Sub: Manufacturing Defects and the sub-standard quality of After Sales Services provided for Nissan Sunny (XVD) car -bearing Registration No. DL4CNA 6001, Engine No. 020195 and Chasis No. MDHBDAN17C10003138 purchased from Sky Nissan M/s Sameet Motors Private Ltd., New Delhi, India.
Dear Sir,
With regards the above I wish to bring it to your notice that-
1. That on 15th February 2012, I had purchased an automobile car i.e. Nissan Sunny (XVD) bearing Registration No. DL 4C NA 6001, Engine No. 020195 and Chasis No. MDHBDAN17C10003138 from Sky Nissan, M/s Sameet Motors Private Ltd., New Delhi, manufactured by Your Company., which was intended to be purchased for my personal use.
2. That the said Vehicle was purchased keeping in mind that you are a reputed manufacturer known worldwide for your quality products and services as I was seeking a state of art vehicle having excellent qualities.
3. That it has emerged that problem with the Vehicle as well as the services provided by Sky Nissan started from the first day o[censored]se itself. It may be noted that on taking the delivery of the Vehicle I noticed that the Vehicle was of a sub-standard quality as it had the inherent defects coupled with the deficiency in services the dealer has subjected me, to which has resulted in a horrifying and traumatizing experience that I have gone through in dealing with Your Company as a dissatisfied customer.
4. The problems that I have faced regarding the defects in the Vehicle as well as the substandard quality of after sales services provided by Your company through Sky Nissan, causing harassment to my client are mentioned herein below:
a. My Client made the booking of the said Vehicle with Your Company Through Sky Nissan (M/s Sameet Motors Pvt. Ltd.) on 25th December 2011.
b. On 11th February, 2012, I received a call from the office of Sky Nissan, informing me that the Vehicle has arrived at the warehouse and I could take the delivery of the vehicle on 13th February, 2012. As per the information received, I was issued an insurance cover mentioning the engine no. D021686 & Chasis no. 17C1002968, Accordingly my financer i.e. M/s Axis bank, New Delhi, remitted the balance amount in to the Bank Account of Sky Nissan (i.e. Authorized Dealer of Your Company) on 13.02.2012. Whereas on 15.02.2012, when I reached the premises of Sky Nissan to collect the delivery of the Vehicle, to the utter shock and disbelief of me, I was delivered the said Vehicle (Nissan Sunny) carrying completely different Engine No. and Chassis No. with a completely new insurance cover. Surprised and confused at the state of affairs, on the assurances of the staff at Sky Nissan, I accepted the Vehicle although under protest.
c. Consequently, Sky Nissan (i.e. Authorized Dealer of Your Company) to the utter disgust and shock of me, was charged with an exorbitant amount of Rs. 7000/- (Seven Thousand Rupees) on account of the warehousing charges of which no justification was given to me till date. I was told to receive the delivery of the Vehicle on 13.02.2012 and he collected the same on 15.02.2012. Thus, there was no reason for the payment of such warehousing charges by me. Even though, I paid the same under severe protest and helplessness, as I had no other alternative than to bow down to the unjustified demand of Sky Nissan, in order to take the delivery of my Vehicle.
d. Furthermore, Upon getting the delivery of the Vehicle and while driving the same home, I was severely distressed to learn that the new Vehicle, I just purchased had already run 298KM as the same was totally uncommon and moreover it was never informed by Sky Nissan (Authorized Dealer) to me. Also, on the delivery note details provided to me, it was specifically mentioned that the Tyre make of the vehicle delivered to me were of MRF, whereas after taking the delivery, I was surprised to find out that the tyre of my Vehicle are to be of the make of Bridgestone. I complained about these issues to the office of Sky Nissan (Authorized Dealer) via telephonic communication to Mr. Sandeep Puri & Mr. Bhatia, but was a given a vague and evasive reply for the same coupled with false assurance that the same shall be taken care of immediately.
e. That after Few months o[censored]sing the said Vehicle, I started experiencing a weird sound (Chu-Chu) from the Rear Right Hand Side of the Vehicle. That also, while applying the brakes in the Vehicle the car makes an unusually loud noise like an old truck makes and moreover, the brakes even after completely pressing the brake peddle does not apply properly and the Vehicle still remains in motion. The unusual loud sound made by the vehicle at the time of braking is highly disturbing and makes driving the said vehicle a torturous task. Furthermore, the defects regarding the faulty braking system in the vehicle is highly risky as due to the non application of proper breaks while driving the said Vehicle, me and any co-passenger in the said Vehicle are in constant risk of our life and safety. I made numerous complaints telephonically as well as written about these defects to the offices of the authorized dealer and all the offices of M/s Nissan Motor Co. time and again but no reply have been received till date and these defects in the said Vehicle are persistent till date.
f. Also within few months of driving the said Vehicle, I started facing a major problem in Gear shifting of the said Vehicle, as the Vehicle at the time of shifting between 1st and 2nd gear, while in motion, the gears gets jammed in between and it becomes impossible for the driver to stop the vehicle in motion. It is more hazardous than it seems, as the gear-shifting problem is irregular and I have avoided many mis-happening till now. I have complained several times about this major problem to Sky Nissan (Authorized Dealer) and has been charged heavily by Sky Nissan (the Authorized Dealer) at his workshop for the servicing of the same, but to the utter risk of the safety of me and my family members, the problem still persists. I am in constant danger of my and my co-passenger’s life while driving the said Vehicle. As the said Vehicle is the main source of transportation for me and my family members.
5. Regarding the Major manufacturing defects in the said Vehicle as mentioned in clause 4(e) and (f) above, I have experienced further mental harassment and horrid experience due to the sub standard and deficient services extended to me by Sky Nissan. The sub standard services and the unprofessional attitude of Your Company’s (M/S Nissan Motors Pvt. Ltd.) staff especially by Sky Nissan, are illustrated herein below for your kind perusal:
a. On 18th February, 2012, exactly 3 days after taking the delivery of the said vehicle, I, besides complaining telephonically, also sent a written complaint through registered AD to M/s Nissan Motors India Pvt. Ltd. (Chennai), explaining clearly the harassment I have faced at the time of getting the delivery of the said Vehicle, the same has been clearly reiterated in clause 4(a) (b) (c) and (d) above, for the sake of your convenience. I also sent a reminder for the said complaint on 18.04.2012 at your concerned offices. There has been no reply by any authority or department of your prestigious company till date to me, as the grievances of your customer has fallen on the deaf ears of the staff of Your Company.
b. On 06.07.2012, at the time of second servicing of the said Vehicle, I specifically complained about the defects in the said Vehicle i.e. the weird and loud noise (Chu-Chu) coming from the rear Right hand side of the Vehicle at the time of application of the brakes, the non application of the brakes properly even after pressing the brake paddle completely due to faulty braking system and the major problem of the gears getting jammed at the time of shifting from 1st and 2ndgear I was assured that these defects will be removed after the servicing and was asked to take the Vehicle as the defects had been rectified.
c. After several telephonic complaints to Sky Nissan (Authorized Dealer of Your Company), my said Vehicle, was sent to the workshop of Sky Nissan on 22.04.2013 and a part namely (Pad Kit-Disc) of the brake assembly was changed in order to remove the defect from the Vehicle. I was charged an exorbitant amount of Rs. 2, 755 via invoice no. CRIA[protected].04.2013) for the same and was assured that the defect of the noise is removed completely.
d. Again, on 04.06.2013, my defective Vehicle was taken for servicing, this time a specific instruction was given by me that the major defects are still persisting in the Vehicle and there is a persistent problem of brakes noise and shifting gears (Between 1st and 2nd). I was Charged Rs. 11, 056/-(Elven Thousand Fifty Six Rupees) via invoice no. CRIA[protected].06.2013) for the said servicing and was again given an assurance that the defects had been removed completely.
e. Within few days of the servicing of the Vehicle and making exorbitant payments amounting to more than Rs. 12, 000/- to rectify the defect, to the utter disgust and disbelief, I again started experiencing the same brake noise and gear shifting problems in the Vehicle. I again, as a dissatisfied customer, made numerous telephonic complaints regarding the same to Sky Nissan (Authorized Dealer of your Company). Each time I was given a vague and evasive reply that the gear-box and the break assembly of the Vehicle needs replacement and that they have reported the matter to head office which will take time. From June to September, for 3 months nobody from the office of Sky Nissan or any department of your prestigious company, bothered to rectify the defect nor they had the courtesy to inform or reply to me. Aggrieved by the same I again made a written complaint on 06.09.2013 to the corporate office of Your company M/s Nissan Motors India Pvt. Ltd. (Chennai) explaining clearly the harassment that I have faced and the security risk that I and my family are facing due to the persistent major defect of gear shifting in the Vehicle. But, again till date no reply has been received from any office of yours.
f. To my surprise, on 24th September 2013, I received a call from Ms. Aarti (Customs Relation Manager) of Sky Nissan (Authorized Dealer) to bring the said Vehicle to their workshop for repairs. Also, Mr, Girish (Customs Relationship Department), of Bangluru office called and informed me, that the appropriate part for repair and replacement of the said Vehicle have been delivered at the office of M/s Sameet Motors Pvt. Ltd. (Sky Nissan). As per the information received by me and believing it to be the end of continuous torture I was facing as a customer of Your Company, I took my car for necessary repairs to the workshop of Sky Nissan on 25th September 2013. To the utter shock and disgust, I received a call from Mr. Kapil (Senior Advisor) at the office of Sky Nissan, informing me that the couple of parts required to rectify the defects in the said Vehicle, were not available with them and due to which the defects have not been rectified. Thus, I was asked to take back the car without repair work and was given another false assurance that the necessary parts will be available after few days. I disgusted, mentally harassed, tormented by the most unprofessional attitude of handling of your company’s Customer, was forced to make another written complaint on 30.09.2013 to the corporate office i.e. M/s Nissan Motors India Pvt. Ltd. (Chennai) explaining clearly the harassment I had faced and the difficulty and security risk me and my family are in, due to the persistent major defect in my Vehicle coupled with the unprofessional conduct of the authorized dealers towards rendering proper services to the customers. Again there was no reply from any of your office or any department regarding the abovementioned complaint till date.
g. I, however, upon persistent complaining and pursuing your corporate office & authorized dealer, and literally begging them to rectify the major defects in the said vehicle, finally received a call from Mr. Gagandeep Singh (Service Manager) of Sky Nissan on 16.10.2013, informing me to bring the said Vehicle to their Workshop in order to repair and rectify the said defects by replacing the relevant parts. I took the Vehicle on 18.10.2013 to the said Workshop and received the Vehicle back on 19.10.2013. At the time of receiving the Vehicle from the said workshop of Sky Nissan, to my utter surprise, I was not issued any Retail invoice, which firstly should be given to me as a Right and Secondly, without the said retail invoice, I didn’t know which part of the vehicle has been replaced and what kind of repair had been performed on the said Vehicle. I protested about the said concealment and deceitful efforts of the staff of Sky Nissan and complained verbally to the Senior Manager regarding the same, but it was in vain as he with an evasive attitude gave me a false assurance, that the defects in the Vehicle have been completely rectified and moreover I was issued a manual gate pass on that day.
h. Within few days of the said repair work, I started facing the same problems from my Vehicle i.e. the weird noise from the rear right hand side of the Vehicle and weird noice at the time of braking and the hazardous problem of shifting gear. Being totally drained and as a totally dissatisfied customer, I, with the final hope for redressal of my grievances, wrote another complaint on 30.10.2013 to M/s Nissan Motors India Pvt. Ltd. (Chennai) the corporate office of Your Company explaining clearly the harassment I have faced till date and the difficulty and security risk that me and my family are facing due to the persistent major defect in the Vehicle. But, again till date no reply has been received from the same from any of the offices.
6. That having been used the defective vehicle for almost two years now with the above listed major problems as mentioned in clause 4(e) and (f) due to which I was immediately concerned, as this is a case of a manufacturing defects in the said Vehicle (i.e. Nissan Sunny XVD). .
7. That in view of the above and without prejudice to the above mentioned contents the conduct of all the offices of M/s Nissan Motors India Pvt. Ltd. (being jointly and severally liable) are in breach of the understanding with me. I therefore call upon M/s Nissan Motor India Pvt. Ltd. and its various concerned offices, collectively and individually to either make their sincere efforts to resolve my grievances within a period of 5 days from today, provide me with a new Nissan Sunny Car (XVD) model free from any faults and defects or instead return the money paid for the Vehicle purchased immediately so that I can then return the Vehicle forthwith on an ‘as is where is basis’.
I call upon all a response to this complaint and action on the part of all the parties to be undertaken within 5 days of receipt of this communication. That in the event the company & its authorized dealer (jointly and severally) fail to comply with my aforementioned demand, within the period as stipulated above, I shall be at liberty to initiate appropriate legal action, under the Criminal and Civil law against all the parties. Needless to say that Your Company shall be exclusively held responsible for all costs, damages and Mental trauma caused to me and the consequences of the same.
