Dear Sir / Madam,
Sub:-Complaint / Grievances from Parth ( Student of ISM Dhanbaad having Mobile No.[protected] regarding arbitrary and illegal deduction of ( Rs 40/ + Rs 40/- + Rs 7/- + Rs 2. 50 + Rs 11/- + Rs 40/- ) by AIRCELL ----- Complaint of improper, unfair and arbitrary implementation of terms and conditions of 2 G / 3 G DATA PLAN OF AIRCELL -- Intimation o[censored]se o[censored]nethical practices by AIRCELL .
FACTS RELATED TO COMPLAINT :-
( 1 ) That my name is Parth Sharma ( a student from ISM, Dhanbaad ) . Presently, I am AIRCELL user and my Mobile No. is[protected] .
( 2 ) That on 9th Aug 2015, some message was delivered on my Mobile No.[protected] in which I was asked to opt / choose for ALL CHANNELS package . It seems that I have just opened the message and it has activated automatically ( merely by opening it ), ALTHOUGH I have not confirmed or messaged regarding the confirmation of the services for ALL CHANNELS package.
ALTHOUGH I DID NOT CHOOSE / SUBSCRIBE, still with in next few seconds another message was delivered on my mobile intimating deduction of nearly Rs 40/- by ARCELL . -----
I was shocked and surprised to see this .
How it is justified to deduct a money by AIRCELL for just viewing the message ( and activating the same by yourself ) and deduct the money from customer ? HENCE, Please refund RS 40/- back to me ( BECAUSE I did not subscribe / opt to choose for ALL CHANNELS package or any other scheme of ARCELL ) .
( 3 ) That similarly, on 12th Aug 2015, Rs 40/- was deducted again by ARCELL from my balance without any intimation . I came to know about this deduction through MY MOTHER ( who got this informaton from AIRCELL Complaint telephone no. [protected] ) . After this deduction of Rs 40, the remaining net balance on 12th Aug 2015 was shown Rs 69 + some paisa .-----
This amount of RS 40/- is also to be refunded back to me ( because I did not use any service of ARCELL for this amount ) .
( 4 ) That on 13th Aug 2015, the balance before using INTERNET was Rs 68/- . I used internet for nearly 3 or 4 minutes only . After this use, 1536 MB balance was shown, but balance of Rs 61/- was shown on 13th Aug 2015 for this use . --- Since, I have taken 2 G / 3 G DATA PLAN OF ARCELL, hence, there must not be any deduction for internet use till my entire free GB exhausted .
( 5 ) That on 13th Aug 2015, I narrated these facts to my mother who dialled AIRCELL Complaint No. [protected] at 4-40 PM and narrated all above said facts telephonically and she requested the concerned executive to LOOK INTO THE MATTER . Customer care executive first kept on avoiding to give complaint no. . After lot of discussion, he had given complaint no. 1 –[protected] .
( 6 ) That on 13th Aug 2015, I checked at around 5-30 PM and found that again Rs 69/- was shown as balance --- WHICH MEANS THAT AIRCELL returned internet use charge of Rs 7/- ( which was deducted as reported above in Para 4 ) .
( 7 ) That on 13th Aug 2015, when I USED internet again three times in evening, THEN Rs 2. 50 was deducted first, THEN, Rs 11/- was deducted on second time and then Rs 40/- was deducted at third time, although at each of the above three times it was showing FREE MB’s in balance ( those free MB’s which are allotted in case of 2 G / 3 G DATA PLAN OF ARCELL . ----
The point is – IF FREE MBs were available as balance THEN, there must be no deduction for use of INTERNET ( as per terms and conditions of 2 G / 3 G DATA PLAN OF ARCELL ) . ---- Hence, all these deductions are arbitrary and illegal ( because these are in GROSS violation of terms and conditions of of 2 G / 3 G DATA PLAN OF ARCELL ) .
REQUEST :-
In view of the above said facts, it is requested to return back to me all my money ( Rs 40/ + Rs 40/- + Rs 7/- + Rs 2. 50 + Rs 11/- + Rs 40/- ) which was illegally deducted by AIRCELL and further requested not to repeat similar unfair trade practice in future as it brings bad name to AIRCELL. KINDLY communicate reasons to me in writing in case of rejection of any of the above said requests .
