Subject: complaint for sale of defective/damaged motorcycle
To my client
I am hereby instructed by my client, shri tarakant dwivedi, aged about
49 years, residing at kalyan (East), district-thane to address you as
Under:
1. My client, shri tarakant dwivedi, had on 2nd december 2018,
Purchased a motorcycle, model honda dream yuga from your
Vj honda showroom, having its address at shri sainath complex,
Shanti nagar, ulhasnagar – 3, district – thane, maharashtra, bearing
Chassis number - me4jc58ecjt015193, engine number –
Jc58et7015231 & registration number - mh05 - dx - 3605.
2. My client states that from day one of the said purchase, he
Observed and found noise emanating from the rear wheel of the
Said motorcycle. He found the noise to be unusual and hence he
Reported the same to the showroom’s service centre during the first
Scheduled service.
3. My client states that the service advisor who attended him
Mentioned that this was just a minor problem and that the noise was
Emanating due to chain cover coming in contact with the chain.
Further, at the time of delivery of the motorcycle from the said service
Centre, my client was assured by the same service advisor that the
Problem has now been rectified and that my client will not
Experience the same problem of motorcycle making unusual noise
Again.
4. My client further states that the same noise started emanating
From the next day itself and it was very clear that the problem in
Question was not solved nor satisfactorily looked into. My client
Bought this to the notice of the service advisor at the time of 2nd
Service. This time, the service advisor came up with a completely
Different reason for the noise. My client was told that the noise was
Emanating because grease was not applied properly on the rear side
Of the motorcycle and hence it is causing friction which is leading to
The noise. Once again when the motorcycle was made available to my
Client during the delivery from the service centre, my client was
Assured that the problem has now been rectified.
5. My client further states that once again, on the next day, the
Same noise started emanating from the same rear side of the
Motorcycle and he immediately approached the service advisor and
Complained to him. This time the service advisor checked the problem
And informed by client that the reason the problem has not been
Solved because they have accidently applied more grease than needed,
Leading to over lubrication. My client was further assured that once
The grease would dry out, the problem would automatically be solved.
6. My client states that he believed the service advisor and waited
For a few days. However, the problem was not rectified and the rear
Side of the motorcycle was emanating a continuous unusual
Noise. My client states that he once again approached the honda’s
Service centre, where the service advisor checked the bike. The
Service advisor this time came with a completely different story. My
Client was informed that this noise is not a big problem at all. He was
Told that since the motorcycle was new, this type of noise is normal,
And once the motorcycle is run for over 500-1000 kms, the problem
Will automatically be solved and the noise will stop emanating.
7. My client states that he took the service advisor’s word at face
Value and rode the motorcycle diligently. However now the
Motorcycle has been driven for over 3000 kms and yet the issue of
The noise persists and it is clear that this has not been resolved.
8. My client further states that he complained about the same last
Month to the service centre in-charge, being fed up of the noise and
The lack of resolution from your end. This time service advisor
Inspected the vehicle and reported that this type of problem has been
Reported with another vehicle of the same make as well. He also
Added that the problem of persistent noise has occurred as the axle
Of the vehicle is damaged. My client states that at the time of taking
Delivery of the bike from service centre, he was once again assured
That the problem has been looked into and solved.
9. My client states that on next day he received a call from honda’s
Customer care and he was asked if he was happy with the service
Received. My client honestly informed the caller that the problem
With the bike still persists and that now he is contemplating legal
Action against the showroom. The caller requested my client to
Contact the service centre manager. My client states that some
Time later, he received a call from a person claiming to be manager
Of honda’s service centre. My client was persuaded to get his
Motorcycle to the service centre one more time. The manager
Assured my client that the problem of noise will be permanently
Rectified now.
10. My client says that on assurance of the service centre manager,
He took his motorcycle to the service centre and once again the
Motorcycle was handed over to top mechanic mr. Ajay
Vishwakarma. My client says that this time mr. Vishwakarma was
Evasive in his replies. When my client asked him what the problem
Was, he was given a different reason once again. My client was told
By mr. Vishwakarma that the chain of the motorcycle is touching
The cover and that they would rectify it. My client states that he was
Handed over the vehicle after 30 minutes. He was asked to check if
The problem was rectified. My client took a round of the vicinity and
Then once again told the manager of the service centre that the
Problem was not rectified and that the problem was still persistent.
Despite that, the manager said that the problem would disappear and
That my client should drive the bike for a few days.
11. My client further states that on 22nd august 2019, he once
Again approached the service centre and complained about the noise.
This time, mr. Pradeep, the service advisor said that this problem of
Persistent noise is a common problem, and that there is no solution to
The noise.
12. My client states that it is pertinent to note that the problem with
The motorcycle has not been resolved till date. Every time the
Service centre advisors have come up with inconsistent and different
Diagnosis and none of them have been able to solve the problem of
Noise which my client has been experiencing.
13. My client is now apprehensive that there is a major problem
With the motorcycle, either mechanical or structural which your service
Centre is either deliberately hiding, or are incompetent to identify and
Solve.
14. My client further apprehends that he has been sold a defective
Product, and that the vehicle was defective right at the time of
Purchase, and that the service centre guys are lying to my client to
Hide the defects and are unable to take care of the problem at hands.
My client further feels that if the vehicle is defective and the noise is
Persistent, it causes immense distraction to him while he is riding the
Motorcycle and this may lead to accidents which might be fatal or
Injurious to my client as well as others. Further, if the vehicle is
Defective and faulty, my client would be blamed for the accident for
No fault of his.
15. My client states that your showroom has either deliberately sold a
Substandard and defective product to my client or are unable to
Rectify the problem of persistent noise from the vehicle. One of the
Service centres accidently mentioned that the axle of the bike is
Broken and since that is an expensive part to replace, your showroom
And the service centre are in cahoots and are not performing the
Necessary repairs to the vehicle in order to save money, thereby
Putting my client at a risk of accident and injury. My client has now
Lost faith in the ability of your service centre to rectify the problem.
16. On behalf of my client, you are hereby called on to either replace
The vehicle at no cost to my client. You are hereby informed that in case you do not do the needful, my client reserves the right to initiate legal proceedings against you and your company, along with all the employees, for engaging in business malpractice, sale of a defective product and breach of trust. You are therefore requested to take note of the same, and acknowledge this notice and replace my client’s motorcycle within 15 business days from the receipt of this notice, failing which my client will be forced to explore all available legal options and pursue the same.

Previously I gave my car for service on Honda service centre but someone took car's tool kit. I saw it today when one of tyre got punctured that too on the way and had lots of trouble changing the tyre. This is so unprofessional of the service care centre.
