register my complaint and do the needful in
this matter so that my claim of Rs.6,10,000/- is settled.

Dear Sir,

Sub : Policy No.142803/11/2010/152 Exp.[protected].
Claim No.142803/11/2010/000002

Ref : A letter dated _______________ sent to you.

In response to my letter dated ______________ sent to you, you had
directed me to first register my complaint with Regional Office of the
insurance company. If I do not get response from the office in one
month, I should write a letter to you.

I have to state that I have not received any letter from the Regional
office of the company. But I have received a letter from branch
office, Veraval. I state hereunder the points that they have
mentioned in their letter:

(1) That Discharge voucher was “full and Final Payment. It was not partial.

Please refer to my loss/damage Intimation letter dated[protected] in
which estimate of loss/damage claimed by me is of Rs.6,10,000/-
(Rupees Six Lac Ten Thousand Only). Though the damage/loss is more
than Rs.6,10,000/-, I have not claimed more than Rs.6,10,000/- because
I had indemnified my property against loss to the amount of
Rs.6,10,000/-. I have paid full premium to cover the loss of amount
of Rs.6,10,000/-. Even if I have not paid less premium and the
loss/damage intimated by me is Rs.6,10,000/-. I have received
discharge voucher of Rs.9355/-. The Discharge voucher is not full and
Final Payment and is partial because against the loss/damage of more
than Rs.6,10,000/-, an amount of Rs.9355/- is issued. This is
partial, unfair and unjustified in any sense of the term. In fact, I
have incurred more loss than what I have indemnified. I have not
claimed any penny over and above what I have indemnified. In fact, I
have incurred more loss than what I have indemnified. I have not
claimed any penny over and above what I have indemnified.

(2) That they have sent a letter to the concerned surveyor in response
to my letter. The surveyor has responded that discharge voucher is
all right and no change is required.

(2) Damage to my property was done on 15.07.2009. Reporting of damage
was intimated on 16.07.2009 and the survey was carried out on
17.07.2009 when the water was receded. The amount of loss surveyed by
the surveyor is unjust, unfair, unreasonable, imbalanced and partial.

The photographs are taken on 17.07.2009. According to photographs
taken by the surveyor on 17.07.2009, my house is not totally
destroyed. I agree with you that my house has not fallen to the
ground. But I will never agree that my house has not damaged due to
flood water. Only the building has not fallen to the ground,
otherwise everything is done to the house. I have estimated the
repairing cost of the building to Rs.3,50,000/-. The total cost of
the building is greater the amount what I have insured.

Contents and FFF are totally destroyed. Some are also washed away
with flow of the flood water.

Each and everything in the house has been destroyed. If you base your
report solely on the photographs and rely on your survey report is
partial, unjustified and not fair.

The house has received the impact of the flood water. The flood water
had made a way through the floor tiles. All the tiles of the all the
floor are cracked and the flood water had seeped through these tiles
made damage to the foundation resulting the cracking of the walls of
the rooms. It has also destroyed the lighting system. There had also
been short circuit in the house which had destroyed the lighting
system of the house which has been replaced. It had cost around
Rs.35000/-. The iron net set in the window has completely been rusted
due to water and needs to be replaced. The windows, doors, the
setties, Palangs, the beds, the pillows, the household goods, kitchen
wares, the china items are broken and rest of the household items are
washed away with the flow of the water, the iron-sheet cup boards,
bags, clothes, chairs, fans, tube lights, bulbs, are damaged not
direct with the touch of the water but when the water entered inside
the lighting system, it caused the short circuit and because of the
short circuit, all the electrical items are short circuited and
destroyed.

(3) That the details of the insurance taken is as under:
(1) Building Rs.3,50,000/-
(2) FFF Rs. 50,000/-
(3) Contents Rs.2,10,000/-

(4) That according to the survey report and the photographs taken, my
building is not totally damaged, washed away with water, fell down nor
met with the ground. Whatever damage has been done to my building by
2 to 2.5’ of flood water has been surveyed and the payment is made
accordingly. Damage to the building is not done to the amount of
Rs.3,50,000/- so it is not payable.

(5) In the same way, contents and FFF which are damaged up to level of
2 to 2.5’ of flood water has been surveyed and also included in the
discharge voucher.

(6) That there could be many things above 2.5’ level of the house such
as Fan, Tube lights, furniture on the wall etc. which could not be
damaged.

(7) That surveyor has carried out survey according to the terms and
conditions laid out in the policy.

(8) That I have not proved that my house and the contents of the house
have been washed away with the flood water or are totally destroyed
and that this house is not being used now.

Whatever damage to my house, contents and FFF has been done upto the
water level has been surveyed and discharge voucher issued according
to the survey is correct

Now, I state hereunder my points of complaint :

Please refer to my loss/damage Intimation letter dated[protected] in
which estimate of loss/damage claimed by me is of Rs.6,10,000/-
(Rupees Six Lac Ten Thousand Only). How could it be final payment and
not partial? Have I not paid the full premium to cover the amount of
Rs.6,10,000/- to indemnify my property against the loss? Against the
claim of Rs.6,10,000/-, I was issued a Discharge voucher of Rs.9355/-.
If it is not called partial then what could be called. In fact, I
have incurred more loss than what I have indemnified. I have not
claimed any penny over and above what I have indemnified.

Damage to my property was done on 15.07.2009. Reporting of damage was
intimated on 16.07.2009 and the survey was carried out on 17.07.2009
when the water was receded. I doubt the cent percent reliability of
the survey report made after the damage/loss to my property. The
amount of loss surveyed by the surveyor is unjustified, unfair and
partial.

According to photographs taken by the surveyor, my house is not
totally destroyed. I agree with you that my house is not totally
destroyed but I will never agree that my house has not been washed
out. Only the building has not fallen to the ground, otherwise
everything is done to the house. I have estimated the repairing cost
of the building to Rs.3,50,000/-. The total cost of the building is
greater the amount what I have insured.

All the tiles of the all the
floor are cracked and the flood water had seeped through these tiles,
made damage to the foundation resulting the cracking of the walls of
the rooms. It has also destroyed the lighting system. There had also
been short circuit in the house which had destroyed the lighting
system of the house which has been replaced. The water has entered in
the safety tank. All the walls of the safety tank are broken. They
need to be reconstructed. The Otlo has detached from the house and
washed away by the water and needs to be reconstructed. The house has
tilted to the side and has received maximum impact of the flood water.
The tiles have separated to each other and need to be set after
filling in the Manchad. The plaster and colour of the wall has been
peeled out and needs to be replastered and coloured. The iron net of
the windows are completed rusted by the water and the windows and
doors are not workable. The plywood of setties, Palang, chairs,
tables have come off. There is no way out but to replace them. The
clothes, beds, bed sheets, shawls, are completely washed away in
water. They are giving stinking smell. The iron net set in the
window has completely been rusted and needs to be replaced. The
windows, doors, the setties, Palangs, the beds, the pillows, the china
items are broken and rest of the household items are washed away with
the flow of the water, the iron-sheet cup boards, bags, clothes,
chairs, fans, tube lights, bulbs, are damaged not direct with the
touch of the water but when the water entered inside the lighting
system, it caused the short circuit and because of the short circuit,
all the electrical items are short circuited and destroyed.

We left the house to save our lives when the water level in our house
was 4 feet. The water gushed into our house which made us unable to
shut the doors and windows. When we returned to house, most of the
items were washed away with flow of the water after the water receded.
The rest of the goods in the house were completed damaged and
destroyed. We have carried out the estimate of repairing work of the
house which has cost us more than Rs.3,50,000/-. FFF and Contents are
completely destroyed. Because the walls have become weak the slab has
tilted to one side. The whole structure needs to be rebuilt.

As of now, we are not residing in this house because of the fear of
poor structure caused by the flood water and may fall at any time.
Even if we live in this structure, we are not getting the facilities
that we used to get. The toilet water is choked. It does not enter
in the safety tank because all the walls of the safety tank are broken
and have come to the ground. We cannot sit on the Otlo which has
detached with the house and completely decomposed. The choktha have
separated from the walls. The doors, windows have separated from the
walls and are hanging on the floor. Because the water has seeped
through the tiles, it has done maximum damage to the walls and because
of it the slab may give way. The whole structure may give way and
fall to the ground at any time. One part of the house is sloped
towards the other so it is not residentiable.

If it is surveyed the entry level of water of 2 feet only to my house
then it will make all the newspapers, the people living the area, the
Mamalatdar report and survey of Municipality wrong in their estimate
of level of water entered in the houses of our society. The muddy and
sandy water entered in my house is upto 4 ½ to 5 feet and not 2 feet.
The Furniture items and most of the contents do lie to this level
and these items are destroyed and some are washed away with the water.

I have taken a insurance from Oriental Insurance company at the time of collecting the premium amount & while doing survey of my bike the agent committed me that you will get an IDV of Rs. 49600/- and the premium will be Rs. 1170/- with tax.

I agreed to pay that amount and paid total of Rs. 1270/- as premium which includes Rs. 1170/- premium amount and Rs. 100/- inspection charge. I made the payment in cash and I do have an receipt for the same.

Now when I received the insurance papers in my mail it shows that IDV value if Rs. 38000/- and premium paid Rs. 1170/- . I spoke to the branch because Oriental customer care is disconnecting the call again and again.

The branch officer told me that sir this is the correct IDV for my bike and there is no changes can be made, If you want to return the policy there will be a deduction of Rs. 400/-.

I checked on the website of Oriental Insurance over there also my bike IDV is showing minimum Rs. 44000/- with premium of Rs. 1150/-.

When I told this things to those people they told me this is not our issue do whatever you want we cannot do anything and then disconnected the call.

              Please help me.

                  Shri Nitin Kalra,

On receipt of your claim intimation dated 26th June, 2009 for the accident occured to your vehicle no.DL4CAA8097 on 25th June, 2009, we had deputed Shri S.N. Singh, Surveyor the same day, who closely inspected your accidental vehicle the vey next day on 27th June, 2009. We have since received his Survey Report dated 28th June, 2009. While making his assesment for the damaged parts, Shri S.N.Singh pointed out CNG pipelines fitted in your car which were found to have been removed from the car after the accident, since the nut, bolt and fitting of CNG indicated that it was removed recently. Further, it is also pointed out that the CNG kit is neither endforsed in the Registration Certificate nor in the policy of Insurance. Various photographs taken by Shri S.N. Singh of your vehicle also indicate that the vehicle was fitted with CNG.

As per Section 52 (1) of Motor Vehicles Act, 1988 - Alteration in Motor vehicle "No owner of a Motor vehicle shall so alter the vehicle that that the particulars contained in the Certificate of Registration are at variance with those originally specified by the manufacturer. Provided that where the owner of a Motor Vehicle makes modification of the engine or any part thereof, of a vehicle for facilitating its operation by different type of fuel or source of energy including battery, compressed natural gas, solar power, liquid petroleum gas or any other fuel or source of energy, by fitment of a conversion kit, such modification shall be carried out, subject to such conditions as may be prescribed."

As per your own acceptance, you had made an attempt to fit-in the CNG in your car after your first claim. Thus, we have the reason to believe upon the finding of Shri S.N. Singh, Surveyor, who has successfully proved by way of physically inspecting the vehicle as also the images of the insured vehicle. Further, it is also found that CNG kit is neither endorsed in the R/C nor in the Insurance Policy, which is a breach of the above proviso under the Motor Vehicle Act, 1988.

In view of the reason stated above, your claim is not tenable and hence hereby rejected, which please note.

Thanking you and assuring you of our services always.

                  Hi Sir,

This is to bring in your notice that my Vehicle No. is DL4CAA8097 Has meet with an accident and it is given on a workshop for repairing in which, A survey has been done by SN Singh ( Survior ) and he has not approved the claim because the CNG is fitted in the care.

This Vehicle was a second hand and CNG was already fitted in the car when i purchased this car i removed it before purchasing.

After the first claim of my car i tried to fit CNG in my car but was not working properly thats why i had removed the CNG but your survey team has captured the Strip which shows the CNG is fitted in my car but the fact is this that this strip was a part of previous efforts to fit CNG in my car.

Would request you to approve my claim.

                      Dear Sir

I'd like to put forward my complaint against Oriental Insurance Co Ltd & Medsave Healthcare Ltd (TPA) who have been showing very callous attitude towards settling the mediclaim for my husband's policy. The claim no. is 4101127B001R21. The claim filed in 8th Sept'2010 (bills submitted worth Rs 3,90000 was to be settled for 2,30000/-) got settled on 19th April'2011 (for 2,23000/-) after my husband's death on March 15th' 2011 after repeated reminders to the agent & mails/ph calls to the regional office at Laxmi Nagar. There had been no response to my mails marked to the Regional Heads of Oriental Insurance Ltd & the TPA's. I'm attaching the mails marked to them to portray the clear picture. The claim settled & response to the difference not paid is not to my satisfaction. They are not able to explain the delay & the difference in the amt of claim. I'm higly disappointed with the attitude of the company & the TPA's & would like to claim the interest on the account of late payment.

THE LETTER MAILED TO REGIONAL HEADS IS AS FOLLOWS :

                      Regional Head Oriental Insurance Ltd./
                      Regional Head Medsave/
Regional Head E-Meditek Services Pvt Ltd

                      Dear Sir,

With great dissatisfaction & after waiting for a long time to get a reply & claim payment, i am forced to write a mail to you. I had submitted a claim in the month of September 2010 on the name of my husband Manish Sahni against claim no. 4101127B001R21. I got a reimbursement of Rs 223096 through a cheque in first week of January 2011 made on HDFC A/c while i'd given the A/c no of Bank of Baroda. The covering letter stated that the department had not received bills worth Rs 149862. I mailed the concern of the claim being settled for less amount(RS 7000) as i'd submitted all the bills. I submitted the cheque back for correction on 9th Jan'11 & mailed this concern to Ms Geeta & Dr Adish on 12th Jan'11. Dr Adish mailed back a reply stating he's forwarded the mail to Ms Geeta who'll revert back.
I've pasted the mail sent by me on 12th Jan at the end of this mail for your reference.
Till date i've received no reply from anybody in regards to either the payment or the missing bills.
During this period my husband passed away on 15th March'11. So when i enquired in first week of April about the corrected cheque i was told by my agent that now the cheque will me made on the nominee's name i.e my name. For the same he took an application & my husband's death certificate on 5th April & said that he'll get the cheque in a day or two. On 9th April he tells me he needs an Affidavit stating that i'm Manish Sahni's wife & the only legal heir. He got the same signed from me on 12th April & said that the cheque is already made on your name which i'll be collecting tomorrow. Then on 13th he said cheque is made everything is done but the audit is going on so cheque cannot be issued, it'll be issued on 15th as 14th is a holiday. Now today on 15th at 5:22 pm he called me up & said i'm waiting for the RM since morning as he's to sign the cheque, he's not come so you'll get it on monday.
Then he made me speak to a genleman at Laxmi Nagar Office.
When i spoke to the Deputy Manager, Mr Ramkishan at Laxmi Nagar Office he said that "cheque correction mein time lagta hai, pehle use bank jaake stop karana parta hai phir naya banata hai, itna time toh lag hi jaata hai aur aapka cheque monday ko Balram le jaayen"
He very arrogantly & rudely said that you can go to the court to claim the interest on your reimbursement not maid on time.
I want to ask Oct,Nov,Dec -3 months for a cheque to be made against a claim. Then 9th Jan to 15th March i.e 64days for a correction cheque & still the work not done?????
I'm very disappointed with the way department is working.
I'm waiting for a satisfactory response in settlement of the claim at the earliest else i'll be forced to go to the ombudsman.

                      Dear Geeta,

Two things to be worked upon -

                      1. verification of bills actually submitted

                      2. correct bank details to be updated

Pl revert as soon as the issue is resolved and also communicate to the insured accordingly.

                      Regards.

Oriental Insurance Co. Ltd. — regarding settlement of cattle claims

                          Respected sir , Date 27.11.2011
With due respect iam hereby complaining u about an insaurance company regarding cattle claims. The ORIENTAL INSAURANCE CO. LTD provides insaurance to cattle owners (Rashtriya Pashudhan Bema Yogna,[protected] who get insured in their schemes n pay their premiums. This scheme is governed in collaboration with UPLDB (UP GOVT). However it is now found that after getting their premiums they r not taking interests in settling the claim matters. As a result a lot of poor cattle owners r on road.
In Ghaziabad, at veterinary hospital block bhojpur , these peoples have collected premiums for 28 cattles , insured them for 1yr time period but now in this time period issues r there which they r not settling. These peoples r creating a lot of trouble for the owners ( especially tag no.39901 and tag no. 39918) n now r not responding to them. They r not even responding to the govt. officials involved.
Therefore sir I request u on behalf of those poor owners that u please look into the matter as soon as possible otherwise these people cheat the poor cattle owners every year.
                          Thanks,
                          Yours truly,

                              Dear All,

I Have taken a Third party two wheeler Insurance policy as on date 18/03/2011 from Oriental insurance company Ltd Hyderabad,Tilak Road Branch. At the time of payment of premium amount cashier said policy will be posted to my residency within two business days. But till today i have not received the policy. And when i have contacted on the number provided at Tilak road branch they are saying that your policy has been dispatched and it might be a mischief of courier services. The person was stating that many times courier services do not visit the address and just leave a note that no one was there at home to receive the courier. It has been a ridiculous experience for me from last few weeks. I have visited the the Tilak road branch where official lunch timings are 1:30pm-2:00pm but the officials chit chat till 2:30pm to 2:45pm if a customers has any queries they say concern person is on his lunch break.Hence i request Consumer Forum to look into the issue asap and help the customers to get better services from the concern organisation.I would really be thankful to you, if i get a feed back from your team for the above issue.

                              Thanks & Regards

I purchased a new cell phone of Samsung make and monte model on feb 7th 2011, under HDFC - 6 EMI Scheme, it was my dream to purchase such a touch screen phone, unfortunately I lost the new cell phone on 14th of Feb 2011, the cell was just one week old and I have not even browsed through the features. The phone was purchased in jayanagar univercell shop, the sales executive told me to immediately send claims to insurance company, per his advice I followed all the terms and send the orginal documents to insurance company ( Alegion Insurance Broking Limited), I have not got the insurance claims till date.

when i call the customer care they gave me a reference number and told me it will take 45 days minimum to process and maximum was unknown.

every month now i am paying the EMI to HDFC bank even when i dont have the cell phone using. can the consumer court please help please help.

                                  Dear Sir/Mam,

my car (DL 8CT 6264 in the name of Maya Enterprises , policy number - 271400/31/2011/2821 , claim number - 31/2011/036469) was insured from the above mentioned company which was purchased on 30/11/2010 - hyundai I10 CNG(fully insured) .Cng Kit was purchased on the same date from the hyundai dealer only under a proper invoice, insurance & all the other relevant documents.

It is known fact that the transport authority takes a few months to issue the RC of the car and only after the issue of RC in can get the CNG enrolled on it .

In january 2011(first week) my car met with an accident , . Till that time the petrol RC was not issued to me. The car was surveyed and repaired(i had to pay the whole amount). The surveyer agreed for clearing damages of around 11000 Rs .

Till march no claim amount was given to me . When i called the staff repeatedly the staff sent me a cheque(directly - without informing) in which 25% of the claim amount was deducted adhoc without any reason . When i asked them they said that CNG fitment was illegal and according to indian laws we are to cut 25%.

Noe when i ask them that under which law they have deducted my payment they are unable to explain and all i think is that they want bribe. Further i have sent them the CNG Invoice they are neither replying to me niether giving my 25 % balance amount.

Sir i would like you to interrupt in the matter and provide justice to me .

In Indian only the people who have a lot of money/power are looked upon and the whole country runs on bribe. I get deeply hurt when i see this. I bought a Samsung mobile on19/08/10 of cost 10,000 rupee with the insurance of 500 for pick pocketing/theft. Unfortunately, on 24/03/11 mobile is picked by pick pocketer. The referred insurance company want a FIR for THEFT under Section IPC 379f or cognizable offence to make the claim. Police said they never make such FIR for a mobile pick pocketing. I am totally helpless with this regard....
