Sub:-grievance of dr. Prof. Gouri kumar prusty, neurosurgeon from no-1, p. O-korian, at-korian byepass, p. S. Town, dhenkanal, state - odisha, pin-759013 and present residing at kolkata in ck birla hospitals (Cmri) (Calcutta medical research institute), kolkata.
Grievance against
1) land acquisition collector, dhenkanal & the competent authority, national highways-42/55, at/p. O/dist-dhenkanal, odisha
2) project director, national highways, dhenkanal, odisha.
3) gayatri project limited, odisha.

The above named petitioner most respectfully sheweth

(A) that in l. A. Case no-61/07/2013 with process no -1257 on dated 26/09/2015, village – korian p. S. Town, dist - dhenkanal.

(B) that in this case an area of a0.430 decimal of taila kisam of land under plot-590 in khata-49 in village korian under dhenkanal municipality has been acquired out of an area of a0.900 decimals for widening (Four laning), korian byepass junction of nh-55 (Old nh-42) as per notification of the l. A. Collector o. P. No-1.

(C) that one kunja bihari behera was the recorded owner in possession of holding no. 49, plot no. 590 measuring an area of a1.08 decimals in his own right title and interest.in the hal settlement record finally published in the year 1986.

(D) that kunja behera is dead since last 25 years and at the time of his death he left behind him his four sons namely 1-ramachandra, 2-harihara, 3-paramanand and 4-dharmanand and three daughters namely golapa parida, lata swain and jayanti nayak. The eldest son ramachandra is dead and he has left behind him his widow bhagyabati and two sons namely satya swarupa and rudraprasad.

(E) that after death of kunja bihari his sons sold an area of a0.52 decimals to one balaram sahoo of korian, who mutated his purchased land in mutation case no-6468/2003 and he was granted mutation pata no.341/240 in his favour.

(F) that from said khata no-49, plot no-590 of village korian, the national highway authority acquired a 0.37 decimals for construction of korian byepass road of nh-42 and in rent abatement case no-22/2004 a0.37 decimal from plot no -590 was mutated in favour of the nh authority in khata no-363 of village - korian.

(G) that after the death of kunja bihari his four son’s of kunja bihari on[protected] vide registered sale deed no-2157/2004 of the office the district sub registrar, dhenkanal sold an area of a1.08 decimals of land from its middle portion in favour of one indulata pradhan w/o - ravinarayan pradhan of village korian for a consideration of rs1, 60, 000/- but for purpose of registration the valuation was determined at rs2, 97, 000/- and stamp duty and registration fees was paid on that market value.

(H) that srimati indulata pradhan got her purchased land mutated in her name in the mutation case no 4947/2004 of the office of the tahasildar, dhenkanaland she was granted mutation khata no341/257 in respect of her purchased land plot no.590/2332 bearing.

(I) that srimati indulata pradhan on[protected] vide registered sale deed no. 1310/2008 of the office of the district sub registar, dhenkanal sold her aforesaid purchased land in favour of the humble petitioner gouri kumar prusty vide mutation khata no 341/377, the said an area of a1.08 decimals at the consideration of rs8, 64, 000/- and delivered physical possession to the petitioner.

(J) that the petitioner dr. Gouri kumar prusty after purchased of the land from indulata pradhan applied for mutation of the land in his favour before the tahasildar, dhenkanal and in mutation case no-2426/2008, the plot no 590/2332 measuring an area a1.08 decimal was recorded in the name of the petitioner in mutation khata no-341/377 in village korian of the office of the tahasildar, dhenkanal

(K) that the petitioner in reconversion misc case no - 460/2008, applied for reconversion of an area a0.12decimals to homestead kisam and according by plot no 590/2332/2436 was converted to homestead land, again the petitioner in r. M. C case no-249/2013 u/s 8 (1) a o. L. R. Act for conversion of another area of a 0.240 decimals no plot no 590/2332/2556 measuring of a0.24 of land to homestead land. And vide plot no - 590/2332/2556, so out of a1.08 decimals plot no 590/2332 measuring an area a0.72 decimals remain as taila-ii plot no 590/2332/2436 measuring an area of a0.120 converted said to homestead land and plot no 590/2332/2556 measuring of a0.240 decimal converted to homestead. Thus out of a 1.08decimals, the petitioner converted a0.360 decimals to homestead and the balance a 0.72 decimals remaining of taila-ii land.

(L) that since december 1975, village korian has been declared as urban area within dhenkanal municipality and the land’s of village korian is treated as urban area and accordingly the compensation should have been assessed.

(M) that all the aforesaid statements are matters of record of the tahasildar office and the l. A. Collector should have taken judicial notice of these facts and before the requisition for acquisition of land fornh-42/55. The l. A. O. And the nh authority should have taken judicial notice of these facts and before the requisition for acquisition of land for nh-42. The l. A. O and the nh authority should have check and verify the requisition. The requisition plots with the r. O. R in the tahasil office but it seems that both the authorities failed judicially to comply for which the schedule of land was not correct and both authorities committed grate in justice in making the award in the wrong persons with connivance and mala fide intention.

(N) the l. A. Collector has played foul. That the petitioners at his own cost constructed a three storey commercial building over his purchased land before the proposal for acquisition was given. The petitioner obtained due permission and sanction from the competent authority i. E. The special town planning authority and the denkanal municipality authority and orissa state pollution control board, angul

(O) that inspite of repeated requests approaches and reminders the officer staff of the l. A. Collector did not take interest and stating that the matter of the petitioner will be enquired fresh and the matter be consider.

(P) that it is not understood whether an area of a0.43 decimals of land is acquired from plot no-590 measuring a0.900 decimals as given in the schedule of the notification or an area of a0.43 decimals has been acquired from the plot no 590/2332/2436 and 590/2332/2556 and 590/2332 and whether acquired land is taila or homestead. The three storeyed building was constructed over plot no-590/2332/2436 and the building was not constructed over plot no 590 measuring an area of a0.900 and under such circumstance the demolition of the standing structure was illegal and due the vindictive nature of the l. A. Authority with vested interest of the gayatri constuction authority from whom she was deriving illegal gratifications.

(Q) that the l. A. O. Authority very well known that the petitioner was serving as neurosourgeon professor at c. K. Birla hospitals, calcutta medical research institute (Cmri), kolkata but she sent e - mail notice for demolition of the building on 29.06.2019 to be present on[protected] at 6 a. M., which was very prejudice and time was very insufficient on his post to be present as he got the email at mid night of 29.06.2019 after he received the e-mail after returning from his hospital duty.

(R) that as several times the advocate of the petitioner mr. Suresh chandra mohanty and his nephew belalsen prusy and the petitioner requested the learned l. A. Collector to demark the acquired line of acquisition, demarcation as on 19.11.2018, the l. A. Collector whimsically destroyed the boundary wall of his premises and the out housing of the compound wall by which his premises was destroyed and his privacy was lost as it was free passage for forest animals, outsiders, to enter to his premises and there was no definite demarcation the petitioner failed to construct his compound boundary wall.

(S) that the action and activity of the l. A. Collector is aggressive and vindictive and such behaviour is not expected from a public officer. So the petitioner therefore request your good self to give justice in getting proper justice and payment of the compensation dues from the competent authority as well as measurement of the acquired land with reference to the acquisition map of the dhenkanal byepass road and the acquisition map for expanding four laneing nh42/55 of the present acquisition. And for this act of kindness the petitioner as in duty bound shall ever pray

That i am the owner of the land and building on plot no 590/2332 measuring an area a1.08 decimal which was recorded in mutation khata no-341/377 in village korian of the office of the tahasildar, dhenkanal, odisha
That the following authorities have demolished my building, out houses and compound wall on 19.11.2018 at 4pm and on[protected] at 6 a. M. Destroying all my assets and belongings

1) land acquisition collector, dhenkanal & the competent authority, national highways-42/55, at/p. O/dist-dhenkanal, odisha
2) project director, national highways, dhenkanal, odisha.
3) gayatri project limited, odisha.

Inspite of my repeated prayer violating my citizen rights. Till date no demarcation line for land acquisition has been marked. Even several times the advocate of the petitioner mr. Suresh chandra mohanty and his nephew belalsen prusy and the petitioner requested the learned l. A. Collector to demark the acquired line of acquisition, demarcation as on 19.11.2018.
A whimsical compensation package has been awarded in the name of some other person.
That the action and activity of the l. A. Collector is aggressive and vindictive.
I have been running from person to person, offices and courts for justice.

Dear sir,
Today morning i cross bhagan toll plaza, i already have fast tag on my car. Deducted amount already mentioned.

Paid rs. 70 for vehicle reg. No 'mat627161jlb06372' at bhagan toll plaza on[protected]:33:57. For future reference toll txn id: 0000000000000002903029.

After that my car stopped by security mans and there 5-6 without dress persons comes and abused and collect till again in cash. I am not understood what is this method and what is fast tag meaning. Kindly look in this matter.

Very bad and abusive katoghan toll workers... They have done a crucial fight... Disgusting for u. P

Good day sir,
This is to complain about the deteriorated condition of nh 11b from dhaulpur to karauli stretch in rajasthan, the company path highways taking toll at two places between this stretch but the condition of road is very bad, pits at many places and the road is broken from middle at many spots.
Kindly look into this matter so that inconvenience is not caused.

In our area on nh-52 in reengus city oppo. To rswm there is no service road on highway. There are chances of accidents. And half of the road is covered with sand.. As there is no service road and we face various problems going to wrong side of road as devider cut very far away and various trucks are parked here that is interference for us.. So this is the warning from my side.. For any mishappening nhai is responsible.. So please do needfull.. Visit and see the problem...

On august 24th i travelled from agra to delhi on nh2. At the mahuvan toll plaza after farah teh toll gae person said the fst tag ws not working and he took 105 form me and issued ticket number a08j0830. I was in lane 10. Half an hour later i got a message from pay tm with whom my fast tag uis attached that my account has been debited by rs 105

How do i get a refund of the duplicate payment

I, rajesh garg is a resident of palwal (Haryana). I have been issued a smart card for the toll plaza being a local resident.

I went to the office and they denied me to recharge the following card, i asked them why, they gave me a reason that smart card are now not valid and you need to get a fast tag for the car.

Being a local resident when forced them, they told me to sumit the documents again!!

I would like to know, why i need to sumit the documents again for the car, the car hasn’t being changed, nor being transferred, then what is the need for the documents again!!

I was travelling yesterday 26th aug 19 to kochi from thrissur kerala via paliayekkara toll plaza.
They collected rs 70.00 for both side even though i returned time span of two hours which is against the rule
This toll plaza is famous in these kind of issues
Please arrange to refund the difference amount to my tag

Waiting fir the response

I was travelling from Mathura to Delhi on 25th August and passed through Toll Road situated between Palwal and Hodal. The Line of vehicles was more than 1 KM long on the Toll Gate and i was compelled to wait for more than 10 minutes. As per Rule, i should have been allowed to pass "Free" but when i tried to discuss this to Toll staff, they tried to bully on me and started abusing badly. I paid the Toll amount but i request NHAI to take appropriate action aginst Toll Staff for 1. Not adhering to the Legal Framework 2. Taking Illegal and Criminal Activity by bullying, abusing and trying to beat Consumer.

They are collecting toll for the road which has 20 speed breakers. No other place in the world this will happen. Why govt or officials not taking action? I heard that chennai high court banned toll between chennai to tirupathi for improper maintenance. Why they are collecting? Also people at toll gates are not responding properly for the traveler complaints

While travelling to Faizabad to Lucknow on 25/08/2019 thru my swift Car having no UP32KW5033, At Raunahi Toll Plaza, i am in the queue for toll, suddenly the booth operator has stopped operating without informing us and when horned after 10 minutes, Toll people have asked to all vehicles to be another queue, that has killed another couple of time.

At counter I have asked because of your service issue, I was delayed for more than 10 minutes then why you asking for the Toll tax as its rules now if any vehicles has to wait more than 3 minutes, No Toll tax will be charged. Then Staff on duty is saying '' Pahle rule thikse pata karo woh State highway ke liye hai naki National Highway, aur Toll tax toh dena hi padega'' I have paid the toll tax and receipt is attached for reference.

I have checked with different resources and found It is correct that if we have to wait at Toll more than 3 minutes, No toll tax will be charged.

Kindly do inquiry of the same with the help of attached Toll tax receipt and CCTV camera installed at Toll plaza and if possible educate / teach your team, how to behave with travelers and do the needful for refund of my paid toll tax

Dear respected sir,
I here by inform you that my vehicle no gj09au1648 loaded vehicle with molasses customs duty goods have been upset to save the life of cow at pindwara, bypass landmark citizen hotel rajasthan 307022. Vehicle upset on 21.08.2019 but i have not able survey by insurance & couldn't lift vehicle till yesterday due to continues holiday.
Today i have went on spot to lift the vehicle with 2 crane & 1 hydra but where as beawar pali pindwara tollway ltd. Toll plaza name :- tp04 uthaman is not giving perission to lifet vehicle
So please contact immediately toll plaza to lift & cop-operate. This is our kind obbession

Dear team, i just wanted to give complaint on the toll staff where they have given false info saying that "fastag has been blocklisted in the toll due to money getting late" and requested me to pay money. Same i did with the counter but i am charged with fastag aswel. I just wanted to bring to your notice to take nessasary action against the toll staff. Please find the references and evidences for receipt and sms.

We went to panji for vacation on 15th aug and back to 18th aug, at khedshivapur toll, we reached around 830 pm. It was so much crowd and like mismanagement situation. A person with hand billing machines came to us an charged rs. 95. E gave us receipt, when we later see there was no date mentioned, no number mentioned (Receipt no 6). I enclosed other tool receipt also. We felt it is wrong bill and need action on culprits, making easy money.in another case they charged money and not given the receipt.
It is very shameful we paid lots of money as tax, roads are not good, maintenance is poor. I expect as honest nhai official take action.

Please take the necessary action as soon as possible.
Please make a permanent solution like engineer can be penalised who pass the design of bad roads and poor water drainage system.

Dear team,

I have two incidents for toll issue.
1. I was travelling from bikaner to jamsar dated on 16 july 2019 (Toll plaza name: khara toll plaza). I asked for toll ticket & told them i am coming back within 12hrs, so give me one-way toll ticket but the guys have refused he told us even if you are coming within 12 hrs. You have to take return journey ticket. Our honorable transport minister announced publicly that if you are coming back within 12hrs, you should take one-way ticket not return journey ticket. Kindly advise us please.

2. I was travelling from bikaner to sri dungargarh dated on 14 july 2019 (Toll plaza name: lakhasar). I asked for toll ticket & told them i am coming back within 12hrs, so give me one-way toll ticket but the guys have refused he told us even if you are coming within 12 hrs. You have to take return journey ticket. Our honorable transport minister announced publicly that if you are coming back within 12hrs, you should take one-way ticket not return journey ticket. Kindly advise us please.

After paying the toll tax, we collected the receipt. After checking it later, the timing written on the receipt was 17:57 pm.
Also there was no registration number written on the receipt.
This has become a common practice among the toll contractors.
These toll taxes are supposed to maintain the roads. But not all the tax paid by the general public reaches to the government. These people working on the toll booths, they are not only looting the general public but also from the government by collecting fake taxes.
Kindly look into the matter and take action against the defaulters.

This complaint is regarding to the
Wuptl plaza ticket no [protected]z. As a law abiding citizen as well as an awared citizen today we asked the toll tax to provide us the tax receipt of 12 hour to which the service provider responded that at this toll plaza we don't provide a 12 hour receipt and at this place we provide either a single way ticket or a 24 hour ticket and if you wish to get a 12 hour ticket then you can contact the concerned minister, mr. Gadkari and get the ticket you wish to receive. The service provider acted as if i was unwilling to pay the government what i was required to pay i only asked them to assist me the way the should and they refused. As i still have faith in the government i am lodging a complaint and i hope that necessary action would be taken against those who are not fulfilling their duties and the situation will rectified at the earliest.

As you know in gujarat six lan work ongoing and road quality become third class then why you collect toll tax.. Even every 15 day have to repair my car.. Whwill give me my money... You responsible for this. You collect tolltax but no improvement on road why??? I need answers for this... I am talking about toll tax which located at vadvasa, sabarkantha, gujarat..

Atleast you can close tolltax till six lan work not completed.

Otherwise i have to take action against this.
