COMLAINT SUBJECT: FORE-CLOSURE CHARGES ON FROM “MESME UNITS” ON TAKE OVER

We are availing undernoted credit Facilities from Kotak Mahindra Bank Ltd.
A) VANSH MARKETING -OD- for WC (A/C [protected]) -90 Lakhs
B) VANSH MARKETING -GECL (5199CL[protected]) – 16.62 Lakhs
Complaint 1: To Regional Business Head (North) on 3rd May, 2022, and reminders on 9th and 11th May 22. Reply received on 19th May, 2022 asking 2% Foreclosure Charges.
Complaint 2: To Zonal Business Head mail dated 13th May, 2022, reminder on 18.05.22, requesting waiver of Foreclosure Charges. Reply recd. on 19.05.22, maintaining decision "to pay 2% Foreclosure Charges otherwise approach to Banking Ombudsman, if not convinced."
Complaint 3: To President and Business Head, Kotak Bank on 13th May 22, 18th May 22 through endorsement of mails. / reminders & replies. No response.
CAUSE OF COMPLAINT:
• We are MESME unit, duly Regd. under Udyam Aadhar. Accordingly, Terms and conditions applicable to our accounts were amended as per Govt’s PSL Norms. Govt. declared many other reliefs to boost MESME units for which Bank had already obtained Udyam Aadhar Registration Certificates from us.
REASON TO SWITCH BANKING
• We were facing non-responsive attitude of Bank like delay in sanction / disbursal of Loan, responding our phone calls, replying mails etc. which showed deficiency and reluctance in providing prompt and satisfactory customer service. In order to take effective business decisions as also to overcome mental trauma, we were compelled to shift 5-year-old credit arrangements from Kotak Bank to elsewhere.
CAUSE OF COMPLAINT:
• Take-over Bank, ICICI Bank today handed over Draft with request to liquidate accounts and release properties in their favor. Kotak Bank, received draft with a condition to release property after charging 2% fore-closure charges on entire limit i.e., Rs. 1.80 Lac + Taxes.
• We understand that terms and conditions under PSL norms are monitored by RBI and are comprehensive and uniform for all accounts whether it is Govt. Guaranteed or guaranteed by Collateral Security hence we are not liable to pay any additional charge as in case of GECL.
• When Govt. / RBI is in free hand to help MESME units, in overcoming Covid Impacts, Bank is imposing unethical hidden charges which are not at all specifically mentioned in Sanction Letter. This is a sort of blackmailing to withhold residential property of our 69 years old Parents and creating mental trauma to family, in addition to other previous financial losses.
We, as MESME unit, have right to switch-over credit arrangement for want of better customer service on better terms and conditions, without any additional hidden charges.
• Kotak Bank’s Seniors didn’t pay heed to our request and are adamant to charge 2% fore-closure charges as demanded earlier else to escalate complaint to Banking Ombudsman.
Prayer: Being MESME units, we are exempted from Fore-closer charges in case of Take-over specifically due to deficiency in Customer Service. We request you to kindly instruct Bank not to impose any additional charge / Fore-closure charge on our accounts and to complete the take-over process without any hindrance.
