I was sent the following notice on email by Tata Docomo for photon plus connection that was deactivated after payment of all outstanding payments more than 2 months back. In spite of repeated requests to deactivate the connection, I was called by a number of representatives from Tata Docomo offering me different plans to continue with the connection. I kept saying no as I didn't need the connection but they disagreed to deactivate the connection on time. I paid all the outstanding bills when I made the request to cancell my connection. Tata photon still generated this bill as they delayed the cancellation from their side. This is consumer harassment by sending a legal notice to scare the consumer and forcing them to pay for services they never asked for. Request you to please help me with my complaint. I read about a number of such consumer harassment cases against Tata photon. I believe we should all take a legal action against the company.

Sub: Notice for recovery of outstanding dues.
Under instructions of our client M/s Tata Tele Services Limited, ’A’ Block, Silicon Terraces, No 30/1, Hosur Main Road, Koramangala, Bangalore-95, do here by issue this legal notice to you.
1. We have been instructed to state that, our client is a limited company, incorporated as per the company’s Act, 1 of 1956 having its Regional office at ’A’ Block, Silicon Terraces, No 30/1, Hosur Main Road, Koramangala, Bangalore-95 and is a Government approved Telecommunication service provider inter-alia engaged in the operation of basic telephone services to its customers.
2. We have been instructed to state that, you had availed a Telephone connection from our client as mentioned above and accordingly executed Customer Application Form together with terms and conditions provided therein. Pursuant thereto you have been utilizing the telephone services provided by our client.
3. We have been instructed to state that, while availing the said Telecommunication facility, you have covenanted to abide by the rules, regulations, terms and conditions of our clients. As against the above understanding and as per records maintained by our client, you have discontinued your payment and hence the outstanding in your account is Rs:633/-
4. We have been instructed to state that, our client have sent the said relevant invoice / bill in respect of the said amount had been sent to you. Despite repeated requests, reminders and notices from our client, you have failed and neglected to pay the said amount to our client till this date, Thus you have committed breach of terms and conditions of the said Customer Application Form. You have deliberately and with a malafide intention to illegally enrich you, have withheld the payments, which are lawfully due to our client.
5. Hence, you are hereby called to pay the said outstanding amount of Rs:633/-along with interest that is due and payable to our clients with respect to the usage, rentals etc., of the said telephone/Broadband, within 7 date receipt of this notice, failing which our client will be constrained to initiate appropriate legal action, both civil and criminal under the various provisions of Indian Penal Code, against you for recovery of the said amount along with interest @ 24% per annum, holding you liable for all costs and consequences arising thereof.
You are also liable to pay Rs;500/-the cost towards issuing this legal notice.
