Sub : Transfer of policy name – delaying process on your side – Legal notice reg;

No. TN 72 AR 1930 – Insd. Name : S. Murugan – PCPP -policy no. [protected] IMM793 period of Insurance – 06.09.2013 to midnight on 06.09.2014.
1. Our client states
that he has purchased the LMV TATA Nano Car bearing regn. No. TN 72 AR 1930
from the previous owner S. Murugan, son of Shanmugam, of Tirunelveli and
registered in his name under the order of name transfer for ownership by RTO,
Madurai North, on 28.05.2014 in R.No. 32307/A3/14 dt. 28.05.2014 and the same
is being insured with your company.
2. Our client states
that after the transfer of ownership, our client has approached your branch
office at Anna Nagar, Madurai and submitted the original policy copy, a Xerox
copy of R.C. for your reference and paid a sum of Rs. 56/- for transfer fees
and requested to cancel the policy document and issue new policy in his name,
on 02.07.2014 on that day our client was informed that there was power shutdown
and the printers were in offline due to network problem and hence, the receipt
and acknowledgement could not be issued and tendered apology.
3. Our client further states that having received
the adequate and required papers and fees to transfer the insured name and
issue new policy document with regard to our client’s car, there is no sign of
response or any kind of reply or new policy document in the name of our client
is issued till the date of this notice which clearly prove the deficiency in
service on your part and our client is not in a position to drive the car
without the transfer of insured’s name / our client’s name. The
acts and attempts prove themselves that you are not having an inclination to
render proper service towards our client and he understands that you’ve made up your mind to dodge
the grievance of our client. Hence, our
client is constrained to issue this legal notice to you.
4. Our client states that now due to the non-transfer of policy document in
the name of our client, he is being very afraid of driving the car even for
urgent purposes and the same is kept idle. Our client states that the
continuing acts, attempts, omissions and commissions clearly prove the gross deficiency
of service on your part. Our client states that he has suffered a lot and
sustained Mental agony and irreparable loss, injury which could not to be
weighed by any of the golden scale. Our
client states that since he is a law-abiding citizen, he has no other option
except to cause this legal notice to thrive his legal right.
Therefore, you’re hereby
called upon by our client to transfer the policy document in the name of our
client to his vehicle bearing Regn. No. TN 72 AR 1930 as per the rules,
immediately and to issue a new insurance policy schedule and to pay the
compensation for the mental agony and untold injury caused to him, a sum of
Rs.1, 00, 000/- (Rupees One Lakh) and Rs.2, 000/- towards the Advocate fees for
this notice, within 15 days from the date of receipt of this notice. Failing
which, our client will be constrained to initiate legal proceeding against you
before the proper Consumer Forum at Madurai
and you will be held responsible for all the costs and consequences thereof.
