We under the instruction and on behalf of Manpreet Kaur D/o Lt. Sh. Jagpal Singh having residence at T1-A, Third Floor, Near Prakash Apartment, Mehrauli, New Delhi hereto state as under;-

1. Our client states that our client is working as Marketing Training Profession with a Multinational Firm At Gurugram and a fitness freak and is into gym and fitness for the past 5 years and has always been keen about her physical wellbeing.
2. Our client further states that our client through an advertisement had came to know about your Gym (RHINO MALVIYA NAGAR BRANCH) and its offers. Our client upon such advertisements and its offerings had taken membership at your gym as on 01.01.2020 and had taken two years and two months membership plan valid till 01.03.2022 and had paid a sum of Rupees 30, 680 via card and the same has been acknowledge through your invoice number 00366. It is pertinent to note that you have also offered and specifically mentioned the membership is transferable with a charge of amount and only on annual package.
3. Our client further states that she was satisfied with the gym and all the equipments and offering till 15th March 2020 but after the covid pandamic when the gym reopened our client was shocked to see that your gym had reduced its all services which they promised while signing up for membership. Moreover from 1st December 2020 they shift their gym area from 5000sq. feet to 600Sq ft. and its offering to such an extent that offerings given to our client felt cheated by seeing that all the equipments and amenities have been drastically reduced. Moreover, you have violated all the provisions and regulations on preventive measures to Contain Spared of Covid -19 in Yoga Institutes & Gymnasiums as per the guidelines issued by the Director General of Health Services ( EMR Division), Ministry of Health & Family Welfare, Government of India on 3.08.2020. It is also noted that you have violated the provisions of process & premises redesigning including proper placements of equipments. It includes the following;-
a) Not given a gymnasiums floor area based on 4m2 per person.
b) Not followed to place equipments including cardio and strength machines, 6 feet apart.
c) Not followed to maintain a minimum distance of 6 feet among individuals
d) No members were used visor whole doing exercise your premise.
e) No regular interval sanitization after each hour.
4. Our client states that our client has reported the same to you several times but unfortunately, you were not given any heed to the same. At this outset, our Client diagnosed as Covid 19 Positive and doctors advised our client for 21 days quarantine and medication. It is very clear that our client got infected Covid 19 only from your premises as our client has visited only your premise.
5. Our client further state that she had informed the desire to transfer her membership to LAJPAT NAGAR branch and that she was willing to pay the basic charge for the same as on 7th December 2020 but to her surprise not only did you refuse for the same but you also had treated by Client with utmost disrespect and had called three four people and that you have misbehaved with our client. Our client further states that our client has filed a complaint against the same before the SHO, Police Station, Malviya Nagar, New Delhi.
6. Our client hereby call upon you to either transfer her membership to LAJPAT NAGAR BRANCH or to Refund her membership fees, failing to reply to this notice within 7 days our client will be left with no other option but to take legal action against you and your gym.
