[Resolved]  American Express Credit Card — Removal of name from defaulters list

This is Shobha Sharma. i was hoding AMEX credit card No. [protected]. On 7 April 2006, i received the settlement letter from the bank which states as under :
"This is to confirm that upon receipt and clearance of Rs. 12,000/- (Indian Rupees Twelve thousand only) in a maximum of 1 instalment vide cash/demand draft/cheque in favour of American Express Bank Limited the above mentioned card account shall stand settled in full and no further dues would be payable to American Express as regards this account."

Accordingly I had paid Rs. 12,000/- vide cheque No. 269714 dt. 7.4.2006 drawn at State Bank of Hyderabad. Clearance of this cheque has also been acknowledged verbally by the customer care of the Bank. But they are denying to give any No Due letter to me and confirm that the letter given at the time of settlement is the proof itself.

I have applied for a Personal Loan with HDFC bank. I got a verbal notice from them saying they were unable to process as SATYAM( database that shows defaulters list) shows my name as a defaulter. I request you to look into this matter as to why satyam is showing my name in defaulters list.

I want my name to be removed from defaulters list with satyam/cbil or any other organisation that holds data. Since I have got the settlement done and payment has also been made, I request you to take immediate action in this regard.

I am holding a Amex Gold card with credit limit of 40000 there was a overdue of 17000 in the month of November but I have cleared the over dues but I am using the card. Now my name has come in the defaulters list. I am still using the card but there is no overdue. Can my name be removed from the defaulter list still while I am using the card. I am not able to get a personal loan due to this.
I completely agree with you. These multinational banks having regard to their finanancial muscle have adopted a settlement system of their own. They don't have regard to the judicial process to be followed in India. They intend to supercede all the legal framework and provisions therein contained for the sake of maintaining the profitability, at any cost. They hire people at least possible wages without looking out for their qualifications, maturity and sensitivity and above all training their staff's tongue towards side of civility. They collect money, give you settlement letter and forget to forward the copy and other details to Credit Bureau for updatation towards CIBIL/SATYAM. Again they go un-noticed and clean handed due to some lacunae in our legal provisions. It shall be the duty of the settling bank to forward the details of the settlement to Credit Bureau so that the INDIAN CITIZENS get their correct status reflected in the system which places him/her to hardships when he/she needs it most.
The current laws and legal provisions are tilted towards 'financially muscled' banks and there is no dearth of EQUITY to protect INDIAN CITIZENS from the being suffered at the hands of FOREIGNERS.

My self Sagar Mal Rathi, , feeling very sorry to inform you that now I am unable to pay due amount of credit card no.[protected]. I got heavy loss in my business in the year of 2006. I tried my best to clear all the outstanding amounts but now I don’t have capacity to pay due amounts. & now I am completely depended on my relatives and My credibility is also zero in other banks due to name in CIBIL.. So now I want to settle my credit card with the help of my relatives. I have informed over telephone to Recovery department executives of your bank about my current position. Now its my polite request with bank to settle my credit card with the small value with considering my position.

Do the needful as soon as possible
