[Resolved]  Plumeria, Garden Estate, Uppal Chaddha Group — Final Demand Letter while the property is still not ready for possession

Hello,

I have received the letter from the builder for Final Payment 2 months back however on Verification of the Property I found –
1. Lift was not installed in several towers.
2. None of the flat was complete in the Tower in which I am allotted the flat.
3. Flats on the higher floors just showed completion of civil work, plumbing etc. had not been done.
4. Security was not adequate for any resident to start living at the premises.

As per clause 7.6 of the Apartment Purchaser’s Agreement the possession can be offered and delivered after the construction and when the Occupancy/Completion Certificate for that Tower has been received.

Adjustment of the charges due from the builder -
The Final Demand note does not have any adjustments of the charges stated in clause 7.4 of the Apartment Purchaser’s Agreement.

Other superfluous charges mentioned in the Final Demand Notice -
a) Sinking Fund – The demand for this fund is nowhere mentioned in the Apartment Purchaser’s Agreement.
b) Water Connection Charges, Sewage Connection Charges – As per Clause 3.2 (a) of the Apartment Purchaser’s Agreement these charges are included in the basic price thus these should not be charged separately.
c) External Electrification Connection Charges – The charge of Rs. 1,28,231/- seems to be too high to be charged to for each flat.

Is there a justification for the above with the builder

I totally agree with the complaint. Moreover this is one of the worst builder I could possible imagine. Their service staff is very bad if you want to talk to them. They are not at all help full. I went to the site and its not liveable and its a big mistake. If there is group we can file a legal complaint against them.

I fully agree with your complaint. The flats are still not ready in spite of a lapse of almost a year since your complaint. Contact: vinod.[protected]@gmail.com
And now Wave Infratech (their new name) has come up with another tantrum - because of their delays and non timely completion, greater noida authority has started a penatly of Rs 100 per day with effect from 25th Aug 2010. This they never conveyed to the customers till January 2011 and now when I went to submit the draft money for registry, they informed that approx Rs 21000 more have to be paid by me as penalty. Been arguing for more then a month but no one respond and gives a proper answer except to get the registry done and discuss this with them after that for a refund - which we all know will never happen.
