Naba Jyoti Pathak, Senior Staff Reporter of a Daily Assamese Newspaper 'Dainik Batori' purchased a Samsung Mobile Set from M/S Maa Electronics, Noonmati, Guwahati on 28.08.2008. Samsung Mobile Set was furnished with a warranty for 1 year which included 10 nos. of terms and conditions. Few days after, the purchase it was noticed that the Mobile Set was not working properly and showed erroneous performances. The matter was brought to the notice of the M/S Maa Electronics but with no results. On 10.05.2009 the Mobileset was not working at all and the Set was handed over to M/S Maa Electronics for clear up. After checking up the Samsung Servicing Centre gave Mr. Pathak an estimate of Rs.2787.2/- for repair of the Mobile Set. The Mobile Set is in very much within the warranty period. According to the Clause of Warranty Card, Samsung Servicing Centre is to repair/replace the Mobile Set free of cost. The fact was narrated to the Servicing Centre but they failed to do anything for redressal of grievances.It is permitted to mention here that the cost of the Mobile Set was Rs. 5200/- nad claiming Rs. 2787.2/- as cost of repair which is above 50% of the cost price and that too during the warranty period is very much unreasonable, excessive, unfair, unjust and cotrary to the provisions of laws, natural justice and equity. It is also strongly affirmed that there was no misuse or illegal operation in respect of the Mobile Set. On behalf of Mr. Pathak, CONSUMERS' LEGAL PROTECTION FORUM's Co-Ordinator Advocate Ajay Hazarika and Forum's member Advocate S.M.Sarma filed a case in DISTRICT CONSUMER DISPUTE REDRESSAL FORUM, KAMRUP, ASSAM and claimed Rs. 16087.2/- as compensation on the date of 26/05/2009.
