Dear Sir,
I have taken a Personal Loan from Bajaj Finserv Ltd, bearing Loan no. 405SPL[protected] months back when I was employed and earning good salary. Thereafter I have lost my job and was unemployed since Dec-15. Still I continued to pay Personal Loan EMI. I was surviving on some Part time jobs and has requested Bajaj Finserv Executives to restructure my EMI to the tune of Rs. 8000/- instead of Rs. 12761/- to enable me honour my EMI. However, for last 5-6 months the Executives of Bajaj Finserv has been promising me that they will restructure my EMI and so they kept on pressurising me to pay current EMI. Every month a new Executive emerged and promised to restructure my EMI and kept on putting pressure to pay current EMI. Some of the Executives who were promising are Birendra Saroj, Juber, Nishir Yadav, Sunil Kadam, Bharat Sharma, Govind, Sachin etc.
I have written several emails to various said Executives including those sent to [protected]@bajajfinserv.in and [protected]@bajajfinserv.in requesting them to restructure (summary of emails attached) EMI. Surprisingly there is no revert from any of the Executives or Chairman or MD. I have also visited and met few Executives of Bajaj Finserv who were initially sounding very helpful then vanished suddenly.
Presently I am jobless and have also lost my part time income since[protected]. Said Executives has been putting too much pressure and have even threatening me to be ready for the consequences if I do not pay my Personal Loan EMI. Such pressure has been from Bharat Sharma and Vinod Kadam who sounded to be very rude. I am scared that such Executives might try to physically harm me as they have already threatened me several times in the past. I have been begging them and informing that I have lost my job and current having no income but Sunil Kadam says that I am lying and trying to get away with the Personal Loan. These Executives are so aggressive that are literally forcing me to take some negative steps to get away from this life. I have never said that I am running away or will not pay Loan back to Bajaj Finserv.
To keep you informed that one Executive namely Bharat Sharma who sounded very helpful in January 2017 and assured me that he is considering to restructure my EMI and hence forced me to pay that month EMI. Thereafter he became very aggressive and I am attaching herewith sms text messages of Bharat Sharma who is giving a threatening which reads as “I don’t want to create any scene in your society...Kindly make payment yom and help us to regularise your account”. Kindly go through with the attached sms text communication and access the aggressiveness of Bharat Sharma. (Text sms communication attached - six screenshots).
During February 2017 Sunil Kadam kept me chasing me for making the payment and I have informed him that I will make the payment by the month-end. Thereafter he changed his voice and represented that he is calling from the Legal department and advised me to make the payment else they will issue a legal notice. He also indicated that “hamari collection executive bahut harami hain aur logon ko pareshaan karte hain”. I don’t know whom to believe and who is genuinely intending to help me?
During March 2017, Bharat Sharma assured me that if I pay EMI for March-2017, no one will chase me for payment for next few months.
I don’t know whom to approach under such circumstances when I am getting too much of threatening for making the payment or else be ready for the consequences.
Also Bharat Sharma and his one colleague visited my residence on[protected] at about 1-1:15pm in spite of my saying that there is no one at my residence presently. He kept on pushing my doorbell and obviously there was no one at the residence at that time but he was not ready to believe it. Bharat Sharma also took out and checked certain letters and courier which were lying / inserted at the safety door grill. I don’t know what was the business of Bharat Sharma to check my courier / letters. The whole incidence has been recorded in the CCTV installed at my residence main door.
This is the kind of threatening your Executives are giving and this indicates that a Borrower could always be put to harm if the borrower fails to pay EMI.
Under such circumstances, I would request you to provide me a solution by reducing EMI in the range of Rs. 8000-Rs.9000 per month by increasing my Personal Loan Tenure.
Could someone responsible take steps to stop such Executives to give me threatening and also appoint responsible personnel whom I can approach for restructuring of my Personal Loan EMI. Please look into it else they will finish me.

With reference to your email, we wish to inform you that to reduce the EMI amount you have to do part payment of certain amount which get adjusted towards principle outstanding amount.
Part payment effect can be given in two ways:-
- Reduction in Tenure, OR
- Reduction in EMI
If you wish to make part prepayment, we request you to visit our nearest branch office and make the payment via cheque or DD in favour of “Bajaj Finance Limited” and payable at branch location.

Conditions for prepayment:
1. The amount of part prepayment shall be equal to a one monthly Instalment.
2. Part Pre-payment charges of 2% + (Service tax15%) i.e. 2.30% will be applicable on part pre-payment amount
3. The above prepayment charges are not applicable to FLEXI, FLEXI RELOC availed by the Borrower, unless otherwise communicated by the Lender to the Borrower at a subsequent date.
