SUBJECT: -NOTICE AGAINST DEFECTIVE GOODS/DEFICIENCY OF SERVICES BY YOU.
REFERENCE: - Order ID: OD[protected], "TRISHAA BY PANTALOONS WOMEN'S KURTA AND PALAZZO SET" from seller named ‘TECH-CONNECT RETAIL PRIVATE LIMITED’.
Dear Sir/ Madam,
The undersigned is a consumer as defined under Section 2(d) of the Consumer Protection Act, 1986 as the undersigned had ordered a "TRISHAA BY PANTALOONS WOMEN'S KURTA AND PALAZZO SET" from your E- commerce website- https://www.flipkart.com on 14th October, 2018 for Rs. 1, 260/-, with an order id of OD[protected] from seller named TECH-CONNECT RETAIL PRIVATE LIMITED. The product was delivered on 26th October 2018 and Invoice No. of the Product was FAAAAB[protected].
However, on opening the packet, the undersigned came to know that the product was incomplete as it has only kurta i.e. the “PLAZZO” was missing. Further, the Kurta Size was Much bigger than size which we have ordered. Thus the undersigned have generated the return request for the same immediately. However, the delivery guy refused to pick the product stating that “I will not receive an incomplete product”, despite the fact that we are returning only because the product was incomplete. Thus, the undersigned called the customer care immediately. Your customer care officer told us that they are cancelling the return request and then asked us to call after 48 Hrs. to enable them to generate return request from their side. The undersigned did the same and again return request was generated from Flipkart’s side. However, to our utter surprise, the return request was cancelled without any intimation or without assigning any reason. Thereafter, the undersigned immediately called Flipkart again and this time your customer care officer told us to raise a new return request and assured us that this time product will be picked up. However, again to our utter surprise, the return request was cancelled after few days without any intimation, call or reason.
Thus, 0n 28th November, 2018, the undersigned have again contacted your Customer Care Executive and raised his concerns. Further, 0n 28th November, 2018, the undersigned have also written on your Facebook Page, Twitter Page, Customer Support Email Address etc about the same. Thus, your Customer Care Executive, Complaint Cell, Social media cell etc, all assured that the product will be picked up on or before 5th December, 2018. However, again to our utter surprise, the return request was cancelled on 5th December, 2018 without any intimation, call or reason.
Thus, despite all my pleadings you have not made good the defect in the product, which is indeed regrettable and highly unprofessional. The above said act on your part has caused us great loss and damage besides mental tension, trauma and inconvenience and loss of value of money.
Thus, on account of your aforesaid dereliction of duty and failure and neglect to rectify the same, you are requested to compensate the undersigned by making payment under the following heads: -
1. Amount Paid for Product/Good :- Rs. 1, 260/-
2. Mental Harassment: - Rs. 50, 000/-
3. Cost of instant Notice Rs. 5, 000/-
Total Amounting to : - Rs. 56, 260/-
You are hereby asked to pay the said amount immediately within 15 days of receipt of this notice failing which the undersigned shall be constrained to initiate legal proceedings against you, both civil and criminal as are warranted by law, against your act o[censored]nfair trade practice and deficiency of services besides filing a complaint under the statutory provisions of The Consumer Protection Act, 1986 exclusively at your own risk, cost, responsibility and consequences which please note.
