My Mediclaim policy No.112800/34/09/11/00002722 taken from New India Assurance Co. for the period 27.7.2009 to 26.7.2010 expired on 27.7.2010.
New India Assurance Co. did not send me the reminder to get the policy renewed.
I was ill & on bed rest for the period 15.7.2010 to 28.7.2010 due to dieses o[censored]rine infection. Hence I forgot to renew the policy on my own without reminder of New India Assurance Co.
As per advise of my agent on 8.8.2010, I submitted request application with all medical reports as a proof of my illness to Division Office of New India Assurance Co. at Fort ,Mumbai on 9.8.2010 i.e. on 14th day after renewal date through my agent Mr. Dalvi.
IRDA’s circular No.52/15/IRDA/Health/SN/08-09 dt.31.3.2009 clearly saya that 15 days delay should be condoned in renewal of policies from renewal date. Division officer Mr. Bhat did not acknowledge my application on 9.8.2010 i.e.14th day from renewal. These responsible officers must have knowledge of IRDA’s circular. I think they do not have. Otherwise they would have acknowledged my application & renewed my policy.
Even though I did not get upset because my agent told me that Regional Officer has given him a form called ‘ Mediclaim –Break In Insurance –Approval Format.’ To get it approved from Divisional Officer. He also said that the delay in renewal can de accepted for thirty days. In this form it is clearly printed that Regional Officer’s limit is 30 days. Mr. Sopan Pawar , the Development Officer made remark on this form that the break in period is 20 days & Party forgot to renew the policy due to illness. The Divisional Officer should have sent this form to Regional Officer with his remarks. But he did not do that.
The Division officers have ignored IRDA’s circular as well as Regional officer’s authority.
When asked by Mumbai Grahak Panchayat’s officers Mr.Avadhane, Mr.Bhat put blame on agent & development officer for not reminding the renewal date to insurer. He told that Company is giving them lot of commission & giving them the list of policies to be renewed . He also told that you can lodge the complaint against them.
I am lower middle class person. My wife & myself are 50 plus in age. We will not get now fresh mediclaim policy from anybody due to Medical Rules. Our joined policy was for 1,00,000 each . We have got Rs.15,000/- as bonus for not claiming the expenses for three years. Hence my loss will be Rs.2,30,000/-,which is very very high. Our future in old age will be miserable if we get diesess.
I have explained you all the truth . Kindly give me justice. I hope you will do that.
If justice is not given in my favor by New India Assurance Co. then I will go in front of Consumer’s Court & lodge the complaint against New India Assurance Co. as well as against the Agent & Development Officer. I will fight up to the end ,result what may come.

Just realize if a person beyond 60 yrs old he/she does not have any of these diseases as mentioned then why should they go for investment in Mediclaim/any health policy..? This is really rediculous things happen in our country.

The New India Assurance — Mediclaims yet to refund since 4 years

Self , Ranjan Kumar Mishra had gone a surgery at Jaslok Hospital on 15/04/2006 and submitted the relevant medical documents for the mediclaim well valid but to my surprise the New India Assurance has yet to refund though the time lapsed nearly 4 years. My mediclaim policy no is 110900/34/06/20/00007897.
The worst thing is that I have sent many letters but the company is neither replying or nor giving me time to meet their manager.

in absence of accountability, it is difficult to pursue the concerned person to do his job.
          2. incomplete details -total sum insured
          3. number of conrinuous years of policy
MD India has a poor claim settlement practices. I will suggest the following:
          1. Ask for a formal document from them stating that the insurance company is delaying the payment. If you get it its excellent, even if not then no worries follow the next step.
          2. Visit http://www.irdaindia.org/ its IRDA's website who is the insurance regulator in India. There is a grievance cell where you will find a form for "general insurance", fill out all the details and send it to IRDA. Call them and ask for help. I am myself working in insurance sector and can assure you IRDA will help you, they are very nice people. Its free of cost.

Now this goods were to be transported at Yavatmal as per LR no 2129 dated 13.05.2008. It is pertinent to note that this goods were transported in the insured vehicle Tanker no GJ06 Z 8619.

                    4. That the accident took place on National Highway no 6, near Sujit Hotel, Navapura, Nandarbar between the Tanker no GJ06 Z 8619 and Truck no GJ12 Y 5502. The accident was reported to the Navapur Police Station vide FIR no 64/2008. Because of this accident the insured Tanker no GJ06 Z 8619 was heavily damaged and therefore, the damage vehicle was carried to the Cargo Motors, Ranoli by towing machine and for that complainant had paid Rs.12,000/- in cash to Gurunanak Crain Services, Ranoli, Dist-Baroda on 15.05.2008 and the opponent insurance company was informed about the said accident resulting into the damage of the insured Tanker no GJ06 Z 8619. The complainant submitted the motor claim form along with required papers such as R.C.Book of Tanker no GJ06 Z 8619, Copy of the policy, Driving license of the driver Mr. Rameshwar Malbari Sanat, estimate of the damage parts of the chassis of Tanker quantified in Rupees by Cargo Motor P. Ltd. and also estimate of damaged tank issued by Ishan Equipment Pvt. Ltd.

                    5. That the opponent insurance company had appointed surveyor who completed his job and has also assessed the loss cause to the Tanker no GJ06 Z 8619. That there were several exchange of letters between the complainant and opponent insurance company as well as personal discussion in the office of the opponent insurance company and all the time all the queries raised by the opponent insurance company were complied by the complainant. The opponent insurance company had raised the query vide their letter dated 25.07.2008 that the driver Mr.Rameshwar Malbari Sanat was not holding endorsement for Hazardous Goods in his driving license and also not taken any training for handling such hazardous material as the HCL was carried in the said Tanker no GJ06 Z 8619 which is considered as a Hazardous and Toxic Chemical. Further the opponent insurance company had also requested to obtain the confirmation from the RTO that whether the material carried in the Tanker no GJ06 Z 8619 was hazardous or non hazardous. In turn the complainant replied their query vide letter dated 31.07.2008 and explained them that the material which was being carried in a Tanker no GJ06 Z 8619 is a HCL 16% diluted by product and the rate is Rs.1 per M ton. Further as per the purchase order of Raymond Uco Pvt. Ltd. where the material was to be dispatched/transported, they have stated that the material is a diluted by product which is used for washing cloths and also the authenticate proof of material was submitted as per the Shreeji Analaytical Lab who has certified that the material carried in the Tanker no GJ06 Z 8619 was non hazardous and non flammable and non toxic. The complainant requested the RTO Vadodara to issue the certificate regarding the goods to be hazardous or non hazardous goods and also submitted the letter issued by the insurance company and chemical analysis report of Shreeji Analytical Lab. The RTO Vadodara has made the endorsement upon the said letter that they cannot issue the certificate as demanded by you.

                    6. The complainant had produced a report of Shreeji Analytical Lab dated 05.07.2008. This certificate was issued to Bromofine Chem Pvt. Ltd, Nandesari, Baroda who had given the sample of Dilute Hydrochloric Acid on 04.07.2008. This certificate also suggest that it is only 16% concentrated. Therefore this material is non toxic and non hazardous and non flammable and this material is used for domestic purpose (cleaning).

                    7. The complainant requested the officers of the opponent insurance company vide their several letters to settle her legitimate claim supported by documentary evidence. However the opponent insurance company vide their letter dated 26.09.2008 repudiated the liability under the guise of “That the vehicle at the time of accident was carrying HCL. As per M.V. Act HCL 30% comes under hazardous category material for which endorsement for hazardous material is required on motor driving license. The driver of the vehicle at the material time of accident Mr. Rameshwar Sanat was holding MDL no MH[protected] which was not endorsed for carriage of hazardous goods nor has the driver under gone the required training for this purpose. As such the driver at the material time of accident was not holding a valid and effective driving license and the vehicle was therefore being driven in contravention of M.V. Act and the breach of policy conditions.”

                    8. It is most humbly submits that the opponent insurance company has repudiated the liability under the policy and the complainant is deprived of her legitimate claim. The complainant states and submits that the material carried in the Tanker no GJ06 Z 8619 was a non hazardous, non toxic, non flammable goods. Therefore, the endorsement in the driving license of the driver driving the Tanker no GJ 06 Z 8619 was never required. Further a delivery challan and Tax invoice issued by Bromofine Chem P. Ltd. to the Viraj Corporation dated 12.05.2008 proves on the record that the material is HCL Dilute by product which is15000 kgs and it is dispatched through Tanker no GJ06 Z 8619. Further as per the certificate dated 22.06.2008 issued by Bromofine Chem P. Ltd to Viraj Corporation also proves that the material was dilute hydrochloric acid is of by product. The same is in diluted form with very mild concentration and normally used for cleaning purpose. Even as per the Shreeji Analytical Lab Report the material is non hazardous, non toxic, non flammable goods and used for domestic purpose cleaning and by handling this material there is no irritation and burning on hands and in eyes. Further it is most humbly submitted that GACL is dealing in the business of production and selling of hazardous chemicals. Particularly in the case of Hydrochloric Acid 30% concentrated, instructions for transportation of Hazardous chemicals are given by the company itself. Therefore, whenever the HCL which carries 30% concentrated then it becomes hazardous goods. In the present case as per the Shreeji Analytical Lab the material carried in the Tanker no GJ06 Z 8619 at the time of accident was 16% which is in diluted form by product HCL and therefore it is not a hazardous goods.

                    9. The complainant’s Tanker no GJ06 Z 8619 after accident was never a road worthy and it was totally damaged and it cannot be used and therefore it was total loss to the complainant, which the opponent insurance company were supposed to indemnify. However the opponent insurance company has repudiated the liability under the policy. Therefore, the entire damaged chassis of the tanker along with the damaged tank of insured vehicle no GJ6 Z 8619 was sold to Shivam Traders of Ranoli on 16.10.2008 for Rs.4,30,000/- and the said amount has been received by the complainant. The value of the insured vehicle no GJ06 Z 8619 as per the policy was Rs.8,78,316/- and the present complainant has received an amount of Rs.4,30,000/- by way of salvage value of the said tanker. Therefore the complainant is entitle for Rs.8,78,316 – Rs.4,30,000 = Rs.4,48,316/- from the opponent insurance company. Further the damaged insured vehicle was kept in the godown of the Cargo Motors Pvt. Ltd. and the complainant had to pay holding charges (Demurrage Charges) of Rs.10,000/-. The details of amount claimed is as under

                    (a) Under the head of total loss Rs.4,48,316/-
                    (b) Under the head of towing charges Rs. 12,000/-
                    (c) Under the head of Demurrage Charges Rs. 10,000/-
                    (d) Under the head of Mental agony Rs. 30,000/-
                    Total Rs.5,00,316/-

                    10. The opponent insurance company has repudiated the liability in spite of all these legal and valid grounds were submitted by way of documentary evidence and thereby has shown the deficiency in the services by not settling the legitimate claim of the complainant.

                    11. That the contract of insurance was concluded within the jurisdiction of this Hon’ble Forum and the opponent’s office is also situated within the jurisdiction of this Hon’ble Forum. Further the complainant is the consumer within the definition of Consumer Protection Act. Hence the Hon’ble Forum has the jurisdiction to entertain and hear the present complaint.

                    12. That the applicant reserves his right to add, amend or alter the complaint or any part thereof as and when required.

                    13. That more will be submitted at the time as when need.

                    PRAYER :

                    IT IS THEREFORE PRAYED THAT

                    A) Allow this complaint and order the opponent to reimburse the amounts of Rs.5,00,316/- to the complainant under the policy along with interest and cost.

                    B) Any other relief, which this Hon’ble Forum deems fit in the interest of justice.

Hello Mediaassist / New India Assurance Team,

My name is Bhanwarlal Jain P(MAID : [protected]) from Coimbatore, TN. I am holding medical insurance of 2 Lakhs with New India Assurance Company. My policy no : 721600/34/09/11/00000374.

My wife Leeladevi (Claim no : 4706755) had undergone surgery at Ganga Hospital. The total expenses at the hospital was 51956/-. But the Mediaassit team had admissed only 39247/-. Below is the reason they have mentioned regarding the nonadmissible amount.

                        1) For Investigation & Lab charges
Reason by MAID Team : X-ray film rs.1045/- Lab charges for reports not enclosed.
We need X-rays and Lab reports with us for future reference. We can submit to you for verification on condition if you send back to us.

                        2) Surgery Charges : Non admissible amount 6200/-
Reason by MAID TEAM : Excess of Reasonable.
We want to know on what basis you are saying it is not reasonable ? Why according to you for dressing 600/- is not reasonable?

We have truly paid the amount and you can verify the same with hospital. Ganga Hospital is one of the best Ortho hospital and such remarks on hospital, cant be agreed. I want to know are the New India Assurance and MAID Team purposely does not process the claims. Hereby i request you to admiss amount for above reason within seven working days or else i would be forced to take legal action against Mediaassit and New India Assurance.

I request the Life council Team, IRDA Team, Dr SR and Dr.SRS to look into this matter.

                        Thanks & Regards

                            Dear Sir/Madam,
Gretings! My name is Sanjay Kumar K (CHE-NI-GH[protected]A)and I have taken New India Assurance's Citibank credit card Good Health Policy for the last 5 years. My Mother, S Vimala (CHE-NI-GH[protected]B) was operated for Umblical Hernia on 14/12/2009 and discharged on 18/12/2009 at MIOT Hospitals, Chennai. The total cost of operation came to Rs 54,000/-(Rupees Fifty Four Thousand Only approximately). At the time of admission i was assured that a payment of Rs 44,000 has been sanctioned. However at the time of discharge a sum of Rs 23,000/- (Rupees Twenty Three Thousand Only) was sanctioned. In the meanwhile i was contacting the insurance company who are saying that as per policy document only 20% of sum assured ie., Rs.2,15,000/-(Rupees Two Lakh fifteen thousand only) will only be sanctioned. I was never explained satisfactorily that why an initial amount of Rs 44,000/-(Rupees Forty Four Thousand Only) was sanctioned.
                            Please clarify me on this.

All the original Bills of Hospitals along with discharge cerfiticates were submitted to Raksha TPS in the month of Dec 2009. After 15 days I got letter form TPS asking for Indoor case papers, I requested the hospital for indoor case papers and these papers were submitted to TPA.

Now on 18th Feb, 2010 I got letter from TPA stating that documents submitted by me (Original Bill of Hospital and Indoor case papers) are not sufficient to process the claim. They want letter from Doctor stating the exact duration and probale mode of transmission of Hepatitis E.

I really think that the documents submitted by me are sufficient enough for processing the claim, but as such company dont want to admit they are just delaying the claim.

In my case the amount is not very big, but the attitute of TPA seems to be very casual and unprofessional.

I appeal The New India Assurance Co. Ltd to please look in to the matter or as a educted consumer I will raise this issue under appropriate law and with appeal to appropriate authority for the justice.

                                    Respected Sir/Madam,

I had send my medical bill amounting Rs. 14148 to RAKSHA TPA on Sept'2009 and till date i have not got the claim amount and when i had spoken to them they denied to do my reimbursement stating late submission of bill, where i had submitted my bill on time and they are trying to play smart and have closed my claim status without informing me about it.
