On 02/06/2017 i bought a moto m (Silver, 64 gb) on invoice date:[protected], having [imei/serial no: [protected], [protected]] mobile phone from you via flipkart having order id: od[protected]. I have discovered that the phone has the following problems
1. Switch off / on itself.
2. Charging /issues
3. Lining in display
4. Software issues
5. Battery discharged from 100% to 20% itself after restart.
I have complained all these problems in your service centre three times.
1st time, on 2nd jan, 2018 - only software has been updated and returned to me.
2nd time, on 3rd jan, 2018 - some parts has been changed and returned to me. But my problems not solved so i resubmitted o 6th, i have my job card also for the same.
3rd time, on 6th jan, 2018 - phone submitted & phone is still in service centre only.
When i spoke to the manager, i have been told to take phone with older version of software, my phone doesn’t support new phone.
But i am not satisfied with his reply so have to write & inform it to you.
The [consumer rights act 2015/ sale of goods act 1979] makes it an implied term of the contract that goods be as described, of satisfactory quality and fit for purpose.
As you are in breach of contract i am entitled to have the phone (Repaired/replaced or refunded) and i would request that you confirm that you will do this within the next 14 days.
I also require you to confirm whether you will arrange for my phone to be collected or will reimburse me for the cost of returning it.
