Sub: Complaint regarding sudden breakdown due to technical ground, sudden stalling of flight and Terrible service leaving passengers stranded, stressed and without alternative
I, Tirthankar Das, am a lawyer by profession. I am highly agitated, annoyed and aggrieved by callousness and unprofessional attitude on part of Spice Jet.
On last Saturday 13.06.2015, I booked a flight SG 252. I paid extra Rs 1000/- for booking Seat 1A as your flights are usually cramped up. The flight was originally scheduled at 5.40 pm from Kolkata to New Delhi. Instead we started at 8.25 pm. This plane was coming from Bagdogra. I want to lodge a strong complaint based on the fact that the flight got delayed by three hours with no proper information to travelers, terrible guidance and terrible service from Spice Jet’s employees. First the flight gets delayed by 45 minutes for some unknown reason and we customers got notified at the very fag end. Then after baggage check in and security check in AT THE TIME OF ENTERING THE AEROPLANE ITSELF that the tired, eager, anxious unsuspecting customers get the shock of their life on the breaking news that the flight had been indefinitely delayed.
We got notified that there were some problems with the plane, some serious technical problems. We could clearly see that the crew were talking amongst themselves about some smell and some wrong readings. They called the technical team to detect the problem. They scrutinized some stuff, while we waited for around 30 minutes in the aerobridge itself, and came to the conclusion that there had been some serious problem with the flight and flight has been indefinitely delayed. Spice Jet people started running helter-skelter. There was absolute mess. We, the customers were LEFT STRANDED. We were not notified at that time about the impending problem. Then there were more chaos amongst the passengers while standing in the non AC aerobridge. At that point of time, a nice Bengali gentleman came from Spice Jet and talked with us. Neither was he a senior officer nor a technical person. He had no clue. Then we requested, nay, implored him to help us. He then informed us that the flight has been indefinitely delayed as they will try to fix it, that we have to go back to the departure section once again and wait for further information and guided us to the departure section.
In the departure section after much chaos, bad behavior of certain persons at the baggage check in counter, we were notified that they are trying to fix up the problem though they were unsure about the final status. Then they told us problem might be fixed but it would take some time.
It is a massive shock and sad fact that a nice passenger detected a burning smell and reported to to a crew member of SG 252 Spice jet. Apparently something had/was burning which created further technical problems. This nice person and we went to the Airport Manager to request as well as lodge complaint to help the passengers traveling by the Delhi bound SG 252 Spice Jet.
The technical problem should have been detected by the technical crew and the normal crew on board as and well during the flight was grounded and usually checked for problems and cleaning up.
My Complaints are –
1. Sudden breakdown of flight on technical reasons which comes within the purview of your technical know how, legal and moral obligation. It is YOUR DUTY to check and solve technical problems before the flight takes off from the Ground.
2. The problem was technical not Act of God. There was no person to check it, detect and explain to us.
3. There were serious technical problem with the plane. Non adherence to strict rules and regulations of proper checking of inside the plane well as well as technical equipments CHECKING WHETHER THE FLIGHT IS AIRWORTHY AND READY FOR TRAVEL It directly put the lives of all the passengers into jeopardy. What if the flight had taken off. THIS AMOUNTS TO SERIOUS BREACH OF TRUST
4. Chaos within aerobridge. Noone was there to give us proper information, hope and guide us about process and procedures. Spice Jet was seriously understaffed unprofessional and UNDER PREPARED. This is serious breach of trust.
5. Chaos within Airport. There was no crew to explain us the process and procedure of to repeat check in OR GIVE ALTERNATIVE BOOKING OF FLIGHT AS WELL AS EMERGENCY ACCOMMODATION.
6. There were no alternatives for females onboard.
7. Misinformation or Negligence and lack of duty of care to inform customer before or during the problem.
8. As passengers we are customers and consumers we are entitled to certain rights which have been seriously breached here.

There are clear Guidelines And Statutory provisions under the DGCA, the Consumer Protection Act and the Contract Act safeguarding the consumers and even under IPC where passengers as consumers and human beings are protected so that Institutions like you cannot cheat us and abuse us. We had put our faith, trust, life and money into your hands for safe, proper and timely arrival at the destination. This was completely breached. Spice Jets actions needs to be highly reprimanded. There could have been serious repercussions for your costly mistake.
This is unprofessional unjust, unfair, and ridiculous treatment of your customers. This is stressful and strainful and did amount to contractual and emotional breach of trust. DGCA should not have reallowed your license because you are so incompetent, unprofessional, under prepared, irresponsible and callous. We suffered mental trauma.
I am deeply disturbed and anguished at these type of actions on your part as a customer and as lawyer. I expect better and higher standards from Spice jet. If you cannot raise the standards, at least try to maintain them. Congratulations, we you have been the worst career on air even beating now defunct Deccan Airlines. We suffered mental trauma.
I had a meeting at 9 pm on Saturday which got canceled and got postponed to Sunday morning. Have suffered massively. Actually we all have suffered massively due to Spice Jet.
This was a mentally devastating experience for all of the passengers which would leave us traumatized for rest of our lives and a serious bad repute to Spice Jet. I want the proper authorities to take notice of this serious issue, address it and address my grievances. Otherwise, I would be compelled to take serious legal steps against Spice Jet.
