lodha amara bad construction

I am owning a flat in lodha amara in w11 flat no 202. Even before completion of 1 year from procession there are serious leakages in the flat. There are heavy leakage happening from above flat and has damaged ceiling. Water from ceiling is also reaching bedroom and there is water seepage on bed. There could be serious threat to conseal electric wiring.

Inspire of complaint many time to your local office there is no action...

Dear sir/madam,

Please note we have made a booking amount of inr 82000 against flat casa rio gold | irvetta | a-104, in the year 2017, later on we decided that we changed our mind and booked a flat in casa bella gold instead, we requested and pleaded to your sales rep, neha joshi but she was rude and we dont expect such gestures from a sales rep of such a renowned developer.

Our concern is we made a booking in your project and later on changed our mind and purchased your flat in your another project which is in the same area/region, both the projects belong to lodha developers then why you cannot refund our amount.

We are a proud owner of c/206, elitra, casa bella gold, pallava, but it is such a shame but you being such a renowned developer cannot even support of refunding the booking amount which is a mere inr 82000

We request you to please refund our booking amount of inr 82000 done against irvetta | a-104, in the year 2017 in the name of ms. Swarnaprabha bhadoria, else we have no option but to put this in social media.

    I booked flat with Lodha on 16-Jul-2019. Unit details Downtown Casa Urbano K 0006 and CRN : 1293982. Booking amount I paid Rs 2, 89, 618

    Issue 1: I booked property under the scheme 95:5. 95%% of property value will be funded y bank and first 12 EMIs banker will bear that. But later Lodha said due to RBI regulations, scheme was stopped and banker can't pay the first 12 months EMI. So Lodha came up with scheme to ensure customer avail the offer. They came up with scheme that Lodha will first 10 months EMI for 90% value of the property.In this case putting 5% interest amount on customer?And Lodha executive firmly told reply will be same if raise the query customer care again.

    Issue2: During booking I was told that I no need to pay for first 12 EMIs. But now Lodha executive says only first 10 months will be paid. The used worse logic 12 months from date of booking and first 2 months goes in loan processing, next 10 months only will be paid. But sales team didn't tell me this logic. They showed a calculation on paper that first 12 months Banker will be paying that and I getting benefit of 12 EMIs amount. In this case again I am losing 2 months EMI amount.

    They also told me to go with same banker which Lodha suggests to avail the offer. I followed the instructions. After couple of chases they sent Bank agent to me to start with loan process.There was delay from Lodha in replies and raised concerns on 26th Juy'19 with sales person. No proper reply. After that lot of discussion between me and Lodha. After certain frustration level, when I said to Cancel the booking, they are telling it is not possible. I gave me options as
    - I have to bear the EMI cost
    - Lodha wont pay for all the commited EMIs
    - Cancellation is not possible


    Could you please help me to cancel this booking and get my money back or else ensure Lodha pay me first 12 months EMI for 95% value of the property

    Today got a call from Lodha and they replied me as below

    s discussed, We would like inform you that once the Application Forms are signed while booking of the unit, it binds the parties to abide by the terms & conditions of the Application Form as it casts obligation on both the parties in abiding by the terms of the contract.

    Please note that the company has incurred substantial cost in processing your booking and has lost the opportunity to sell the unit to other prospect buyer due to your commitment. Further the terms & condition of the application are executed with mutual consent of the parties privy to contract and hence we urge you to comply and abide by the terms and conditions and not try to divulge out of your contractual obligation.

    As per the policy 10% of consideration value gets forfeited since you have paid less the 10% the entire amount gets forfeited.

    Request you to reconsider the same and let us know how can we help you to continue with the unit.

    But I am not dropping this due to my personal commitments, this decision is purely failure of Lodha commitment. I am least bothered with Lodha subvention scheme, as end user I am believe in figure. With Lodha subvention scheme nearly Rs 1.30Lakhs going extra from my pocket. I am not happy with this.Though initially I said no, later I came with below proposals to solve this issue.

    - As initially I was told 12 EMIs, but later Lodha told only 10EMIs PDC provided. As the issue with 2 EMIs, I asked Lodha to bear 1EMI and I will bear one.
    - Downgrade to 1 BHK with same 10EMIs offer with no property transfer charges
    - Cancel the booking

    But Lodha said no to all my proposals and asking me to reconsider as per their conditions only. This is unfair.

    Please make a note I didn't raise this lately with Lodha. I raised this on 26th July'19 the moment I heard about withdrawn of 12 months EMI offer .Then I was told by sale executive "Lodha currently working on this to solve this as many bookings were done on this offer only". Lodha came to me few weeks later with this subvention scheme, but I realized with this offer I need to bear extra amount. Immediately informed the same with Lodha and asked to cancel if Lodha failed fulfill its commitments given to me during booking.

      I am satyawan dattatray hajare.
      I booked flat on 14/09/2019 from lodha group.
      Project name is epic casa estela j 0306.
      I paid booking amount 99000.
      Due to following reason i cancal flat on 15/09/2019 and send mail
      Regarding cancle flat and refund amount but they don't reply on mail.
      Reason are following
      1) they don't say acutal project location. After confirming the location the location is midc taloja road which is very long.
      2) there is no tracking source require 30 minutes to reach station.
      3) they force me for flat booking
      Showing different offer.
      I humble to request that please provide my flat booking amount as
      Early as possible.

        My self amit chavan i had booked a flat in lodha green shore taloja bypass road i paid booking l & ll amount which was 194146/- last month my wife was hospitalized due to pregnancy emergency and health issues bcoz of this i borrow lots of money from outside i already updated the same in lodha service support team i requester them to cancel by unit as i have not signed any agreement and allotment papers and refund my money but unable to get positive response from them.
        Here i am requesting to lodha group please refund my hard earn money to me this money will help me to clear my dues i am in trouble now.

        No Resolution happen yet, i am continuously following through mail around 30 to 40 mails i have sent you for my Refund Back but only receiving mail that you will not refund my booking Amount from your side why you people don't understand from last 7 months i am trying and insisting you that i am able to continue and wanted my hard earn money back which blocked by Lodha group 1.94 lakh it is not small amount for us.

        Even i am getting harassment mails from you that i have to pay remaining amount it is request big organization like LODHA please consider my request and refund my amount.

          I had made EOI payment on 21st Apr 2019 for Lodha Amara 2 bhk flat which was going to launch by 10th May. Since I was not satisfied I had requested cancellation on 15th May 2019 and till date I have not received my refund of EOI Rs 2, 16, 000. I had escalated almost 7 times now to Lodha customer care and everytime a new executive calls back and provides new date for refund. I am being cheated and Lodha is holding my money illegally for so long. Even the sales team didn't bother to respond now.

            I have been contacting u all by last 3 months, but no rep has been given. As I am living in ladha casa rio nyasia D block 801, is suffering from a problem of seepage and water falling from roof. Due to seepage fungus is been occurring in the wall. Wall paints are getting fall day by day. Please it a request to come and see, how many problems are there. How I am leaving I know. Water is falling from roof in hall, kitchen, room, and even in bathroom also. So please rep asa soon as possible.

              My son aditya r patwardhan had bkd one bhk flat at lodha palava city at dombivali on 30.03.2019 by booking rs.99000.00. It was a online booking. However at the time of booking the flat not any o[censored]r executives specifically told that once the flat is booked the booking amount is not refundable in the discussions. If this fact at that could have been told to us we could have thought to book the flat or not. Now due to some obvious reasons aditya is not interested to go ahead with the booking and he is not interested to purchase the flat for which he booked for.in this regard he has already mailed to lodha group in april or may 2019 requesting to cancel the booking and refund the amount of rs.99000.00.

              I kindly request u sir to look into matter and arrange to refund the booking amount of rs.99000.00 at the earliest. Nearly 5 months are over.

              Expecting ur quick response and return reply in this regard.

                As per discussion with sales executive I have paid the application money for 1.07 lakh on 31st August 2019.                   These people have committed the possession to me before 1/8/19 now they have told us it will be 1/2/2020 and i have done the payment accordingly but now i have been told to push this & check the registration where they have mentioned the date of 1/2/2020
                  Then why lodha people have given me the payment schedule in that manner i have unnecessarily paid them excess amount
                  For the proof i am attaching my payment schedule which these people have smartly changed.
                  Need to take some action against lodha group deeds.

                    My in laws have booked a flat in lodha golden dream project on taloja road. The site head rakesh and sales team person yuthika had shown them the road side view flat and they registered different flat. When we got to know this we confronted them about the issue. Now they are accepting the mistake and forcing us to choose another flat which we are not interested in since the actual flat which they had shown us has been allocated to somebody else. Since they are not giving us options so i asked them about the cancellation charges and they are saying that they won't refund anything.

                    Please look into this matter as they have invested their life time savings in this and the site head rakesh is trying to fool them.

                    The sales team Yuthika is talking rude and yesterday she told us that there is cancellation request for the flat which we didn't raise. They are putting all blame on their colleague and not trying to provide us better options. Is this really how lodha group works? We are so much disappointed.

                      Hi.
                      It's humble request to lodha group.
                      Please refund my pre-booking amount 27, 000 which was paid on 21 july 2019.
                      On 21 july we had a meeting with lodha group sales managers and at lodha palava (Golden dream) project, orchid cluster, gate no-4 dombivali (E).
                      We wanted to book a flat in lodha palava (Golden dream) project but due an emergency we cound not book the flat and now we want our mony to be refunded in short period so that we can help our family in this bad circumstances.
                      Since last one week i am having mail conversation with respective sales manager and he is saying you amount is non refundable as per ba1 and ba2.
                      Is there any policy made by lodha that the whatever amount is paid during booking or pre-booking of flat will not be refunded at any cost.

                        I had paid eoi through debit card swipe on 9th of june and immediately next day i requested ms. Sonali talreja sales manager for refund as got negative feedback about the project and while paying itself she mentioned that incase you wish to withdraw the eoi you will get refund within 45 days today 25th july after multiple follow up they have given cheque dated 25/08/2019 which means 30 more days to the refund amount. This matter is also known to her senior mr. Jinesh parekh.

                        I need the refund immediately and need the interest for the delayed period.

                          In mhada lottery i got a room and paid all charging they said to pay, also my loan is going on that room. Now i have received letter stating i have to pay 84042 amt as infrastructure cost. I have already paid the said amt to mhada in the beginning of the procedure. The lodha people says i have to pay the amount in 15days which i can't arrange. Plz help how can i pay the amount double which i have already paid to mhada, after my 3emi's debited from my account.                           I have already paid the amount of Rs.84042 to MHADA on 11th September 2018. Now again received a letter stating to pay infrastructure amount of the same value. Now my registration is complete my loan emis are going on and now they are demanding more charges? The representative says that the government has put forth charges and now I have to pay in 15days of the letter received (20/07/19). I don't understand after giving houses n after completing all the procedure why I should pay the infrastructure amount? It's my humble request to look into the matter as I don't have money to pay now.

                            I have booked a 2 bhk optima flat in upper thane project, before booking the flat i have informed the sales manager that i require home loan of 40 lack but there is some issue with my cibil so they told me that we'll take care of it and if they are not able to arrange a loan then the token amount will be refunded

                            They have forwarded my application to jm finance and they confirmed that i am eligible for only 30 lakh so there is sort of 10 lakh and the same was informed to lodha employee shreekant (Loan adviser).

                            Srikant called me and start misbehaving with using very rude tone and shouted at me like "you will not getting the refund amount (Token amount), do whatever you can do i'll see how you'll get your amount" in a very rude manner

                            At the time of booking every person deal in a very kind manner and when it comes to refund the amount they changed and dealing like i had committed a crime by booking and paying the token amount.

                            Request you to kindly look into this so i can get back my amount

                                Booked a flat at lodha eternis in february 2017 and took possession recently in march 29019 after considerable delay - more than normal delay as m/s. Lodha was using the premises for sales office purpose delaying the possession on flimsy explanations/grounds.
                                When enquired repeatedly through a series of email communications, it was informed that the last installment paid towards possession will be refunded. But now the stand is changed to paying a meager interest for 2-3 months of last instalment.
                                Please do needful to refund the money as promised at the earliest.

                                  It breaks my heart to post this complain on a public domain, however after a lot of to and fro of mails and phone calls my request still remains unresolved.

                                  My late father mr sanjay khandelwal had booked a flat at upper thane, mumbai at cosa treetop project (Under construction) and had paid a booking amount of rs 20, 000/-. On 7th jan 2018. Since last one year my father had been hospitalized, and eventually he departed this year in march 2019. Our family would hence be not able to go ahead with the purchase, and had only requested for reversal of booking amount, which during sale pitch was informed to us that it would be reversible in case of any future cancellation. Now since last two months with all the to and fro of mails and phone call this request has been denied, where we were informed that there internal teams are denying the request. No reason whatsoever was provided, as to why this request has been denied. Please understand that we have been under lot of financial and emotional strains, and we this amount is should be reversed to us rightly.

                                  I request the team to not keep asking us the details again & again and just help us with the reversal. We have already submitted all the proofs, and documents for the same

                                    I got a call from Kamlesh Dubey (sales executive at lodha Amara thane) for follow up of my visit. He behaved not in a good manner when I told him I booked somewhere else. He told something before putting down the phone that was not professional.
                                    During visit also he was so loud in pushing us to pay for EOI that we got irritated and left from there.
                                    Just wanna let you know that we were really impressed by the amenities of lodha and the greenary.
                                    Anyways, due to some preferences I didn't make it into lodha family. All the best for your project.

                                      I have booked flat in Upper thane in the month of october 18 and paid booking amount.
                                      As per payment slab my first payment was scheduled in the month of December 18.

                                      31st Dec 2018- Pl refer the mail from Lodha Rep.Mr. Viral Desai- Issue pertaining to mismatch floor numbers hence documentation was incorrect from lodha(" As informed, the interest is charged automatically post due date of any demand which is as per the T&C of the registered agreement. We can assure you that we will not penalize you for any delay from our side. Once your disbursement is done and you receive the payment receipt, please send us request to waive off interest charged because of delay from our side. Hope this helps and clarifies.With this resolution we have closed your service request #04005429.")

                                      16th Jan 19- Again Documentation mistake-After lots of discussion with Lodha reps on documentation, I have finally sent mail on incorrect ROC and Architect Letter

                                      17th Jan 19- Spoke with Mr.Prashant on 17th Jan and informed that there is an error in registry itself hence disbursement cannot happen thus it will go for either re-registration or rectification. Pl refer mail sent on 17th Jan

                                      ( Dear Lodha Team, It was really nice talking to Lodha Advisor Mr.Prashant, as discussed with him, there is an error in the registry hence bank is not able to disburse the payment. In solution to this, Lodha will confirm the date on which i have to submit current registry which will go for re-registration. This will take few days hence no penalty will levy on me and according to revised payment schedule, bank will start disbursement. Also, with this request you to help with ROC letter as mentioned in my previous mail and with Demand letter pl share the architect letter.)

                                      24th Jan 19 -Post which I have sent original document/registry to Lodha after discussing with multiple round of lodha and bank authorities then finally after discussion with Lodha rep Ms.Aarti sent original agreement via registered AD, Number, RM[protected]IN.

                                      31st Jan 19- I was given a date of rectification as feb 8th between 1:00 PM to 2 :00 PM, Please refer mail of 31st Jan 19. Since rectification was already planned so thought to remove parents name from application as they had to travel every time to bank because of all the issue raised by lodha hence on my own expense I raised deed of release as well on the same day to avoid even a day delay.

                                      6th Feb 19- Lodha rep assured me that there will be no penalty as delay is from Lodha's end. Mail excerpts ("As mentioned in all the previous conversations, we are going ahead with rectification deed as there was issue with the agreement hence i will not have to pay any interest/Penalty for the due payment. Bank will release the amount once all the required documents from Lodha are in place. Hence Lodha can help with revised demand letter by excluding penalty/interest with architect certificate, ROC letter once agreement is in place.")

                                      8th Feb 19-On 8th feb 19, i completed the deed of rectification and informed Ms. Aarti that i have completed Rectification deed process in registrar office.

                                      19th Feb- share the indemnification letter with Ms.Aarti and requested to courier agreement and again requested to share ROC but till date didnt receive correct revised ROC.

                                      28th Feb 19- I received mail from Lodha mentioning about initiating duplicate ROC request and mentioned that one ROC copy was altready shared with me, for which I responded on 2nd March 19 ( Dear Lodha team/Aarti- As per the earlier mail exchanged between us, i am ignoring this mail as ROC is part of documentation to release money from teh bank. Earlier also, ROC was having error hence it went for rectification, this time since rectification in the agreement has done hence bank is taking few days to complete the process. Hence as per our earlier communication and confirmation, i will not be penalized for late fees).

                                      23rd March 19- Along with multiple followups from my side I have sent mail on 23rd March requesting for ROC (kindly help me with ROC, as i need to submit the same to the bank for disbursement. )


                                      23rd April 19- ROC was couriered to me on 24th April 19 Courier Company-Blue Dart, Tracking Number-[protected]

                                      30th April 19- I have made the marginal payment and post which bank made the entire disbursement.

                                      Now in this whole scenario, i kept on asking for documents and registry with ROC but lodha employees took time to share and now forcing me to pay penalty.
                                      Its a mental torture from Lodha.
