CASE HISTORY

28th May 2010:

I purchased one Nokia X6 (IMEI No [protected]) on 28 May 2010 from Nokia priority (M/s Tripathi Communication, Haridwar). I was extremely upset with the mobile phone. It does not work properly since I have purchased. Most of time when I wanted to make urgent call, it remains in hanged conditions, touch screen and virtual key either do not work or erratic behaviour is observed. The problem was immediately referred to the Nokia priority (M/s Tripathi Communication, Haridwar) for warranty replacement of the set since the problem is detected in the very first week of my purchase, and it was still persisting. M/s Tripathi Communication, Haridwar tried to make the set right without opening the set, but failed and subsequently asked me to approach Nokia Care,Haridwar for repairing, since M/s Tripathi Communication, Haridwar intimated that there is no role of a dealer after the product is sold to a consumer.

As advised by Nokia priority, the handset was handed over to Nokia care centre, Haridwar on 12/7/2010 and the problem was communicated to them by me as well as though Nokia Dealer ( M/s Tripathi Communication, Haridwar). They informed that the software will be loaded again and I have to leave the set for 2 days the same and checking the set and accordingly I handed over the set.

and received back the set from Nokia Care Centre after re-loading of software and checking at their end and communicated to me as “OK” (as informed by NOKIA Care Centre) on 14 July 2010 evening .

I came back with the mobile set with the assurance given by Nokia Care that the mobile has been set right by them and it is checked for 2 days and now it is perfectly OK. But in reality, the problem was not resolved at all and the mobile set again started giving same problems. I once again approached Nokia care and explained him the problem shown for the repair and requested that the set is giving problem within one week of my purchase and Nokia care should give a Warranty Replacement of the set. The set was handed over to Nokia care on 15th July 2010 and it was communicated to me that the mobile will be sent to Delhi for repair and it will take 2-3 weeks time. On 8th August 2010 I have been told that the mobile is irreparable and company has given ne mobile against Warranty Replacement ( with New IMEI No [protected] duly endorsed in the cash memo) though It did not look like a new set with lot of scratches on the screen, but it was functioning O.K. .

Now within one and half months, the replaced mobile is also started giving lot of trouble particularly (i) audio quality (sound is cracking) is so poor that audio from the other end is not clear and understandable (ii) even after conversation is over and the call is disconnected, the mobile remains in hanged conditions for quite some time and because of this I have to wait for long for making next call. I have again referred the problem to Nokia Care located at Haridwar on 29/10/2010 and they have taken the set for repair and issued me a job sheet. Now, from the job sheet it is also very clear that the replaced mobile given to me on 8th Aug 2010 was a used one since purchase date shown in system/Job sheet indicates 12th May 2010 which might have purchased by someone on 12th May 2010 and warranty was effected from that date.

Though I have been told that mobile has been replaced by a new one, it is actually not a new set, rather a used one. This is clear case of fraud being done by Nokia.


Now, with all this I once again express my dissatisfaction and displeasure in puchasing a product from a multinational company NOKIA and I am tired of visiting Nokia Care and sit in long que for repairing the set again and again.


Now in view of this, I want to file this case in the consumer court for compensation for such an harassment, loss of business and mental agony due to non-performing of the mobile and also Warranty Replacement by a new mobile set which can be used without any further trouble.

nokia x6 mobile — Malfunctioning of mobile and Fraud

I purchased one Nokia X6 (IMEI No [protected]) on 28 May 2010 from Nokia priority (M/s Tripathi Communication, Haridwar). I was extremely upset with the mobile phone.       Dear Sir,

      I am also facing the same problem from the past few months. Same non readable, irritating and annoying messages from two senders: TD-55555 and DM-55555.

      I am using nokia handset with airtel carrier.

      That was not enough for those bloody senders, that they increased their sending frequncy to 1-2 messages per minute. Now i have my inbox full of their approx 500-600 messages in just 12 hrs.

      I request you to please look into the matter ASAP.

      I have been receiving unknown and anonymous sms's from TD-55555, these sms's have jumbled alphabets and numbers which don't mean anything. I have spoken to Airtel Customer Service and they informed me that no value added service is active on my number.

      The frequency of these sms's is very high and to the tune of 30 - 40 sms's per day. The worst part is that these sms's are chargeable to my account. I would request you to please check this.

        Hello,
        I had purchased a Nokia X3 handset from Big Bazar about 12 days back. The handset is not getting network signals of any service provider after 10 days of purchase. I went to the Nokia customer care and they advised that it would take 15 days to service it and they cannot provide any standby set for that period. they also informed that the set can be only repaired from Delhi and not in Kolkata.
        As i have only 1 handset and that too a new one and all my business associates contacts me through the same number, how can i stop everything for 15 days???
        Pls help me replace the set at the earliest possible.

              sir,

              i purchased nokia 5233 in june from bhopal.

              from the date i purchased it has been submitted for repair for more than 5-6 times and of these twice it has been sent to their HO and still it is lying with them for the third time and for the same problem.

              - i have replaced the headphone.
              - there is noise in the music player when volume is increased or decreased and also the songs stretches like a tape recorder when played for 1/2 hr or more.
              - time automatically changes.
              - when reminder is switched off camera opens automatically.

              nearly 50% of the time after purchase it has been lying with the nokia repair centre, i could not use the phone properly and require to visit nokia care ofter.

              this is disturbing my job, i m required to take leave/ permission and requested nokia to replace the phone but they are not ready to do so and are saying that after a week check at the noka centre for status whether it is repaired or replaced.

              the set i got has some manufacturing defect, the problem of automatic time change is persisting in the handset and not getting resolved and i cannot be a part of nokia R&D team to again and again visit their service centre and ask them to repair the set.

              i request you to kindly help me getting my MONEY BACK from nokia for the set i purchased which is a defective one and also i would ask for compensate me for the problem i faced regarding the set and service they did.

                  I have purchased Mobile handset Nokia 3110 classic through ICICI Credit card from Plant M Fort Branch.
                  But Fort Branch is totally closed down. I have misplaced my Bill but I have got the warranty card with all the details i.e name, tel no. mobile model , IMEI no. date of purchase, warranty valid upto , Purchase at . My date of purchase is 6.1.2009 and warranty valid upto 5/1/2011.

                  I contacted Dombivali (East) branch. They said they require the bill copy + warranty card. I told them that my bills has been misplace and I have got warranty card, They said they want both the things. If bill is not there and warranty card is there, the warranty card stands nullyfied.

                  Tell me what to do. My mobile is dead for more a month. If I don't get the bill the mobile won't get repaired.

                  One of my friend told me purchase mobile from planet M, as their service is very prompt and accurate, so I purchased it.

                  Please advise.

                    I am sandeep I had purchased a Nokia 6303 Classic in which my Opera mini is not working . Although I had recharged a Rs. 98 regarding taking internet service by using the opera mini but I don't understand why it every time shows me fail to connect plz suggest me how will it work as my younger bro to have opera mini facility in his Nokia moset 5130 music express in that i found that his opera mini was working without any problem . When I am trying to install operamini a message coming that failed to connect to internet kindly contact your service provider & when I contact the service provider for settings there is a message coming that your phone's information is not persent in our database. In this situation kindly suggest me what should I do?

                      Dear Sir,

                      I purchased N85 Model of Nokia cell phone at the end of year 2009 for Rs. 27,000. Within two months, it has got a problem in charging i.e. charging point in the mobile got shakened/disconnected. On 8th January 2010, I gave my cell phone to the Nokia service provider in chennai city in the following address.

                      Till Date, 4 times my cell phone was replaced with the new pieces. But it is saddening to say that none of the replaced cell phone has worked properly. It seems all are already repaired/damaged one.

                      I lost my image on the Nokia company and also the service provider.

                      I spent around Rs. 27,000 in the purchase of cell phone, but I was not able to use it even for two months with out any problems.

                      I don't know the concept of replacement. Even after replacement, the cell phone has got additional problems like frequent switch off, often asking insert sim, etc.

                      Fourth time also, I got the same model with ESN/IMEI: [protected]. It also continues with the same problem (Job Sheet No:[protected]/100320/73, Date:[protected]

                      I am totally disappointed with the phone and the service provided.

                      On 28th September 2010, again I handed over the phone to the same service provider and asked them to replace the same with a new/ latest model (Job sheet No:[protected]/100928/102).

                      Atleast hereafter, they should not supply phone with the same problem.

                      Through this letter, I ask them to replace with a new/latest model with out opening the pack with all necessary accessories equivalent to my purchase cost. I don't want once again the opened individual piece. I want a full set with the following:

                      New/Latest packed set (Equivalent to the cost of Rs. 27,000, my purchase price)
                      Charger
                      Head set
                      Battery
                      Memory card
                      Data cable, etc.
                      Guarantee/Warranty Card

                      If the new set is a opened one with no accessories, sorry I will not accept it.Also I will not accept any phone which is less than the cost of my purchase price.

                      If I am not satisfied with the new one, no doubt, I will lodge a complaint with the consumer court and claim compensation also.

                      Hereafter I will not approach either the company or service provider.

                      I got a mental agony due to this in the last one year.

                      Can I atleast now get the solution at the earliest? I will not wait for more days also.

                      I regret to inform you that hereafter I will not go for nokia cell phone and approach the above mentioned service provider. I will not recommend also.

                      Nokia N-85 — new model defective

                      Purchased the n-85 worth Rs 23800/- on 01.07.09. But it was defective from the very first day.Then i deposited the set to nokia care infotel service 26/2 Hindustan park gariahat kol-29. my job sheet number[protected]/090/930-23 on 30.09.09 but when i got it back,it was in the same defective condition.then i again deposited it over there, job sheet no:[protected]/091107/16 on 07.11.09.contacted nokia care line at bangalore for 9 times also contacted at the set service center several times, but till date neither i hv received the set nor i have received the present status of the set.i am deprived o[censored]sing the new set for about a year since i have bought it.plz do help me out in this crisis. do contact me on my number:- [protected]..................

                      On 24/12/2009,I buyed a full housing change model of nokia N95,from NOKIA CARE CENTER c 33/2-c(opp.Bharat Mata Mandir),chandua,sigra,varanasi Ph[protected].I dont live in varanasi but i buyed the accesiories from there.After returning to SATNA (MP),i found that the model was not at all running properly and it even damaged my original model.There was a defective accesiories given by that nokia custumer care.After telling my mistake several times to them they did not took any action about that.That is why i am conveying it to you so that i can get a new body of it or I can get my money back.I hope you will definately pay attention to my request.I am waiting for your rsepose.

                        Nokia — Nokia 5800 Xpressmusic poor handset and poor service

                        I purchased Nokia 5800 Express Music Mobile on 11/06/2009, worth Rs.18500.
                        From that day onwards the mobile was giving me problem. The applications in that
                        were not working, e.g. when I use to open any application it was giving me error
                        "memory full, close some applications and then try again". There was no memory issue because
                        the mobile was having 8 Gb memory card and there was nothing in it. Even the contacts could not be opened, the
                        error was "Contacts could not be copied from the sim".
                        I visited the Nokia Care they told me that I have to upgrade the version, so I kept the mobile with the service centre.
                        Next day I collected the mobile, again the same problem.Now two more problems were added to the previous one,
                        the touch screen was not working properly as it was working previously, the rotation function was not functioning properly
                        The ASC people told me not to use memory card.
                        (Then why they have provided the memory card.) . They told to change the SIM card. So I didnt used the memory card
                        and changed the SIM card, then also the same problem. Then they told me that they will send the mobile to HEAD OFFICE.
                        It will take 10 days, so I submitted the mobile 3rd time, I was left with no mobile for 10 days. I received the mobile on 3rd of July 2009.
                        Even after that the issue was not solved and now again they have send the mobile to the HEAD OFFICE on saturday 4th July 2009.
                        In between I had requested the ASC incharge to replace my handset with new one but that incharge was very RUDE and was just asking to change the SIM
                        card and not to use MEMORY card.
                        There was no proper co-operation from the ASC people. The Incharge of the ASC do not have the manners to talk to the customer.
                        Even to the other customers he was not talking properly.
                        I have paid Rs 18500 for NOKIA 5800, but I haven't used that handset for a single day and I am fed up with the Handset and the services of NOKIA CARE.
                        Plz help me out to get my money back, I dont want that mobile...I want my money back.

                          I had purchased a Nokia 5130 Mobile from Reliance Digital,City Central Mall,Mangalore.

                          The Purchased Product was found to be a used set. This we came to know when we found a video and Photo in the mobile.

                          When i raised this matter with the Reliance Digital, they confirmed that they had sold me the displayed set. And asked me to continue using it as it had no probelms.

                          Also they had not opened the seal of the mobile case in front of me.

                          Soon, the set started giving trouble. When i am attending calls the mobile suddenly restarts.

                          When i contacted Reliance Digital trough phone they spoke rudely and disconnected the call.

                            Nokia mobile phones are not reliable and the service centres are charging too much and most of the time the defects remain same. I had paid to service centre Rs. 800 for repairing my mobile 2700 which never worked. Finally I took it to local repair centre and it was repaired but has a very low battery back up. The battery discharges within ten minutes of conversation.I again took it to Nokia Service centre and they refused to repair as I got it repaired from other service centre. What shall I do with this Nokia 2700? Kindly suggest.My E-mail is [protected]@yahoo.com. Can I expect from Nokia, something to solve my problem.

                              Hi,

                              I purchased Nokia N97 Mini on 27th Jun 2010 from Nokia Priority Dealer , Multiline Dwarka, with IMEI-[protected].
                              Within 1 month I started facing some serious manufacturing defects in my phone, which I reported twice to Nokia Care Centre in Dwarka Sec 6 but in Vain, both the times girls sitting there make me wait for over 3-4 hours and post that say that its been cleaned up and fine.
                              I work in a telecom company myself and trust I know that its not worth even talking.
                              Defects which I could figure out are -
                              - Problem in microphone, ppl on the other side of the phone hardly hears complete sentences from me, and every time I need to repeat over and over.
                              - On 8th Sep for entire day, it was charging itself without any wires connected, sounds weird but I took the videoshot of it in morning and evening (attached as continuous shots from video which is already shared with Nokia, capture1, capture2, capture3)
                              - On 19th Sep, though the phone has option of going on stand by in 1 min, it dint somehow and was on light mode half of the day, when i noticed I switched it on and off, only then it went back on standby, again without leaving anything on chances I took videoshot (sent to nokia already, cannot attach here)

                              Apart from this , phone is dead slow with only half the load, it hangs at times to an extent that I need to take out battery to switch it on.
                              I have now no clue what to do, I cannot speak with this phone and cannot throw it away too.

                                I had given my handset 7610 supernova for repairing the problem of bluetooth &radio at maa communications east delhi on 7-August-2010.
                                After two weeks on 20-August-2010 when i recived it had scratches on screen (which were not there before)after complaining they replaced the screen.
                                On 21-August-2010(saturday)evening i collected my handset from the center after paying repairing charges of Rs.550.when i came back home the same problem as on 7-August was there plus it was also not charging.
                                I went back to them on 23-august-2010 (monday)with the complain they made it bounce but still kept it for repairing.
                                On 28-august-2010 they said it is not repairable and they didnt even know the problem.
                                After making so many calls to there center and also to nokia customer care i had not recived any satisfactory action My JOB SHEET NO-3544.
                                I claim my repairing charges and my handset in the same condition as it was on 7-August-2010.I also doubt mishandling of my instrument by the center.

                                  bought a Nokia E 51 handset from The Mobile Store on 25/06/08 for Rs 11989 only (too little to care about for the company) Invoice No.: UP/01335/00001/1434 ?Option, Phone pick and digit 1 buttons of
                                  the handset stopped working within 2 months. ?I sent the phone for repairs with original purchase papers to Nokia (Don’t)Care Center in Dehradun. ?Waited for more than a month to get my handset back. They said it has been sent to Delhi for repairs. ?Got it back, worked fine for a month or so, then again the same problem. ?Sent it to Nokia Care center again, got it back after 15 days. ?Again the same problem. ?They never told what the real problem was. ?Every time they said the problem has been rectified.?The same problem again. The handset this time was given at Nokia (Don’t)Care Center at Lucknow. They initially denied the problem, when insisted upon they took the phone. Returned it after 15 days again the same problem. ?I kept the phone away thinking I will not buy a Nokia phone again. ?My wife insisted on sending the phone for repairs again. I submitted the handset again on August 03, 2010. This time I was told what was the real problem (Warranty was over). It had its main circuit board bent which would cost 80% of the new handset. ?It was my hard earned money that the company took from me and their service centers kept me in dark for such a long time (fraudulently of course)

                                  My suggestion to all is that if you face any problem with your Nokia phone ask for immediate replacement or money back. Don’t rely on Nokia Don’t Care Center. They will hide information till warranty is over.

                                  Please Don’t just read this review, but vote if you find it useful. I want Nokia Don’t Care, and Nokia people to realize that customers cannot be taken for a ride.



                                  One of my friends is facing the same problem with his E 71. Same buttons (in the upper left hand corner) Menu, Phone pick and digit 1 have stopped working.


                                  Perhaps there is something terribly wrong with E series of Nokia. They know it, thats why they keep postponing to tell the real problem until the warranty is over.


                                  In my opinion all E series handsets should be recalled.

                                    I have nokia 6233 since last 1.5 years and it is functioning satisfactory for which i need to replce its body case (plastic)complete as it is broken.
                                    I contact nokia centre where told it is not available....Surprised.
                                    So i requested customer care by mail...they replied it is not available.
                                    This is very much painfull since due to nokia after sales mismanagement/irresponsibility i m unable to use my mobile which is technically working.

                                    I think Nokia as reputed brand must look-in to care for their old loyal cutomers.
                                    Nokia simply can't escape from its accountability bye saying "not available".
                                    I search email Id of Mr D.Shivkumar, MD Nokia-India but didn't get.Hope this may go to Mr.D.Shivkumar for needfull action

                                    Nokia — cosmetic very poor

                                    Hi,
                                    I was send to Nokia N 95 8GB purchasing date28l02/08 care to do needful.( cosmetic) it is very poor quality, but they send back to me without do anything. this is very expansive cell. they have to deal with customer with good way i am not happy with there behave r if there product have some week point then they have to accept it and do something to needful not neglect the problems.

                                      MY NOKIA 6303C MOBILE HANDSET, PURCHASED ON 04.2010, SL NO-[protected] (CASH MEMO ATTACHED) SUPRISINGLY GETTING BLACK LINES ON ITS SCREEN. YESTERDAY, THERE WERE 1 STRAIGHT LINE, TODAY, THERE ARE 4 PARALLEL BLACK LINES HAVE APPEARED. WHILE VISITING TO YOUR SERVICING CENTRE, MORE SURPRISING EVENT IS TO EXPERIENCED, THEY SAY THAT THE VDU IS PHYSICALLY DAMAGED WHERE NO SIGN OF PHYSICAL DAMAGE AT ALL AND I CAN ASSURE THAT IN NO WAY IT WAS PHYSICALLY DAMAGED. I AM REALLY ASTONISHED REGARDING THEIR VIEWS ON MY NEW MOBILE.
                                      I WANT A LITERAL SOLUTION OF THIS PROBLEM.

                                        Sub: Legal Notice.

                                        I have been instructed by Sh. Bimal Gupta S/o Sh. Bimal Gupta, Set No. 3, Building No. 38, Middle Bazar, Shimla-1 (H.P.) (hereinafter referred to as my client), to serve upon you this notice to the following effect:-
                                        1. That my client in order to have a good Mobile Cell phone and after going through the advertisement made by you addressee No.3 through Media, visited the authorised dealer of you, addressee No.1 and on 30.9.2010 and you addressee No.1 shown N97 Mobile Cell phone by projecting the same to be one of the best Cell Phones having longer battery life and other latest features. As such, my client believing the said representations of addressee No.1 to be true, purchased a mobile phone being Nokia N97, EMI/MEI No. [protected] for a consideration of Rs. 31,300/- (Rs. Thirty One Thousand Three Hundred only) from the show room of addressee No. 1 (i.e. M/s Gainda mull Hemraj, The Mall, Shimla) vide bill CA1-39210 dated 30/9/2009.
                                        2. The mobile purchased from addressee No.1 started giving problems after few days from its purchase. The Mobile started giving problems to my client while putting on the mobile for charging it started taking a long time i.e. ten hours to get fully charged and battery of mobile used to become hot. The mobile also used to get hanged a number of times while using the phone i.e. while receiving and making the calls.
                                        3. That it is also important to mention that the mobile set of my client used get hot while kept in pocket during day time and thereafter resulting of discharge of battery all of the sudden making the set dead. Not only this vibration mode of the mobile was also not functional right from the very beginning.
                                        4. That the aforesaid problems were brought to the notice to the representative of your company who is always present in the shop of addressee No.1 and advised my client to visit the Nokia care centre for upgrading the software by posing that the problem in the set is due the old version of software. The set as such was even taken to Nokia care centre at The Mall Shimla. Who upgraded the software version but when my client used the phone after the upgradation of software the problem remained as it was earlier.
                                        5. That again my client reported the problem to the representative of the Nokia available in the showroom of the addressee No. 1. He again assured the proper functioning of the set after changing the setting of the mobile set and informing that the problem stands rectified. But in vain.
                                        6. That recently because of inherent defects in the mobile set in question it started giving charging problem as despite putting the same for charging for hours together but it failed to charge the battery at all. When this problem was brought to the notice of your representative in the shop of addressee no. 1 he again advised to take the mobile set to Nokia Care Center. On his advice the set was again taken to addressee No.2 on 18.9.2010 and respondent No.2 after preliminary examination of the set asked my client to leave the set as it will take one or two days to set it right. The Mobile in question of my client was thereafter retained by addressee No.2 vide job sheet No.6617 and my client was asked to collect the same on 20.9.2010. On 20.9.2010 when my client visited addressee No.2 the M.set was given to my client with the understanding that everything has been set right and now there will be no problem. On this assurances, more particularly, in view of the fact that addressee No.2 is one of the authorised/approved Care Centres of addressee No.3 must be expert in the field, more client took the Mobile Set. However, when my client again put the mobile phone for charging, my client was shocked to see that the same problem persisted. As such, my client once again immediately informed addressee No.2 on[protected] about the same and thereafter on 22.9.2010 my client once again visited addressee No.2 on which date addressee No.2 again took the Mobile Set back of my client vide job sheet No.6691 and informed my client that the set has to be sent to company for replacement under Warranty.
                                        7. That it is pertinent to mention that my client being professional had stored contacts and details of his clients in the said phone, which could not kept due to the defect in the mobile set being dead. In these circumstances, my client has left with no option but to purchase another set of Noika Make, being Nokia E-72, vide retail invoice No. CAI 39006 dated 23.9.2010 for a sum of Rs.16600/- from addressee No.1 so that his clients should not face any difficulties in contacting my client.
                                        8. That it appears that your product i.e. Nokia N-97 purchased by my client was having inherent manufacturing defect from day one, but the said fact was deliberately concealed by the representative of you addressee No.3 available in the shop of addressee No.1, when the problem was brought to his notice at the first instance. Even thereafter, addressee No.2 tried to conceal this fact after uploading the software twice, rather they represented that the problem in the set was because of software only.
                                        9. That because of defective set sold to my client my client faced great hardship inasmuch as under the mitigating and forced circumstances he had left with no option but to spend extra money of Rs.16600/-.
                                        10. That my client is a professional and for want of mobile he is facing a great inconvenience in doing his day to day work and as such forced to purchase a new Mobile set, as stated above. As such, you addressees, have opted unfair trade practices including extortion of money on account of acts of omissions and commissions on part of you addressee No.3, my client has suffered mental agony and pain notice and for that purpose my client restricted its claim to Rs.20,000/-, besides burdening extra burden of Rs.16,600/- for purchase of a new Mobile.
                                        I, therefore, by way of this notice call upon you, all addressees, to refund the actual amount of Rs.31,300/- for purchase of N-97, which was taken by addressee No.2 for replacement. Besides this on account of mental agony suffered by my client my client is entitled to Rs.20,000/- as also cost of Rs.16,600/-, which my client has to spent for purchase of new mobile set, and to pay Rs.1100/- as costs of this notice i.e. Rs.69000/- within 15 days from the date of receipt of this notice, failing which my client shall be constrained to take appropriate legal proceedings against all you addresses in the Court/Forum having the competent jurisdiction and in that eventuality, my client will claim the actual losses which my client has suffered for want of Cell Phone besides compensation on account of mental agony and harassment and all such proceedings, if initiated will be at your costs and risks. Copy of this notice retained.
