Refund against cancellation of package for wrong commitment

We were offered a holiday package of 3 years and were told that it covers domestic and international destinations. We made full payment for the package. We received a verification call from club mahindra and at that time we were informed that the package covers only domestic destinations. We immediately asked to cancel the package. The same was done immediately in their system as confirmed by club mahindra officials at mahableshwar resort....

On Behalf of my Mom: Suman Randhawa:
In the month of July, Suman Randhawa, (can provide the Club Mahindra ID if required) had referred a friend of hers (Mrs Sindhu Mohan) to take up the Club Mahindra membership. Mrs Sindhu Mohan then connected with Ms Vaibhavi Mule from the Mumbai team and told her about being referred by Suman Randhawa (passed on Suman Randhawa`s membership number) and took up the membership. Vaibhavi assured Mrs Mohan multiple times that the referral points will be credited. (Mrs Sindhu Mohan`s Club Mahindra ID can be shared if required) Her membership is valid from 7th July 2023. Ms Vaibhavi told Mrs Mohan that Suman Randhawa will be credited with 35, 000 points.
Despite repeated reminders, there has been no progress. After asking Suman Randhawa to send multiple emails with all the details, Club Mahindra has very conveniently told her that nothing can happen since it wasnt her own RM who did this transaction. This was never told before and neither did Ms Vaibhavi Mule tell this, else she would have done the needful.
Case number is 03262815 as assigned by Ms Pooja Ganapathi Navade on email dated 26th July.

    I hope this email finds you well. I am writing to request the cancellation of my Club Mahindra membership under the name Rajesh Chandrabroose, with the Member ID 2937911.

    Upon reviewing the terms and conditions of the membership, I was not made aware of the annual subscription fee, which I find to be significantly higher than I initially anticipated. Considering the cost and my current circumstances, I regret to inform you that I do not find the membership to be worth the plans offered.

    I kindly request your assistance in processing the cancellation of my Club Mahindra membership effective immediately. I understand that there might be certain procedures or formalities to be followed for the cancellation process, and I am prepared to cooperate accordingly.

    This is with reference to your mail dated 6-MAR-2023 regarding cancellation of your Membership number 2937911. We would like to discuss about your request. Please let us know a convenient date and time for the same.

    Please note membership document contains the required information about cancellation of Club Mahindra membership. We would like to draw your attention to clause 8.1 & 8.2 of the
    membership Terms & Conditions which states that,

    � 60% of the total membership cost is towards Admission Fees which is non-refundable.

    � The refund is applicable in the remaining paid amount on proportional basis post deducting - holidays taken and other gifts availed.

    Based on these clauses we have calculated your refund amount and the details are mentioned in the attachment.

    Cancellation of your membership wouldn`t be the best solution and definitely not in the best interest of both o[censored]s. You will stand to lose a substantial amount; hence we request you to reconsider your decision. We would not like to lose a valuable member like you.

      I have been a dissatisfied customer of Club Mahindra and haven't used their services for past 2 years due to non-availability of resorts, poor quality of resorts and amount charged in the resorts for different activities.

      The amount they charge as Annual Subscription fees keeps on increasing year after year.

      Below is one of the emails I send to Club Mahindra Employee Mr. Mayur Bhujpal

      I am firm in cancelling my membership with ' the great memorable holiday maker' Club Mahindra.

      In next 2 working days please send me the following document as mentioned in SI No:1 below and clarification with detailed reply for SI.No: 2-4 :

      1. The contract signed by me which mentions the below terms and conditions as mentioned in your email dated 18/06/2023.

      2. What is the ASF I have paid till date?

      3. What is Pro rated Entitlement Fees?

      4. What is 'Cost of White Goods Delivered' ?

      Club Mahindra, I don't intend to waste any more money with you, please don't dream of dragging the issue and reply to this mail beyond July 1st with the idea of charging me the ASF for one more year.

      Further it would be my earnest desire to make your company policies which you have stated to me below public as to warn my fellow citizens not to fall in the trap to Club Mahindra.

      These guys hasn't bothered to reply back neither they are sending a confirmation of cancellation. They are not responding to my emails neither to the mails from Ministry of Consumer Affairs.

        I have been called by club Mahindra persons for a meeting as a premium customer of Hyundai car and shown a presentation of membership package.I was told about a package cost of 53k, in which 25 nights will be offered over a period of 3 years. Trusted the company and took the membership and later once paid complete 53k, they started asking more money total 1.2 lakh. It was well crafted scam of club Mahindra to pitch less cost of package and once sold continue to ask more money.

            I am a senior citizen with above membership with club
            mahindra. I am not a very tech friendly person with limited working capabilities on a computer. I had booked a holiday for 4th August in CM Nusa Dua pr0perty in Bali for my son who is a co applicant in the membership and received a confirmation voucher there of from CM and access fee for the same was duly paid to CM by me.
            While I am the primary applicant in the membership and my son is a co applicant meaning thereby that both o[censored]s can utilize the facility. With this understanding the booking was made and I did not notice that the booking should have been made in the name of the co applicant instead of my name and that this option was necessary to mention at the time of booking but later when I contacted the facility they said that the booking was in my name hence I needed to be present during the stay, which was not the case as my son was traveling not me. I requested them to change the name in booking to which they told me that there was no problem in doing so but since the booking was done through CM, they wanted a mail confirming the same from Club Mahindra, which sounded a simple thing as a correction to a typographical error made in ignorance by a senior citizen member .
            I contacted Club Mahindra member relations several times only to be denied correction or even simply sending a mail to the facility to this effect and also fore feiting the access amount paid by me to Club Mahindra against this booking as the same would be a no show and cancellation would not be possible as per their norms.
            I have made a protest to this with them and feel grossly cheated by a company of this repute and that too having a non sympathetic attitute towards a senior citizen who has pleaded sorry for not having understood the technical snag at the time of booking and requested them to simply send a NOC to the resort of allowing the co applicant to use the booking.
            While on one had we in India are supporting the elderly who have a fair chance to live and enjoy the final part of their life's journey, company like CM are trying to breach the trust and making money from them like this.
            To err is human and a senior citizen who is not very comfortable with gadgets is more likely to make small typo errors in ignorance, and this aspect should have been addressed .
            I feel cheated by the company and above all by the teams they have for consumer redressal. They have made several errors in past which when highlighted were corrected by them so why will they not correct an error made by a senior citizen client specially when the facility is willing to do so but needed a simple mail from CM .

              I have club Mahindra Bilss membership with ID 2824802, I had requested cancellation of membership on 14 th of July 2022, after lot of follow up over emails and on phone till today refund is not provided . they are not responding . Kindly help.

              The same with me.. The dont reply to emails, registered post..Not even the emails from Ministry of Consumer Affairs. 2 people for the company Mr.Mayur and Ms Ankitha will call occasionally to change our mind and while repeating the same request to send an email for cancellation they say they will do it immediately which they never do. Above all now these fraudsters have updated in their system that I have orally agreed to continue the membership. I wonder why Government is not taking any action against such fraud companies.

                Dear Sir/Madam,

                I wish to cancel Club Mahindra Membership due to following reasons:

                (a) I had taken the membership considering I can visit most resorts as per my wish and as per my children's holidays. Hence, I had taken the membership in July 2022 and paid an amount of Rs. 2, 36, 400 against the membership. When I try to book for a holiday, I find most of the resorts filled. I cannot go to holiday when my children have school days however I was not aware of this fact as I was misrepresented by Club Mahindra sales representative. I had even booked for a holiday in September 2022 at Arookutty Alleppey resort, but it was been cancelled by the hotel staff itself because of the strike on the checkin date. I had contacted club mahindra guys for the refund of my 4 days lost in booking, its been 1 year now and there is no response from them till now.

                (b) Club Mahindra is accused of taking different membership fee from different members. I have paid Rs. 2, 18, 400 while some members have paid only Rs. 1, 90, 000 towards the membership in[protected].

                (c) I have paid a total amount of Rs. 2, 36, 400 to Club Mahindra including ASF but I do not find any utility of taking such membership as resorts are never available when required, resorts are very far-off and compared to other such resorts available online through Make My Trip, fee charged is too much.

                (d) Cost of food is exorbitant. Per person buffet is somewhere like Rs. 850-950 while Ala-carte is very costly. So, while most other hotels offer complimentary breakfast and reasonable meals, cost of meal at Club Mahindra is very high. There are almost no other options available for dining except Club Mahindra. Thus, in a day for a 2 Adult + 2 Kids, one will end up spending something like Rs. 4, 000-4, 500 per day and then they tell that cost of boarding is free with membership.

                (e) Different prospective members had been given expensive gifts such as TV, paid trips to abroad, etc, which also was never offered to me even though I have paid more than most members in same category.

                Policy adopted by Club Mahindra in making members is differential and unjust. Similarly policy by Club Mahindra in giving holidays is also unjust. For example, Membership at Pavana, Lonavala is not offered online reason for which is beyond my understanding.

                It is my sincere desire to surrender the Membership and get the refund in this respect. I also desire to resolve the matter amicably failing which I may decide my future course of action including legal recourse against the Company in an appropriate forum.

                  1. Holidays cannot be booked at convince time. U need to book when resort is available.
                  2. Maintenance fees charging around 18000 INR for Blue studio per year which itself is expensive.
                  3. Behavior of front desk manager of Virajpet resort is pathetic.
                  4. Customer care not available 24/7.
                  5. Requested for cancellation & refund of Blue studio membership.

                    I have been a member of club Mahindra for over 15 years. I used to hold a red 1br membership. I once went to stay in their Ooty property and the club Mahindra person there coerced me into upgrading to the purple studio package. I somehow believed him and paid the extra money. From then on, my vacations have been hell. I cannot book rooms even though I have the balance. I am not able to travel with my family of five since we need 2 rooms everytime we book a holiday. Now I really want club Mahindra to get me back to red 1br so that I can holiday in peace.

                          Hi,

                          I kept getting calls from CLUB MAHINDRA sales people from last couple of weeks and finally they offered me complementary 2 nights stay in their property of my choice.

                          Anjali, from club Mahindra called me and assure to take presentation and I will be assured to get voucher in my email.

                          Since they didn’t take any email address of mine, I believe they did fraud with me so the sake to attending the presentation.

                          In Addition, I was informed that within 24 hours I will be getting a voucher. I didnt get any call or such thing to receive the voucher.

                          I called the respective manager who sent the sales guy to my address and asked him about the voucher and he simply told that marketing team will call and update me on the same.

                          This is a fraud that #clubmahindraresort and their sales people are doing. I need justice.

                            Hi Team,

                            I wish to cancel my policy with immediate effect. I purchased the 3 year policy on 15th July 2023 and raised a request to cancel on 16th July. I got an email with complaint number 03232917, and was promised to get a call back after 4-5 days but no one has contacted me.

                            Also I would like to get my refund of 42479 rs which I paid for the initial membership plan.

                              It is intimated that I am getting daily spam mails from Club Mahindra Holidays through [protected]@connectinboxx.com under different heads ie CMH, Club Mahindra, Club Mahindra Holidays etc. I fail to understand how a Company of Mahindra & Mahindra group resorts to such cheap telemarketing tricks and violates the privacy of citizens. It is even more shameful because there is no way one can contact this company as it has no compliance...

                              Gozest Membership cancellation and refund (ID: 3010320)

                              I requested membership cancellation which was purchased by my wife. She was unaware that we already had a membership in another club and thereby we could not use Club-Mahindra membership. Membership was purchased on 29-April-2023 and I requested cancellation on 30-April-2023.

                              I am writing to express my profound disappointment and frustration with Club Mahindra regarding the cancellation of my membership and the refusal to process a refund. Despite my anticipation of exciting vacations and memorable experiences, I have yet to undertake any trip due to the constraints imposed on me to book way in advance.

                              When I decided to become a Club Mahindra member, I was enticed by the promises of delightful holidays at numerous exotic locations across the country. The sales representative assured me of the flexibility to plan trips based on my availability and preferences. Regrettably, this turned out to be far from reality.

                              One of the significant reasons for my decision to invest in the Club Mahindra membership was the expectation of having the freedom to plan my trips at my convenience. However, I was dismayed to discover that reservations had to be made well in advance, often months ahead of the intended travel date. This rigid booking policy has severely restricted my ability to utilize the membership effectively, especially considering the unpredictability of my work schedule and family commitments.

                              Furthermore, as I had not been able to undertake any trips, I promptly decided to cancel my Club Mahindra membership. I followed all the cancellation procedures as outlined in the membership agreement and contacted your customer service department. To my surprise and dismay, I faced an unreasonable refusal of my cancellation request and the subsequent refund.

                              As a consumer, I have the right to make choices that align with my needs and circumstances. The refusal to process a refund has caused me considerable financial strain, as the membership fees represent a significant investment for my family. I believe that Club Mahindra has an ethical obligation to respect the cancellation requests of its customers and process refunds accordingly, especially when no services or benefits have been availed.

                              In light of the aforementioned circumstances, I am left with no choice but to request the following actions:

                              1. Immediate cancellation of my Club Mahindra membership with no further impediments or delays.
                              2. An expeditious refund of the membership fees to the original payment method.
                              3. A thorough review and revision of the booking policy to allow for more flexible reservation options that cater to the needs of the members.

                              I sincerely hope that Club Mahindra will address my concerns seriously and take appropriate steps to rectify this matter promptly. As a reputed and customer-centric organization, I trust that Club Mahindra values its customers' satisfaction and will work towards ensuring a positive experience for all its members.

                              I request a response to this complaint within 14 days from the receipt of this letter. Failure to provide a satisfactory resolution will leave me with no alternative but to seek legal assistance and escalate the matter to relevant consumer protection agencies.

                              Thank you for your attention to this matter. I look forward to a swift and satisfactory resolution of the issues outlined above.

                                We Sadhana Bhagat (Member) & Omkar Mahimkar (Co-Member) member of Club Mahindra since Tue, 16th Dec, 2014. Our Membership No: 2608267, Purple - Studio, There is no EMI Due (We paid our last EMI on 7th March 2023) on our account. ASF is already paid and the due date is 21st October 2023. Please find attached all screenshots & Tax sheet for reference/ Knowledge.

                                Hi Team,
                                I requested for cancellation of my membership on 7th day of purchasing as there were a lot of terms and conditions which were not communicated to me while I was purchasing and I was lied about a few things. I have not received any kind o[censored]pdate or response post the initial email that I will get a call back within 3-5 working days. It's been around 2 weeks now and I have called multiple times but still no resolution or update. I have written multiple emails and have not received any reply.
