Respected Sir/Madam, My husband Late Bhanwara Ram Godara who served in Central Industrial Security Force and died in a road accident on 06 Nov 2014. Late Bhanwara Ram Godara had a Para Military Salary Package Account with State Bank of India, Paota, B-Road, Jodhpur with A/C No. [protected]. The bank has issued Debit Card No.[protected] and the card was insured with Reliance General Insurance Company Ltd as policy No. [protected]. After the death of Bhanwara Ram Godara, SBI, Paota intimatted the RGICL on 19 Feb 2015 and RGICL raised Claim No [protected], as I was unaware that my husband's card was insurance cover. I had submitted all documents to SBI, Paota branch manager on 25 Mar 2015 and same was deposited to RFICL, Hyderabad by Branch Manager. After contacting several times on 18003009 and e-mails to RGICL they come forward stating that the claim was rejected due to submission after 105 days of the death of Bhanwara Ram Godara. but it is mentioned in para 7 of Annexure-2 to Personal Accident Insurance Death Cover (PAI) guide lines. It is there fore I humbly request you to issue instruction to RGICL to re consideration to restore the claim and settle as per rules of IRDA. I have taken a passenger carrying vehicle package insurance policy from M/s Reliance General Insurance Co. Ltd, Bangalore. The validity of the policy is from 7 Nov. 2014 to 6 Nov. 2015. The insured vehicle met with a road accident on 2 December 2014 and has been notified to the insurance company, the documentation in filing the claim with the insurance company has been completed within 3 days from the date of accident. The insurance company has taken cognizance of the claim and has issued the above mentioned claim number. The insured is aggrieved in getting relief from the insurance on the following counts and hence approached this honorable District Consumer Forum for justice and prevail upon the insurance company for unfair trade practices. 1. The insured has written letter dated 19 Dec. 2014 (copy filed with this complaint) to the insurance company giving various options in settling the legitimate claim. The insured has also met the company executive, Mr Vinay, in their office for resolving the issue. But till date there is neither any response to my letter and any solution found. 2. The insured has again written letter dated 15 January 2015 (copy filed with this complaint) urging the company to act on the claim as the accident vehicle was lying unattended for over 45 days. To this letter also the insurance company maintained silence. During these intervening periods, the insured contacted and Mr Satish Acharya, the Claims Manager (Mob. [protected]) and met in their offices on several occasions and sent several SMSs pursuing for an early resolution to the claim settlement either by authorizing repairs or in settling the claim, but there are no responses whatsoever from his side. SMSs sent to the claims manager can be made available to the Forum as evidence whenever required. Since there is no response from the insurance company, I have mentioned in the above letter that in I am going to authorize repairs in a local garage, as the vehicle dealier, M/s Ravindu Toyota has given an exorbitant repair estimate (copy of estimated filed with this complaint) and I am unable to pay depreciation on new parts. I have submitted the repair estimate from M/s HBR Service Point to the insurance company for assessment of loss. The surveyor appointed by the company, Mr M N Manjunath (Mob. [protected]) has taken his own time in attending the claim and submitting his survey report to the company after two months. This has happened in spite of consistent repeated follow-ups from the insured. 3. The insured has complied with all documents that are required to be submitted such as KYC documents, to the insurance company through the appointed surveyor. However, the surveyor on 8 June 2015, after a gap of two months of submitting the documents, writes a letter to the insured asking him to submit the cancelled cheque/bank passbook of the insured, and original bill of the repairer within 7 days failing which he will treat the claim as closed. I have asked the insurance company to provide me under what terms & conditions of the policy the insured need to provide the cancelled cheque/passbook in settling the claim for which the insured has not responded so far. I have also asked under what authority the appointed surveyor writes to the insured threatening that he will close the file (a copy of my letter dated June 12, 2015 addressed to the insurance company dated is attached with this complaint). 4. The local garage has submitted a bill amounting to Rs. 2, 60, 546 considering replacing only damaged parts and reasonable labour. As per the policy conditions, the insured has to pay 40% depreciation on new parts for vehicle of 6 years old and there are no depreciation on all parts made of glass. The repair invoice submitted by the local garage, M/s HBR Service point for labour of 72, 700 and for parts after applying 50% depreciation instead of 40% as per policy schedule amounting to Rs. 1, 87, 846 is fair and reasonable. The insured was willing for a further negotiation with the insurance company and met the company executive, Mr Vinay and Mr Satish Acharya, but I could understand their intention not to arrive at an amicable settlement and drag on this claim. They even try to enter into bizarre arguments. They tried to convince that that will not be paying 100% replacement cost on glass which is against the contract conditions on policy wordings (policy copy highlighting the depreciation clause is attached with this complaint). NOW THE CLAIM Since the insurance company is unwilling for an amicable settlement of the claim, my humble request to this hon’ble forum in giving relief to the aggrieved are as follows : Repair invoice paid by the insured Rs. 2, 60, 546 Compensation for delay* Rs. 7, 16, 000 Cost of filing this suit Rs. 10, 000 TOTAL Rs. 9, 77, 546 *This Hon’ble Forum may also note that the repairs to this kind of damages will take about one month and accordingly, the insurance company should have authorized repairs and ensured that the vehicle is delivered to the insured before 3rd January 2015 i.e. one month from the date of accident. Based on this, the delay is calculated at 179 days. The Toyota Innova will earn Rs. 4, 000 per day as revenue. Accordingly, the compensation is calculated at 179 days @ Rs. 4, 000 per day is 7, 16, 000. This Hon’ble Forum is apprised of the fact that whether the commercial vehicle runs on the road or not, the owner of the vehicle has to incur the costs such as Driver’s salary, Quarterly taxes to the Government, insurance cost, maintenance cost, interest on car loan availed from the bank apart from the EMI itself. It is therefore imaginable that due to the unfair trade practices and harassment of such insurance companies, the insured has to undergo tremendous financial burden and mental agony. It is the humble request of the aggrieved that this Hon’ble Forum may please take note of these findings and give a fair justice to the aggrieved person and send a strong message to the companies such as Reliance General Insurance Companies who violate their own policy terms and conditions. I am sure that this Hon’ble Forum will prevail against such dubious companies and pass a favourable justice to the innocent customers. Thanking you, Yours sincerely, VIJAYAKUMAR V

My Toyota Innova Car (Maxi Cab) met with an accident on 2 Dec 2014. The process of filing the claim with with the insurance company with relevant documents have been completed within 3 days from the date of accident. The insurance company has taken almost 5 months to authorise repairs in spite of my repeated visits to the Insurance Company office and meeting the Claims Manager (Mr Satish Acharya, Mobile No. [protected]) to expedite the process. I had several letters written with acknowledgements obtained from them and umpteen number of SMSs and telephone calls for which I have not received a single reply/response. You can imagine this has happened to me, as I myself is an insurance professional worked in the middle east for almost 15 years in a general insurance company particularly dealing with motor claims. One can guess what kind of treatment a layman customer will get into a situation like this with a company of Reliance General Insurance. Now after the repair work has been completed by a local garage, the insurance company in connivance with the Surveyor (Mr M N Nagaraj, Mob. [protected]) is now asking me to agree for a settlement of the claim for Rs. 1, 34, 321 for the repair invoice of Rs. 2, 60, 000 from the local garage, the dealer, M/s Ravindu Toyota has estimated the loss of Rs. 4, 25, 000. These unscrupulous Surveyor has a dubious distinction of getting kickbacks from the local garages by manipulating the claims. I have won cases against insurance companies from the Consumer Forums in Bangalore in which this Surveyor is involved. When I visited the insurance company couple of days back to find out the status, they are getting into bizarre arguments saying that the assessed loss for glass parts will be paid at 25% of the actual cost whereas the policy terms & conditions clearly says that there are no depreciation on all parts of glass. The company executive even try to argue that the assessed loss for glass. I do not understand where is the question of assessed loss for a glass. I simply asked the question what do you mean by assessed loss for a glass. Does the surveyor mean the glass parts can be repaired/reinstated to its original shape unlike other mechanical/metal parts which can be repaired, if not replaced. The insurance company again is blundering on their arguments that lamps, either head lamps, tail lamps or fog lamps are made of plastic which do not form part of glass. Can any one believe their arguments. As per the dealer's repair estimate, the damaged glass parts itself cost around 72, 000, which is 100% payable, reasonable labour for this kind of damage shall be around 72, 000, other metal parts considered costing Rs. 1, 15, 000, totalling the repair invoice to be Rs. 2, 60, 000 taking into consideration appropriate depreciation as per the policy which states 40% for the insured vehicle is of 5 years old. In fact, the depreciated we have calculated on the damaged parts is 50% as against 40% prescribed in the policy schedule. The insured has suffered huge financial loss the delay in authorising repairs for 5 months and the actual delivery of the repaired vehicle was done after six months from the date of accident. Since the insured vehicle is a commercial cab, it has to earn revenue for the insured to meet its financial commitments like EMI on the car loan, salary to the driver, quarterly taxes to the government, insurance cost, maintenance, etc. On an average the insured car has to earn Rs. 4, 000 per day to meet these financial commitments. Under these conditions, the undue delay caused by the insurance company in arranging repairs to the insured car has resulted in a financial loss of Rs. 6 lakhs (for 5 months delay, i.e. 150 days @ Rs. 4, 000 per day). The surveyor has collected the repair invoice and some relevant KYC documents for settling the claim on 15 April 2015 and has taken two months to submit the same to the insured company, has written a letter to the insured to again submit the above documents within 7 days failing which he will treat the claim as close. How arrogant is he to write such a letter to the insured, since the insured has no direct contract with the surveyor. The insured has written a letter to the General Manager of the insurance company to respond on or before 20 June 2015 with a reasonable settlement, failing which the insured intend to take the matter with the concerned Consumer Forum for justice of his legitimate claim.

Dear Sir/Madam: Please consider the below and enclosed as an official complain against Reliance Life Insurance (Reliance) for the floater policy # [protected]. We have been a Reliance General Insurance (Reliance) client for over 10 years (Since 2006 onwards). Last year, we were informed of discontinuing the existing policy by the company and were suggested alternative offers for continuing the health coverage. Based on the previous policy, the local Reliance representative recommended the floater policy of sum insurance of 3, 00, 000 for the husband and wife. Earlier our insurance costed us somewhere around INR 5, 680 and with this floater policy, it is somewhere around INR 38, 764. This is almost 7 times of the previous policy. We asked about this several fold increase and we were assured that this is floater policy so premium is high and anyone can avail INR 3, 00, 000 for medical expenses. We were never told that there would be any sub limit for each applicant during the application. Please find the enclosed document of the application. On May 25, 2015, based on the discussions with Dr. Dimple R. Parekh of Parekhs Hospital, Ahmedabad, we submitted the documents for right knee replacement of Mrs. Bhartiben Acharya for caseless facility. The doctor has requested to be admitted at the hospital by the afternoon of May 27, 2015 so that the surgery could be completed on May 28, 2015. In the late evening of May 26, 2015, we received, a SMS from Reliance that only INR 92, 000 has been approved for the claim of INR 2, 35, 000. Since then we have communicated several Reliance representatives at the local office, toll free number and by email. Their response and services were worse. They kept us on hold several times and disconnected the calls Based on our request, they promised the timeline to respond; however, they did not call. On day before yesterday, it took over 90 mins to receive the response from them. Their response is keep changing. Earlier they said that there is a sub limit of 115, 000 for her. After deducting 20% from this as copayment, the amount comes 92, 000. In the latest telephonic conversation with the Hyderabad office, they responded that because of pre-existing alignment problem, we are approving 92, 000. This is contradictory from earlier conversation. Furthermore, there was not any pre-existing condition when the policy was opted. Once over the phone, we denied for this excuse said that the phone is recording the person has stopped talking. Overall, we have been mentally harassed, misguided and cheated during this difficult situation. Imagin how can a farmer like us who pay such a high premium would do in such situation. It seems too much mental harassment while managing the emergency medical situation. They should have provided all the relevant information including the any sub limit during the application. It should not be once the premium is paid and you come up with terms and condition. We request you to have a complete investigation about this. I am sure likewise, there would be thousands of people who have been misguided and/or fooled by Reliance. If this can happen with a farmer of Mehsana, the hometown of Mr. Narendra Modi, the Prime Minister of India, then it could be happened with any one. We are also planning to take a legal action, going to social media, Press, TV and prime minister's office (PMO). Should you require any additional information, please do not hesitate to communicate at [protected]. I look forward to receiving a prompt positive response. Regards, Ankit Acharya

My policy No is [protected] This is to inform you that I had taken insurance cover from "Reliance General Insurance" in the M/o June14. After 5 months in (Oct-14) when I met with an accident and the company denied for settling the insurance claim. Because company has given me NCB benefit which was not due. That mean I was running without insurance from 5 months. Now when I asked for the solution, Than they told me that I have to deposit the NCB recovery which is around 2800 & than your policy will get renewed but condition is very clear that firstly I have to take out the vehicle by clearing all claim amount which is around INR 16000/-. They will only accept money when that claim will get closed in their system. So I have deposited entire amount & took my vehicle from Hyundai workshop. When I went to branch office for depositing the balance NCB recovery amount they refused to take money for 2 weeks when I asked them what will I do for these 15 days if my vehicle theft during this period or some accident occurs than who will be responsible. They don’t have any answer. I was totally harassed & not left with any other option. After 15 days Company has taken all photographs again and verified the vehicle again. After completion of all formalities they took money from me & given me endorsement on 22-Nov-2014. (Copy of endorsement attached along with this mail. After that much harassment Reliance has renewed that policy from “Back date” If as per company’s terms, company is not supposed to provide cover for last 5 months than how company can charge amount from the back period. Anyways company is supreme they don’t listen anything from consumer that’s why I wrote complaint to all higher officials also but no one from "Reliance general Insurance Company" is bother to reply on my mail. Best part came in this month (May-15). When I again approached for renewal which is due on 22-Jun-15, the total due amount is INR 16041/- while asking the break-up of this value. I came to know that I am not eligible for NCB discount because I have taken claim in Oct-15. That was shocking. So, requesting you to investigate this at your end and confirm whether this amount is correct or not. Regards Sumit

Hi, I have filed a claim for car accidental damage after my car DL 6 CM 1763, met with an accident. An auto rickshaw coming from opposite side brushed left side of my car and while trying to avoid that my car got rammed on the bumper guard of a SUV(Scorpio) moving ahead of my car on 3rd May, 2015, Below are the points towards which I want to draw your attention. 1. Surveyor(Manish Tiwari, contact # [protected] ) denied claim on damage on the left side of the car, saying it was an old damage and only acknowledged the claim for front damage only. The damage on left side is the major damage both doors got deeply scratched and sheet came off beside the second door. However, front damage is minor, the bumper got scratched below the left headlight and headlight cover got cracked a little. 2. Though the surveyor is following up the case from very first day(03rd May), he surveyed the car only on 6th May though he was in the same area on 05 May. He called me up on 05th from another workshop(which surveyor suggested) in the same area but he didn't go to the workshop where I left the car for repair which is just a few meters away from the workshop from where he called me up. 3. When I objected the surveyors findings, he gave his supervisor's(Praveen Sharma) number([protected]) but I still didn't get any resolution from him as well even after 2 days of follow-up with him. 4. Why do I have to suffer because of the incompetent surveyor and his supervisor? 5. Is this because of the nexus between the workshop and surveyor, I am suffering? Request you to look into this matter and do the needful. Thanks, Rajiv Contact # [protected]

Private Car Policy Policy Number : [protected] this is to inform you that i had taken insurance cover from "Reliance General Insurance" in the M/o June14. After 5 months when I met with an accident. During that I came to know my policy has been void & not valid because company has given me the NCB benefit for which i was not eligible. Than i paid the entire amount & released my vehicle from Hyundai. Total loss was of 15000. Then i went to branch office & asked for the solution, they told me to deposit the NCB recovery which is around 2800 & than policy will get renewed. Then Company has taken all photograph again and verify the condition of vehicle. After all formalities I have deposited the money. I got endorsement on 22-Nov-2014 that too after several number of follow ups. When all process was repeated then why Reliance has renewed that policy from back date If as per company’s terms, company is not supposed to provide cover for last 5 months than how company can charge amount from the back period. If company would have covered me than company must have settled my claim . If company is renewing my insurance from back date i.e 26-Jun-2014 than company is supposed to settle the accidental claim as well. But company is supreme they don’t listen anything from consumer that’s why I wrote complaint to all higher officials of but no one from "Reliance general Insurance Company" is bother to reply on my mail.

                                    Address: Thane, Maharashtra

I, Mr. Prakash Thakkar, a senior citizen have a mediclaim Policy with Reliance Insurance Company for myself (age 63 ) and Spouse (age 61) with a cover of Rs 1.5 lakh for myself and Rs 1 lakh for my spouse at a premium of around Rs 5600 around 8-10 years back. I have also taken for two policies for my children for Rs 50, 000 each at a premium of Rs 750 each. I have been regular in my premiums and have accumulated no claim benefit bonus all these years around Rs 60000 each for me and my spouse (currently in dispute). Recently, I got a letter from Reliance General Insurance that as per IRDA approval, they are withdrawing this individual mediclaim policy for new and existing customers and thereby this policy of ours will be discontinued and we would have to move either into their new plans Healthwise or Health gain and pay premium of around Rs 17000 or Rs 40000 as per the plan chosen for same cover and loss of Cumulative bonus or through portability switch to other plans wherein the premium for this age is around Rs25000 to Rs 45000 for both o[censored]s due to our age. My first doubt was how could IRDA approve of it for existing customers? IRDA has always been the protector and a guardian in safeguarding the interest of customers against Insurance companies who are interested only in Business at any cost. If there is any such clause providing Insurance companies such provision that all insurance companies at every stage would use it against customers as and when required—migrate to a higher premium plan or opt for portability? Where is the interest of customers safeguarded then by IRDA ? This is a clear breach of trust between insurance company and customer, wherein a customer chooses a insurance company stays with it for 8-10 yrs or more, saves every penny and invests for old age security, and finally with falling age the company changes its norms stating IRDA approved kicks of a customer. In this country doesn’t senior citizen have right to good health or Justice? How can people like us pay thrice the existing premium at this age and why should we? We have been paying regular premiums throughout years beforehand and it is my right to continue my policy on the same terms and pricing. It is a clear loss of the time, money and trust I invested for so many years in the insurance company? Where was it disclosed in Insurance policy or proposal form that a company can choose to withdraw its policy and customer has to pay extensive higher premiums to continue for migration. Or for that matter, is there any such provisions made by IRDA to keep the customers informed at the time of proposal that such condition may prevail. Where is IRDA protecting or safeguarding interest of customers at mass level, tomorrow what if every insurance company uses this provision to increase its premium? Customers of INDIA look upto IRDA as SUPREME AUTHORITY to safeguard our interest, protect us from such manipulation and exploitations and provide us the right to life and good health at this age being a senior citizen of this country. But if there is any such approval from IRDA, where do we go? Whom do we complaint to ? I would request you to look into the matter and kindly assess the loss faced by an existing customer at this age: 1) Senior citizens at this age are mostly denied by companies for fresh policy 2) If a fresh proposal is accepted, 4 years of waiting period of existing disease and low cover or higher premium starting from Rs 20000 to 45000 for me and my spouse together. 3) If opted for migration within the same company, around thrice the current premium plus loss of cumulative bonus. 4) Loss of time, money and trust invested at young age with an insurance company to secure old age related health issues! 5) Finally after all this, what is the guarantee that the same conditions would not repeat in future? We will again not be asked to pay higher premiums and kicked off again with any said policy or Insurance company? 6) Any such breach of trust, exploitation only leads to mental, emotional and financial harassment to senior citizens like us who are retired, cannot afford higher premiums and have to manage high cost of medical expenses and livelihood with limited savings. " It is not only about me and my family, but thousands of customers now and in future who will be a victim of this game plan, if there is any provision for Insurance companies to withdraw their existing plans and force customers to pay extensively higher premiums, wherein the customer at signing the proposal form is not aware of it, nor there are any provisions by IRDA to protect customers in such situations. And as in my case, I am afraid the prime target would be customers in age group of 45 and above where they are helpless with no options available anywhere plus struggling with age related health issues". Yours faithfully, Prakash Thakkar [protected]@yahoo.com [protected]
