[Resolved]  Unitech — Delay in construction

Dear Sir,

I booked an apartment in Unitech Verve, Greater Noida in Dec 05, with possession promised in Dec 08. The project is still not ready with management now estimating June 2010 as the possession date. Unitech is taking its customers for granted without realising that people have invested their hard earned money in this project. This is simply ridiculous and strict action must be taken against the company.

Unitech management is down playing the entire situation by saying that they will compensate the customer with INR 5/ sq.ft as damages, which works out to a penal interest of just 2% p.a. on the property cost of INR 3000/sq.ft. Whereas, if the customer defaults on payment, the penal interest is a staggering 18%. Is not the difference staggering !!

I request the concerned authorities to please look into the matter.

Dear Sir, I represent Legalistic Solutions Private Limited, a legal consultancy firm in Noida; that represents numerous clients in such matters of subvention scheme fraud. We are currently handling several subvention fraud cases against the developer, where the buyers were not granted possession on time. Many of our clients had planned their expenses in accordance with the promises of property possession made by the developer. Due to the delay in completion of the project those clients are now forced to bear additional expenses as they are paying EMIs along with rent expenses for their current residences. We are about to initiate negotiations with the developer and are contemplating our options. We have come up with the following alternatives- 1) Complete refund of the entire amount paid to the developer, from the bank as well as initial down payment made by the buyer, along with interest. 2) Allotment of property of similar value to the clients (assuming possession is immediately available). As of now we have close to a dozen clients who have been duped by the subvention fraud and we would like to invite more complainants to join us in our effort to get compensation for our losses. The more complainants we have, the more pressure we can build upon the developer. Only by uniting can we force the large corporation to sit at the negotiating table. Unitech is a White collar fraud.
I, and millions of others, have had the same experience as you. Just search the internet for all the scams Unitech is involved in all over the country. You'll be horrified!
I haven't had a single, positive interaction with any Unitech employee. All of them are masters at the art and craft of deceit. They stiffly deny any wrong-doing, refuse to listen to you, start accusing you instead and threatening to cancel your allotment, and continue billing you exhorbitant sums of money that are totally unjustified.
Whenever Unitech is caught in an illegal tangle, they blame the recession. When they want investments in their group of companies, then they boast about how well they are doing. They divert funds, they indulge in fraudulent practices. They have tremendous political clout (so if they 'have no money' how do they keep their godfathers happy?) which is probably why they get away with everything possible under the sun.
They're nothing but a bunch of scamsters!
Aggrieved Unitech buyers have formed groups (project-wise) in groups.google.com, commonfloor.com and other buyers' forums. I personally think an umbrella organization englobing ALL aggrieved Unitech buyers should be formed. We should file a PIL and ask for cancellation of their licence to build or have anything to do with the construction industry. There's strength in numbers. Join up. Perhaps one day justice will prevail.

Hey guys a piece of good news I happen to visit Unitech office and happy with the response I got... the reason for Capella's delay was recession and then the breakdown of their system, due to which they lost very crucial data and had to setup the whole system again and stuffs. Don't worry guys they are not fooling us, but they themselves are stuck with a lot of issues. I am sure our issues will be dealt with soon and as committed. Keep up the hope. And yes not to forget if there are many dissatisfied customers at the same time they have satisfied ones too. So don't worry.
The reason could be that if a consumer defaults his payments the whole project will be affected thus making other flat owners also suffer that's the reason to discourage defaults the penalty is high as far as compensating the consumer is concerned I think whatever you would be getting will be cream only I understand your apprehensions about the project, but imagine we also many times miss the deadline we commit in our professional life how we expect the other person to be considerate in such a situation. Unitech executes project at a large scale and such projects are very dynamic due to uncertainty. So have Patience.
Hi, basically the costing for these projects are done on estimates and are very vulnerable to change since market prices for resources fluctuates. We ourselves know how fast things change right. I think If you ask Unitech the reason for this change I am sure they will answer you. It would be really difficult for them to sustain their operations if the prices will increase. I would suggest we should look on both sides of the coin.

Unitech is very good in making showhom, but when it comes to the real execution of project, they totally lack the imgaination and common sense. They are also very insensitive towards the consumers request and sentiments. They charges premium for their flats, but they do not deserve it. Unitech took money from real estate investors and home owners, and they invested this money in their other projects and were very high risk and no benefit to the flat owners. In past two years, all unitech stakeholders have to pay a price for reckless management policy of some individuals o[censored]nitech who think themself to be smart, but are stupid, as they lost all their goodwill and trust
I[censored]nitech lacked in the imagination and common sense while executing their projects, can you explain how they are the second largest real estate developers in India? As far as your allegation about investing money taken from real estate investors and home owners in other projects, I am sure that Unitech does not participate in any such malpractices. After all they have a really good market image to preserve. Speaking about the good will and trust people have in Unitech and their projects, you can easily see the excellent response their new projects are receiving. You should think twice before writing about some good organization.
As the project can get hampered if the money does not keep flowing in at the time of development, the developers try and avoid such a situations by implying a heavy fine in the case of default. Delays are the inseparable part of real estate development now a days and every developer is facing the same problems. I would advice you to be patient and cooperate the company to get your home as soon as possible.

In a big real estate project, the actual work is sub-contracted to other small contractors. As these construction activities are interlinked and very sensitive to small changes, it makes even the small delays to reflect in a far greater end results. As far as Unitech is concerned, your money is in safe hands. It is a very reputed company.
