General Issues Faced bu Supertech Flat Customers: 1. Flat delayed by over 2 years : The flats were supposed to be delivered by Supertech by 2012 (as per Flat allotment agreements) and these are still not ready. Moreover, Supertech has never communicated about these delays and reason of delays to anyone. Even after multiple requests proper completion dates were not provided to Customers. 2. Delay Penalty: Supertech is not ready to pay any delay penalty. They are supposed to pay a penalty of Rs. 5/sq feet per month. If customers ask them to adjust these penalties in demand or make the payment to customer they will tell that it will be taken care at the time of possession. If you ask them at the time of possession then they will tell you your payments were delayed and so you are not eligible to get the penalty even you customers have made all the payments on time. 3. Inconsistent and incorrect Demand letters : Most of the demand letters are using different calculations for service tax and the amount demanded as part of the demand. Advance service tax was also being charged by Supertech for the payments which are supposed to be made at the time of possession. The service tax should only be paid on the due amount not on the full amount (including the amount to be paid in future). Some of the demand letters are also sent without complete the construction as per the payment plan and when customer calls Supertech to verify the construction status or they visit the site to check the status they are told that the construction is not completed up to that floor/level. In these scenarios they told that this demand letter is issued by mistake and no payment is required to be made. Sometimes after these calls they also sent revised demand letters with lesser amount. 4. Demand for Interest even after making all the payment on time: Customers who have made all the payments on time and even then Supertech is charging them Interest in Lacks @ 24% rate. 5. Additional charges demanded along with possession letter: Supertech is also demanding additional amount in Lacks addition to the sum mentioned in the allotment agreement. This comes as a surprise in the possession letter as this is never informed to customers formally or informally until they are sent offer of possession. Below Issues may be raised after possession: 6. Boating lake/swimming Pool is not ready: Customers have paid PLC or additional money to avail these facilities as this is given in the layout of the project. The land on which this lake/swimming pool was supposed to be built is not even acquired by Supertech. So, Customers should be compensated for this loss by Supertech. 7. Other amenities are also not ready: Other amenities promised in the project details are also not developed yet. Let's bring this fraud to the court, as they seems to have lost the ability to understand the evidence, arguments, logic & facts related to their own agreement letter.

    Hi, I booked a flat in 2012 in Ecovillage1 of Supertech Limited. I was very happy as the construction was going on in full swing. But, due to some financial issues I had to cancel my booking and for my surprise I received my money back without any headache and time delay. I am thankful to Supertech for helping me in my difficult time.
    Supertech customer support has been notified about the posted complaint.
    Whatever be the scene, I got my money back which I needed badly and the way developers keep your money I was damn scared but Supertech didn't let my hopes down.
    Very innovative builders in NCR. Never came across such brilliant ideas in real estate ever.
    haha... Supertech is innovative in making a fool out of common man... Haven't seen so many complaints against any big developer.. worst management...
    ye admi supertech se pesa kha ke ye sab acha acha likha hai verna 99% customer to supertech ko gali hi dete hai...

      By way of an introduction, I am Srijit Mukherjee, Advocate and am the Transferee of Capetown Noida Unit No. R026CG41501 (hereinafter referred to as the “Unit”), along with my wife Mrs. Priyanka Laik from Mrs. Kumi Das, Mr. Dhrupad Das and Ms. Shreya Das (collectively referred to as the “Transferor”), who were originally allotted the said Unit vide the original allotment letter dated 2-May-2011 (the “Original Allotment Letter”).
      1. That the Transferor agreed to transfer the said Unit to the Transferee at a mutually agreed consideration and on the same terms and conditions as specified in the Original Allotment Letter issued to the Transferor by Supertech.

      2. That in order to complete the transfer of the said Unit from the Transferor to the Transferee, Supertech instructed to execute a Memorandum o[censored]nderstanding in the format prescribed by Supertech, which was executed by the Transferor and the Transferee on 29-Oct-2014 (the “MOU”).

      3. That Supertech further instructed an undertaking to be furnished by the Transferee in the format prescribed by Supertech, which was furnished by the Transferee on 29-Oct-2014 (the “Undertaking”).

      4. That on the basis of the above documentation requested by Supertech and provided by the Transferee and clearance of all outstanding dues with respect to the said Unit until the date of the transfer, Supertech issued a duly signed by authorized signatory and stamped No Objection Certificate with respect to the transfer of the said Unit (the “NOC”). The NOC clearly stated that Supertech has “no objection” in the transfer of ownership from the Transferor to the Transferee.

      5. That Supertech issued a Provisional Allotment Transfer Form duly stamped and signed by its authorized signatory from their CRM Department, Mr. Raj Mangal Singh on 24-Jan-2015 (the “Provisional Allotment Transfer Form”). The title and name of this document itself shows it is a transfer and not a fresh booking.

      6. That on 31-Jan-2015, Supertech approached the Transferee for issuance of the endorsed allotment letter in favour of the Transferee to reflect the completion of the transfer of allotment process in relation to the said Unit.

      7. That the Transferee was shockingly surprised to see that the terms and conditions with respect to the possession date of the said Unit has been altered from what was originally stated in the Original Allotment Letter. The Original Allotment Letter clearly stated in the section relating to the possession of the Unit the possession date to be that of October 2013. The same clause also has a compensation provision in case of a delay in possession effective post 6 months of grace period from the original possession date at the rate of Rs.5.00 psft per month to be paid by Supertech until actual possession. However, in the endorsed allotment letter draft provided by Supertech to the Transferee for signature, the said provision relating to the original possession date of the said Unit has been altered to March 2016, clearly indicating the mala fide intention and unethical practice of Supertech to evade the compensation accrued on account of delay in possession since the possession date of October 2013 as specified in the Original Allotment Letter. This compensation is a contractual and legal right of the Transferor which has now transferred to the Transferee vide the transfer process for the said Unit and issuance of the Provisional Allotment Transform Form by Supertech.

      8. That Supertech needs to understand that this action on its part is completely illegal on the face of it due to the reason that the present situation of transfer of the said Unit from the Transferor to the Transferee is not a fresh booking to materially change the terms and conditions of the Original Allotment Letter, but a transfer of all rights and liabilities of the Transferor to the Transferee. The only thing that changes in the allotment letter is the name and address of the allottee and nothing more. All other terms and conditions of the Original Allotment Letter remain the same. This fact is further confirmed by the MOU, the Undertaking and the Provisional Allotment Transfer Form, all of which documents clearly state that this is a transfer of allotment and these documents are prescribed formats of Supertech only.

      9. That it is worth noting the a few provisions of the MOU and the Undertaking which go on to corroborate and show that the present situation is a transfer of allotment with original terms and conditions of the Original Allotment Letter and not a fresh booking to materially change the terms and conditions of the Original Allotment Letter. Clause 1 of the MOU states: “That the Transferor is transferring his / her all rights in the above mentioned said property in favour of the Buyer because of his / her personal reasons and without any undue pressure, force or favour from any quarter in any manner whatsoever. The Transferor has taken the consent of his / her co applicant Mr. Dhrupad Das & Ms. Shreya Das, if any, to transfer his / her booked unit to Mr. Srijit Mukherjee & Mrs. Priyanka Laik."

      10. That this action on the part of Supertech to arbitrarily alter the terms and conditions of the Original Allotment Letter is illegal, unethical, malicious, mala fide and full of mal intention to evade the accrued compensation payable by Supertech on account of delay in possession since October 2013.

      That in addition to the above malpractice indulged into by Supertech, I want to bring to the notice of the top management of Supertech that the conduct of the officials of Supertech is highly unprofessional, unethical and unlike human beings. Specifically if I am to refer to one Mr. Suman Kumar, supposedly a Senior Manager, who did not have time to speak to me regarding the matter, however, had loads of hours talking to his friend over the phone. I want to ask the top management if these unscrupulous people have been employed by Supertech to cater to customer relations or for any other purpose especially harassing the customers.

      That I would demand a prompt investigation into the aforementioned matter by the top management of Supertech within a week’s time from the date of this notice, else I shall have no other alternative than to route for resolution through appropriate legal recourse.

      For any clarification, ask your legal department to contact me via email, letter or phone.

      Kindly treat this as my final notice, post which I shall take up this matter in the court and social media.

        I booked my flat in Mar’12 in B1-14 tower (whenthis tower was on 4th floor) & marketing team confirmed that possession will be given on DIWALI (Nov’12). I had made 90% payment as peragreement before time. i am making follow up since lasr 2 years but nt getting any positive response. earlier you were making some statement but now you are not even responding tomail. It seems that tower is ready sine last one r but lift not installed till date. i have my flat on fifth floor. i have to kids & elder parent with me. how can i go to fifth floor without lift? please let's know that when i will get possession of my flat (B1-14/52)

          Dear sir, I have booked flat B1-13/41 in Metroplis city Rudruapur. Till now i have got the possesion for the same whaich was supposed to be completed by march'2012. Every time i ask for some date for the readiness i get three months advance mail. Please help me. Now people at metropolis city site has stopped taking ownership of the completion also. Please support. please tell me what should i do. Please help me i will not able to take long for the same i am giving EMI & house rent for the same. i am seeing my money being wasted. i can't take 20 lakhs of penality of booking flat with Supertech.             Dear Sir/Ma'am I have booked a flat from Supertech at Noida ext-1(Eco- Village 1 flat No-A4-1205) in Mar 2010. They are making several changes in payment terms from the day of booking. Initial they said only 10% of amount is sufficient for booking the flat then they increased it to 15% just after the two months later I gave the 10 % booking amount. Due to local farmer dispute at the site and the matter was in court, the construction work could not made progress. Hence they modified the possession date to 31.03.2014 and made a new agreement letter on Nov 04-2012 and declared previous period as ZERO period. But at the same time they cleverly made us to sign on installment due dates since 2010(including ZERO period). Now at the time of possession after 8 months of due possession date they are charging interest on all installment payment made by us. They have shown our every payment as short payment, late payment and application for 24% interest chargeable. Total interest they are charging more than 1 Lac which is more than 10 % of the total cost of flat. Not only this, they are charging Farmer Agitation charges and Labor Welfare Charge which was never mentioned in agreement. They have not mentioned anywhere [protected]@5/Sq Ft per month for delay in possession in their demand letter which was made in agreement. I have attached all relative documents i.e agreement document, interest calculation document, possession cum demand letter document. Please suggest me, I have no idea how to deal. This please guide. Supertech is having Registered Off: 1114, Hemkunt Chamber, 89, Nehru Place New Delhi-110019.

                Hi, My parents had purchased a 500 yards plot in meerut at Hapur Byepass in 2002-03, which is near to supertech green village site currently. We have completed its boundary wall in 2009-10. As this plot is on the road side and coming in front of Supertech Gate, So our plot has been leveled by dust illegally to prepare entrance for the colony and our boundary has been demolished. My parents raised this issue to the sales office, but none of them is taking this issue seriously. Then, we requested for help and went to meet DM, SDM and all official at thesil Meerut. They helped me and gave order to probe into this matter and allow us to take possession. But i am afraid that again they can demolished our boundary wall and grab it illegally. We are not capable to bear the expenditure of boundary wall again and again. Would anybody suggest me, what should i do in this case. I will be highly grateful to you.                     Hi, Supertech & its representatives Investors Clinic have been unfair in dealings regarding the ECO Village 2 flat that I made payments for. When the farmers disputes were on I was advised NOT to make the payments. I received a cheque for less than the payment amount after a year. I disputed the cheque and wanted a flat as compensation, I was denied that saying its too late and I need to keep the cheque. I disputed that however no one paid any attention or returened my calls. I asked for a fresh cheque as the cheque was stale after six months of chain mails and calls to Supertech. I haven't received that either. I have seriously upset with the casual way of dealing with my property and now with the compensation. I am not happy with the compensation amount at all! Aprajita [protected]

                    How much time.. I am referring to the patience required to deal with Supertech issues here. First my plot was held and removed due to farmers been cheated. Now my money to the tune of 2 lacs.. the interest I would have earned by now is much more than the anxiety you have caused with no responses or irresponsible resolutions to my issues.

                    Please BEHAVE. This is no way to treat customers. This is not a strong consumer law system at all. Just a cheap copy I am really sorry to say this but in another country a law suit would have been filed by now.

                      Hello, I had booked a flat in Supertech Livinston, Tower-D-2, Flat No.- 2402 in Crossings Republik, Ghaziabad on[protected]. It was a Ready-to-move flat and in the allotment letter, Supertech Limited had provided the Possession Date in March 2013. As 2014 is about to end, there is no sign of delivery of flats. I had visited the site various times, and found the construction too slow. This situation has caused too much problems for me. While I contact CRM Team about the status request, they provide me a date of possession and it keeps extending always. I want to know if Supertech is sincere enough to deliver the flat to its customers. I'm seriously disappointed by the functioning of Supertech. Furthermore, I have noticed that the quality of construction is extremely poor and I'm also suspicious that Supertech didnt obtain the necessary approvals from the civic bodies (GDA, Etc.) for the top floors. I'm unable to find a solution to this problem after paying 95% of the total amount. Thank you, ABU ASIF [protected]

                          I have booked a flat in tower B of supertech livingston in 2007. At that time they gave me in written that they will give possession in dec.2009. but till date there is no hope of getting posession . From last two years whenever i go to supertech office they told me that they will give possession in tree month but their thee month never come. I think i did biggest mistake of my life to invest my whole life hard earned money to this fraud builder .please advice me what legal action can be taken to this cheater so that it can not cheat to other people. thanks Anil

                            Hi, Hi This is with reference to a flat that I have purchased in re-sale- Metropolis city, Rudrapur, H1-7-21 :- I bought flat( H-1-7-21 ) in Supertech metropolis township in JAN’14 & submitted all transfer charges in MARCH’14 but still I am waiting for the transfer letter & new allotment letter. I have submitted all necessary documents in march’14. I am still clueless to know when will get the transfer letter & allotment letter. I have been continuously in talk with local officials. I have not received a single communication from builder side about the transfer papers. There is no response from the customer service helpline no also.

                                Hello, I have applied for Supertech Affordable housing in sector 79 Gurgaon Haryana dated 24th June 2014 with initial 10% amount which was told of Rs. 264000/- and cleared vide cheque no. 872821 of Rs. 164000/- (yes bank), 033874 (axis bank) of Rs. 70000/- and 694920 hdfc Bank of Rs. 30000/- towards supertech ltd a/c. despite of my best possible efforts, I am still clueless to know when will get the allotment in said project. I have been continuously in talk with their chennel partners who are dealing on their behalf in this project "INVESTA GURU" but no reply is received so far. Now, since 6 months passed by no info on matter has been revealed and I am doubtful on builder's intention. I visited their office last Saturday and had meeting with Mr. Kumar and Mr. Bharat Bhushan Bhatia over phone demanded my money be refunded with interest but there is no answer to this question despite of sending repeated mails and messages and phone calls there is no reply as on date. I have been getting responses not to invest in Supertech just because the kind of reputation they have developed in the market is not good for investors and good to stay away from them with any kind of investment even if it looks much-tempting. But i had ignored them and landed up in great trouble. They are the biggest cheater on this piece of earth and they should changed the name of their customer relation management to Supertech relation management as there is no one who would listen to the grievances of the customers.                                   Hi even i am facing the same issue i had also issued a DD of INR 1, 00, 000 on 7th june 2014 till now they have not refunded the same and not responding. Let me know if you have any constructive lead on the same.

                                    Hi, As a supertech capetown buyer i had booked my flat through khalsa real state which is a dealer who met me in supertech registered office. After few days i came to know that instead of booking of discussed amount, he booked in more amount and for the same he had given me the credit note of 54000. This amount is payable to me at the time when i made 50% payment of the flat. Within 3 months i did that payment and ask that dealer for that amount. He refused and said that supertech is not giving its commission and thats why he is not able to make that payment. After few days he called me and ask me to meet at supertech office as there he had given me a another note in which it is written that supertech will give my amount after deducting from its commision and that letter is attested and received by supertech officials. Because of supertech officials i stop following that real state agent and start following supertech. But now nobody in supertech office is concerned about that note and everyone is saying that its not there call . However i checked that document which is still in supertech file.Now i am very much depressed as i dont know whom to contact and whom i call. Please help me in this. Thanks Prashant

                                      Superetch ltd. is not ready to give me the delay penalty (INR 39, 150) as per the signed agreement. As per the agreement the maintenance charges is INR 1.00 PSF but now they are asking me to pay INR 1.20 PSF. At the time of booking the salesman informed me the power backup is optional but now they are asking me to pay INR 20, 000 for the power backup also.

                                        Hi This is with reference to a flat that I have booked at Supertech - Eco City Sector 137, flat no-705, Floor - 6, Tower- U, Super Area- 890 sq feet . I have made the complete Down payment and the possession was due in April 2012. Various attempts to contact the Builder have failed. I have not received a single communication from the builders side about the possession. There is no response from the customer service helpline no Regards Rashmi Sharma

                                        This is the worst country I have ever seen, these builders are making money with these practices. No justice to the crime. every one is aware of this naked truth. The same condition is with me and I had even booked it in early 2010 and paid all the amounts at that time, is there any provision that we can take resort to court and teach them a lesson asking huge penalty for harassing us ?
                                        I will definitely sue them and will ask for the compensation against the harassment, please let me know if any other forum is going on.
