I HAD RETIRED ON JUNE 28, 2010 FROM M/S. IPCA LABORATORIES, KANDIVLI, MUMBAI AND TILL DATE I HAVE NOT RECIEVED MY PROVIDENT FUND AMOUNT EVEN AFTER SEVERAL VISITS TO THE REGIONAL PROVIDENT FUND COMMISSIONER, SECTOR 3, CHARKOP MARKET, KANDIVLI WEST, MUMBAI -400067. I HAVE A REAL PROBLEM, SINCE I HAVE NO INCOMING CASH FLOW. PLEASE HELP-REGARDS CHARLES DSOUZA

My PF No is DL/7405/395. My PF Documents were submitted to PF Office in Skylark Building, Nehru Place.New Delhi on 19th March 2007 by my employer. My employer was OMAM CONSULTANTS Pvt. Ltd in New Delhi. But till now I have not received money from PF office in my account that is given in the pf withdrawal document. Even after numerous visits to PF office and asking them of the status of my pf I have not received any reply from pf office.

Whom should I follow up with? I am in need of money.

I'm a retired employee from an Organization situated at Hyderabad on[protected]. I had been getting pension of Rs.1394/- from the EPF Office regularly since April, 2009 onwards. PENSION PAYMENT ORDER NO.AP/HYD/49672 dated[protected] refers in this context.
However, I had not received the pension arrears of Rs.15, 752/- as mentioned in the above said Order, till date. In spite of repeated visits to EPF Office, I could not get the arrears even today also.

As far as I know once a employee leaves a company he has two options as per the latest rules in PF withdrawal
1. He can transfer the same if does not wants to withdraw &
2. He can claim for the money .

I don't have any objection in sending you the Affidavit and copy of pan card except declaring that now I don't work in any other organization .

In that case I require a help from you.

Affidavit and copy of pan card is required by PF office Vashi for all the members withdrawing PF after 3 yrs from the date of leaving the organisation.

In that case let me know how do i get my pf as i have been running to everyone incl you for clearance of my pf since 2007 . At least then you could have advised me to submit pf forms for easy clearance .

Subhash Chander Chopra was employee of Adecco Flexione Workforce Solutions Limited having its registered office at Adecco India, Sai Deep, Sri Nidhi No. 2, Nal Wind Tunnel Road, Murgeshpalya, Bangalore – 560017, India. I was working in the branch office at 1st Floor, 39/A Pusa Road, Karol Bagh Delhi – 110005. From 17th April, 2006. I joined at the level of Accounts Executive and was assigned employee code FWS0654. A copy of letter of appointment and the salary breakup is annexed as Annexure 1.

2. I served the organisation with my best efforts and zeal. But due to some personal and official problems I was constrained to resign from the job. I worked in Adecco Flexione Workforce Solutions Ltd. around Two years & Six Month and resigned from my post in month of August, 2008 after giving due intimation, handling all the files/cases, following proper procedure and after taking consent of my reporting officer Mrs. Shashi Singh, Asst. Manager Commercial at Delhi Branch.

3. As per the terms and conditions of the employment contribution has to be made to provident fund both by employer and the employee. Adecco Flexione Workforce Solutions Ltd. has regularly deducted contribution to provident fund from my monthly salary during the term of my employment with them.

4. After resigning from my services I submitted my PF & Separation forms & to Ms. Pratibha Singh, HR department of Adecco Flexione Workforce Solutions Limited to provide necessary documents, appropriate forms and statement of contribution to provident fund account made by company and me, to enable me to withdraw the amount standing in my provident fund account. But I was informed that the provident fund cannot be released to me before payment of recovery against Full & Final Settlement in the organisation. When I told her that provident fund cannot be encumbered or stopped like this, it was informed to me that this is the only procedure and practice company follows. A copy of receiving of PF form is attached herein as Annexure 2.

5. Thereafter I contacted Mr. Kush Bhargava, Head HR of Adecco Flexione Workforce Solutions Ltd. for releasing my provident fund but he gave no heed to my requests and asked me to wait for sometime.

6. While I as waiting for any positive communication, I was shocked to receive demand through e-mail dated 6th May, 2009 wherein a arbitrary, illegal and unjustified demand of Rs. 3, 251/- was made from me on pretext of full and final settlement. It is pertinent to point out that in the said demand mail no reason whatsoever have been assigned to support the said demand attached herein as Annexure 3.

7. In reply to mail dated 6th May, 2009, I replied vide letter dated 11th May 2009. In said mail It was brought to the knowledge of the Adecco Flexione Workforce Solutions Ltd. that I have been following up of my Provident Fund from the last couple of weeks but still the matter is pending from your side. Any employee cannot be encumbered and made subject to charge as per the provisions of Section 10 of the Employees Provident Fund and Miscellaneous Provisions Act and employer is liable to release the provident fund documents/forms irrespective of any dispute or demand against an employee. A copy of the said reply letter dated 11th May 2009 is attached herein as Annexure 4.

8. Adecco Flexione Workforce Solutions Ltd. replied to the aforesaid reply vide their letter dated 11th May, 2009. Once again the Adecco Flexione Workforce Solutions Ltd. giving reasons for alleged demand of Rs. 3, 251 against recovery of Full & Final Settlement. A copy of the demand mail dated 11th May 2009 is attached herein as Annexure 5.

9. That being aggrieved from the malpractices of Adecco Flexione Workforce Solutions Ltd. and after failure to resolve the matter through various correspondences, I am constrained to approach your goodself for redressal of my grievances.

I pray before your goodself to take cognizance of the said matter as per law and take appropriate actions against Adecco Flexione Workforce Solutions Ltd. and the officers in charge and issue necessary directions for release of my provident fund and pass any other order as it may deem fit in facts and circumstances.

This is to bring to your notice that I am experiencing an issue with Reimbursement of my Provident Fund from Wipro BPO Kolkata. I am an ex employee of Wipro BPO and is yet to receive the Provident Fund. Please find in the details provided below:

Details for Reimbursement of Provident Fund from Wipro BPO.
1.Joined Wipro on 29th October 2007 as Technical Support Associate.

3.Worked for the Process British Telecom’s In Wipro Kolkata Sector:- V Salt Lake Kolkata:-700091.

4.Confirmed as an employee of Wipro BPO on 29th May 2008.

6.Resigned from service on 9th June 2009.

7.Resignation accepted on 3rd July 2009.

8.Withdrawal of PF balance application was submitted with the Kolkata EFA department on prescribed form on the date of collection of release letter without any acknowledgement.

9.Assurance was received from them regarding settlement of PF within 1month to 1 and half month.

10.I made telephonic conversation with the EFA department approximately in the month of December 2009 and was instructed to resubmit the fresh PF application as the older one might have been misplaced.

11.I visited Wipro BPO on 15th February 2010 at 3:50 and was informed that the department is closed. I was provided with a number [protected]. I called the number and spoke with Sushmit De who represented himself as the Head of the EFA department. When enquired regarding the place of existence of my PF account Sushmit denied to disclosed it.

12.Further contacted the EFA department at [protected] and spoke to Sushmit again who asked me to contact the EFA on 19th February 2010. Personally approached the Reception of Wipro BPO to at 4:00 pm who informed that the EFA Department is closed for the day due to income tax issues.

13.Urged to speak to the TED department to discuss regarding the issue. I spoke to a lady who informed her name as Moutushi and further informed me that she is not aware regarding the PF reimbursement and asked me to repeatedly contact EFA and disconnected the call.

14.I am presenting residing at Vishakapatnam due to some Job purpose, hence leaving for Vizag on 22nd February 2010 (Monday).

I would request you to please look into the matter and advice me the right way to receive the reimbursement of the PF amount from Wipro BPO Kolkata.
