Hi Team,

I purchased a Kutchina Chinmey before 2 months. However it is not working from day 1 but the dealer is not ready to accept it and he is not exchanging it after couple of follow ups and reminder. Please can you look into this matter immediately to avoid to register this complaint in consumer court against the company and the dealer.

The fact of the case in brief is that complainant purchased a kitchen Chimney being Model No.Kutchina[protected] Stanza SS from o.p.no.1 on 06.09.2015 which was manufactured by o.p.2. The price of the Kutchina Chimney was 15, 800/-. Just after 20 days from the date of installation complainant noticed that one fan motor was not running. On 08.10.2015 complainant informed the matter to o.p.no.1 and as per their advice complainant lodged a complaint and docket being no. AB/70/1015 was provided by Kutchina Customer Service. Complainant demanded the replacement of the unit since fan motors are the main parts of the chimney. On 15.10.2015 there was a telephonic conversation with o.p.no.1. Then complainant came to know that the chimney motor was totally defective. Then complainant understood that it was previously known to o.p.no.2, since there was no inspection from their part till that day. Thereafter op.no.2 tried to replace the defective motor with a repaired old one. But complainant did not accept that. Since complainant did not agree with the proposal, the Zonal Manager threatened the complainant.

On 15.12.2015 at the time of redressal before CA&FBP Department, Government of West Bengal, the representative of o.p.no.2 told that which docket was generated that one was a dealer service docket and o.p.no.2 is not responsible to replace the defective goods. Finding no other alternative the complainant filed the instant case praying for direction upon o.p.s to return Rs.15, 800/ or to replace the old Kutchina kitchen chimney along with compensation of Rs.25, 000/- and litigation cost of Rs.10, 000/-.

Both o.ps contested the case by filing support w/v.

In their w/v o.p.no.1 denied all material allegation inter alia stated that the case is bad for non-joinder and misjoinder of necessary parties. The case does not fall within the purview of CP Act since there is no gross negligence, unfair trade practice and deficiency in service. Complainant filed the instant case only to harass op no.1 unnecessarily. O.p. sent an Engineer to examine the defective goods and to repair the same. But complainant did not allow the said Engineer to examine the chimney. O.p.no.1 also stated in their w/v that packed goods are come for selling to the customer and o.p.no.1 is not allowed to open the pack to examine the goods. They are the dealer of various company to sale the goods. Hence the complainant is liable to be dismissed with cost.

In their w/v o.p.no.2 stated that they requested the complainant to allow them to check the machine and repair the same after receiving the complaint regarding the chimney. O.p.no.2 sent their mechanical expert at the residence of the complainant on 29.10.2015 and 09.11.2015. But the mechanical expert was not allowed to check the machine. Since there was no scope to investigate the machine, O.p.no.2 could not render the service in favour of the complainant. Since there was no report by technical expert the case may be dismissed with case.

Decision with reasons

We have gone through the pleadings of the parties and materials on record evidence in particular. It is admitted fact that the complainant purchased a Kutchina Chimney from o.p.1 which was manufactured by o.p.no.2 on 06.09.2015 upon payment of Rs.15, 800/-. Only after twenty days after the date of installation one motor stopped functioning. Accordingly complainant informed the matter to o.p.no.1 and a docket being no.AB/70/1015 was generated through Kutchina Customer Service. It is also admitted fact that the technician of o.p.no.2 visited the complainant’s residence on 29.10.2015 and 09.11.2015 and the representative of o.p.no.2 offered for replacement of the defective fan motor only. Since the chimney was purchased only a few weeks back complainant did not agree with the proposal and requested them to replace the chimney with a new one. But o.p.2 did not agree with the proposal of the complainant.

At the time of hearing Ld lawyer for the o.p.2 submitted that o.p.2 wants to replace the chimney in question by a new one. Since they are offering a replacement with a new one so there is no question of deficiency in service and therefore no question of giving compensation also arises at all. Complainant in person was present at the time of hearing and he argued that he suffered from the very beginning after the purchase of the chimney i.e. 15.09.2015. At the very beginning complainant opted for replacement of the chimney in question but o.p.2 did not bother his request. If o.p.2 replaced the same at that time complainant would not have filed the instant case. Complainant suffered harassment and mental agony due to the act of o.p.2. So we find the deficiency in service on the part of the o.p.2

O.p1 is dealer of o.p.2 and they only sold the chimney in question in a sealed pack. After the chimney was delivered there is no liability of o.p.1. Rather, when complainant contacted with them after nonfunctioning of one fan motor of the chimney. They contacted with the service centre of o.p.2 and accordingly a docket no. was provided to the complainant. Hence we have not observed any deficiency in service on the part of the o.p.1.

In view of above we find deficiency in service on the part of o.p.2 and as such complainant is entitled to get relief.

As a result the complaint petition succeeds.

Hence, ordered.

That the case no.08/2016 is allowed on contest against o.p.2 with cost and dismissed against o.p.1 on contest.

The o.p.2 is directed to replace the Kutchina Kitchen Chimney of the complainant by a new one of same specification within 30 days from the date of order. After the installation of new chimney o.p.2 will collect the old kitchen chimney from the complainant’s residence.

O.p.1 is also directed to give Rs.3, 000/- for compensation for harassment and mental agony caused by them along with litigation cost of Rs.1, 000/- to the complainant. O.p.2 is also directed to pay the aforesaid amount within 30 days from the date of communication of this order i.d., an interest @ 10% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.

Supply certified copy of this order to the parties free of cost.

      Docket no PD/379/0219.It is a fraud company.They have no technicians. They just cheated the customer.Whenever I call they assured me to give the service. But still now no results.They are too much liar. I bought Golde-x.on6/10/2016.At the selling time they assured to give the service time to time.But now they just harassed .Everyone should know about them and be careful of such type of fraud company.

        I am not a person who is complaining in nature, I tried my best to coordinate with Kutchina (Bajoria) but finally i found no other way rather complaining.

        Couple of points why I am complaining -
        1. They were not ready to start work on the date of work agreement. I took a day off because they said they will be working from 23rd/24th Nov-2016. I called them on the same day and they said they can't come because they are working in some other place. I scold them over the phone then send somebody to work on the same date. Later on i cam to know the lady (Subhra Banerjee) who was in charge of the work was on marriage leave.
        They should have inform me earlier then I can plan accordingly. This was a total mismanagement.
        2. They took more time to complete my kitchen work, every time I need to followup with them.
        3. They have completed kitchen work by end of December but i have not received a completion certificate yet.
        4. I bought one chimney (ARC) and one Hob (HB 4BKDLX) but I am yet to receive the Hob.
        5. They don't even inform me about the incident that they can't deliver the Hob now, every time i need to call them.
        6. In between i have to mention that the total payment was completed by end of November 2016 - check payment. After that it is your duty to follow them up to get the work done.
        7. I have not receive any demo for the new chimney.
        8. Again I came to know the lady has resigned job, and no proper handover took place.
        9. The lady gave me a store manager number - Arindam and asked me to contact with him. I contacted with him he again gave me a number of another lady Rupshi and asked me to contact with her. Now you understand how good they are in management work..bunch of A******. sorry I i could not help me.
        10. The story is still continuing ... they said the hob model is not in stock now, come to topshia and see another model. I said i can not go there, let me know when it is available in chinarpark - Bajoria office. Because I contacted chinar park office and it is close to my home. Even after 6 months they can't display a product in chinar park ... what type of business they are doing !!!
        11. I asked Mr. Arindarm to work on the pending items and complete my kitchen work - Completion certificate, Demo on Chimney, New Hob delivery..
        He told me he will call me back in 5 minutes ... but even after 2 hours he is not available. Again I called him and he was not answering my phone ...
        So i decided to complain here ...

        I would not suggest anybody to get the product from them ... They are totally people dependent not process oriented. This is not a sign of a good brand. Once the responsible person is resigned in between your work, you will be in great trouble.
        They need to seriously think about their management ... this is the time to restructure there people at the top.

        I brought a kuchina purica water purifier from sunny traders, Agartala. Also we have paid them in advance for servicing but every time they provided with bad servicing, the water leaks evrytime and today my father slipped as he entered the room. Also they don't receive our call and behaves very rudely. Please do take the matter seriously .

          I purchased a Kutchina ARC chimney in the year end of 2015. While purchasing the product I was being told that 3 servicing will be provided free of cost. However, the free servicings were not free provided at all except the 1st servicing and that too with great difficulty.
          This is how we people are being fooled to purchase the product but without after sales service.

          I am somnath biswas pH. [protected] complaint regarding cleaning of my chimney. The man which you have sent does not know how to clean and simply cleaned the chimney cover with hard scrubber and put scratch. Now tell me who will replace the cover.

            only fraud and corrupted company can show such type of indifferent attitude.
            why efficient technicians are not appointed by the company to solve such problem?
            why the company is waiting for expiry of warranty period?

            On 15th December, 2016 I registered a complaint for my HOB HB4BECOGO but the said problem was not solved due to negligency on your part. Is this a sign of after sale service? This incident proved the company is looking for profit motive only. Post your comment .

                I have paid 3 years AMC Charges in advance.But every time they do not provide service after booking.In all occasions I am to give reminder for atleast 5 times during a period of 3 months.This time again I booked on 11.01.17 vide docket no.[protected] but no one came till date.I lodge one complain at [protected]@kutchina.com on 27.01.17.After 2nd reminder they apologize for delay but till date they took no initiative to solve my problem.Till now I send 4 reminders but they are mum.They must pay financial penalty to harass the customer year after year.

                      In gurantee period we have complaint to your rourkela distributor /service agent anshad khan for break down of chimney 2013 but service man came & just cleaned the chimney, after repeatedly chase up of non heating of chimney & self discharge is not working is is being ignored by your local service people, after some time they came and told the card is not working, and charged for the card, and now finally they changed the motor with second hand motor & asking to change the heater coil with charging with 7000.00 for heater coil, which is not ethically right.Please look into the matter and short out our issue under warranty.

                            Panel Damaged (cream colour), Few Channels have rusted (Hettick SS Channels), Some rusts in Handles (Hettick SS Handles) . The Kitchen was purchased from M/S Oliya Appliance, Asansol on 30.01.2012. Complain had been lodged in Toll Free Number (Complain Number MTP/25/1216 dated 05/12/2016). Before this we had been complaining to M/s Oliya Appliances for the past 3-4 months but they have not taken any action. The Contentions by M/s Oliya Appliances are 1. Cream Colour Panel cannot be replaced as the company has stopped the manufacturing of the said colour 2. Channels could be replaced but would be of an inferior quality as to what had been supplied earlier 3. Handles design have been changed, hence cannot be replaced. A mail had been also written to [protected]@kutchina.com on the 20/12/2016.
                            please look into the matter and please resolve the said issue.

                              To begin with the gas oven is of very poor quality. The gas burners completely worn off in just a year. The customer service is equally bad. They ran out of spare parts. Although parts are of poor quality, they are massively expensive. And once you are struck with the gas stove, you will have to buy their spare parts, which is recurring expenditure.

                              Each time there is even minor problem, you are required to pay 375 rupees service charge. My parents who are old, live alone, and do not understand the operations properly. The service guy just changed the battery and made them pay 375 as service charge, plus 17 rupees for battery.

                                I have an old Kutchina chimney. I wanted to service it so called up the company and a sales person came and told us that the earlier model (kutchina sleek) is very old and spare parts are not available and there is an exchange offer available so we can have Smartec BK model for 22, 999 and if we exchange the old chimney then we can have it for 20, 999. So we did pay them some advance. But we got little suspicious as we were not shown any pricelist, so were not sure if the price was correct or not.
                                Therefore we did some search on the internet and realised that company does not display the MRP anywhere. I called up the call centre and they refused to tell me the price, instead told me that an agent will get in touch with me.
                                Meanwhile I also checked for online price and the price for the model Smartec BK varies from 14, 447 to 15, 500.

                                So now I am having a doubt as to what is company policy of not displaying the price either in their website or in the brochure or for that matter even when someone calls up their call centre.
                                Is it that they plan to cheat the customer as much as they can ? Because a gullible customer will have to trust the sales person for the price and will never know if the price quoted by the agent is genuine or he is making a big margin for himself.
                                I encountered them with online price and they tried to scare me by saying that online product are not genuine.

                                So I have a serious doubt on the sale strategy of Kutchina and I feel they are not being fair to their customers and trying to make fast buck by trying to cheat their customers.

                                I am not sure if this will be read by some responsible person in the company. Still, I am writing this because I am so fed up with your agents in Kolkata, e.g., Ace Marketing of 39, Sukanta Park, Kolkata-101.
                                I bought the model STANZA SS in November, 2012 and entered into a service contract with them. Their service has been extremely unsatisfactory throughout, to say the least. When they do not turn up for servicing, we have to make umpteen number of calls which go unanswered.
                                The machine has not been serviced for a long time and is gathering oil deposits. Soon it may stop functioning.
                                Will anyone kindly look into this and have the needful done immediately?

Service centre personnel took the motor for replacement however it seems they will take another week's time at least before they can replace the motor.in the mean time my house is getting badly damaged.                                         Kutchina provides worst service and they are degrading their name day by day. Also they are really poor in customer handling.
                                        I just had a worst experience with a Kutchina serviceman whom we have booked for gas oven problem. In spite of fixing the issue, he had taken 400 INR as service charge and didn't gave a document for this. He had promised to visit our house the next day to fix this, but when we called him the next day he denied to come and assured us to return the money back in next 2-3 days as he can't handle this. When we called him after 4 days he denied all his promises and started using slang.

                                        Is this a way to handle a customer? Are the top level management are doing nothing and they only recruiting these nuts who knows nothing except to cheat customer.

                                        If this continuously goes on then Kutchina company will be locked up one day.Very poor service I must say.

                                        I request the forum to ask the Kutchina grievance manager to take this seriously and take strict action against the serviceman who did all this thing, and either fix our gas oven problem or return back our money.

                                        Having a worst experience in after sales service; after repeated complaint to "Bajoria Appliances Pvt.Ltd., Guwahati-781007" no one has turned up to repair my chimney which is lying ideally for a long time.If my complaint is not attended within 21.12.16 than I will have to approach the consumer forum.
