abnormal delay in refund of booking money after project got scrapped

Hi,

I made a booking in project called Adwita (117, Barrackpore Trunk Road, Kolkata - 700058) during Jul'15 which was developed by Tata Value Homes and subsequently paid 20% of Project Cost including TDS amounting appx. 12 lac on getting allotment letter.
On getting the news of the project getting scrapped and no favourable movement, I decided to quit from it and applied for refund during Dec'16.

Hi,
I had booked a house in tata ariena bhubaneswar on oct 12, 2016, currently not in a position to acquire this home due to financial condition in family. Previously no staff in tata ariena mentioned that there will be no refund after cancelling. This is irritated. After booking i got mail that your booking is sucessfull and if you are cancelling then you will get 0 refund. This is cheat by tata housing.

    Booked a 2 bhk in tower 9, tata ariana at kalinga nagar in bhubanesar in march 2016 by 30 :70 scheme and have already paid 30% equal to almost 19 lakhs. However, as this is an under contruction property, it attracts 12% gst for the remaining 70% that is to be paid in december 2017 even though 70% of tower 9 has construction has been completed before the announcement of gst. The company claims it has received no input credit hence the 12% gst is to be borne entirely by the buyer. However, the club house has been completed before the gst announcement, so why levy 18% tax on that? Why should customers have to bear the increased amount? According to gst, builders cannot increase the price of an under construction house inclusive of tax. So why are buyers being made to bear the entire 18% gst on the club house that has been completed before gst? Why are buyers of tower 9 bear the entire 12% tax on bsp when they should be levied 12% only on that phase of construction that occurred after the gst was announced?

    This complaint is not resolved. Tata Housing will definitely receive input credit hence must pass on the benefits to the buyer - the 12% GST should not be borne entirely by the buyer. See replies from the Prime Minister's office and the Revenue Secretary's office in the attached images.

      I shifted to tata ariana on the 24th of september 2017 and today is 27th of september 2017. What i learnt from these 3 days is faulty maintenance policies and mismanagement on such an upscale property. At close to 1 am, i reach for the taps to find them running dry. I rush down to the maintenance wing just to be greeted by drowsy security guys who aggravate the situation furthermore by telling me that there's nothing much i can do about the situation right now as there's no particular complaint form available on them since "it is a newly constructed property". Had a talk with an even drowsier dg operator, mr. Ranjit who said that the pump operator shall arrive only after 9 am.
      Point 1. When you guys are such incapable to handle such meagre affairs, why on first place did you give possession and permissions to occupy the flats?
      Point 2. Maintenance was promised 24 hours, 7 days a week, why isn't there no one authorised or responsible around?
      Point 3. I feel cheated on having paid maintenance when you so called "big brand" people can't even take care of such necessities.
      Hardly disappointed. I want a revert on my complaint asap or i'd be bound to take affairs to the top management.

        Hi this is regarding tata primanti, gurgaon. Here i would like to state my car was passing through tata primanti suddenly one of tata company jcb took break and my cars front glass got smashed/ broken. The driver of the jcb said he is coming 2 mins, he didnt came after 2 hours tata companys security along with bouncers came, i told them your driver has broken my cars glass instead of getting repaired they start abusing and said do whatever we will not get it repaired.
        Here i would like state tata primantis staff is very rude / bully. They talk like more of criminals.
        Very bad experience.

          Dear sir,

          I had booked a 2 bhk at tata ariana at kalinga nagar bhubanesar in may 2016 by 30 :70 scheme. I have already paid 30% equal to 19 lakh rupees. Present service tax is 4.5% vat is 1%. Hence total tax is 5.5%. After gst implementation tax is 12%. As per gst law builder can not increase price of house under construction inclusive of tax. Hence tata housing has to give me at least 6.5% discount and take input credit from government on actual basis. Now tata housing is not giving me any discount as a result of which my house price will increase by 6.5%. Why a customer will bear this increase in price?. Builder tata housing has to bear this or return my advance. I am agree to take my advance return even without interest but can not pay 6.5% more for no fault of mine. Tata housing is not returning my advance either. Please help. I am an old lady having one daughter and without any job. Or income.

            My husband booked a flat in chennai, tata's new haven ribbon walk, golden garden c -73 by paying ₹6, 90, 000/- towards booking and 1st instalment on 13july16. Unfortunately he passed away on 25dec16 due to massive heart attack. On 19jan17, i personally met mr. Thirumurugan, informed him, requested to return the full money without any deduction as i'm a housewife and my son is studying in engg college, nri quota, and this money will be helpful for me to pay his fees. I hv sent a detailed mail with reqd documents to tata care and mr. Thirumurugan. On 20th jan mr. Mohamed thameem mailed me stating that they will revert with a solution in refund claim. As per your legal team all documents were finally submitted by us in person on 19th april. Till now neither we have received the refund nor reply. Kindly expedite and refund us without any deductions to enable fee payment for my son's college.

              Hi with great dreams, i purchased an apartment in tatavalue homes santorini in chennai. From the day of purchase, i really get very poor customer support from your team. None of my queries are answered over email. I need to send reminder over reminder. Thru' phone i could not reach my customer care representative ms. Sujatha.                 On 30th March 2017 we visited the Tata Serine site and after speaking to the sales guys and looking at the project we decided to book 2 flats. The all inclusive price quoted to us for a 1 BHK apartment 735 built up area was 1, 15, 68781 and the sales guy assured us that this will be the final price paid by us and we agreed to it and made an online payment of 1 lakh rupees as a token amount. After the payment was made we received the cost sheet and after carefully looking at it we found the amount which was quoted excludes other charges of 3, 05, 495 rs which was not disclosed to us.

                If he would have disclosed it in the beginning we wouldn't have gone ahead and booked 2 flats in it. We feel cheated as the facts were hidden from us and don't want to continue with the booking and would like to cancel and get the refund amount at the earliest.

                After chasing many times the sales representative is not responsive and straightaway declined to give us the refund. Kindly look into this matter.

                  Tata Value homes have come out with a project in Noida Sector 150 by the style Destination 150 Noida. However the payment they are asking is in the name of Landkart Builders P ltd. We are unable to understand this. What is the relationship between the two companies.

                    I have paid online booking amount of INR 30000 through amazon for Tata Housing Goa project on 22 December 2016. That time we haven’t seen the site so sales team confirmed that if I will cancel the booking he will refund 100% booking amount. I have all the mail confirmation from his official ID [protected]@tatahousing.com. After visiting the site, I and my family member didn't like the site and we decided to Cancel the booking. I have called the sales executive on 18th January 2017 that we are not interested, so as confirmed kindly refund my booking amount of INR 30000. Sales executive name Anant Suhas Wagh confirmed to refund the booking amount within 15 days.

                    It’s been more than 15 days and now he has stopped responding me. Kindly help me out to get the refund.

                      I booked a flat with tata housing(Serein) in thane last year in march 2016 under the scheme in which you will have to pay 10% of the whole amount in 1st year and then 20%, 30% and 40% in 2nd, 3rd and 4th year respectively. I paid to them 10 lakh+ in 1st year now our financial condition is not good I will not be able to pay anymore to them. Initially only the application form is been signed and nothing else. Now I want to cancel my booking and I asked them about cancellation, they are saying if you cancel now 5lakhs will be forfeited which is a huge amount for me who belongs to middle class. Instead of proceeding with cancellation they are giving me new scheme according to which they are asking me to pay Rs. 5lakh more and then after 3-4 years when the whole project will get ready, you can resell it to other person. So my kind request to you people is to help me with my getting my whole amount. Kindly help.

                        The said company is not changing security guards for last three years with excuse that them being son of the soil. Time and again complaints made to Facility Management to replace them as many a time they were found absent from duty or busy in chitchatting with outsiders. Also many times they allow people from outside to come to wrong floor without monitoring or not inform the flat owners about anyone coming to flats via Intercom. Violation takes place right from main entrance gate where only car no. of outsiders are recorded but no identity verification or inside of cars are checked for any contraband or arms while coming in or going out.

                          I applied for a flat at adwita project in kolkata which got scrapped later. Now you are not refunding the money with interest and tds. I missed a chance to buy a new property because of this. I have submitted a consumer forum complaint (81471) for the same. But i will make sure that i file a civil suit against you guys if you dont refund the amount in 3 days.

                            This is in reference to the apartment which was bought by me in the year 2011 at the project Amantra being developed by TATA Housing at Kalyan, Please find below the problems faced by me.

                            1 Delay in Possession : Although the building is completed, the developer is not willing to handover possession of the apartment for the reason being unpaid penal interest which they have charged on my account for no reason.

                            The developer has completed the project in May-16 however the same was committed to handover by Dec 2015 on the Sale deed, The developer is yet to pay interest at 9% for the delayed months. I am still staying on rent paying the monthly rental of Rs 35K

                            2 Parking Charges : Ins pite of court ruling, the developer has sold parking
                            area.

                              COMPLAINT REG BOOKING OF FLAT IN TATA VALUE HOMES SANTORINI, CHENNAI
                              I was alloted flat in KORFOS B23 as requested by us and the same flat was subsequently allotted to some other customer few days later. When questioned how this can be done, Mr. Sudhesh who is the in-charge of the Chennai office agreed for the mistake and requested us to accept simmillar flat in COLDERA B23 and also offered us a gold coin. We were left with no other alternative but to agree to this offer and accepted COLDERA B23.

                              However, we received a great shock in life when Mr. Sudhesh informed us on 18.11.2015 that he cannot give us the gold coin offered to us earlier. Hence I am approaching TATA VALUE HOMES once again to make arrangements to give us the promised gold coin enabling us to proceed further.

                              Please note that we have been paying all the instalment payments in time, but have not paid the instalment due towards ‘completion of brick work’ and have decided to pay the same if the ‘gold coin’ issue is settled.

                              We have the following alternatives before us:

                              a) Allot KORFOS B23 as was originally requested and allotted by TATA VALUE HOMES. We have documents to prove the same.
                              OR
                              b) Arrange to immediately give us the ‘gold coin’ promised for accepting COLDERA B23 for the mistake committed by TATA VALUE HOMES.
                              OR
                              c) Return all the payments made by us so far with 18% interest and relieve us from TATA VALUE HOMES.

                              Payment towards instalments will be promptly made as and when due, after the issue is settled.

                              Please reply, as I had not received any reply for my earlier e-mails dated 21.11.15 and 04.01.2016.

                                Further, we had made a booking of Residential Unit (Tower 1-B2-4th Floor) in the project TATA ADWITA, Developed and managed by TATA VALUE HOMES situated at 117, Barrackpore Trunk Road, Kolkata 700 058.

                                In view of the present delay in construction, we requested to kindly withdraw our candidature for buying the above said residential unit and refund our deposited amount along with the promised interest rate at the earliest.

                                The refund was requested on the 10th May 2016. However there has been a delay in providing us the refund. In spite of numerous chasers what we hear from the representatives that it will be done soon. I am very annoyed by the TATA Value home staff and the poor service and commitment towards their customers. I appreciate the sweet talk and patience while speaking to us but not at the cost of actual service. The refund needs to be done soon, as we have already suffered so much monetary loss.

                                  Due to land issues i have applied for refund of 20% of money paid. Same was applied 3 months before and even with commitment from tata housing refund not received till date. Every time only some sweet word are exchanged by the officer of head office with no result. Even they can not confirm the date of refund. Being tata is most respected business family same was not expected. Hope at least tata will maintain its good name and act on refund.

                                    Project ADWITA at 117 B.T. Road, Kolkata

                                    I booked a flat adwita, kolkata in March 15 and my proposed flat no is TRUPTI -08-C 3.
                                    I have already paid around rs 12, 86, 667/- against booking and 1st demand note as per receipts sent to me.

                                    As per last communication we had dated 06.10.15 and 18.12.15, I came to know that work in the project was stopped as the land is under litigation. I got news that land mutation is not completed . As per the letter dated10.02.2016...
