With ref. to trail email and by subsequent follow-ups with Bajaj customer care, I regret to inform you that I'm following up regularly with your team for replacement of my Bajaj Pulsar 150 DTSi motorcycle.
However, there is no yield neither from Bajaj nor from their authorized dealer or from authorized service center.
1. Contact Bajaj service center at Gurgaon (Krishna Bajaj) & Dealer (SHUBH VINAYAK AGENCIES) on 4th of July 2017.
2. On 11th got response from customer care of Bajaj to contact Krishna Bajaj service centre, the service centre never contact me .
3. On 12th I have requested the service center and dealer for expected duration for availability of fuel tank no response received.'
4. Complaint ref. ISR 164403 initially closed without any resolution.
5. Called customer care they suggested me to visit service center on 22nd July 2017, Mr. Anand Wardhan (Manager Service center) accepted that they have 01 fuel tank in store which is 7-8 Yrs old I have made a physical inspection of the tank available.
6. During physical inspection of the fuel tank following was the observations :
(a) Multiple scratches on the fuel tank body.
(b) No hallmark / hologram on the part. Bottom edges have paint removed & rusted at many locations.
(c) The butt joint of tank has rusting on the inner surface of the tank.
7. My motor cycle mfg. yrs is 2008 approx. 8 yrs old and the tank available is also 8 yrs old. How can we ascertain the service life of this spare tank considering the condition of my tank as provided with the bike.
8. I requested the service center to provide 75% discount to which the service center refused.
9. I again contacted customer care they suggested me to place an order with service center . However, my initial communication was the same .
10. The service center refused to take / place the order instead demanded full amount to be deposited ion advance. Also, there was an remark from service center that " The was you are inspecting we cannot satisfy your demand we have this tank only with us and Bajaj Auto is not providing further spares so we cannot serve you, you may do whatever you wish to do"...
11. On 10th Aug 2017 again contact customer care regarding my Complaint and action taken for ISR 164403 & ISR 170501, was again advised to contact dealer for availability on [protected] however the calls made were never responded.
12.I feel the fuel tank of my motorcycle was already placed as defective piece by Bajaj during manufacturing as the motor company provides certificate of fitness for minimum cycle of 15 yrs and Fuel tank is not an general spare it's backbone of the motorcycle as the engine is the heart of motorcycle.
13. My daily expenditure on the motorcycle is INR 150 for carburetor & fuel cock cleaning since 3rd July 2017.
14. Wastage of fuel with an average of 9.5 Ltrs against 25 Kms of running (Spilling of fuel & Overflow due to rust mixed fuel jammed in carburetor)
I hereby considering above facts and intentional delay from Bajaj Auto to respond request you to compensate me @ INR 150 per day till the fuel tank is made available along with compensation of INR 50000/- for mental, physical & financial harassment and practicing wrong business ethics and lack of service.
15. Also, As per Consumer protection act 1986 read with amendment act 1993 with effective 18.06.1993 the manufacturer is supposed to provide & ensure availability of genuine spares in good condition up to 10 Yrs from the date of official announcement for discontinuation of the product.
16. Ref. Judgement by Competition Commission of India Dated.27/07/2015 case no. 03/2011. (para. 11, 12 15, 17 &18) The order was released with DG's recommendations that OEMs and authorized dealers have to make all necessary arrangements for spares at marginal rates with genuinely without violating the competitions act 2002. May pls go through the judgement as the same shall be my grounds to justify my agony against Bajaj Auto.
I hereby once again request all concerned to revert latest by 14th Aug 2017, else I'm left with no other option to take legal advice in this regard.
Further, Pls be appraised that all the commuicatins made in this regard verbal/electronic shall be treated & will be provided as documentary evidence.
