Big Companies are cheating the Consumer by not providing with Genuine Spare Parts but are selling Spurious Products with impunity. Are such Companies above law. They don't even acknowledge the complaints.
Here i am complaining about the company which falls under the brand name of TATA and adopts "TATA's Code of Conduct"
Below is the detailed complaint and matter which i am trying to register with TATA SKY
The Managing Director and Chief Executive Officer,
Tata sky, . Mumbai.
The Preface of your Company amongst others states " The Company believes in the conduct of the affairs of its constituents in a fair and transparent manner by adopting Standards of Professionalism, honesty, integrity and ethical behaviour. Towards the end the Company has adopted the Tata Code of Conduct, which lays down the Principles and Standards that should govern the actions of the Company and it's employees. Any actual or potential violation of the Code, however insignificant or perceived as such would be a matter of serious concern for the Company.".
In the above background, I would like to bring to your notice as to how your staff or outsourced personal of your Company tries to cheat and befool the Consumers.
On 5th July, 2019 a complaint was lodged by my daughter in law with regard to the non functioning of my bedroom T.V. It is to the credit of your Company that Technician was at our door steps with in minutes. After examining the T.V and others accessories he declared that Set Up Box and Adapter are not functioning and are to be replaced and took out from his bag an Adapter and a set up box for replacement.Both these accessories were not in sealed or Packed Condition and it appears that they had been used earlier. How such accessories can be used as replacement for defective parts when these are not in Packed Condition nor a Consumer would know the date of Packing or its MRP. Can any Company in the garb o[censored]sed or open products can pass on the same to the Consumer as a New Product. Be that as it may, the Adapter which I was using earlier had been purchased by me only a month ago which of original make. On my asking, the technician used that Adapter and the same is functioning till date. For the replaced Set Up Box, I have been charged Rs 400/- which amount stood deducted from my Tata sky Account with in minutes.Whereas for monthly payments made by the Consumer online your Company takes about 24 hours to update the Account and in the meantime a Consumer goes on getting the reminder on its TV screen that your account is valid for one or two days, as the case me.
After replacement of the Set Up Box, I enquired about the Warranty Period. The Technician answered that it is for One Year.On my demand no such Warranty was provided. Moreover, no copy of worksheet has been provided so as to enable the Consumer to have the record which part was replaced when and at what cost. .
Under the above circumstances, I would like to highlight that all the above acts done by the Technician on behalf of Tata sky amounts to deficiency in Service and Un Fair Trade Practices as envisaged under the Consumer Protection Act, 1986, as replaced Set Up Box was in open condition whereas it ought to have been in Packed Condition with Manufacturing date as well as Maximum Retail Price clearly depicted on the sealed packing. Secondly, no written warranty for one year has been provided as oral warranty has no meaning in the eyes of law.Lastly, how the Company permit the Technician to keep used products such as an Adapter when these are available in the Markets in Properly Packed Conditions. .
As Prima Facie there has been violations of Provisions of Consumer Protection Act, 1986 in the present case, therefore I call upon your Company to suitably compensate me for deficiency in service and for indulging in Unfair Trade Practices.
