I residents of shipra revera working in suprem court of india at shipra revera bazar near gate no 8 gyan khand 3 indrapuram. There are commercial shops at basement but i noticed that in shop illegalconstruction took place they made a partitionin shop which is against the gda property act 2002 . I requested to you kindly take action against it and they also digging a floor in shop.

    Hello sir. I am from Nyay Khand 3rd Indirapuram Ghaziabad. This complaint is against a big sever is open in front of our house. It is very dangerous for us and children.. and in rainy days so many disease influence also pollute the environment. Please cover it as soon as possible.

      We the residents of Plot no. 568-569 IIIF Sector-3 Vaishali Near Chaya Public School, Ghaziabad, UP. I would like to say that there is a basement area (This is not according to GDA approved norms). When the Sewer is Jammed or overflows the water is going to back in to the basement. due to this so serious diseases increase like Dangue and also reduce the age of building. The surrounding area is also effected.
      This is a very serious matter and look forward to you.

      We would like to request you to, kindly take the necessary action and fill the basement.

        I am still waiting for my refund of the scheme of 2006. I had registered for GDA Indraprastha Housing Scheme code 750 in Catagory E. My Application number is 1430. I had deposited Rs 56, 740/ for registration. It is 10 years and I still haven't recieved my refund. Since I was not alloted in the draw, Please refund me the money at my Bank account.           In our location, block -2, sector -2 rajender nagar from plot no. 157-166, new road and nali were made in the month of june 2016 and the quality of road constrction is so poor (Contractor used poor quality of material and eat allotted money) that road is damage in a month time. Now big holes appears in road and daily due to damage in road, accidents happens.

          Request to hold the payment of contractor and ask him to repair / complete build road again.

            We are a resident of flat no. 6 c plot no. 700. Shalimar garden extension 1. The building we are residing at has a basement area where there are two shops which remains closed. The complete area is nowadays filled with severe water of almost 6 feet deep. We had a talk with the owner of the place mr. Behel on phone requesting to clean up the place as its polluting the environment and there is danger of dengue due to rainfall. He said that he would come here on sunday i. E. Yesterday but he did not. The other families of this building says that it's been continuing since a long period of time. We have little kids in our home. If something happens due to his negligence then who is going to be responsible for this.
            We request you to register our complaint and do the needful at the earliest.

                Dear Sir’s,

                I, Sh. Rajneesh Mishra and Smt. Nalini Mishra, R/o S-857, Mangolpuri, Delhi-110083 and also joint owner of Apartment number C 201, 2nd Floor at Star Rameshwaram, Raj Nagar Extension, Ghaziabad ( UP ), I hereby serve upon you with the following complain:

                1. That we are law abiding and respectable citizen of the society and after going through widely published colorful and alluring brochure and advertisements about residential housing project under the name & title as “Star Rameshwaram” situated at Raj Nagar Extension in Ghaziabad, U.P., shown interest to book a Flat in your said project.
                2. That being induced by his alluring advertisement, I visited office of Star AMD Realcon ( Builder) as above said office in the month of July 2011 to inquire about aforesaid project and on the basis of projection and visiting the Project Site, We decided to book a flat in the said Residential Project and subsequently booked a unit bearing No. C-201, measuring 890 Sq. Ft. in our joint name by paying a booking amount of Rs. 21, 000/- through cheque dated[protected]. Here, it is pertinent to mention that at the time of booking the said unit my client also handed over a cheque amounting to Rs.2, 49, 750/- dated[protected] towards the first installment which will be realized for encashment .
                3. At the time of booking the said unit, it was assured by Mr. Kamal Kishore (Marketing Manager of Star Amd Realcon) that they will give all amenities and possession before June 2013.
                4. That as per the terms and conditions, the total consideration amount of the said unit booked by my clients was finally fixed at 22, 41, 481 /- ( Included covered car parking amounting Rs.2, 06, 180/- + Preferential Location charges Rs 1, 11, 250 /-, + Power Backup 1Kvh amounting 20, 000/- + Club Membership Charges Rs 50, 000 /- + Additional Development charges Rs 1, 06, 800 /- + EEC charges Rs 31, 150 /- + Fire fighting Charges Rs 31, 150 /- and service tax Rs 96, 482 /-) . The total consideration amount of the said unit booked by my clients was fixed at Rs 22, 41, 481/- which were paid timely by us in advance before take possession .

                5. Booking conducted in the month of July 2011 and date of possession was fixed and committed by Builder to be handed over by June’ 2013 and after the delay of 3 Year by February 2016 they given possession without give all amenities and completion certificate is still not issued by GDA. Before give the possession they had taken complete flat cost with amenities cost and much other unjustified cost from us. The other preference and amenities which were offered by them at the time of booking and, all are missing in practically and for that they have taken fully amount in advance by us before possession (12 Feb 2016) like as for For Power back up of 1 Kvh Rs 20, 000/- + For Electricity Meter security deposit Charges Rs 24, 000 /- ( 1 Kvh 6000 * 4 Kvh ) and also offered to give many amenities like as Swimming Pool, Gym, Golf court etc and for this had taken payment in the name of common area, all are still in the dark.

                6. Here, it is pointed out that in the said details of dues some of the other charges like Enhanced ADC @Rs.30/- per Sq. Ft. Amounting Rs.26, 700/- + VAT Rs.21450/- (that’s not applicable in UP Apartment Act) respectively have been unnecessarily added and demanded by builder from us and forcefully taken from us through cheque before the registered sale deed and without give possession.

                7. They also demand illogically amount in advance of Rs. 27, 088/- (towards interest free maintenance charges Rs 17, 088 /- of one year and Rs 10, 000 /- for electric recharge coupon before possession) and threaten to us, so it was paid by us before taken the possession of the said flat.

                8. We have paid all above mentioned hefty amounts Rs 23, 60, 719 /- for the cost of Flat & Amenities etc till Feb 2016 to Star Amd Realcon/ Fresh Facility Management Services Pvt Ltd in advance and due to threaten by them, They forcefully taken our sign on their manipulated documents like as blank dated layout revised consent letter and Illegal Maintenance Agreement etc.

                9. They also charged Rs 35000 /- in cash before register sale deed and possession that was not justified.

                10. Finally on dated 12.02.2016 sale deed was done through your representative Mr Abhinav Dagg, when we asked the detail of his duly authorization and demand chain of complete property and land related documents and visited their kaushambi office yet which was not done despite the several reminders by my us to the Builder named Star Amd Realcon.

                11. Thereafter registered sale deed on Feb 2016, we reached at our flat and found that the finishing of this flat was very dirty and there was no amenities these were committed by the Star Amd Realcon as builder/ developer and now we have no money to repaired it so we did locked the main door of this apartment and come back at our previous permanent residence in Delhi. On dated 03.07.2016 about 05.30 Pm, I received a call through Anjani Pandey asst Manager of Fresh Facility Management Services P Ltd (Maintenance Agency of Builder) he told that water are leaking in the 1st floor flat. I gone from Delhi and reached there about 07.00 Pm . When I opened the door of my flat, found that there is no light in my flat, I called to start the light to Mr Daggar, Maintenance Manager of Fresh Facility Management Services P Ltd and then looked that RO that was provided and fitted by builder that’s water was leaking very speedily and the whole flat are in the custody of water, kitchen wooden/ tiles and entire drying room were being damaged . It was our own Apartment that was full of water due to a very poor RO it is deficiency in service.

                12. I asked the reason of disconnection of light then he given the bill of Rs 8294 /- and Rs 1075 /- Total was Rs 9369 /- and he told that my advance paid recharge payment Rs 10, 000 /- has been adjusted in the maintenance through a Single prepaid Electricity Meter and If I will advance recharge by give more money thereafter Light will be re-connected. I was very flurried so he requested to reimburse my advance deposit Rs 20000 /- (Security amount of 1Kvh DG Connection ) & Rs 24000 /- (security deposit of 4 Kvh PVVNL connection ) that’s I paid to you in advance in before possession . He refused to give the refund of DG deposit amount Rs 20000 /- and Rs 24000 /- security deposit of 4 Kvh PVVNL connection and also ignored the request of separation of maintenance & Electricity through one prepaid Electricity meter. I said that you cannot take maintenance without give full amenities and completion certificate.

                13. Thereafter many time I did request to Mr Goldy Gupta and narrated their complete soreness and requested to take a justified action in this regard and sent several E-mails, Text to enquire about the said refund and amenities, but no satisfactory reply was received from their end regarding those quarries.

                14. That I further asked through the E-mails about the status of the preferences and amenities like Fire Fighting system, covered car parking, swimming pool and club facility, Refund that was deposited etc but neither they notices nor their employees given any satisfactory replies to those quarries and instead pressing to us to pay the maintenance dues immediately.


                15. Once again when I visited the said site of Project, they were shocked to see that none of the facilities like the park, covered car parking, swimming pool and the Club etc are nowhere to be seen for which I have already paid the hefty amounts and the same were supposed to be ready for use/occupation along with the possession of the said flat/unit.

                16. That I was further shocked to see that more than 150 families are living there and still Fire Fighting services is not working in entire project and height of the towers were raised to 16th floor, which was originally meant for 14th floor as was mentioned in Layout plan of 2010, without the knowledge, consent and meeting of the consumers and further noticed that builder have started constructing another set of Towers in the same vicinity and the consumers of the said new project have also been offered the same facilities and amenities which were originally meant for exclusively the existing consumers and thereby playing fraud and mischief with us and other consumers also.

                17. That on account of their aforesaid dereliction of duty and failure and neglect to reply the communications, breach the terms of flat buyer agreement and further demanding the exorbitant amounts again for park SUV Car in covered parking that’s amount Rs 2, 06, 180 /-already paid to them in the year of 2013 for covered car parking before handing over the possession of the said flat/unit of I indeed regrettable and highly unprofessional like.

                18. Thus, in view of the above facts and circumstances, it is apparent that they are guilty of committing various criminal offences of cheating, criminal breach of trust, mischief and misappropriation of property which has caused a wrongful loss, mental harassment and agony to us. However, they have not sent any reply of the above said E-mails, this apparently shows that since from the beginning, they have malafide intention to illegally collect the hard earned money of innocent person like us and further, charging the excess amount in spite of the repeated personal requests to withdraw the same. It is not a case of cheating only, their criminal intention is being prove also .

                Layout of this project is also having a big question. They should given all the facilities and amenities as mentioned above till before sale deed & possession

                Due to facing mental, economical harassment and agony, we want initiate action against them as criminal proceedings as are warranted by law, I am filing this complaint under the statutory provisions of Indian Panel Code 1860, The Consumer Protection Act 1986, The Company Act 2002 and Domestic Building Contract Act 1995, The Real State Act 2016 for redressed of my aforesaid grievances.

                A copy of this complains also forwarded to DM Ghaziabad by speed post & by mail at [protected]@up.nic.in & DGP FIRE SERVICE HQ & TRG. CENTRE 4TH FLOOR, INDIRA BHAWAN, Lucknow by speed post & by mail at [protected]@nic.in and has been retained in my office for further action.

                You are requested to take a strict action against FRESH FACILITY SERVICES MANAGEMENT PVT LTD AND Mr Goldy Gupta & Mr Nitin Gupta both are owner/ partners of both companies.

                NO RESPONSE FROM THIS SITE AND THERE IS A BIG CORRUPTION IN GDA GHAZIABAD ALSO... YET WE HAVE FILED CASE IN THE CGRF MEERUT AND WON THIS CASE. NOW BUILDER CAN NOT TAKE MAINTENANCE THROUGH ELECTRICITY PREPAID METER.

                    Dear sir i want to draw your attention regarding going on comercial activities in gc grand indirapuram society flat no. 3b 121. Daily around 50 people come in this flat we feel very unsafe due to this reason. After completing many times to rwa we have not received any positive response. After all this i am approaching you to resolve our problem. Hope for early response from your side.

                      Hello there,
                      I am a resident of nyay khand-ii, indirapuram, ghaziabad. i reside in 396-g, nyay khand-ii, indirapuram.
                      I would like to bring the fact in your notice that the street road condition of this area is so worst that we cannot even walk. children and old persons are facing a lot of problem in this rainy season while they are walking on the road.
                      So please construct these street road as soon as possible.

                      The second problem is the problem of cleanness of street. these street must be cleaned on daily basis in order to keep the health of the resident in good status but unfortunately these streets are being clean on weekly basis. and, surprisingly, mail roads are cleaned on daily basis where no one is residing and breathing for a long.

                      Please take care of these issues/problems at earliest.

                        I, nitin chauhan a resident of indrapuram ghaziabad by this application want to convey information regarding a grave fraudulent activity that has been done by a company named assotech ltd. which falls under your jurisdiction to investigate.

                        I had purchased a flat (number: f-014) from assotech ltd – a-12, sector 24, noida (pin: 201301) under their project named the nest – flexi homes, ghaziabad on march 2012. further this flat was allotted to me vide allotment letter no: 1292 dated: 28/09/2012 (copy enclosed with annexure-1). the said company had to give possession of the flat on or before 31.12.14 which has not been given so far. it has been more than 4 years now & the date of providing possession is also long gone. however instead of either giving me the possession of my flat or compensating me my invested amount the officials of assotech firstly tried to ignore me and asked for various extensions, but now they are now telling me that they have not even acquired permission from ghaziabad developmental authority (gda) for the particular tower. thus, now the company assotech is asking me for more money when i have already paid a substantial amount i was entitled to pay in accordance with the allotment letter.

                        The management of said company comprising of sanjeev srivastava managing director with connivance, with other director and employs with intent to deceive, to gain undue advantage to injure interest of creditors have misappropriated & embezzled funds aggregating rs. 64, 70, 69, 550/- and have committed fraud with public.

                        According to a very reliable source of mine, the owner of assotech ltd, is planning to flee the country wherein he is in gross violation of the recent “real estate (regulation and development) act 2016” according to which:
                        ‘separate bank account to deposit amount realised from allottees:

                        (a) open a separate account in scheduled bank to deposit 70%of all the realizations from allottees from time to time to be used for the project only on the proportionate percentage of completion basis.’

                        However, the owner of the aforesaid company under mala fide intention is trying to pilfer all our hard earned money.
                        In order to reaffirm as to what i have claimed, i would also like to inform you that this fraudulent company has charged an amount of 64, 70, 69, 550/- till now and sold 371 flats (documents of the same enclosed with annexure-2) under the name of same project. however even the construction of these flats is not yet completed.

                        Therefore assotech has not only deceived me but many more, from whom they have charged a good substantial amount from each purchaser promising flats to all of them. however like me, none of them have got the possession of their flats yet. thus a fraud of 64, 70, 59, 550/- has been done by assotech. they have been dodging the purchasers till now and also are misapplying their hard earned money. since you can see even after charging this huge amount from us, no work had progressed; no construction of our tower has even begun. but instead, the assotech amd is asking for more money.

                        It also needs to be noted that u/s 14 (3); u/s 18 & u/s 19 (4) of the aforesaid act that, the allottee shall be entitled to claim the refund of amount paid along with interest and compensation, from the promoter, of the promoter fails to comply or is unable to give possession of the apartment, plot or building as the case maybe, in accordance with the terms of agreement for sale or due to discontinuance of his business as a developer on account of suspension or revocation of his registration.

                        M/s assotech ltd, management assotech ltd, have transferred/syfined all funds recovered from honest investors for the said project to their other company namely assotech realty ltd, and they have launched other projects, assotech projects creta, in sector 135 noida on the basis whereof again they are befooling the public and collecting the money. photograph of their advertisement in this context is enclosed herein.

                        As it is very clear from the aforesaid facts, the company assotech ltd. has no intention whatsoever of handing over the possession of the flat, keeping on this mind i have already filed an fir against the fraudulent company. therefore, i urge you to take immediate action against this fraudulent company, by investigating about the under the various sections of real estate (regulation & development) act 2016. i am also attaching all documents necessary which would work documentary evidence in the court of law.

                          Just about 24-36 hours back, my caretaker and representative who has visted the place has come to know that one garbage loadable type bin has been installed just in front of my house at plot no. 12/45, raj nagar ghazaiaad, in all likelihood the handiwork and in collusion of corner house owners in 12/46 as he threatened my caretaker while getting installation done, removing the same garbage bin in the side lane in front of 12/46 raj naagar for decades and all of a sudden, just in front of my house, this has been unlawfully and unauthorised done, which will create ailments and will be a health hazard and spoil the beauty/image of my house.
                          I am a lady owner tuching 60 years of age and just adjoining my house is agrawal nursing home in 12/44 where patients will also get adversely affected.

                          In any event, i am concerned that overnight and in collusion, sucha new thing has come up and no wonder, other aspects may be checked up by dda, i[censored]nauthorised some piece of land has also been encroached while removing the garbge bin from previous location in side/backlane of 12/46 raj nagar.

                            We found that trucks started dumping the wastage at the back of ahinsa khand 2, near cloud 9 society. Due to which heavy smell started coming.

                            Dumping ground near residential area, will lead to illness and diseases to all age people. This is really unhygienic and unsafe for all residential people.

                            We request to take necessary action immediately.

                                      Dear Sir,
                                      I have been allotted a flat in Indraprastha housing scheme 844, 63M code. The flat no. is J506. I have sent surrender application on 11th February 2016 and it is received at GDA office on 15th February as per tracking status of speed post.
                                      I have written several emails to [protected]@gmail.com, but they are not able to solve the problem. The email id of Vice chairman vcgda.[protected]@yahoo.in is not working at all.
                                      I did not get my money back into my account, it has almost been 3 months.

                                        My complaint No. is GDA4900, which I posted on your department whatsup No. [protected] with the some picture o[censored]nauthorized construction on the open area of the building. One Shri Brijpal, (Supervisor) came GDA who silently met the accused party in their home. Never taken any statement from the complainant and the other resident of the building. As a result unauthorised structure has been plastered without any fear and preparation has been made for putting roof on it.

                                        Sir I reside with my family members on the upper ground floor. Three of my family members are in Govt. jobs and children are preparing for competitive exams. Any one can enter my gallary through this unauthorized structure and possibility of theft may take place. The incharge of P.P. Tulsi Niketan has already been informed reg. this. But no action has been taken place till date. It is therefore requested kindly check and verify the property papers of the culprit belongs to this property and immediate action may please be taken through a responsible officer.
