Subject: complaint u/s 5 and sec. 15 & 19 of environment (Protection) act-1986 and u/s 379 ipc for illegal & unauthorized bore-wells & illegally extraction of ground water house no-65, khasra no. 273/228/173, ground floor, near - convergence public school, elect pole no-532-49/5/1/1, gali no-10, village wazirabad, delhi-110084

My complaint regarding the above-said matter/issue and i have also attach/uploaded the detailed complaint with this grievance and please read as part of my complaint. Owners of the said house kamla, prahlad & his sons vinod & ved prakash doing paying guest business at said house and tenants use bore-wells water which are unsafe for health and body but owners of the house compelled the paying guest/tenants to use bore-wells water for daily use and misuse the ground water. National green tribunal time to time give directions to the govt. Authorities to take action on illegal bore-wells which are running without permissions because borewells discharging contaminated water containing high levels of fluoride and arsenic, in red colour to approse people that the water was not fit for human consumption.
Owners are use bore-wells again and again by digging from very long period of time and also owners are the illegally/unauthorized digging and use the djb pipe line water and stealing the govt water regular basis. After the several complaints property & bore-wells neither inspected nor sealed by any of the govt. Officials till date.in this house all activities are illegal & unauthorized and against the n. G. T, d. P. C. C, c. P. C. B, mcd-north & environment law-rule-regulations, owners are committed crime as cognizable & non - bailable offence as per law.
The environment (Protection) act, 1986 provides for power to give directions with regard to stoppage or relation of the supply of electricity, water or any other service u/s 5 and sec. 15 of the act provides for penalty for contravention of the provisions of the act and the rules, orders and directions. The sec. 15 of environment (Protection) act provides for imprisonment for a term which may extend to 5 years or with fine which may extend to rs. 1, 00, 000/- or with both and as per schedule ii of classification of offences of cr. Pc the offence u/s 15 of environment (Protection) act is cognizable and non-bailable offence.
That as far as the registration of a case under ipc with regard to illegal
Boring/bore-well is concerned, at the most it can be registered for the offence u/s 379 ipc for stealing of water and the punishment u/s 379 is maximum for three years. So, the provisions of section 15 of environment (Protection) act are more stringent then section 379 ipc. Even otherwise, environment (Protection) act is a special law and as per the provisions of cr. Pc and ipc, the special law will prevail.
Please the issue the directions to the djb, local police, concern s. D. M (Civil lines), and central ground water board to jointly inspect the property bore-wells and take legal action as per law.

Sir, please take legal action against the culprits and save the environment as per the environment (Protection) act-1986 and give the direction to the local police and other authorities to register the f. I. R on above said issue.
