1) DELAY IN POSSESSION OF FLAT : I booked a flat in Capetown project of M/S Superetch Limited in Aug'10 in CB3 tower # 1206 with booking amount of 2, 82, 140 wide Cheque dated 27.08.2010, Cheque No. 584066. The Allotment agreement was signed on 14th Nov 2010. As per BBA (Buyer Builder Agreement) possession of the flat to be given to me by April’13. However this period may be extended due to unforeseen circumstances maximum up to 6 Month i.e. Oct’13. As per BBA builder has to pay 5/Sq Feet/Month for delay. As on June’15 total penalty amount comes out to be 5*1080*20 – 1, 08, 000 INR When the project was launched in July’10. My tower CB3 was in Phase -1 of the project. Since last 2 years i.e. 2013 there is no significant construction done on CB3 tower. Though it was in full swing till builder have taken 90% funds of the total flat value as per the payment terms. Infact, the towers which were launched in Phase - 2 & Phase - 3 is far ahead of CB3 tower I have already paid 90% of the total property cost in March 2013 & rest 5% in Jan’15. CB1 & CB2 towers which were launched with CB3 are ready for possession, Infact few families are shifted there. I also paid the same amount as they would have done. (The payments made to M/S Supertech Limited as on date is attached for reference.) 2) INTEREST CHARGES ON DELAY PAYMENT M/S Supertech Limited has charged unjustified/illegal interest on delay payment of worth 3.5 Lacs, (Interest sheet sent by M/S Supertech Ltd. & payment made by me as per there demand letter is attached for reference.) • There was 2 months delay from M/S Supertech Limited to furnish the allotment letter. Supertech has provided the Allotment letter in Nov’10, though the flat was booked in Aug’10. Due to non-availability of the allotment letter, I was not able to submit the relevant documents to HDFC bank to get my home loan sanctioned & disburse the amount. Besides, Please note the project was not bankable till Mid of Nov.10. As allotment was signed in Nov’10, M/S Superetch should charge interest on the payments made after Nov’10 i.e. too basis on demand letters due dates. • In BBA, it's clearly mentioned that these payment terms are tentative & in case of any changes in the dates same will informed by M/S Supertech & those dates will be considered as final for any purpose (Which includes calculating interest as well.) Once i receive Demand Letter, same is considered as updated information on the payment & hence mentioned payment terms in BBA are null & void (As per BBA ). • M/s Supertech is charging interest @ 24% PA on delayed payment whereas, the delay compensation charges is only @ Rs. 5 Sq Ft. 3) EXTRA ILLEGAL CHARGES • M/s Supertech has raised the payment demand in Jan’15 based on the payment plan mentioned in BBA(Note, till then they were following HDFC Bank Plan) where it has raise the demand of 5% on completion of 12th floor roof even after getting the payment previously on completion of 12th floor and also taken payment up to Top floor. The payment was made after getting mail confirmation from Supertech. • M/s Supertech has raised demand of Labor Welfare Charges which was not a part of BBA. The demand was paid under protest. • M/s Supertech is demanding Water connection charges @ Rs.25, 000/- at the time of possession from the buyers however as per BBA all the facilities are to be provided at free of cost. ( As per Noida Authority it’s 5, 000 ) • M/s Supertech is demanding Electricity charges @ Rs.20000/- per KW for Electricity connection at the time of possession which is to be provided without any extra cost. (As per Electricity Board it’s 7, 000) • M/S Supertech is charging Maintenance charges in advance for 1 year from all buyers @ 2.5 Sq. Feet where in BBA it’s mentioned @ 2 Rs/ Sq feet, Demand letters issued in Jan’15 the maintenance charges are mentioned as 2 Rs/Sq. Feet. Why should we pay maintenance charges now I.e. too in advance for 1 year. As per BBA it should be charged on monthly basis on 7th of every month. Infact there are no amenities so far. 4) COSEQUENCES FOR DELAY IN POSSESSION • I have lost an opportunity of claiming my principal of home loan in Income tax (1.5 Lac) for last 2 financial years, As the property is still in construction mode & possession is not yet happened. As per Income tax law you are eligible for home loan benefit ONLY if construction is completed & completion certificate is provided. For Home loan Interest benefit which is 2 Lacs, if the property is not acquired/constructed completed within 3 years from the financial year end in which the loan was taken, the interest benefit reduces to ONLY 30, 000 INR • Further delay from April’15 onwards & payment demands I have to pay additional service tax of 1.64% @ 14% which was 12.36% in 2014-15 financial year. Same should be borne by M/S Supertech. • There will be loss to me on Stamp Duty as well due to the late possession, As Circle rates has been increased by 24% in last 2 years & expected to increase by 34% by Aug’15, this has to be borne by M/S Superetch. • Because of this delay in possession I am losing on huge interest on EMIs to HDFC bank. I am paying monthly rental as well along with EMI which is huge financial loss to me, If would have got my possession on time, I would have saved my rent + interest to bank & prepay the bank loan. • Due to delay in possession Rent paid @ Rs. 11, 000/- PM from Oct 2013 till June’15 of actual possession requires has to be compensated i.e. 2, 20, 000 INR 5) FAR ISSUE • The Site Map provided at the time of booking has been changed by M/S Supertech without the consent, New Tower are being constructed ( CV8, 9, 10, 11, 12 and CB-4 ) and also Bird Sanctuary, water bodies shown are not coming as the land shown does not belong to Supertech. It is misrepresentation to fool the buyers, Without the required permission of existing owners and without following the UP Apartments Act 2010. This tend to reduce access of green area as well amenities for me. 6) OTHER ISSUES • Builder is asking to pay the final amount on pre-possession demand, however in BBA agreement there is no term mentioned. It says buyer has to pay 5% on “offer of possession”. Which means flat is ready to move in with in 1 months’ time. There has to be time lines mentioned in the offer of possession letter in which flat will be completed in all means if flat is not ready by that time after paying the amount there should be a penalty clause for builder for further delay. • As per Lease agreement between NOIDA Authority and M/S Supertech physical possession can be handed over only after registration. The registration can only be done after getting Occupation & Completion Certificate from Noida Authority. Presently M/s Supertech does not have Occupation certificate & Completion Certificate without which legally physical possession is not possible. As per Building Regulations for New Okhla Industrial Development Authority (refer page 28 Cl. 20.1.1& 20.1.2) "No building erected, re-erected, shall be occupied in whole or part until the issue of occupancy certificate". • With Present status of the construction it seems remote that the possession can be handed over in near future with all amenities as promised in brochure at the time of sale and with all legal formalities / rules complied.

    I have shifted in Supertech provided flat nearly 6-7 months back. Supertech have charged a reasonable amount to provide luxury specification and after spending so many months here I didn't found any drag or problem in the construction quality, Even few days back, a plank of wooden flooring came out and to my surprise the maintenance provided by Supertech took it as their responsibility to get it done. And trust me guys, the work was done free of cost and hassle free. After spening so much time in Supertech building, I can say that company is good and working is ethical as well.

      I had been continuously visiting Capetown projects since begining and observing the materials of contruction being used by builder is cheap. Till structural constructions it was OK as he was supposed to sell the project and later he starts putting third class materials ike - Domut bricks, poor sand-cement ratios, ghatia plastering, Chinese Doors made up of cardboard sheet with hollow structure which any one can break by putting two strong punch (total filmy doors0 even at main doors, poor fittings and Utilities. All can be seen which looks I am standing in worst than DDA building.

        It had a best experience of my life. My 1st property investment with Supertech Ltd. in HUES Project of Gurgaon was most profitable deal where I invested amount at the time of pre launch. After that company has keep on providing me ongoing updates on the project site as I don't reside in NCR. The cooperation being shown by Supertech's staff reflects the ethics and values of company. I always refer property by Supertech to all those who are looking for their dream home.

          Without Supertech, buying property could never be so easy.I booked a flat in Supertech Safari Studios. Not only the project, the company is also very good and supportive. Their working style left me astonished like the way they welcomed me, helped me in deciding a project according to my need and budget and eased my payment methods. I single suggestion for Supertech is that the company should follow the given time frame of possession. Rest all, the best company with best work ethics and values. Thanks Team Supertech!

            Me, Nitin Verma heard a lot about Supertech Limited and that is why we invested out money in Green Village, Meerut Project and booked one Flat in Tower-E (1103) in First Quarter of 2012. We paid all as per the schedule except one demand of Rs. 1, 64, 000 and for which I am ready to pay the interest as well. Here I would like to tell you that because I chose Down Payment Mode I had to pay 80% amount within 60 days. I submit all required documents to bank on time but the disbursement of amount made in Jul’12 because papers of Project Insurance were made available by Supertech in Jul’12 only and during the period I was in continuous touch with the local Supertech Team and they told me we will not penalize for this delay. Although for my satisfaction I wrote this thing to Supertech Headoffice as well at [protected]@supertechlimited.com on 11-Jun-2012. On 13th Mar 2015 we received possession letter from Supertech where Penalty of Rs. 1, 97, 000 was imposed to us. Till today I was following with Mr. Arun & Mr. Navneet Teotia, here I would not like to mention that how many time I visited/call them and how many time they responded and responded in what manner. They assured me that the penalty will be settled and day before yesterday they told me that only 50% of penalty can be settled, I was agree on that because I need flat to shift immediately but today I get final settlement letter from Mr. Arun in which only Rs. 48, 000 settled. Supertech is such a reputed & extreme orgainsation and I believe that my issue will be taken up on priority to resolve.

                I had bought a flat in Supertech Capetown, Sector 74 Noida in 2010 (CG1 - 1104). The payment plan was of Construction Linked Plan in which it is clearly mentioned that the payment due dates would be based on the construction progress. Recently, i got offer of possesion letter from Supertech in which following gross fudging of data was found while calculating due payment from me - 1) I have been shown to have made delayed payments. The payment due dates taken by Supertech are those which they had mentioned in Allotment letter and not as per the actual construction progress. Hence, they have shown that i need to pay a delayed payment interest of approx. Rs. 80000.00 to Supertech. 2) On above pretext of delayed payment from my side, Supertech has clearly refused that they would not be paying any delayed possession interest to me. 3) I had been made to pay 100% labour welfare charges which have to be borne by Supertech and the flat allottee in ratio of 50-50%. When i asked Supertech to credit my 50% of share of welfare labour charges that i had initially paid, it has clearly refused me. Pl help me to get the above issues resolved. I am also planning to take legal action as i have got good evidence along with payment demand letter in which dates are different. What a way of fudging the figures that these builders have resorted to!! There should be some strict rules against big builders otherwise they would keep on playing with innocent customers.                 I am also facing the same problem, they are asking me to pay interest amount of 80000 for delayed payments.They are also asking for one year advance maintenance charges which will start from July-15. I agree with Nitin, some action must be taken to check such bad practice by Supertech.

                    I had booked a flat in metropolis Rudrapur in Aug 2012, but i have not got the possession yet. I have visited their offices every now and then, but have not got any positive responses from their side. After waiting for so long finally in Jan2015 i was communicated that I had to pay the final pending amount by 15th Jan 2015 and then in a fortnight time I will get my possession. As per the communication I did my part and paid the pending amount but I was not given the possession till date. Also I have been calling them for the status but they keep on giving different numbers of different people for further enquiry. I have also dropped several mail to the Supertech officials but haven't got any reply from them. I want to know the possession date and need the penalty for delay possession.

                      This is to bring to your notice that I, Jaswinder Singh[protected] had booked a flat in your above mentioned project on 19 feb 2015 through your broker Mr B S Rajput of SRIM KUBER LTD (Shree Krishna Properties). The property was booked at the BSP of Rs 3900/sq ft. The size of the flat asked for in my application was 1250 sq ft.The application form was filled by myself in my own hand duly signed by me and the same rate i.e. Rs 3900/sq ft was filled in the application form also. A booking amount of Rs 500000 was also paid vide cheque no 073745 dated 19 feb15 of HDFC bank and cheque no 006761 dated 19 feb 15 o[censored]nion bank of India. I was told that I will receive a call from some representative of Supertech regarding my choice of floor and location of the Flat. However no such call came from the company office till date. Meanwhile my cheques for the booking amount were encashed by the company. However on receipt of booking letter from your office It was found that I have already been alloted flat no T7/0806 without asking my choice and the most surprising aspect was that it has been alloted at a BSP of Rs 4325. It is not understood why the BSP quoted in your allotment letter is different from what I quoted in my application form.Since my cheques have already been encashed by Supertech it was deemed that Supertech would be selling the flat to me at the BSP of Rs 3900. Otherwise the company should have returned my application without encashing my cheques. . You are therefore requested to investigate the matter at your end to acertain the reason for variance between the rate of BSP applied for and the rate at which it has been alloted. In case it is found that there is a case of cutting or any overwriting on the BSP column or my signatures are missing from my application form then its a clear case of forgery at some level which warrants legal action.In this regard Mr Amit Solanki of CRM dept of Supertech has also confirmed that company does not accept any application without customer's signatures or with any cuttings which are not duly authenticated by the customer In view of the above you are requested to resolve the issue at the earliest and issue me a fresh allotment letter at an amended BSP of Rs 3900/sq ft. Otherwise my allotment be cancelled and complete booking amount be refunded at the earliest this being a case of cheating and subterfuge.                         Dear All, Yesterday we get the demand letter/offer for possession in Eco-2 Tower B16. In this demand letter supertech(Superchore) is charging the farmer compensation from us, while flat was booked in Mar 2010 before this dispute & the increased compensation is to be paid by the Builder & not from the buyer (refer the article of economic times). http://articles.economictimes.indiatimes.com/[protected]/news/30306548_1_flat-bu... This is against the high court notification since it was to be applicable only for new flats & not for the OLD flats Thanks Hemant

                          Booking a flat in Supertech Ecovillage 3 is one of the best decisions i took in life. Me and my wife both are very happu with our decision and would recommend everyone to opt for supertech only. the amenities available have proved my investment worthwhile. though delivery of flat got late by few months but outcome is worth waiting. No regrets at all. Happy to have my own home now and credit goes to Supertech Limited, the best.

                          Seriously a good builder. I am very happy and satisfied with their project, staff and quality of construction material. All now I am waiting for possession.

                              First of all the CRM staffs are pathetic.I went to meet them and they kept me sitting for 1:30 minutes..waht is this type of customer support.. The CRM is not ready to discuss anything they don't intimidate anything and they fraud in money transcation.My money was transferred from one account to another account in Supertech only and they cut 15000 as transfer fee without any consultation and intimidation.I have villa booked in upcountry s1-72..the date of delivery after grace period was sep 2013 and it is not handed over yet. CRM team is even worse than custommer support by govt officals and no one to listen.

                                it has been severly inform from our side that be wont to cancel subject mention order, due to some my some personal reason.

                                The incisioal cancalation request submitted from our side on dtd 25.Feb.2015 but i am not yet received cancelation confirmation from our side.

                                We once again request you to pls immediatly do the needful on priority else have no option to go legely.

                                  A 2 BHK flat in Araville at Gurgaon has proved to be a fruitful investment for me. The location of the project is a most profitable point which will give you a good return on investment. Though construction is bit slow but I am sure that builder will deliver the units in a promised time frame. My personal suggestion to all the buyers is always make a site visit before investing your money. The site visit gives you a actual image of your money growth graph.

                                  Unbelievable designs and fantastic infrastructure. I must review Supertech as a best builder in Delhi NCR.

                                  Fraudulent PLC Charge

                                  Hi Booked a flat in capetown. was charged Rs.50 psf as park facing plc but found that there is no such park facing my flat. when i demamded my PLC refund they are not responding. Cheater builder. Pls help.

                                    Dear sir i would like to inform you that i have book flat in supertech cape town noida sector 74 dt 16.08.2009.i have paid booking amount Rs 50000.00 vide ch no 329052 SBI. but due some financial crises i am have not paid instalment when builder demand . builder have cancelled my unit on 25.03.2011 due non payment . As per cancellation terms builder has to return us my booking amount after deduction 15% cancellation amount . but in spite of my several time reminder and personnel follow up builder not ready to pay our booking amount . i have attached herewith booking form for your reference where clearly mention that " cancellation charges : point 6.1 to 6.3 .                                       Supertech has launched a project by the name of hill town in sohna. being a defence officer I invested my hard earned money in the project. After almost 5 months when the allotment was conducted i was allotted a flat which was also allotted to another party also. They are such big liars . Never trust them till you have the allotment letter in yr hand. I am cancelling the deal. Pl be aware.

                                        Few months back I was looking for a residential property for an investment purpose in Gurgaon. I came across many residential projects as I was looking for a proper luxurious project and finally opted for Araville at sector 79, Gurgaon. Good connectivity, superb amenities and world class floor plans. The way they utilized the space is something remarkable. Speed of construction is bit slow but I expect that there won't be much delay in delivering the project.
