Re: rectification of defects in/ replacement of yahama mt-15 abs bike

This is to bring to your kind notice that i had purchased yahama mt-15 abs model bike from 1) sri mahaalakshmi motors on, chennai 31.07.2019 for a consideration of rs 1, 84, 000 paid in upi transfers against invoice no vmg-vsias 278.

The said bike is suffering from the following defects:
(I) leakage of oil from engine
(Ii) reduced mileage and engine overheat.
I had reported the above defects to svd motors private limited, chennai (Authorized yamaha service centre) several times and each time the vehicle is returned back after servicing as how it was rendered and without rectifying the defect. Despite all pleadings they have not made good the defect in the bike, which is indeed regrettable. On account of aforesaid dereliction of duty and failure and neglect to rectify the same i had incurred additional expenses of rs 10, 000 which i am liable to be compensated.
It is to be noted that the manufacturer, dealer and the service center are all jointly to be held responsible for supplying such defective bike to the customer besides paying such huge amount.
My request to rectify the problem or replace the engine or return the monies paid is repeatedly denied by both the dealer and service center and their continued arrogance has forced me to write this complaint as it is evident that both the dealer and service center are not willing to settle this matter amicably.
You are hereby finally called upon to
(I) remove the said defects in the bike or
(Ii) replace the bike of same model or
(Iii) pay compensation of rs 20, 000/- for mental agony and harassment suffered due to your negligence of not rectifying the defects as mentioned above along with the cost of the bike in the sum of rs 1, 84, 000 with interest @18% per annum within 15 days of the receipt of this complaint failing which i shall be constrained to initiate against you for redressal of my aforesaid grievances and recovery of the aforesaid amount such proceedings, both civil and criminal as are warranted by law, besides filing a complaint under the statutory provisions of the consumer protection act, 1986 exclusively at your own risk, cost, responsibility and consequences which please note.
