i booked a flat in Omaxe Grandwoods ,noida in 2007 nov,the builder signed letter of agreement on 2009 march ALPINE TOWER 601 , till then i had paid 12 lacs ,the flat was to be completed in 2 years and it was delayed ,I have paid about 47 lacs and have to pay 3 lacs more but company is demanding additional 2 lacs for parking and 3 lacs for late charges ,all their records show date of 2009
i have requested company personally by going there and sent many mails that i should be given interest on my 12 lac rs which was paid in 2007 which is no where in records because for 2 years my money was used by the company but neither interest nor that date is being considered .The company is not replying to any of my mails nor do they reply when we go to their office,All my payments have been through cheque .since last 7 months all my mails are unanswered and their tactic is to delay answering and then create dispute for delay in payment

    Hello please tell me the allotment date of Omaxe Residency Phase 2,I have come to know that the price of the project is going to increase drastically upto even Rs 2600 psf or more for 3BHK flats of 1575/1775 sqft by March 2012 due to heavy demand as the project is at a very prime place in Lucknow.Premium on the project is already up by Rs 300 persqft.Are they delaying the allotment and later charge us? I hope since I have already booked it at 1800 psf I do not have to pay a premium of more than Rs700 when it increases to Rs2600 by March before allotment.Please reply anyone who is clear on the issue.

      I have booked a 2 BHK flat in OMAXE Ltd's "HAPPY HOMES PaLWAL " prject in August,2010. and the time of booking it was promised that
      possession given in the end of 2011.But till date they have not started even excavation for the unit alloted to me.

      Sincle last 8 months i am taking follow up with OMAXW team but every time i got same statement that work will be statted in the next month.

        THERE IS NO REPLY FROM OMAXE LTD. AND THEY ARE SILENT ON THIS ABNORMAL DELAY AND THEY ARE SITTING ON THE BOOKING AMOUNT/S . ALLOTMENT DATE IS STILL NOT CLEAR / KNOWN ....................DETAILS ON FACE BOOK ATTACHED HEREWITH...............The bookings for Omaxe Residency were already completed by April / May 2011 and after 4-5 months, no allotments have been made. Why the delay ? We were given to understand that the allotments would be done within 45 days . Is there some problem ? Please tell us the exact date when the allotments will be done and also please explain why the allotments have been delayed, beyond the committed date .

        Shravan ji..why are you so worried about the allotment...you will get it soon. there is some lag always in booking and allotment. there is a huge premium on that project now and i am made to believe from locals there that its is as high as 20-30% and it will only increase going forward. i have also checked out the construction update on website and on ground. they are going fast and its a matter of time when they hand it over..
        so chill and relax...
        Agreed, there is a time lag between Booking & allotment but it should be reasonable. It seems that there is actually something wrong. Omaxe is not even showing the project Residency II on its website. Neither one can get a idea of the size of the project in terms of Acres, Number of apartments. The silence from Omaxe's side on the status of the project is disturbing. Agreed they are taking up Phase I speedily.

        Someone from Omaxe should comment on the status of the project to ease the discomfort of investors.
        Agreed with above feedbacks. I also want know about the actual cause of delay of the allotment of Omaxe residency phase 2.At least Omaxe should display all the details of this project on the official wsite judt like Residency phae 1.

        Omaxe Ltd — Fraud

        We have not got any registry letter from them before 20 nov 2012. But suddenly they have sent a letter that you have been penalised 28000rs for not doing the registry of your villa and after two three days they increased the penalised amount to 32000rs. This is totally a case of fraud. Please look into this matter.

          BACKGROUND OF THE CASE

          I had booked an apartment with OMAXE Ltd at 'North Avenue' Bahadurgarh (under construction since 2007) on 08 Jun 2009 for Rs 22,85,225/- including Rs 1,50,000 for covered parking. the Flat was booked under construction linked payment plan. I had paid 15%(3,45,225/-) of the construction cost at the time of booking and applied for loan with AGIF for the balance 85%(19,40,000/-). I paid 51%(11,63,887/-) in Sep 2009, 10%(2,40,000/-) in Dec 2009 & 11%(2,49,200/-) in Aug 2010. Thereafter , I did not receive any demand letters from the company till 17 Oct 2011, when I was asked to pay an installment of Rs 1,13,087/- along with a delay interest of Rs 5,48,000/-. On enquiry with the Omaxe Ltd, I was informed that interest was calculated wrongly with effect from 2007 while my booking date was from 2009 and the interest was Rs 86,000/-.

          At the time of booking contact persons at the site informed me that the flats will be ready for possession in Dec 2009 that is just 06 months from booking date and accordingly I planned my loan installments in Sep 2009(12,00,000/-), Dec 2009(2,40,000/-) & last installment in Mar 2010 (5,00,000/-) expecting a delay of 03 months. When I asked about the progress in Dec 2009, I was told that the flat will be ready by Jun 2010 and accordingly I approached AGIF to split the last installment into two parts that is Rs 2,50,000/- in Jul 2010 and balance 2,50,000/- in Sep 2010. while I paid the next installment of Rs 2,49,200/- in Aug 2010 the flat has not been offered for possession till date that is Nov 2011.

          The above delay has already caused me monetary losses of Rs 3,50,000/-in terms of Pre-EMI interest since the EMIs will start only after the disbursement of last installment and this loss is continuing at the rate of Rs 13,800/- per month in terms of Pre-EMI interest as of now.

          When I approached OMAXE Ltd at their Delhi, Kalkaji office, the customer care brought out the agreement wherein the company has agreed to offer the possession of the said flat within 30 months of the contract and another 06 months delay due any of the whole lot of reasons given in the contract.

          QUESTIONS

          1. Since the company had asked for approximately 70% amount within first 03 months of booking -meaning that 70% construction was completed, should the time period for offering possession(30 months in contract) also not reduce by 70% that is the company should have offered possession in next 09 months by may 2010?

          2. Is the delay clause as mentioned in the contract of paying Rs 5/- per sq ft per month by the company as compensation applicable here? If yes, for how many months?

          3. Govt of Haryana while licensing and permitting OMAXE Ltd to undertake construction on the said land, it has asked the company to keep the basement as parking space for the flat owners exclusively. Is OMAXE Ltd correct/authorised to sell the covered parking @ Rs 1,50,000/- & uncovered parking @ Rs 75,000/-?

          4. Can I file a suit for harassment in Consumer Court against their letter dated 13 Oct 2010 received on 17 Oct 2010 demanded an incorrect amount of Rs 5,48,000/- as interest which almost caused me an heart attack - not literally, but ruined my Diwali celebrations?

          I would suggest you to include the finacing company in litigation, since they are liable to crosscheck the construction status before releasing the payment to the builder.

          is facing similar situation and hav given OMAXE time till decmber to hand over the possission or i wil file a sure shot consumer court case.

          Also, you may want to contact the TV channels who take up these matters.

          SIR SIMILAR HARASSMENT IS ALSO HAPPEN IN A MUCH WORSE WAY. THE FLAT THOUGH BOOKED BY ME IN APRIL 2006 AND AT A HIGHER PRICE & 75% PAYMENT MADE IN 2008 . STILL WITHOUT ANY COMMITMENT FOR POSSESSION HUGE INTEREST IS BEING LEVIED AS AGAINST NO ASSURANCE FOR DELIVERY OR COMPENSATION FOR DELAY.             I Aplied for Omaxe Ltd in Bhiwadi Project, Earlier I have got 1008 in Dafodil-B Toer in 10th Floor, but later i got a letter from Omaxe to change me at 303 in Daffodil -G without my consent, then I write a letter to Omaxe to provide me option in Faridabad Project or refund me with interest but despite my repeat requests for a change in allocation or refund with interest.I got cancelation letter and forfitted my all money,
            I have a copy of the letters that I had sent to Omaxe.
            If there are more like us, Please suggest on this whether we can look to form a association and file a case similar to CCI / Consumenr court for same

              Dear Concern,

              Kindly note the below complaint :

              1. The PLC ( Park Location Charges ) is not applicable in our flat as per the agreement signed by us and OMAXE limited whereas at the time of possession the company is asking us for Rs 160,000 as the PLC charges . It is clearly mentioned in our agreement that , there is not PLC applicable in our flat .
              2. The project has been delayed by the company for so long , I have paid the full payment at the time of launch of the project. As a proof for the same , I have the payment receipts for the same. Now , as per the agreement, the company has to pay a sum of Rs 5 per sq ft monthly , as rental after 42 months of the booking date till the possession date. Now they are not paying us the penalty for such delay also.
              3. The company is still not clear about the actual shifting date for the above flat . I am paying the insatlments every month and also the rent for my current house , but the company is not at all concerned about such issues.


              Kindly help .

                Dear Sir / Madam

                I own an under construction flat with Omaxe in their project Omaxe Heights Sector 86 Faridabad, Haryana.

                Flat Details: Flat Number 502, Tower Petronas,Omaxe Heights Sector 86 Faridabad, Haryana.
                Area: 1165 Original; revised 1203 sqft.

                The buyer agreement was signed on 31st January 2007, and Omaxe should have delivered the flat by their own maximum commitment of 2.5 years and 6 months grace period, that makes 3 years, i.e. latest by 31st January 2010.

                It has already been more than 18 months over the due date, and still there is no sign or intimation from Omaxe on delivery date, etc.

                I have already paid 95% of the flat cost and other charges amounting to INR 20,67,350

                Omaxe has sent an increased EDC (External Development Charges) letter for INR 140 per square feet, amounting to an extra of INR 1,74,120.

                I have already paid INR 1,74,750 @ 150 per sq feet EDC charges at the time of agreement.

                I understand that I am/was liable to pay any revised or increased charges till 31st January 2010, the handover date. If any charges are increased or changed then Omaxe is liable to pay on behalf of the customer to the Government because the project has been delayed by the builder himself.

                I have approached and discussed the same with their Customer Service head, Name : Ms. Apoorva (Mobile #: [protected]), who says that she is aware that this is wrong but is unable to help me or the customers. She says that Omaxe would pay customers a late fee of INR 6 per sq feet per month due to delay in possession which amounts to INR 1,29,924 for 18 months (which does not even cover the increased EDC)

                Omaxe has sent a letter to pay the new and increased EDC charges by 15th August 2011, else 24% interest charges would be applicable.


                I would like to plead to you against the below mentioned malpractices of Omaxe and injustice towards its buyers:

                1. Asking customers to pay increased EDC, while Omaxe should pay the same on behalf of customers as they have delayed the project. Also, I believe they are passing their late fee interest to be paid to the Govt onto customers.

                2. Omaxe has developed a podium in the area as per their wish without customers' approval or knowledge and are charging the customers for the same.

                3. They have increased flat area (earlier 1165 sq feet, now 1203 sq feet) without informing me, and want me to pay for revised charges and calculations.

                4. Omaxe would charge 24% late fees from customers, I beleive they should pay me INR 4,96,164 (24% interest for 18 months calculated on already paid INR 20,67,350 due to non delivery of flat within due date)

                5. Omaxe should also pay approx INR 15,000 per month as rent to customers that would otherwise had been earned by customer either by renting the flat or staying themselves, amounting to INR 2,70,000. I am paying INR 20,000 per month for staying in a rented flat that would have been saved if I would have been staying in my own flat in Omaxe.

                6. Omaxe has sold me one open parking for INR 75,000 for one car, which is agianst the law. I want the same money to be returned back to me.


                Summing up the above points:

                Omaxe should pay current and future EDC and any other revised or increased charges on behalf of the customer to the Govt due to their own delay in the project.
                Omaxe should pay me INR 9,71,088 (INR 2,70,00 as rent, INR 4,96,164 as interest, INR 1,29,924 as INR 6 psf late fees and INR 75,00o return of open parking space sold)
                Omaxe should not charge its podium or any other new development charges that were not approved or informed to the customer.

                  Myself Md. Zeyauddin had purchased a flat in Omaxe Grandwood (Flat No 705,Seventh floor Alpine-C at situated at Sector -93 B of Noida(U.P.)).
                  I have received the offer for possession of the above said flat vide letter OBPL/N93B/1077 dated 18th June 2011 from Omaxe.
                  I would like to draw your attention towards an anomaly between the value of the flat as per the Statement of Account attached with the letter offering possession of flat vide letter OBPL/N93B/1077 dated 18th June 2011 and the Allotment letter of the flat which issued in May 2010/Intimation of due installments letter dated 15th Feb 2011/endorsement letter addressed to HDFC Ltd Dated 20th April 2011 allowing HDFC to mortgage the property.
                  As per the Statement of Account attached with your letter OBPL/N93B/1077,total value of the flat has been stated as Rs. 4767240/- whereas as per the Allotment letter/Intimation of due installments letter dated 15th Feb 2011/endorsement letter addressed to HDFC Ltd Dated 20th April 2011,the value of the flat is Rs.4629050/-
                  Assuming that it is just a typographical mistake, I e-mailed Omaxe to correct this anomaly. Though I am yet to receive a written reply from them, verbally they have informed that they are loading an additional amount of Rs. 1.11 Lakhs because my flat is a park facing location. I would like to draw your attention that as per Allotment letter of the flat issued in May 2010, my flat is not a park facing location and hence they had not charged anything under that head during the time of allotment. T he same thing can be endorsed through latest statements as recent as April 2011 issued by Omaxe during resale process of the flat wherein Omaxe has maintained the price of the flat at Rs.4629050/. Now all of a sudden they have realized that flat No 705 is park facing location and liable to pay preferential location charges.
                  This is unwarranted and against the sanctity of a contract and a huge and unplanned burden on me.
                  Through you I would request Omaxe to stop harassing through such unlawful means.

                    I have booked a 2 BHK (1185 Sq. Ft.) flat in OMAXE Parkwoods, Baddi in November 2006. But till date I have not received possession of the flat. I have made total payment (Approx. 86 % of total cost) of Rs 17,21,000/- Out of which 7 Lakhs were paid by self and 10.26 Lakhs by HDFC.

                    As per the Builder – Buyer agreement, Builder will pay penalty @ Rupees 5 /- per square feet, if the Project is delayed by more than 18 months. But I don't know when they will handover the possession of flat to me.

                    More than Four and half years have been passed, I am afraid that Project may not take off. Whenever I contact staff of OMAXE, they rarely bother to respond neither of my mail, nor my phone calls.

                    I am paying EMI of Rs 14,720/- per month on the disbursed loan amount.

                    I request you to guide me to get rid of this situation.

                      I have booked a flat in Imaxe Height, Bhiwadi in 2006 and paid Rs.382950/- (Rs.250000 on booking in 31.05.2006 & Rs.132950 (on allotment of flat no.) on 21.06.2008).
                      Even after allotement of flat number omaxe has not started this project and now they are not returning the amount also and saying to transfer in another project.
                      The company like Omaxe is seems to have big name only but the behaviour / response is totally un-professional.

                        Hi,

                        I have bought a Villa from Omaxe in Bhiwadi II in June 10. They advise that I will be receiving my agreement within 45 days. After many follow ups, I finally got my agreement letter in Dec 10.

                        Till now, there is no further information on the project. I have learnt from the nearby property dealers that they have still not got the 90 B letter (converting agricultural land to residential land) and that the reason they are not asking for second instalment till now.

                        As they do not have that letter, there is no bank who are offering loan for that property.

                        I would urge all the people who have bought property in Omaxe Bhiwadi II to come together and lets put some pressure on them to get the project going.

                          I had booked the flat at Omaxe Ltd., Rudrapur, Uttaranchal on 27.12.07. It carried penalty clause for non possession of the flat, if not delivered in one year of time from the date of booking.

                          After a year of booking I moved up the flat size form existing 1224 sqm to 1440 sqm with the concert of the bulider changing no conditions. Neither change in any of the conditions been communicated by bulder.

                          In spite of repeated request and number of personal visits to the site, its been observed that Bulider has not progressed much in the construction and even after 3.5 yrs, flat is stil under construction.

                          I need to understand the date of possession and if it is delayed any further, I am not interested and need my money back in total along with the interest.

                            HI I have purchased a flat in Sonipat in OMEXE in 2004. till this time inspite of colected all the money they have not handed over the property .. if we delay we pay 18 % intrest however if OMEXE delay they dont pay any thing .. this compmnay is heading for a scam ... pl keep away and dont invest any thing .. these big names too are into scams .. below my old email and still my property is not handed over..

                            IN 2008 THEY PROMISED AND TILL 2011 HOUSE IS NOT HANDED OVER .. PUBLIC IS WARNED FOR THE INVESTMENT S.......

                              The Builder omaxe has provided an agreement for assured return to my wife, this agreement has serious flaws in it and our case against Omaxe is ongoing people with assured return agreements from 2007 onwards in any project of Omaxe may contact me on [protected], or drop a whatsapp message if I do not receive your call, possibility of a major settlement is very possible due to this flawed and fraudulent agreement.                                 I am not geting my flat in Omaxe grandwoods as comitted by Sales Person and Customer Care people of Omaxe.
                                I had bought a Flat in Omaxe grandwoods with a possession promise of October 2010.
                                In August I got a email for possesion in Decmber 2010.
                                I have written 3 emails to customer care headMs. Neelam Singh,She does not pick up phone or responds to emails.
                                In March 2011 they are saying they will statrt giving possession in May 2011.
                                I am a middle class Indian who has bought flat on loan .I am paying rent for my existing residence and EMI for the Omaxe House.
                                Its huge burden on me and I am not able to support my family finacially.
                                I want to know when i will get my house and what will the penalty cost.

                                Cheating by Omaxe builder/sale unauthorized flat (no approval from Noida authority but they got the money for those apartments, it can happened in our country, my country is great coz corrupts persons are here)

                                Unfortunately, I have booked an apartment in your esteemed scheme Grandwoods located at Sector 93B Noida Expressway. Recently, i saw few news via online about approval for ground floor of regent b tower, please tell me about it. did you get it (approval from noida authority) or not? how you can sale unauthorized apt. I m really disappointing and frustrated, how omaxe can do this job, they r very reputed builder in market, i hv invested my money on their name. oh my god' What i should say, should be a matter of joy, happiness and pride had turned out to be a big disappointment. I am now really sorry to have made such a big investment (at least big for me as well as common man) with you.
                                .Now, I would like to know the current status of work progress of Ground floor, TOWER-Regent B, grandwood, Sector 93B, Noida. Also, I would like to know the exact date for providing possession. As I saw some information about approval PROBLEM for above mentioned floor, so kindly tell me the exact situation. Did omaxe get approval from NOIDA authority?
                                I have submitted one RTI to get the information about the approval of above mentioned floor but they are not responding me, there is no meaning for RTI. All system is corrupt in our country, where should we go?
                                I hv a flat in LINCOLN omaxe, company is offering me a possession and demanding the amount due for it.
                                flats are not ready, lift is not being installed, they are saying monthly mentaince will start from 1 april 2012.

                                @ Omaxe Grandwood Noida.. Is The Worst Society To Live inn..Only Club Facility is Good .. Rest Interms of Security of Your House, Car even car parking is not Safe.The Gym Treadmills don't have a UPS.So Get Ready to Trip if there is a Power cut while you are on it.(its been more then 6 months now). Thankfully we have Internet now after 3 months.Flat Quality compared to rest of the societies is not so great.. Think about it before shifting inn. And The Estate Manager Will Always Commit things which are never done on time.If you grumble he'll take action against you.Thanks.

                                  Dear Sir,

                                  Believing Omaxe’s repute, we chose to book a flat in “Omaxe Grand Tower” and are deemed to be part of the Omaxe Family in accordance with your Allotment Letter referred above, however, It is deeply regretted that despite writing various letters, telephone calls and personal meetings to your office/officials, we have not been updated on the Progress/No Progress of the subject Project.

                                  Please note that while booking the flat in your subject Project on November 18, 2009 vide customer code no. OGT/84 and Receipt ID 405969, we were promised the possession of the flat by April 2012 but it’s deeply regretted to note that till date even the excavation at the Site has not begun. Notwithstanding this, whenever we pursued OMAXE about the reasons for the no /slow progress no positive response or confirmation regarding the pace of the Project has been communicated in writing or verbally. This is quiet alarming and unless some remedial action is taken by M/s Omaxe this will have a cascading effect on finishing the Project.

                                  Please note, we have so far made timely total payments of Rs. 8.75 Lac (the initial booking amount of Rs. 5 Lac and the second installment of Rs. 2.75 Lac) as stipulated in the payment schedule from November 18, 2009 & January 04, 2010 i.e. so far almost 15 Months have passed till the total stage payments were demanded & paid.

                                  However, the dismal or no progress has resulted in substantial loss of time, loss of money, trouble and mental harassment to us personally. Moreover, this is a breach of Good Industry Practice as well as relevant consumer protection statutes.

                                  The undersigned once again requests you to kindly apprise us in writing within 7 (seven) days of receipt of this letter, regarding the actual progress at Site and the steps taken by the Company to expedite and mitigate the delay so as to Complete and handover the possession of flats within the stipulated time.

                                  Such actions by you will repose faith of its patrons in Omaxe.

                                  Water supply being cut arbitrarily at Omaxe Executive Homez without any notice and staff are unionized. Club house has not been constructed by Omaxe and they have stopped providing maintenance and not even handing over control to society.

                                    Hi we are a group of customers of Omaxe builder in Delhi. Omaxe has been cheating us for the last 5 years and committing frauds openly.
                                    We would request you to help us in any way that you can.

                                    Here is our story

                                    We had booked a flat with Omaxe builder in pre launch in 2005 in their Palm Green project . At that time it was communicated the launch would happen in 6 months time. After an endless wait, the project was finally launched in 2009 after

                                    4 years. All this whenver we called omaxe, they kept telling us that the launch would happen soon. All our requests for pulling out were turned down.


                                    In march 2010 we came to know that the project which was being constructed was totally different from what was proposed at the time of booking and signing the agreement. I have sent around 100 emails and phone calls to Omaxe, but they just ignore our communication and do not have an answer for the changes to the project.

                                    The following were the changes to the project.

                                    The project size which was shown at the time of booking was 50 acre which is now reduced to only 23 acre

                                    In the original layout plan, there were 35 towers in 50 acre project while there are 28 towers in 23 acre. So originally open area ration (0.7Tower/Acre) was reduces to (1.2 tower/Acre)

                                    The following features were shown at the time of booking but removed later without informing the customers

                                    Lake Garden
                                    Lake side restaurant
                                    Swimming pool
                                    Amphitheater
                                    Musical Fountain
                                    Tennis Courts
                                    Badminton Court
                                    Pedestrian Plaza
                                    Clock Tower
                                    Entry Plaza


                                    So what was initially a luxury apartment was reduced to value/budget homes but consumers still paid the price of luxury apartment. We filed an RTI and came to know that out of the 50 acres that Omaxe had aquired for this project, the 27 acres were surrendered in 2008. Still after surrendering the land, Omaxe made us sign agreements about the project and the area of project specified was 50 acres. This is sheer daylight robbery.

                                    Their customer service is very frustrating. One of their customer service lady called Nandita, got heated up after i demanded an answer and she said "[censored] off" and kept the phone.

                                    It is 2011 and 6 years since we booked and there is hardly 20 % work done on the project. All our requests for refund are ignored and on top of it the customer service guys dont talk to us.

                                    Can you please help us in any way in highlighting this issue and bringing it to the notice of other people.

                                      booked flat in omaxe spa villa in 2008 and paid 10 lacs as intstallment . but till now the phase of the construction project is too slow and i dont think i will handed over it time . they have just started the ground work on it.

                                      Mean while i am asking them to refund the amount /transfer to the amount to some other project which they are refused to do it.

                                      i have written so many mails , but all my effort has been in vain . it has given undue financial constraint

                                        SIR,

                                        We had applied for appartment in Greater Noida, under Palm Greens in September 2006 and had paid Rs 640000.00. We were alloted flat no 902 in Spear Palm Tower and an agreement document sent, which said that the flat would be handed over in 30 months. in the meantime as when demanded we paid the other installment of Rs 454375.00.
                                        I happen to visit the site in the first week of December 2009 and I was shocked to see that there was whatsoever no construction done till date for the Spear Tower against which I have already paid Rs. 1094375.00 ( Ten Lac Ninty Four Thousand Three Hundred Seventy Five Rupees)
                                        I have sent many letters to them asking them to return my money with interest but they are not replying.
                                        Kindly help.
