Ideally, the entire right to the land should be transferred to the society after the conveyance deed is executed. This is in line with the common practice and the intent behind the formation of cooperative housing societies. We believe that this ensures a transparent and fair distribution of land ownership among the society members, leading to more equitable management and decision-making.

1.Clause [Conveyance to the Society and Other Societies: 14 (i) line no 6-8]: This clause allows the builder to retain ownership of the land even after the execution of the conveyance deed, granting them an undue advantage and creating an imbalance in the rights and obligations of both parties.

On or before 31/12/2022 or within 3 months from the date of issuance of the full Occupation Certificate or the full Completion Certificate with respect to the Real Estate Project, whichever is later or latest, or as may be prescribed by the applicable laws, the Real Estate Project with the common areas, facilities and amenities described in the Fourth Schedule hereunder written shall be conveyed to the Society vide a registered indenture of conveyance, provided however that the basements, podium and stilts shall be retained by the Promoter and shall not be conveyed to the Society (“Society Conveyance”). The Society shall be required to join in execution and registration of the Society Conveyance. The costs, expenses, charges, levies and taxes on the Society Conveyance and the transaction contemplated thereby including stamp duty and registration charges shall be borne and paid by the Society alone. Post the Society Conveyance, the Society shall be responsible for the operation and management and/or supervision of the Real Estate Project including any common areas facilities and amenities and the Promoter shall not be responsible for the same.

2.(ix) At the time of execution of the Society Conveyance, the Promoter shall handover lawful, vacant, peaceful, physical possession of the common areas of the Real Estate Project as detailed in the Fourth Schedule hereunder written to the Society, save and except the basements, podium and stilts retained by the Promoter; 


3.(xv) The Allottee/s shall not take any objection, on the ground of nuisance, annoyance, and/ or claiming any rights, of easement, and/ or any rights in nature of an easement and/ or obstruction of light, air, ventilation, open space and/ or open area, and/ or on any other grounds, of any nature whatsoever and/ or shall not directly or indirectly do anything and/ or shall not ask for an injunction, and/ or prohibitory order and/ or calling the Municipal or any other authorities to issue stop work notice, and/ or withdraw and/ or suspend or cancel any orders passed and/ or approved Plans so as to prevent the Promoter, or any of their nominees or transferees, from developing and/ or to carry out construction, on the Larger Land. 


4.(xvi) It is further agreed that the Promoter shall not be required to give inspection of the said Premises to the Allottee till the time the Promoter calls upon the Allottee to come forward and take inspection of the said Premises before offering for possession.

5.Formation of the Society and Other Societies: 13 (vi)The unsold areas in the Real Estate Project or elsewhere, save and except the municipal taxes at actuals (levied on the unsold premises) and a sum of Rs.1000/- (Rupees One Thousand only) per month in respect of each unsold premises towards the outgoings.

These clauses describe the unfair or unfavorable condition, and explain why it is problematic or disadvantageous to the homebuyers. This condition undermines the rights and interests of the homebuyers, and it is important to rectify this to bring about fairness and compliance with the RERA Act.

Subject: Request for Refund of Additional Interest Charges Levied Unfairly Due to Non-Compliance with RERA Norms and Tri-Party Agreement


Dear Madam/Sir,

I hope this letter finds you well. I am writing to bring to your attention a matter of significant concern regarding my recent interactions with your company in relation to my property at Flat No A 1003 IVY Tower, Crompton Greeves Compound, Kanjurmarg East, Mumbai 400042.

As per the terms of our Tri-Party Agreement and the established norms of the Real Estate (Regulation and Development) Act (RERA), it was clearly stipulated that certain documents needed to be produced, and specific visits, including flat inspections and mortgage-related visits, were to be conducted within a specified timeframe. Regrettably, these essential aspects of the agreement were not adhered to, resulting in additional interest Rs.105635/- charges being unfairly levied on me, further compounded by non-compliance with RERA norms.

I would like to highlight the following issues:

Non-Production of Required Documents: Despite the clear terms of the agreement and RERA norms, I have not received several crucial documents within the agreed-upon timeline. This has not only caused delays in my mortgage process but has also led to additional interest charges imposed unfairly due to extended processing times.

Missed Flat Visits: The agreed-upon flat visits, which were crucial for inspections and evaluations and are also mandated by RERA, were not carried out as per the schedule outlined in the agreement. This delay in assessing the property's condition has further contributed to additional interest charges levied unfairly on my mortgage.

Mortgage-Related Visits: Similarly, the required mortgage-related visits, which are in accordance with RERA norms, were not conducted in a timely manner, resulting in the mortgage process taking longer than anticipated. Consequently, additional interest charges were imposed unfairly during this period.

Due to these deviations from our Tri-Party Agreement and non-compliance with RERA norms, I have incurred unexpected financial burdens in the form of additional interest charges, which were unjustly imposed due to actions (or lack thereof) on your part and a breach of regulatory standards. Please find the attached email & other relevant document attached for your referance.

I am hereby formally requesting a refund of the additional interest charges that were unjustly levied due to these lapses in compliance with the agreement and RERA norms. I believe it is fair and just for your company to assume responsibility for these financial burdens, as they were a direct result of actions taken by your company.

I kindly request that you review my case and promptly process the refund for the additional interest charges. This will not only help alleviate the financial strain caused by these charges but also reaffirm our commitment to upholding the terms of our agreement and complying with RERA norms.

I trust that your company values its reputation for integrity and professionalism and will take the necessary steps to address this matter without further delay. Hi Lucy Madam,

I visited today and waited more than 2 hours for the key whereas Rajeev was @ 905 IVY and the customer raised the same concerns about the quality of workmanship & tiles.
I came to know from Rajeev that approval for replacing the wooden flooring and the rest tile is yet pending from the management side. It has been more than 3 months since I brought the Runwal Project team's attention to an agreement on vitrified tile in both bedrooms. Not sure how much time is needed to resolve below 4 faults
1. To make a refund of the illegal interest charged (yet to receive receipt of Rs.1.05 Lakhs)
2. Replace wooden flooring with vitrified tiles per agreement.
3. Replace poor-quality tile in the hall & passage of the kitchen to the entrance of both bedrooms with Marble,
4. Possession: Your team has been making false commitments since flat booked on 14th Aug 2022 that keep changing every 2 months & another fake commitment comes into the picture (an entire mail trail regarding the same is there).
Ideally, Runwal Bliss must pay back for the delay in possession (Since Oct 2022 till today and the date of realization) along with interest (per RERA) and rent from July 2023 upon failure to provide quality work & possession on time.

I have already requested to complete the above 4 requests on or before 29/10/23 and to date, visited more than 10 times whereas the Runwal Bliss team continues to close tickets via email trail instead of acting, providing approval for the entire flooring tile replacement with quality of material & workmanship.
After getting fed up with so many follow-ups and if things are not getting delivered that is minimally expected quality work from the Runwal Bliss project team. Upon losing patience any customer may raise their concerns with RERA and other legal forums.
Hence would suggest instead of testing the patience of customers try to deliver quality products and materials that represent the Runwal Brand.
Please find the attached video of Sample flat 101, IVY shown at the time of booking which is clean today & kept ready for possession.

Really appreciate for sending hard copy of payment receipts after 2 months of payments.
Upon my visit to my flat A 1003 dated 22nd Sept 2023 tto look on resolution offered by Runwal team after 3 weeks, only few things are carried out whereas attached concerns were left unattained.
Requesting you kindly do the needful on or before 29th Sept 2023 as I want to take possession asap.

Will share those videos in mail trail due to limitation of 5 MB per email.
As mentioned earlier about wooden flooring, still its not replaced with Vitrified per agreement.
If you look at current flat finishing & flooring material, Ideally Runwal Bliss Project management team should have not only come forward & replace this degraded quality material with marble in past 3 weeks but also cloud have returned interest charged which was act of 1. Delay in submitting required documents to Canara Bank by Runwal Bliss management team, 2. The rescheduling flat visit 5 times to Bank Evaluator.
Now its almost 6th time I have been requesting to resolved issue of poor quality of material & finishing of work done since past 3 months and only tactically pushing the customer to take possession with degraded quality of material & work by closing request ticket been done by Runwal Bliss team, hence customer is getting suffered unnecessarily.
Kindly replace entire flooring of Flat A1003 with Marble asap and handover possession asap.

    I am writing this regarding the refund of the booking amount for Unit no:T34-0903 on 9th Floor at Runwal Gardens - Tower 34. I had booked the flat on[protected] and made a payment of 60, 497 Rupees as the booking amount.

    I regret to inform you that due to an unforeseen family medical emergency, we have had to reconsider our decision to purchase the property. Given the circumstances, I kindly request your assistance in processing the refund for the amount I paid towards the booking of the unit.

    I have made numerous attempts to contact various Runwal Group representatives, including the Head Office, Twitter, CRM Team, and Sales Team, in order to resolve this matter. However, I have not received any response or confirmation regarding the refund process.

    I must emphasize that I am currently facing financial difficulties, and the refund of the booking amount would greatly alleviate the situation. I understand that there might be certain terms and conditions associated with the refund process, but I sincerely hope that you can empathize with my situation and help expedite the resolution.

        Hi,

        I have been following up with the Runwal team to make the TDS payment, it’s been more than 2 weeks but am not getting any help or support from them.

        I was told that I need to contact one of their CA’s who will charge me some nominal amount to make the TDS payment, my question is why should I contact someone else, why isn’t the Relationship Manager equipped to help the customer.

        When I send them an email on customer.[protected]@runwalgroup.in, I get a reply stating that “In order to auto-route this mail to your designated Relationship Manager so as to ensure a time bound response, you are requested to write in from your registered email ID that has been listed in our records or by logging in from your Customer Portal.”

        My registered email ID is Derrick.[protected]@Gmail.com if they are saying that it’s not the registered one then how come I am getting emails on the same email address from them.

        I have also tried to log into their Customer Portal where I have to enter my email Id & password but I have to set up a password to log into the portal, however when I click on the forgot password it states that it will send a link on my email address which is Derrick.[protected]@Gmail.com & I will need to follow the steps to reset the password however I have not got any emails to reset my password.

        I had escalated this issue last time as well to Zeeshan from Runwal however I did not get any assistance.

        I wouldn’t usually make a complaint however it’s really frustrating as am getting a total run around & that to for making a payment, imagine what would happen if I were to receive something from them.

        Hoping that someone from Runwal will come forward to help me out with this situation.

          I have booked a flat in Runwal City - Dombivli. this is ready to move flat, while booking it was told to me that with in 7 days of loan approval i can register for flat. I got my loan approval with in 7 to 8 days, since then i am checking when we can register and get this flat. almost 20 days passed, but no one have clarity when can i register. i need my money refund with one month interest...

          This is very sad to inform that RMs and other internal staff is ruining the name of well known builder.
          I have done a booking in Runwals garden, Dombivali east. While booking (Aug 2022) sales executive named Akanksha was assuring thet the possession will be given by Dec of 2024. After enquiring get to know that possession will be expected by Dec 2025 or first half of 2026. This in totally inappropriate information conveyed.
          Secondly from the month of April RM was chasing to provide sanction letter as agreement will be done in June and first demand will be raised in August month. Now when I am confirming when the first order will be released no one is assuring that it will be released before August. I have the sanction letter dated May 2023 having validity of you months. I am continuously following up of this for confirmation via email however no one is responding and answering properly.

            I had booked 2 BHK flat 653 Sq ft carpet in Runwal garden T5-1006 on Nov-19.

            1. Your channel partner sold me 653 sq. ft. carpet area of T5-1006 without plan approved by RERA.

            2. They will charge Rs.1 lakh extra (669 Sq. ft. carpet area cost 60, 40, 000/-all include)

            3. We paid the 10% value on 27th Feb.2020 but they will delay agreement by 7 Months (Agreement done on 22nd Sep-2020) due to revised plan approval not received from RERA.

            4. At the time of agreement, there is a scheme running of 1.5% stamp duty waiver & we received mail confirmation from your CRM team on 24th Nov.2020. That we have eligible for this scheme & 1.5% stamp duty amount adjusted at the time of possession.

            5. I have received the final demand against possession on 18th April 2023 after several follow up with CRM and I have already paid the final amount with extra charges on 15th April.2023. Excluding CCAM charges.

            6. I am visited to CRM office on 28th April. 2023 for 1.5% stamp duty & 1% referral benefit adjustment and paid balance CCAM charges after deducting 1.5% stamp duty & 1% referral benefit.

            7. I am continually follow up with CRM team regarding 1.5% stamp duty scheme adjustment but still this amount not adjusted in my account and they will hold my possession.

            8. On 31st May.2023 CRM called and inform Audit has rejected the approval for stamp duty adjustment so we will not be able to adjust the amount against your flat & you have to pay this amount.

            They will cheat the customer i am continually take follow up with CRM but they will take 2.5 years to inform your 1.5% stamp duty scheme rejected.

            Same here. Deep Venrulkar RM called me in 2020 and informed me about this Trap/Lollypop that they have come up with option. so we opted and initiated HM Loan and went for registeration. post she and Darsana other RM gave me Email confirmation that you are eligible for this and will be considered in Final Demand. Which they didnt adjusted. also now they are saying our management disapproved it. what a fraud this is.

                Hello All,

                Please refund my entire money with interest.

                3rd class customer support, 3rd class service, 3rd class building, 3rd class material.

                I got my possession on 20March 2023 but still work in pending in my flat. Nobody take ownership from CRM and FACILITY.

                FACILITY HEAD said RUNWAL not paid us for this, We can do anything.

                MY question I pay for new then why they are using damaged material.

                I am very frustrated with RUNWAL MY CITY.

                  Hi booked flat and paid 1% token money as 35118. After booking we came to know many things about Runwal and even price offered is very high compared in Market. When we just went to see about the property and lady Manager forced us to pay token money saying you won't get the same rate if you miss to pay token money. Now
                  Runwal Group customer support has been notified about the posted complaint.
                  I am looking forward for my Refund money as per ReRA Law.
                  Reminder 1.

                  Dear Runwal Team,

                  As notified earlier. I am not interested to take up the flat. So please refund the 1% token money taken from me. Please have the curtsey to reply your clients.

                    Hello,

                    I have booked a flat in tower 5 -0607 in Runwal Gardens Dombivli. There was an offer given to me at the time of registration that if registration is completed as per date given by Runwal that out of the 3.5℅ stamp duty paid by me. Runwal garden will return 1.5% that is approximately Rs. 85000/- at the time final demand. However now Victor and Deepa from the CRM team re denying the offer and have confirmed that offer was rolled out erroneously. This is a miss from Runwal garden and hence I need help from Runwal gardens management.

                    I will be sending a legal notice on this as well.

                      I have paid the amount for booking RS 37000
                      i want refund of the same.
                      as i am not willing to purchase the flat not

                        I have booked my Flat in Runwal Gardens on 03rd November 2020, In Lucky draw I won 32inch LED and they promised that it will be delivered at the time of Registration but till date after several follow ups I have not received it. This way Runwal is spoiling the Brand name and giving False commitments.

                        Would appreciate if you could look into it and do the needful at the earliest.

                          I purchased the flat in T-24, since the last two weeks I am continuously trying to reach my relationship manager Deepali Pawar, as I needed some information about the site visit and possession of the flat, we have been told that the site visit has been started last December 22, but till today we were unable to do so, I am continuously calling and sending messages on Whatsapp, have called on customer care no. and left the message too, but no response so far...

                          it's very sad to see such kind of services getting from such big brands,
                          this kind of behavior and attitude of relationship managers leads to spoiling the reputation and trust of big brands like Runwal...

                          hope to get the proper answer to this complaint.

                            Runwal my city cluster 4, tower 10, p2001. We got a possession on 20 March. Today 40 days completed but stil my flat work is incomplete there is lot of leakages and other issues. Facility team always said they are doing work but every time they lie. That's my house but still they behave like his property and on every point they said this is like this only you should agree you can't do this and that.
                            Still my parking place is not clean and marked. Thy said you park your vehicle on another place but we are not going to clear that garbage from parking.
                            Because of there lazy and very bad work we can't do our interior work . Now we said we are starting my interior work but they said you can't do this before that you should sign and notery some terms and conditions there is a condition, which mention " you agree with all the work of builder" how I agree still my some issues are not yet resolved. And who thay are going to stop me for my home interior. That is my flat I completes all my payments then why they are doing this.
                            Also my maintenance was start from possession date but still we are not get complete flat . My 2 month maintainance was totally waste.
                            I request you to kindly take necessary action on above issues and resolve as soon as possible. Than you.

                              Township Maintenance and Tower Maintenance charges

                              Dear Team,

                              I have been allotted a flat in Tower-5, Room No-1108"(Said Flat)" situated on the TOWER 5, i have received the possession notice and i have paid all payments excepts security deposit and maintenance charges

                              1) Security Deposit : Rs.25000
                              2) Building Cam Charges : Rs.32085

                              I was following with CRM but did not get any response from her, hence lodging the complaint for redressal...

                                I have booked flate in runwal mycity dombivli manpada road .in 2018 .now allmost 6 years completed and in agreement possession date is december.but i couldn't get possession till now as I suffer lot .they told me on December pay full payment.as i paid full amount in December but they r not giving possession.and now no one is answering any thing about possession.i don't know what to do.
