It is to bring to your notice that i have booked a new maruti suzuki zxi amt car (Petrol) with your authorized dealer, m/s automotive manufacturers private limited, nagpur on 25th august 2018, which has been recorded to have been booked on 27th august 2018.
The details of payments made prior and subsequent to approval of car loan from sbi, belapur bhawan branch, mumbai, are indicated below:

Delivery of the car was to be given on 13th september 2018, ganesh chaturthi, an auspicious day and accordingly we visited the show room of automative manufacturers private limited. All the formalities of delivery of vehicle were completed and we were taken out of the show room for formal delivery of the car. I observed and noticed that the body of the car had many scratches on other parts including distinct dent on right front door and a part on the bonnet adjacent to the right front door. On pointing out these defects, the person responsible for the pdi stated that the damage has been done by the workmen in the workshop after completion of pdi by him. On my stating that i have paid full price of the car without any comprise and that accordingly i shall not make any compromise with the quality of the product and that i shall not take delivery of car with damaged body parts.
On my persistent refusal to take delivery of the car with damaged body parts, the representatives of automotive manufacturers private limited assured me to replace the damaged body parts with new ones and deliver the car on 14th september 2018 afternoon.
They were kind enough to provide us with one car (Vitara brezza - no. Mh 40 ar 5895) for coming back to my home as well as for its use till delivery of the new car.
Having not received any call for delivery of the car, from representatives of automotive manufacturers private limited, nagpur till 2.30 p. M. On 14th september 2018, i made a call to mr. Ankush and mr. Sameer on my own, two to three times, duly reminding them to call for delivery during daylight so as to observe if the replacement of damaged body parts have actually been done honestly. Despite reminders, the call for delivery was received from mr. Ankush as late as 6.10 p. M. Almost at the time of sunset. Taking into account the time to reach the show room for delivery, i denied to visit the show room as it would have been dark, after sunset.
I further stated to mr. Ankush and subsequently to mr. Sameer that my visit to the show room for delivery would be subject only to produce the existing damaged body parts as a proof of actual replacement. Mr. Ashish contacted to me subsequently. No satisfactory explanations were, however, received from any of the representatives of automotive manufacturers private limited including mr. Sameer, mr. Ankush and mr. Ashish. Mr. Ashish, on the contrary, said that the existing damaged body parts have been repaired, dented, painted and fitted to some other car and therefore cannot be produced for verification. On insisting not to complicate the matter, i informed him that i have since lost trust i shall not take delivery of the car without having seen the proof of replacement of existing damaged body parts. He assured to call back after some time, which never happened and he did not respond till now.
I, as a result, sent a message each to mr. Ashish and mr. Sameer stating the non-receipt of any call from them in this regard. Subsequently, i received a late call from sameer only, who requested me to come for delivery at 11 a. M. On 15th september 2018 and that he would show the existing parts. It may please be noted at this stage that the statements of sameer differs from that of ashish and are contradictory, duly confirming that they are lying about having replaced the existing damaged parts. Rather, their statements confirm the doubt that the damaged body parts have been repaired, dented, painted and fitted again and not replaced. Apparently it is an unfortunate case of purchasing an old car from a workshop after denting and painting of a new car depreciating its value before delivery rather than purchasing a new car from a show room of maruti suzuki limited after paying full price for a brand new car.
I visited automotive manufacturers private limited again today, the 15th september 2018 for delivery after receipt of a call from mr. Sameer and mr. Ankush bahise duly informing that existing old parts replaced would be available for us to see as a proof of replacement. To our surprise, the existing old parts replaced were not available for us to see vindicating a blatant lie of representatives of automotive manufacturers private limited. They initially stated that the existing old parts replaced are in the workshop and thus cannot be shown today but finally admitted by mr. Mishra in presence of all other representatives of m/s automotive manufacturers private limited. Mr. Mishra also agreed to replace the parts in my presence subject to availability but without giving reasons for the replacement that the damage was existing prior to delivery. I, however, desired that his letter should state the fact that the damage was existing prior to delivery of the car for which he did not agree. The enclosed/ attached copy of mr. Mishra vindicates the fact that damage was there and that parts were not replaced. The new car was, thus repaired through denting and painting to remove the scratches.in the absence of inclusion of fact of the case, delivery of the vehicle could not be made possible.
I, therefore, request you to peruse the matter at an appropriate level and ensure delivery of a new factory product and not a repaired workshop product as the price paid by me is for new product.
