The above order was placed by me on 8th March 2015 for flats of the size 38. As there was a size problem so I went for an exchange for size 36 on 10th March. I was delivered the package with the size 36 on 22nd March which had a sandal of the size 41 instead of 36 which was given on the invoice and what I had ordered for. I lodged a complaint for the same on 22nd March. Since 22nd March I have made them several calls, have written enormous e-mails but neither they have delivered me the right product nor returned me my money. And infact when I explicitly wrote them that if they did not resolve the issue I would go to consumer forum against then they dared me do that which obviously shows that the company doesn’t have any fear of law or of any action against them. I was harassed so much by these people that I stopped using the site altogether. They have kept my money since then, have wasted my enormous time & resources, have harassed me mentally. I am still keeping the product with me. Although Rs.700/- are not a big deal but its not about money only but about ethics. I have been cheated and I want justice. Following is the mail I sent them, appended for your reference:

The above order was placed by me on 8th March 2015 for flats of the size 38. As there was a size problem so I went for an exchange for size 36 on 10th March. Since 22nd March I have made you several calls, have written you enormous e-mails but neither you have delivered me the right product nor have you returned me my money. As you can browse the history from my registered mobile number & the order number so I am not repeating it all here. I have following queries in the matter:
1. You deliver the fresh product in two working days but it took you 12 days to deliver the exchange product which means there is a deliberate delay of services and you kept the money with you for longer period unnecessarily. Why so?
2. I ordered for 36, got 41 & then I was told that 36 size was out of stock. So either you took exchange request for a product which was not available in your stock & then you delivered a wrong product for cover-up or else if it was not deliberate then the right size product should have been there in the stock as wrong size was delivered. What among above was the situation?
3. You said that the fault was with your seller. So what are the steps you have taken against this seller?
4. When after a month it was decided that my money would be refunded then I was asked for a declaration form along with my id proof for refunding the money. Now firstly you refunded one of my COD order previously in the same account number but did not asked for any declaration then (ref order no.- OD[protected]. This product was returned at the same time so there was no policy change. Now again, either you did not follow the policy while returning quoted order or this time you were harassing me deliberately as I had lodged a complaint or you might have refunded the money of the quoted order to some wrong account as you did not ask for the declaration. Kindly explain your stand on the same, i.e. whether you committed a mistake in the quoted order or you are troubling me deliberately in present order.
5. If a product can be paid on COD basis, the return should also take place on ‘Cash at Door’ basis. Why do I have to provide my bank account details for any COD returns.
6. One day out of the blue I got a message from you that there would be someone at my doorstep to pick-up the return, when there was no intimation from your side about the mode of refund then how could you decide on your own, without consulting me about the return. Also wwhen I sent you a mail regarding the same rather than getting a clarification I got another message of cancellation of the return, obviously again without any intimation or consent. So do you decide everything related to my order on your own without your customer’s consent?
7. In total its almost 40 days now, neither you have returned me my money nor have you delivered me the desired product. So firstly, are you going to pay me any interest on the money that you have kept with you for so long unduly? Secondly, is this money being used for some illicit unaccounted purposes as I must not be the only consumer who is facing this, there might be thousands like me whose money is lying with you and this sum might be being used for some illegal purposes?
8. I have wasted money on the several phone calls that I made to your customer care for getting my money back and of course my precious time on writing e-mails and making phone calls as well, what is the compensation you are offering me for the mental & financial trouble/harassment inflicted upon me?
I would also like to mention that I never expected flipkart’s services can be of so poor standards. You spend so much on your advertisements but its your services that publicize you. Your complain resolving mechanism is very poor and apparently you do not have any control on your sellers. The executive to whom the complaint was assigned was absolutely rude in her dealings, so obviously you do not spend on the training as well.
Kindly respond to above in writing as I want a written evidence of your explanations. Rather I hope this time you would be able to spare your precious time and respond to me.
And last but not least your another executive gave me [protected]@flipkart.com for writing the above complain on which there is a delivery failure so obviously another cheating. You have no transparency, no complain resolving mechanism, moreover you do not want to resolve any complain that's why you do not even have any e-mail id's for the escalation of any complain so you are fraudulent too. Now I must see you in the court, as this is what you are seeking.
